(DC), Kathua vide No. DCK/LA/2017-18/4051-56 dated 29-03-2018 for

land measuring 84 Kanals 17 Marlas situated at Village Keerian Gandyal,

Tehsil and District Kathua for public purpose i. e. construction of approach

road to link 1210 Mtr. double lane pre-stressed/RCC Bridge over River

Ravi under Inter-State Connectivity (ISC) by the PWD, calling upon the

objections from the land owners/interested persons and no objection was

received from anyone within the prescribed time period ; and

Whereas, Collector, Land Acquisition (ACR), Kathua vide

No. DCK/ACR/LA/2021-22/27 dated 26-04-2021, recommended the case

to District Collector (DC), Kathua, for issuance of notification/declaration

under Sections 6 & 7 of J&K Land Acquisition Act, Samvat 1990, who

vide No. DCK/LA/2021-22/233-35 dated 06-05-2021 endorsed to Divisional

Commissioner, Jammu, who after examination vide No. 502/4355/Acq/

PWD/Gandyal/Kathua/21/3128 dated 20-05-2021 returned the case with

some observations ; and

Whereas, Deputy Commissioner, Kathua vide No. DCK/LA/2022-

23/2495-98 dated 25-01-2023, clarified the observations and

re-submitted the case to Divisional Commissioner, Jammu who,

vide No. 502/4355/Acq/PWD/Gandyal/Kth/23/2023 dated 11-02-2023

endorsed the same to Financial Commissioner (Revenue), J&K, who

vide No. FCR-LAND/36/2023-06 dated 17-02-2023 forwarded to this

department for the said purpose ; and

Whereas, Chief Engineer, Jal Shakti (I&FC) Department vide

No. IFCJ/W/19102-06 dated 09-01-2023 has granted NoC on the basis of

communication of Administrative Department vide No. JSD/TL/computer

No. 103475/2022 dated 21-10-2022 in respect of Irrigation Department

land measuring 24 Kanals 03 Marlas out of 84 Kanals 17 Marlas acquired

for the said purpose ; and

Whereas, the report furnished by Collector, Land Acquisition (ACR),

Kathua vide letter referred to above, duly endorsed by District Collector

(DC), Kathua, Divisional Commissioner, Jammu and Financial Commissioner

(Revenue), J&K has been examined and it has been found that no one has

filed any objection to the proposed acquisition ; and

Whereas, the Government is satisfied that the aforesaid land is required

public purpose i.e. construction of approach road to link 1210 Mtr. double

lane pre-stressed/RCC Bridge over River Ravi situated at Village Keerian

Gandyal, Tehsil and District Kathua under Inter-State Connectivity (ISC)

by the PWD.

Now, therefore, in pursuance of Section 6 of the J&K State Land

Acquisition Act, Samvat 1990, it is declared that the land measuring

84 Kanals 17 Marlas situated at Village Keerian Gandyal, Tehsil and District

Kathua is required purely for public purposes i.e. construction of approach

road to link 1210 Mtr. double lane pre-stressed/RCC Bridge over River

Ravi under Inter-State Connectivity (ISC) by the PWD and the Collector,

Land Acquisition (ACR), Kathua is directed under Section 7 of the said

Act to take orders for acquisition of the said land after giving prescribed

notice to the interested person(s) as required under the Land Acquisition

Act/Rules.

Further, the Collector concerned shall be held specifically responsible

for identification and proper title verification of all types of lands involved in

the case for making apportionment of compensation amongst all the

interested persons/rightful claimants, in accordance with the relevant laws/

rules in force, while making the award. The Collector/Indenting Department

shall also ensure that no compensation shall be made for the portion of land

which has already been acquired for the road in question.

Directors borne on J&K Economics and Statistics (Gazetted) Service as it

stood on 01-07-2022 was notified for inviting objections from the concerned,

if any ;

Whereas, 10 objections were received in the department from officers

of J&K Economics and Statistics organization ;

Whereas, these objections were examined as per rules in the

department and necessary changes wherever required as warranted under

rules have been incorporated in the seniority list ;

Whereas, the details of the officers who have retired on superannuation

from various levels in in-charge capacity after 01-01-2016 but are yet to be

regularized by the PSC/DPC due to deficiency of documents have been

included under are provided as footnote to the seniority list of respective

levels. The case of these retired officers who have not been regularized

due to deficiency of documents shall be separately placed before PSC/

DPC if they submit requisite documents and are also otherwise eligible for

promotion and competent authority approves for placement of these cases

before PSC/DPC.

Whereas, the members of J&K E&S (Gazetted) Service apportioned

to UT of Ladakh vide Govt. Order No. 1212-JK (GAD) of 2021 dated

15-11-2021 are to be excluded from the seniority list w. e. f. 15-11-21 in

terms of Circular No. 09-JK (GAD) of 2022 dated 08-03-2022. However,

name of the officer belonging to UT of Ladakh who have already been

placed against the higher post in in-charge capacity on/before 15-11-2021

in terms of Circular No. 20-JK(GAD) of 2021 dated 19-06-2021 have been

shown in the final seniority list for the purpose of their regularization by the

DPC.

INTRODUCTION :

The proceedings are as per the provisions of Section 23 of “The

Right to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013” for determination of

compensation in respect of land measuring 12½ Marlas under survey

numbers 1629 min (10 Marlas), 1630 min (2½ Marlas) recorded as

Properiotery land required for construction of Tube-well/Pump-cum-

Operator Quarter, WSS Baghwanpora in Village Shal Tokina, Tehsil

Awantipora. The acquisition proceedings were initiated on the basis of

request made by the requiring body viz. Chief Engineer, PHE

Department, Srinagar, Kashmir.

NOTIFICATION OF SOCIAL IMPACT ASSESSMENT AND

REPORT OF SIA :

The process for conduct of Social Impact Assessment Report under

the provisions of Section 4 of the Right to Fair Compensation and

Transparency in Land Acquisition, Rehabilitation and Resettlement Act,

2013 was initiated as per this Office No. ADC/AWP/LA/20-21/63-72

dated 16-09-2020, in concurrence with the District Collector Office

Order No. DCP/LA/2020/610-30 dated 25-08-2020 whereby following

members already nominated were assigned the task for conduct of the

field survey for the proposed project :

(1) Assistant Executive Engineer, R&B, Pulwama.

(2) Assistant Executive Engineer (Jal Shakti), PHE, Pulwama.

(3) Assistant Executive Engineer, Irrigation and Flood Control,

Pulwama.

(4) Range Officer, Forests, Awantipora.

(5) Agriculture Extension Officer, Tahab.

(6) Representative of Indenting Department.

The report so prepared by the committee members for the instant

land

acquisition

case

was

submitted

the

Appropriate

Government/District Collector vide this Office No. ADC/AWP/LA/

20-21/193-95 dated 10-11-2020 for accord of approval/authorization for

issuance of notification under Section 11 of the said Act.

EVALUATION OF SOCIAL IMPACT ASSESSMENT REPORT :

On the basis of the recommendations and the observations submitted

by the committee constituted, it was established that the land for which

the indent stands placed is required for legitimate and bona fide public

purpose which necessitates the acquisition of land identified. Direction to

the Collector for proceedings ahead under the provisions of Section 11 of

the Right to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013 was communicated by the

District Collector vide his Office No. DCP/LA/2020/1188-89 dated

18-12-2020.

PUBLICATION OF NOTIFICATION AND ISSUE OF NOTICES :

The preliminary notification under Section 11 (1) of the Right of Fair

Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013 was issued vide this Office Notification

No.

under

endorsement

No. ADC/AWP/LA/20-21/317-22 dated 19-01-2021 for calling upon the

objections, if any, from the interested persons/land owners. The same

was published in the official Gazette on 18thApril, 2021 in volume 134

and wide publicity was also made. In response to the said notification,

during the stipulated period of time no objection was received by this

Collectorate and accordingly the case was submitted under Section 15 of

the Act vide this Office No. ADC/AWP/LA/21-22/670-74 dated

23-12-2021 with recommendations to the District Collector, Pulwama for

a decision and issuance of declaration under Section 19 of the Act.

The case was examined by the “appropriate Government” District

Collector, who after thoughtful consideration was satisfied that the land

acquisition is in the interest of the public purpose. The “appropriate

Government” District Collector issued declaration under section 19 (1)

of the Right to Fair Compensation and Transparency in Land

Acquisition, Rehabilitation and Resettlement Act, 2013 vide Notification

No. 10 of Rev(LA) of 2022 dated 08-04-2022 under endorsement

No. DCP/LA/2022/26-29 dated 08-04-2022, whereby it was stated that

the land measuring 12½ Marlas is required for construction of

Tube-well/Pump-cum-Operator Quarter, WSS Bhagwanpora at Village

Shal Tokina, Tehsil Awantipora.

Public notice under Section 21(1) of the Right to Fair Compensation

and Transparency in Land Acquisition, Rehabilitation and Resettlement

Act, 2013 was issued to the interested persons/land owners to state the

particulars of the land so needed, and to state the nature of their

respective interests in the land and the amount and particulars of their

claims to compensation for such interests, their claims to rehabilitation

and resettlement along with their objections, if any, to the measurement

made and to appear personally or by agent or advocate within a period of

30 days. During the prescribed period of time no such objection was

received by this Collectorate.

METHODOLOGY

USED

FOR

DETERMINATION

COMPENSATION :

On the basis of alignment given by the PHE (Jal Shakti) Department

revenue extracts, including Khasra Paimaish were submitted by the

Tehsildar, Awantipora. The type of land for khasra number 1629 min

(10 Marlas) is recorded as Wari and Khasra number 1630 min

(2½ Marlas) is recorded as Aabi Wari. The land rates per kanal as

applicable to the type of land stands notified by the Chairman, District

Valuation Committee vide his Office Notification Number 09/DCP-SQ

of 2020 dated 31-12-2020 under endorsement number DCP-SQ/20-

21/1808-22 dated 31-12-2020. The value of the land as per the market

value guidelines for the corresponding year is as under :

There is no residential/commercial structure on the proposed site.

POSSESSION OF LAND :

The possession of the land was handed over by the land owner to the

Executive Engineer, PHE, Jal Shakti, Division, Pulwama prior to

initiating the land acquisition proceedings. Therefore the department had

already started the developmental activities.

OWNERSHIP :

Name of the persons whose land is under acquisition, was

ascertained from the revenue records and the same has been included in

Award statement.

MUTATION OF OCCUPANCY IN RESPECT OF THE SAID

LAND BEING ACQUIRED :

Consequent upon taking over possession of the said land and the

payment of the compensation to the concerned interested persons, the

Tehsildar concerned shall ensure that the revenue records and all the

relevant documents relating to the ownership/occupancy of the said land

are accordingly updated and show the transfer of the said land solely in

the name of Government through Jal Shakti (PHE) Department.

APPORTIONMENT :

Compensation amount will be paid accordingly to the latest entries in

the Revenue Record and as per enquiry conducted under Section 23. In

case of any dispute, which I cannot settle within reasonable time, the

amount of compensation will be remitted to the court under Section 64 of

the Right to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013 for the determination of

ownership rights.

ENCUMBRANCES :

The land under acquisition is free from all encumbrances and has

been mentioned in the Award statement.

DETERMINATION OF SOLATIUM :

As per the provisions of Section 30(1) of the Right to Fair

Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013, 100% of the market value is awarded as

Solatium has been determined in the award statement.

COMPENSATION OF LAND :

After considering the parameters provided in Section 26 across 29 of

the Act, the compensation of the land stands determined. The total

amount of award works out to be Rs. 12,50.000/- (Rupees Twelve Lacs

and Fifty Thousand Only).

The details of compensation of the land acquisition as per the

apportionment statement enclosed herewith as Annexure “A”.

APPROVAL OF THE DRAFT AWARD :

The Draft Award so framed vide this Office No. ADC/AWP/LA/

22-23/322 dated 22-09-2022 for an amount of Rs. 12,50,000/- (Rupees

Twelve Lacs Fifty Thousand Only) involved in the instant land

acquisition case was submitted before the Deputy Commissioner,

Pulwama vide this Office No. ADC/AWP/LA/22-23/323 dated

22-09-2022 in terms of Rules 32 and 34 of Right to Fair Compensation

and Transparency in Land Acquisition, Rehabilitation and Resettlement

Act, 2013 for accord of approval of the rates.

Accordingly, the instant land acquisition case was put before the

Collector’s meeting held on 30-11-2022 under the Chairmanship of

District Collector, Pulwama. The minutes of the meeting were circulated

vide District Collector, Pulwama’s Office No. DCP/LA/2022/415-19

dated 13-12-2022 where rates adopted and the action taken was approved

with the direction that Collector, Land Acquisition shall proceed further

strictly in accordance with the rules in vogue.

PAYMENT OF COMPENSATION TO THE INTERESTED

PERSONS :

The interested persons are informed that the payment of

compensation shall be made through Bank accounts only for which the

land owners who are deemed lawfully entitled shall receive the

compensation amount on submission of the below mentioned documents

in my office.

1. Original Revenue extracts of the claimant.

2. Non-Encumbrance Certificate from Tehsildar.

3. Copy of Aadhaar Card.

land measuring 32 Kanals at Village Galar and Chak Harkha, Tehsil and

District Samba (J&K) for establishment of Border Out Post

“WHALEBACK” ;

Whereas, it appears to the Government of UT of Jammu and

Kashmir that land measuring 32 Kanals at Village Galar and Chak

Harkha, Tehsil and District Samba is required for defence purpose for

establishment of Border Out Post by Border Security Force. It is as such

hereby notified that land in the area specified is required for above

purpose.

The notification is made under the provisions of Section 11(1) of

Right to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013, to all whom it may concern.

24-03-23 issued under endorsement No. DCS/ACR/LAS/2022-23/

115-122 dated 24-03-2023 exempted Social Impact Assessment Study

along with exemption of an additional compensation of 75% of the total

compensation under Sub-Section (5) of Section 40 of the Act, as the

project affects the security and strategic interest of the State/UT.

In exercise of powers vested in me under Section 11, Sub-Section (1)

of the Right to Fair Compensation and Transparency in Land

Acquisition, Rehabilitation and Resettlement Act, 2013, I, Dr. Kusum

Chib, JKAS, Collector, Land Acquisition, Samba do hereby notify that

the land whose particulars are given herein below is required for

establishment of Border Out Post at Village Galar and Chak Harkha,

Tehsil and District Samba by Border Security Force.

Further, under Section 11(4) of the Act, no person shall make any

transaction or cause any transaction of land i.e. sale/purchase etc. or

create any encumbrance on such land from the date of publication of this

notification without prior approval of the Collector.

Objections to the acquisition, if any, may be filed by the person(s)

interested within 60 days from the date of publication of notification as
