29-01-2018, notification under Section 4(1) of Land Acquisition Act, Samvat
1990 was issued by Collector, Land Acquisition (SDM), Chenani vide No.
SDM/C/2017/18/948-55 dated 26-03-2018 for acquisition of land measuring
02 Kanals and 09 Marlas situated at Village Ghantwal, Tehsil Chenani,
District Udhampur for public purpose i. e. construction of road under PWD
(R&B) from Champari to Ghantwal at Village Ghantwal, Tehsil Chenani,
District Udhampur by the PWD, calling upon the objections from the land
owners/interested persons ; and
Whereas, pursuant to above notification no objection was received
from anyone within the prescribed time period ; and
Whereas, Collector, Land Acquisition (SDM), Chenani vide No. 155/
SDM/C/2018-19 dated 03-05-2018, recommended the case to
District Collector (DC), Udhampur, for issuance of notification/declaration
under Sections 6 & 7 of J&K Land Acquisition Act, Samvat 1990 for public
purpose i. e. construction of road by PWD (R&B) from Champari to
Ghantwal at Village Ghantwal, Tehsil Chenani, District Udhampur,
who vide No. DCQ/SQ/495-97 dated 12-05-2018 read with No. ACRU/
SQ/9398-9400 dated 24-03-2023 forwarded to this department for the said
purpose ; and
Whereas, the report furnished by Collector, Land Acquisition (SDM),
Chenani vide letter referred to above, duly endorsed by District Collector
(DC), Udhampur, has been examined and it has been found that no one has
filed any objection to the proposed acquisition ; and
Whereas, the Government is satisfied that the aforesaid land is
required for public purpose i. e. construction of road by PWD (R&B) from
Champari to Ghantwal at Village Ghantwal, Tehsil Chenani, District
Udhampur by the PWD (R&B).
Now, therefore, in pursuance of Section 6 of the J&K Land
Acquisition Act, Samvat 1990, it is declared that the land
measuring 02 Kanals 09 Marlas situated at Village Ghantwal, Tehsil
Chenani, District Udhampur is required purely for public purposes i. e.
construction of road by PWD (R&B) from Champari to Ghantwal at Village
Ghantwal, Tehsil Chenani, District Udhampur by PWD (R&B) and the
Collector, Land Acquisition (SDM), Chenani is directed under Section 7
No. 8] J&K Official Gazette, 25th May, 2023/4th Jyai., 1945. 185

of the said Act to take orders for acquisition of the said land after giving
prescribed notice to the interested person(s) as required under the Land
Acquisition Act/Rules.
Further, the Collector concerned shall be held specifically responsible
for identification and proper title verification of all types of lands involved in
the case for making apportionment of compensation amongst all the
interested persons/rightful claimants, in accordance with the relevant laws/
rules in force, while making the award. The Collector/Indenting Department
shall also ensure that no compensation shall be made for the portion of land
which has already been acquired for the road in question.

In the Jammu and Kashmir Industries Land Allotment Policy, 2021-
30, after clause 18, the following shall be added as clause 19 ; namely :—
‘‘19. UTILIZATION OF LAND AVAILABLE AS PER
NOTIFIED FLOOR AREA RATIO-FAR.—
19.1 Industrial units can utilize the available floor area as per the ratio
notified by Government of J&K for expansion of the existing unit
and/or setting up of new/additional unit and subject to compliance of
building bye-laws, FAR available and due appraisal.
19.2 The ownership/shareholding pattern of the original project under
implementation and the proposed sub-unit/sister concern shall be
identical.

19.3 The line of activity in the additional unit shall be complementary
to the line of activity of the original Project under implementation.
19.4 The investment made in the sub-unit should be in addition to the

19.5 An additional fee at 20% of the current land premium rates, shall
be payable to the IDC, against the area of land proposed to be
covered.’’

Annexure to Government Order No. 99 JK(IND) of 2023 dated 06-04-2023
In the Procedural Guidelines to the Jammu and Kashmir Industrial
Policy, 2021-30 ;
(i) after clause 6.2, the following clause shall be added ; namely :—
‘‘6.3 The concerned Director, Industries and Commerce
Department on the recommendations of the Managing Director,
J&K, SIDCO/SICOP shall be the approving authority for allowing
any change in Name and Style at the Pre-registration stage, subject
to the following conditions in relation to revision of DPRs :—
i.
That there is no upward/downward revision of the allotted land
and it shall remain a constant factor, under no circumstances
revision of DPR should lead to a requirement for allotment of
additional land.
ii.
The merit of the allottee on the basis of which land allotment
was done shall not be affected adversely by the permissible
change in the DPR post allotment.
iii.
The change in DPR shall not downgrade the criteria of merit
as in point 2 above, or bring in any drop in the investment/Kanal
and employment/Kanal based on which land was allotted.’’
(ii) after clause 8.4, the following clause shall be added ; namely :—
‘‘8.5 The Managing Director, J&K, SIDCO/SICOP on the
recommendation of the concerned Director, Industries and
Commerce Department shall be the approving Authority for
allowing any change in line of activity/additional line of activity at
the Pre-registration stage, subject to the following conditions in
relation to revision of DPRs :—

Whereas, vide S.O. No. 237 dated 23-07-2020 issued by

Acquisition, Northern Railways, has been designated as Collector, Land
Acquisition to perform the functions of a Collector in District Ramban
for Northern Railways (USBRL Project) under the Right to Fair
Compensation and Transparency in Land Acquisition, Rehabilitation

NOTIFICATION
Whereas, the Election Commisssion had announced the schedule
for preparation of electoral rolls in the UT of Jammu and Kashmir with
reference to 01-04-2023 as the qualifying date, vide its letter
No. 23/2022-ERS (Vol. II), dated 20th March, 2023 ; and

Whereas, the period of filing claims and objections was fixed from
5th April, 2023 to 20th April, 2023 ; and
Whereas, the draft rolls were published on 5th April, 2023 ; and
Whereas, Chief Electoral Officer of Jammu and Kashmir has
requested for extension of the period of filing claims and objections due
to certain administrative reasons ; and
Whereas, the Election Commission has considered the matter and
decided that the period of filing claims and objections in UT of Jammu
and Kashmir should be extended up to 6th May, 2023.
Now, therefore, the Election Commission, in exercise of the powers
conferred by proviso to Rule 12 of the Registration of Electors Rules,
1960, hereby extends the period for filing claims and objections up to
6th May, 2023 for the ongoing preparation of electoral rolls with
reference to 01-04-2023 as the qualifying date, in the UT of Jammu and
Kashmir.
