Section C of Annexure-B of the Common Application Form shall
be designed by the concerned department as per functional
requirement(s) of each e-Service provided by that department.
3.
The adoption of Common Application Form for the designated
seventy (70) e-Services shall be completed within a period of ten
(10) days.
4.
Feedback/suggestions in respect of these e-Services shall be
furnished to the Information Technology Department within a
period of one month from the date of issuance of this order.

INTRODUCTION :
The proceedings are as per the provisions of Section 23 of the
Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement Act, 2013 for determination of

compensation in respect of land measuring 4 Kanals 15 Marlas falling
under Survey No. 279 recorded as Proprietary land required for the
construction of Government High School Bathen at Village Bathen
Tehsil Pampore, the acquisition proceeding were initiated on the basis
of request made by the requiring body viz. Director School Education
Kashmir.
NOTIFICATION OF SOCIAL IMPACT ASSESSMENT AND
REPORT OF SIA :
The process for conduct of Social Impact Assessment report
under the provisions of Section 4 of the Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement Act,
2013 was initiated as per this office No. ADC/AWP/LA/21-22/588-96
Dated 05-11-2021, in concurrence with the District Collector Office
Order No. DCP/LA/2020/610-30 Dated 25-08-2020 whereby following
members already nominated were assigned the task for conduct of the
field survey for the proposed project—
1) Tehsildar Pampore.
2) Assistant Executive Engineer R&B Pampore.
3) Assistant Executive Engineer (Jal Shakti) PHE Pampore.
4) Assistant Executive Engineer Irrigation and Flood Control Pampore.
5) Rang Officer Forests Pampore.
6) Agriculture Extension Officer Pampore.
7) Representative of Indenting Department.
The report so prepared by the committee members for the instant
land acquisition case was submitted to the Appropriate Government/
District Collector vide this office No. ADC/AWP/LA/21-22/728-30
Dated 03-02-2022 for accord of approval/authorization for issuance of
Notification under Section 11 of the said Act.
EVALUATION OF SOCIAL IMPACT ASSESSMENT REPORT :
On the basis of the recommendations and the observations
submitted by the committee constituted, it was established that the
land for which the indent stands placed is required for legitimate and
bona fide public purpose which necessitates the acquisition of land
identified. Direction to the Collector for proceeding ahead under the
provisions of Section 11 of the Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement Act,
No. 37 ] The J&K Official Gazette, 14th December, 2023/23rd Agra., 1945. 865
2013 was communicated by the District Collector vide his office
No. DCP/LA/2022/42-43 Dated 26/05/2022.
PUBLICATION OF NOTIFICATION AND ISSUE OF NOTICES :
The preliminary notification under Section 11 (1) of the Right to
Fair Compensation and Transparency in Land Acquisition, Rehabilitation
and Resettlement Act, 2013 was issued vide this office Notification
No. 09 of 2022 Dated 04-07-2022 under endorsement No. ADC/AWP/
LA/22-23/193-200 Dated 04-07-2022 for calling upon the objections, if
any, from the interested persons/landowners. The same was got
published in the official gazette on 11th August 2022 in Volume 135 and
in the two daily news papers viz. Srinagar Times Dated 06-07-2022,
Kashmir Images Dated 07-07-2022 and wide publicity was also made.
In response to the said notification. during the stipulated period of time
no objection was received by this Collectorate and accordingly the case
was submitted under Section 15 of the Act vide this office No. ADC/
AWP/LA/22-23/397-401 Dated 07-11-2022 with recommendations to
the District Collector Pulwama for a decision and if found appropriate
issuance of declaration under Section 19 of the Act.
The case was examined by the appropriate Government District
Collector who after thoughtful consideration is satisfied that the land
under acquisition is in the interest of the public purpose. The appropriate
Government District Collector has issued declaration under Section
19(1) of the Right to Fair Compensation and Transparency in Land
Acquisition. Rehabilitation and Resettlement Act, 2013 vide Notification
No. 01 of Rev/LA of 2003 Dated 04-07-2023 under endorsement
No. DCP/LA/2023/108-14 Dated 04-07-2023, that the land measuring
04 Kanals 15 Marlas is required for construction of Government
HS School at Bathen Tehsil Pampore.
Public notice under Section 21(1) of the Right to Fair Compensation
and Transparency in Land Acquisition, Rehabilitation and Resettlement
Act, 2013 was issued vide this office No. ADC/AWP/LA/23-24/124-31
Dated 19-07-2023 to the interested persons/land owners to state the
particulars of the land so needed and to state the nature of their
respective interests in the land and the amount and particulars of their
claims to compensation for such interests, their claims to rehabilitation

and resettlement along with their objections, if any, to the measurement
made and to appear personally or by agent or advocate within a period
of 30 days. During the prescribed period of time no such objection was
received by this Collectorate.
METHODOLOGY USED FOR DETERMINATION OF

On the basis of alignment given by the Education Department
revenue extracts, including Khasra Paimaish were submitted by the
Tehsildar Pampore. The type of land for Khasra Number 279 is
recorded as Labroo, Banjre Qadeem and Gair Mumkin Banah. The land
rates per Kanal as applicable to the type of land stands notified by the
Chairman, District Valuation Committee vide his Office Notification
Number 12/DCP-SQ of 2021 Dated 31-12-2021 under endorsement
number DCP-SQ/20-21/1689-1703 Dated 31-12-2021. The value of the
land as per the market value guidelines for the corresponding year is
as under.

There is no residential/commercial structure on the proposed site.
POSSESSION OF LAND :
The possession of the land was handed over by the land owner
to the requiring department i. e. education department prior to initiating
the land acquisition proceedings and the department had already
constructed the two storied school building over the said land in which
Government High School Bathen is functioning.
OWNERSHIP :
Names of the persons whose land is under acquisition was
ascertained from the revenue records and the same has been included
in Award statement.
MUTATION OF OCCUPANCY IN RESPECT OF THE SAID
LAND BEING ACQUIRED :
Consequent upon taking over possession of the said land and the
payment of the compensation to the concerned interested persons, the

Tehsildar Concerned shall ensure that the revenue records and all the
relevant documents relating to the ownership/occupancy of the said land
are accordingly updated and show the transfer of the said land solely
in the name of Government.
APPORTIONMENT :
Compensation amount will be paid accordingly to the latest entries
in the revenue record and as per enquiry conducted under Section 23.
In case of any dispute, which I cannnot settle within reasonable time,
the amount of compensation will be remitted to the Court under Section
64 of the Right to Fair Compensation and Transparency in Land
Acquisition, Rehabilitation and Resettlement Act, 2013 for the
determination of ownership rights.
ENCUMBRANCES :
The land under acquisition is free from all encumbrances and has
been mentioned in the Award statement.
DETERMINATION OF SOLATIUM :
As per the provisions of Section 30(1) of the Right to Fair
Compensation and Transparency in Land Acquisition, Rehabilitation and
Resettlement Act, 2013, 100% of the market value is awarded as
solatium has been determined in the award statement.
COMPENSATION OF LAND AND ADMINISTRATIVE
CHARGES :
After considering the parameters provided in Section 26 across 29
of the Act, the compensation of the land stands determined. The total
amount of award works out to be Rs. 33,25,000/- (Rupees Thirty Three
Lac and Twenty Five Thousand only) and the administrative charges
@ Rs. 2.5% to the tune of Rs. 83,125/- (Rupees Eighty Three Thousand
One Hundred and Twenty Five only) as admissible under the provisions
of Rule 5 of Sub-Section 1 of the Act.

2. Whereas, based on the above, a case FIR No. 290/2017 under
Section 506 RPC, 7/25 Arms Act and the Section 38 of ULA (P) Act,
was registered in the Police Station, Shopian, and the investigation of the
case was set into motion. Subsequently, during the investigation, the
offence under Section 506 RPC was dropped and the offence under
Section 20 of ULA (P) Act was added in the case ; and
3. Whereas, during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statements of
witnesses acquainted with the facts and circumstances of the case were
recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, it was found that the accused
terrorist viz. Asif Ashraf Malik, got injured in an encounter with the
Security Forces on 29-03-2018 at Marang crossing, Shopian for which a
separate Case FIR No. 88/2018 was registered in Police Station, Shopian,
and subsequently, was arrested in the said case. Later on the accused was
released from the said case by the competent court of law on medical
grounds due to which was not arrested in the instant case ; and
5. Whereas, during the investigation, it was established that the
accused viz. Zaffer Paul, Mohd Amir Malik, Amir Yousuf Mir, Asif
Ashraf Malik, Ashiq Hussain Bhat, Rahil Magray, Sameer Ahma Wani
and Atimad Hussain Malik, went missing and joined the terrorist ranks of
HM/LeT banned outfit for carrying out terrorist activities in the
area ; and

6. Whereas, the accused terrorists viz. Zaffer Paul, Mohd Amir
Malik, Amir Yousuf Mir, Ashiq Hussain Bhat, Rahil Magray, Sameer
Ahma Wani and Atimad Hussain Malik, have been killed in the different
encounters with the Security Forces and the proceedings under the law
would abate against them ; and
7. Whereas, on the basis of the investigation, the statements of
witnesses recorded and other evidence collected, the Investigating
Officer, has established prima facie involvement of the below mentioned
accused for the commission of offences punishable in terms of the
provisions of Unlawful Activities (Prevention) Act, 1967, as shown
against his name :—

party office near CTO crossing and made provocative speech and tried to
cause disaffection against the sovereignty and territorial integrity of the

2. Whereas, based on the above, a case FIR No.05/2023 under
Sections 121, 121-A, 153, 153-A, 505 IPC and the Section 13 of ULA
(P) Act was registered in the Police Station, Kothibagh, and the
investigation, of the case was set into motion. Subsequently, during the
investigation, the offence under Section 503 IPC was added in the
case ; and
3. Whereas, during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statement of
witnesses acquainted with the facts and circumstances of the case were
recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, the accused viz. Suhial Ahmad
Khan S/o Khazir Mohd Khan R/o Rathusan, Beerwah, Budgam A/P
Mustafa Abad, Lane No.1, HMT, Srinagar, Nadeem Shafi Rather S/o
Mohd Shafi Rather R/o Maloora, HMT, Srinagar and Umar Majeed
Wani @ Ghazi S/o Abdul Majeed Wani R/o Baghat-i-Shoora, Soura,
Srinagar, were arrested in the case ; and
5. Whereas, during the investigation, it was established that on the
date of occurrence the accused viz. Suhail Ahmad Khan, Nadeem Shafi
Rather and Umar Majeed Wani @ Ghazi, held a press conference and
delivered a provocative speech and instigated the general public against
the sovereignty and territorial integrity of the Union of India, besides
promoting enmity between different groups on grounds of religion ; and

Sections 153-A, 506 RPC and the Section 13 of ULA (P) Act, was
registered in the Police Station, Nigeen, and the investigation of the case
was set into motion. Subsequently, during the investigation, the offence
under Section 153-A RPC was dropped and the offence under
Section 153 RPC was added in the case ; and
3. Whereas, during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statements of

4. Whereas, during the investigation, one Shahid Ahmad Sheikh S/o

5. Whereas, during the investigation, it was established that on the

one PoK based terrorist namely Abdul Hameed Sheikh S/o Faqir Sheikh
R/o Dhani, Karnah A/P PoK and sold the same to another person identified
as Javaid Ahmad Lone S/o Mohd Yousuf Lone R/o Tangdhar, Karnah, in
order to promote terrorist activities in the area ; and
2. Whereas, based on the above, a Case FIR No. 94/2022 under
Section 7/25 Arms Act, 8/21-29 NDPS Act and the Sections 13, 16, 20,
23 and 38 of ULA (P) Act, was registered in the Police Station, Karnah,
and the investigation of the case was set into motion. Subsequently, during
the investigation, the offence under Section 16 of ULA (P) Act, was dropped
and the offences under Sections 18 and 39 of ULA (P) Act were added in
the case ; and
3. Whereas, during the investigation, the accused viz. Mohd Azam
Danyal was arrested in the case and during the investigaton arms/
ammunition viz. 01 Pistol, 02 Magazines and 43 Rounds were recovered at
his instances. The accused viz. Mohd Azam Danyal was found in contact
with terrorist of LeT banned outfit viz. Abdul Hameed Sheikh, who provided
the said arms/ammunition to him in order to promote terrorist activities in
the area. During the investigation, the person namely Javaid Ahmad Lone,
was not found involved in the case and subsequently, was dropped from the
case ; and
4. Whereas, during the investigation, the seizure memos were prepared
and the statement of witnesses acquainted with the facts and circumstances
of the case were recorded under the relevant provisions of law ; and
5. Whereas, during the investigation, it was established that the
accused viz. Mohd Azam Danyal, was working as Over Ground Worker
(OGW) for the terrorists of LeT banned outfit particularly the PoK
based terrorist viz. Abdul Hameed Sheikh, and under well knit criminal
conspiracy was providing logistic support to him, besides, procured arms/
ammunition from the said terrorist for carrying out the terrorist activities in
the area ; and
6. Whereas, on the basis of investigation, and other evidence collected
the Investigating Officer has established prima facie, involvement of the

below mentioned accused in the commission of the offences punishable

they have crossed over to Pakistan through Attari-Wagah border, by using
valid Passports and subsequently, returned back to Kashmir alongwith illegal
arms/ammunition and are active in the area for promotion of terrorist
activities ; and
2. Whereas, based on the above, a Case FIR No. 127/2022 under
Section 7/25 Arms Act, and the Section 20 of ULA (P) Act, was registered
in the Police Station, Pattan, and the investigation, of the case was set into
motion. Subsequently, during the investigation, the offence under Section
7/25 Arms Act, was dropped and the offence under Section 38 of ULA (P)
Act, was added in the case ; and
3. Whereas, during the investigation, the seizure memos were
prepared and the statements of witnesses acquainted with the facts and
circumstances of the case were recorded under the relevant provisions of
law ; and
4. Whereas, during the investigation, it was established that in the
year 2018, the accused viz. Gulzar Ahmad Ganie and Mohd Umar Lone,
crossed to the Pakistan through the Atari, Wagah Border, and after obtaining
illegal arms/ammunition returned back to the Kashmir and joined the terrorist
organization of LeT banned outfit for carrying out the terrorist activities in
the area ; and
5. Whereas, the accused terrorist viz. GuIzar Ahmad Ganie, has
been killed in an encounter with the Security Forces at Bandipora,
on 11-05-2022, and the proceedings under the law would abate against
him ; and
6. Whereas, on the basis of investigation, and other evidence collected
the Investigating Officer has established prima facie, involvement of below
mentioned accused in the commission of the offences punishable under
Section of the Unlawful Activities (Prevention) Act, 1967, as shown against

and territorial integrity of the Union of India, besides, the accused terrorists
viz. Farooq Ahmad Bhat @ Nali, Hilal Ahmad Wani, Faisal Rasheed Rather,
Ishfaq Ahmad Itoo and Muzamil Manzoor Dar S/o Mazoor ahmad Dar
R/o Badroo, fired some gun shots in air during the funeral in order to create
terror among the general public ; and
5. Whereas, the accused terrorists viz. Hilal Ahmad Wani,

beneficiaries to get their entitlements directly in a convenient and
seamless manner by obviating the need to produce multiple documents
to prove one’s identity ;
WHEREAS, Youth Services and Sports Department provides
scholarship to the students/players for National/International Games
participation/medals.
NOW, THEREFORE, in pursuance of Section 7 of the Aadhaar
(Targeted Delivery of Financial and other Subsidies, Benefits and
Services Act, 2016 (18 of 2016) hereinafter referred to as the said
Act), the Government of Jammu and Kashmir hereby notifies the
following, namely :—
1. (I)
An individual eligible for receiving the benefits under the
scheme shall hereby be required to furnish proof of
possession of the Aadhaar number or undergo Aadhaar
authentication.
(II)
Any individual desirous of availing benefits under the
scheme, who does not possess the Aadhaar number or,
has not yet enrolled for Aadhaar, shall be required to make
application for Aadhaar enrollment before registering for
the scheme provided that he is entitled to obtain Aadhaar
as per Section 3 of the said Act, and such individuals
shall visit any Aadhaar enrollment centre available at the
Unique Identification Authority of India (UIDAI) website
(www.uidai.gov.in) to get enrolled for Aadhaar.
(III) As per regulation 12 of the Aadhaar (Enrollment and
Update) Regulations, 2016 the Department through its
Implementing Agency, is required to offer Aadhaar
enrollment facilities for the beneficiaries who are not yet
enrolled for Aadhaar and in case there is no Aadhaar
enrollment centre located in the respective Block or Tehsil,
the Department through its Implementing Agency shall
provide Aadhaar enrollment facilities at convenient locations
in coordination with the existing Registrars of UIDAI or
by becoming a UIDAI Registrar themselves.
2. In order to provide benefits to the beneficiaries under the
Scheme conveniently, the Department through its Implementing Agency

shall make all the required arrangements to ensure that wide publicity
through the media shall be given to the beneficiaries to make them

Scheme is deprived of his/her due benefits, the Department through
its Implementing Agency shall follow the exception handling mechanism
as outlined in the office Memorandum of Direct Benefit Transfer
Mission, Cabinet Secretariat Government of India No. D-26011/04/2017-
DBT dated 19-12-2017 (available on https://dbtbarat.gov.in/).
4. The notification shall come into effect from the date of its
publication in the Official Gazette.

one place to another for carrying out the terrorist activities in the
area ; and
2. Whereas, based on the above a Case FIR No. 05/2021 under
Sections 18 and 39 of ULA (P) Act, was registered in the Police Station,
Pulwama, and the investigation, of the case was set into motion.
Subsequently, during the investigation, the offences under Sections 18
and 39 of ULA (P) Act were dropped and the Section 13 of ULA (P)
Act was added in the case ; and
3. Whereas, during the investigation, the accused viz. Aquib GuIzar
Mir, was arrested in the case and was found working for the terrorists
in order to promote terrorist activities in the area. During the investigation,
some incriminatory material was seized on the instance of the accused
viz. Aquib Gulzar Mir ; and
4. Whereas, during the investigation, the seizure memos were
prepared and the statement of witnesses acquainted with the facts and
circumstances of the case were recorded under the relevant provisions
of law ; and
5. Whereas, during the investigation, it was established that the
accused viz. Aquib Gulzar Mir, was carrying out the unlawful activities
in the area, thereby intended to disrupt the sovereignty and territotial
integrity of India and to cause disaffection against india ; and
6. Whereas, on the basis of investigation and other evidence
collected the Investigating Officer has established prima facie,
involvement of below mentioned accused in the commission of the
offences punishable under Section of the Unlawful Activities (Prevention)
Act, 1967, as shown against his name :—

7. Whercas, the Authority, appointed by the Government under
Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention)
Act, 1967, has independently examined the Case Diary File and all the
other relevant documents relating to the case and has come to the
conclusion that a prima facie case is made out against the above
accused ; and
8. Whereas, after perusing the Case Diary File, the relevant
doruments and also taking into consideration the views of the Authority
appointed under Sub-Section (2) of Section 45 of the Unlawful Activities
(Prevention) Act 1967, the Government is of the view that there is
sufficient material and evidence available against the above-mentioned
accused for his prosecution under the provisons of law.
Now, therefore, in exercise of the powers conferred by Sub-Section
(2) of Section 45 the Unlawful Activities (Prevention) Act, 1967, the
Government hereby accord sanction for launching prosecution against
the accused viz. Aquib Gulzar Mir, for the commission of offences
punishable under Section 13 of ULA (P) Act, arising out of FIR No.
05/2021 of Police Station, Pulwama.

SO-418.—-Whereas, on 21-03-2023, a reliable information was
received by the Police Station, D.H. Pora to the effect that two suspects
identified as Waseem Ahmad Naik S/o Mohd Younis Naik and Mudasir
Ahmad Mir S/o Mohd Asan Mir R’s/o Nihama, D.H. Pora, Kulgam
are conspiring against the sovereignty and integrity of the India and UT

of J&K and are planning to cause damage to the Police/Security Force
in the area with the illegally equipped arms/ammunition, thereby created
fear among the general public ; and
2. Whereas, based on the above, a Case FIR No. 15/2023 under
Sections 13 and 18 of ULA (P) Act was registered in the Police Station,
D.H. Pora, and the investigation of the case was set Into motion.
Subsequently, during the investigation, the offences under Section 7/25
Arms Act and the Sections 20,23,38 and 39 of ULA (P) Act were added
in the case ; and
3. Whereas, during the Investigation, the accused viz. Waseem
Ahmad Naik and Mudasir Ahmad Mir, were arrested in the case and
were found in contact with a terrorist of TRF banned outfit namely,
Mohd Asif Wani @ Yawar S/o Dilawar Ahmad Wani R/o Taki,
Gopalpora, D.H. Pora, who provided a hand grenade to the accused
viz. Waseem Ahmad Naik and Mudasir Ahmad Mir, in order to promote
terrorist activities in the area. Subsequently, during the investigation, 01
Hand Grenade was recovered at their instances ; and
4. Whereas, during the investigation, the seizure memos were
prepared and the statements of witnesses acquainted with the facts and
circumstances of the case were recorded under the relevant provisions
of law ; and
5. Whereas, during the investigation, it was estahlished that the
accused viz. Waseern Ahmad Naik and Mudasir Ahmad Mir, were
working as Over Ground Workers (OGWs) for the terrorists of TRF
banned outfit particularly the terrorist viz. Mohd Asif Wani @ Yawar,
and under a well knit criminal conspiracy were providing logistic support
to him, besides, procured a hand grenade from the said terrorist for
carrying out the terrorist activities in the area ; and
6. Whereas, the accused terrorist viz. Mohd Asif Wani @) Yawar,
has been killed in an encounter with the Security Forces and the
proceedings under the law would abate against him ; and

7. Whereas, on the basis of the investigation, the statements of
witnesses recorded and other evidence collected, the Investigating Officer,
has established prima facie involvement of the below mentioned accused
for the commission of offences punishable in terms of the provisions
of the Unlawful Activities (Prevention) Act, 1967, as shown against their

SO-419.—-Whereas, on 05-04-2023, Police Station, Bandipora,
received a docket to the effect that a reliable information was received
about the movement of a terrorist of LeT banned outfit namely
Mohammad Umar @ Salman @ Ayaan S/o Gh. Hassan Mir R/o Brath
Kalan, Sopore, in Aloosa, Bandipora area. Subsequently, a joint Naka

was established by the Police/Security Force at Canal Road, Aloosa and
during the checking a suspect while seeing the Naka Party tried to escape
but was chased down on the spot and indentified as Jamsheed Ahmad
Bhat S/o Ab. Rashid Bhat R/o Aloosa, Bandipora. During his personal
search, the Police recovered 01 Hand Grenade and 12-AK 47 Rounds
from his possession ; and
2. Whereas, based on the above, a Case FIR No. 45/2023 under
Section 7/25 Arms Act and the Sections 18 and 23 of ULA (P) Act
was registered in the Police Station, Bandipora, and the investigation
of the case was set into motion. Subsequently, during the investigation,
the offences under Sections 20,38 and 39 of ULA (P) Act were added
in the case ; and
3. Whereas, during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statements
of witnesses acquainted with the facts and circumstances of the case
were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, it was found that the accused
viz. Jamsheed Ahmad Bhat was in contact with the terrorist of leT banned
outfit viz. Mohammad Umar Mir @ Salman @ Ayaan, who provided
a hand grenades and ammunition to the accused viz. Jamsheed Ahmad
Bhat through an unknown person in order to promote terrorist activities
in the area ; and
5. Whereas, during the investigation, it was estahlished that the
accused viz. Jamsheed Ahmad Bhat, was working as Over Ground
Worker (OGW) for the terrorists of LeT banned outfit particularly the
terrorist viz. Mohammad Umar Mir @ Salman @ Ayaan, and under
a well knit criminal conspiracy were providing logistic support to him,
besides, procured a hand grenade and ammunition from the said terrorist
for carrying out the terrorist activities in the area ; and
6. Whereas, the investigation, in respect of an unknown person(s)
who handed over the grenade and ammunition to the accused viz.

Jamsheed Ahmad Bhat shall continue to ascertain his identity and to
bring out his role in the case and the supplementary charge sheet against
him would be filed in the Court of competent jurisdiction ; and
7. Whereas, on the basis of the investigation, the statements of
witnesses recorded and other evidence collected, the Investigating Officer,
has established prima facie involvement of the below mentioned accused

received by the Police Station, Poonch, to the effect that three persons
identified as Mohd Aslam S/o Mohd Sadiq Caste Gakhar R/o Degwar,
Maldayalan, Haveli, Poonch, Mohd Jahangir S/o Mohd Sadeeq Caste
Sheikh and Mohd Bashir S/o Habib Ullah Caste Sheikh R’s/o Nakarkote,
Degwar, Maldayalan, Haveli, Poonch, are involved in smuggling of
contraband from across the border on the behest of PaK Agency ISI
with the intention to sell the same among the youth, in order to promote
terrorist activities in the area ; and

2. Whereas, based on the above, a Case FIR No. 28/2023
under Section 8 (a)/21-29 NDPS and the Sections 13 and 18 of ULA(P)
Act was registered in the Police Station, Poonch, and the investigation,
of the case was set into motion. Subsequently, during the investigation,
the offence under Sections 20, 38 and 39 of ULA(P) Act were added
in the case ; and
3. Whereas, during the investigation, the accused viz. Mohd
Aslam, Mohd Jahangir and Mohd Bashir, were arrested in the case and
it was found that the accused viz. Mohd Jahangir and Mohd Aslam,
received 03 packets of contraband (Heroin) from the accused viz. Mohd
Bashir, with the directions to hand over the same to one Liaqat Hussain
S/o Mohd Aslam Caste Charak R/o Khari, Karmara, Haveli, Poonch,
in consideration of an amount of Rs. 50,000/- per packet and later a
hide the same near a Nallah situated at Degwar Maldayalan.
Subsequently, the accused viz. Liaqat Hussain, was also arrested in the
case and during the investigation, 03 more packets of contraband
(Heroin) were recovered at their instances ; and
4. Whereas, during the investigation, the seizure memos were
prepared and the statement of witnesses acquainted with the facts and
circumstances of the case were recorded under the relevant provisions
of law ; and
5. Whereas, during the investigation, it was found that the accused
viz. Mohd Aslam, Mohd Jahangir, Mohd Bashir and Liaqat Hussain,
were in contact with two persons namely :— Naseem Ahmad Khan
S/o Hassam Din Caste Gakhar R/o Nakarkote, Degwar Maldayalan,
Haveli, Poonch A/P PoK and Safder Hussain S/o Manzoor Hussain
Caste Charrak R/o Khari Karmara, Haveli, Poonch A/P Saudi Arabia,
through the virtual mode, who provided the contraband (Heroin) to
them from accross the border for promotion of terrorist activities in the
area ; and
6. Whereas, during the investigation, it was established that the
accused viz. Mohd Aslam, Mohd Jahangir, Mohd Bashir, Liaqat Hussain
and Safder Hussain, were working as Over Ground Workers (OGWs)
for the terrorists of LeT/Al Badrm, banned outfits particularly the
Pakistan based terrorist viz. Naseem Ahmad Khan, and under a
well knit criminal conspiracy were providing logistic support to them,
besides, were facilitating the terrorists for transportation of Narcotics
(Heroin) from one place to another for promotion of terrorist activities
in the area ; and

SO−443.Whereas, on 25-07-2018, a reliable information was
received by the Police Station, Anantnag, regarding hiding of some
unknown terrorists, equipped with illegal weapons, in the house of one

Nazir Ahmad Khan S/o Ab. Rahman Khan R/o Mehman Mohalla,
Anantnag, in order to carry out terrorist activities in the area ; and
2. Whereas, based on the above, a case FIR No. 124/2018 under
Section 7/25 Arms Act and the Sections 16, 18 and 20 of ULA (P) Act,
was registered in the Police Station, Anantnag, and the investigation of
the case was set into motion. Subsequently, during the investigation, the
offences under Section 7/25 Arms Act was dropped and the offences
under Section 307 IPC, 7/27 Arms Act and the Sections 19, 38 and 39 of
ULA (P) Act were added in the case ; and
3. Whereas, during the investigation, a Joint Cordon and Search
Operation was launched by the Police/Security Forces and during the
search the hiding terrorists fired indiscriminately upon the Search Party,
with their illegal arms/ammunition, with the intention to kill them. The
fire was retaliated, resulting in killing of two terrorists of LeT banned
outfit who were later on identified as Abid Hussain Bhat S/o Walia Bhat
R/o Bagwa, Doda and Binyamin Dar @ Bilal Dar S/o Mohammad
Yousuf Dar R/o Bonpora, Khudwani, Kulgam. During the search,
arms/ammunition viz. 01 AK-47 rifle, 02 AK Magazines, 01 INSAS
rifle, 02 Magazines, 04 Rounds and some incriminatory material were
also recovered from the place of encounter ; and
4. Whereas, during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statement of
witnesses acquainted with the facts and circumstances of the case were
recorded under the relevant provisions of law ; and
5. Whereas, during the investigation, the accused house owner viz.
Nazir Ahmad Khan, along with his two sons namely, Abid Hussain Khan
and Tariq Ahmad Khan S/o Nazir Ahmad Khan R/o Mehman Mohalla,
Anantnag, were found working for the terrorists in order to promote
terrorist activities in the area. Subsequently, the accused viz. Nazir
Ahmad Khan and Abid Hussain Khan, were arrested in the case and the
accused viz. Tariq Ahmad Khan, has later joined the terrorist ranks of
LeT banned outfit and subsequently, has been killed in an encounter with
the Security Forces ; and
6. Whereas, during the investigation it was established that the
accused viz. Nazir Ahmad Khan and Abid Hussain Khan, were working
as Over Ground Workers (OGWs) for the terrorists of LeT banned outfit

particularly the terrorists viz. Abid Hussain Bhat and Binyamin Dar @
Bilal Dar, and were providing logistic support to them, besides on the
date of occurrence voluntarily harbored the said terrorist in their
residential house for carrying out the terrorist activities in the area ; and
7. Whereas, the accused terrorist viz. Abid Hussain Bhat, Binyamin
Dar @ Bilal Dar and Tariq Ahmad Khan, have been killed in the
different encounters with the Security Forces and the proceedings under
the law would abate against them ; and
8. Whereas, on the basis of the investigation, the statement of
witnesses recorded and other evidence collected, the Investigating
Officer, has established prima facie involvement of the below mentioned
accused for the commission of offences punishable in terms of the
provisions of the Unlawful Activities (Prevention) Act, 1967, as shown
against their names :─

SO−450.Whereas, on 23-03-2023, the Police Station, Tarzoo
received a docket to the effect that a reliable information was received
about the movement of some unknown suspects in Peth Seer near
Railway Station, Sopore. Subsequently, a Joint Cordon and Search
Operation was launched by the Police/Security Forces and during search,

a suspect while seeing the Search Party tried to escape but was chased
down on the spot and identified as Umar Bashir Bhat S/o Bashir Ahmad
Bhat R/o Munz Seer, Sopore. During his personal search, the Police
recovered 01 Pistol with magazine, 15 rounds and 01 hand grenade from
his possession ; and
2. Whereas, based on the above, a case FIR No. 25/2023 under
Section 7/25 Arms Act and Sections 23 and 38 of ULA(P) Act, was
registered in Police Station, Tarzoo, and investigation of the case was set
into motion. Subsequently, during the investigation, the offence under
Sections 18 and 20 of ULA (P) Act was added in the case ; and
3. Whereas, during the course of investigation, the site plan of the
place of occurrence and the seizure memos were prepared and the
statement of witnesses acquainted with the facts and circumstances of the
case were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, the accused viz. Umar Bashir
Bhat, was found in contact with a Pakistan based terrorists of LeT
banned outfit @ Tahir Nazir, through virtual mode, who provided the
arms/ammunition and explosive material to him through an unknown
person, in order to promote terrorist activities in the area ; and
5. Whereas, during the investigation, it was established that the
accussed viz. Umar Bashir Bhat, was associated with the terrorist
organization of LeT banned outfit and under a well knit criminal
conspiracy procured arms/ammunition and explosive material from
Pakistan handlers viz. @ Tahir Niazi, for carrying out the terrorist
activities in the area ; and
6. Whereas, the investigation in respect of Pakistan handlers
@ Tahir Niazi and an unknown person who handed over
arms/ammunition and explosive material to the accussed viz. Umar
Bashir Bhat, shall continue to ascertain their actual identity and to bring
out their role/involvement in the case and the supplementary charge sheet
against them would be filed in the Court of competent jurisdiction ; and
7. Whereas, on the basis of investigation, the statement of witnesses
recorded and other evidence collected, the Investigating Officer, has

SO−452.Whereas, on 01-01-2023, the Police Station, Karnah
received a docket to the effect that a reliable information was received
that two persons identified as Umar Aziz S/o Aziz-ul-Rehman and Syed
Touseef Geelani S/o Syed Mehmood Geelani R’s/o Chatkari, Taad,
Karnah, procured some arms/ammunition and narcotics from across the
border in order to promote terrorist activities in the area. ; and

2. Whereas, based on the above, a case FIR No. 01/2023 under
Section 7/25 Arms Act, 8/21-29 NDPS Act and the sections 13, 18, 20,
23 and 38 of ULA(P) Act, was registered in Police Station, Karnah, and
investigation of the case was set into motion. Subsequently, during the
investigation, the offence under section 120-B IPC and the Section 39 of
ULA (P) Act was added in the case ; and
3. Whereas, during the investigation, the accused viz. Umar Aziz
and Syed Tauseef Geelani, were arrested in the case and during the
investigation, 05 Pistols, 10 magazines, 77 rounds and 10 packets of
contraband were recovered at the instances of accused viz. Umar Aziz ;
and
4. Whereas, during the investigation, the seizure memos were
prepared and the statement of witnesses acquainted with the facts and
circumstances of the case were recorded under the relevant provisions of
law ; and
5. Whereas, during the investigation, it was found that the accused
viz. Umar Aziz and Syed Touseef Geelani, were in contact with a
Pakistan based terrorist of LeT banned outfit namely Ab. Hameed Sheikh
@ Mama Kumar S/o Faqeer Sheikh R/o Dhani, Taad, Karnah A/P PoK,
through the virtual mode, who provided the arms/ammunition and
narcotics (Heroin) to the accused viz. Umar Aziz, in order to promote
terrorist activities in the area ; and
6. Whereas, during the investigation, it was established that the
accused viz. Umar Aziz and Syed Touseef Geelani, were working as

particularly the PoK based terrorist viz. Ab. Hameed Sheikh @ Mama

Act, 1967, has independently examined the Case Diary File and all the
other relevant documents relating to the case and has come to the
conclusion that a prima facie case is made out against the above
accused ; and
11. Whereas, after perusing the Case Diary File, the relevant
documents and also taking into consideration the views of the Authority
appointed under Sub-Section (2) of Section 45 of the Unlawful Activities
(Prevention) Act, 1967, the Government is of the view that there is
sufficient material and evidence available against the above-mentioned
accused for their prosecution under the provisions of law.

In the said notification, for the words, letter and figure “30th day of
June, 2023” the words letter and figure “31st day of August, 2023”shall
be substituted.
2.This Notification shall be deemed to have come into force with
effect from the 30th day of June, 2023.

revision of 30% rent. Whereas the Elected Body of Municipal Council
Ganderbal has passed the resolution No. 46 dated: 14-09-2023 for
revision the monthly rentals for the Assets/Rooms they currently occupy
