Case was called. Ld. Counsel for complaint present. Accused

Perusal of the file reveals that as per report of dockets issued
to the accused he was once served on 01-10-2019 but has never
appeared before the Court and further docket annexed on the backside
of the file reveals that the police agency could not trace the whereabouts
of the accused inspite of every place of mentioned address being
searched and it is further reported that the accused has already
absconded. After perusing the whole material on record, this Court is
of the opinion that the accused has absconded and there is no immediate
prospect of his arrest. So, he is also declared as absconder and

accused. Form the perusal of order dated 14-12-2021, it is reveals that
the accused was informed telephonically as well as through whatsapp
with regard to Court hearing and on the same day non-bailable warrant
was issued against the accused and as report was fild by police station

from his relatives, it was replied by them that they are not aware of

Whereas, it appears to the Government that a total area of
11 Kanals, 12 Marlas and 01 Sirsai of land is required in Village
Batapora, Tehsil Shopian District Shopian for public purpose namely
‘‘Construction of Lawyers’ Chambers, Residential Quarters for Judicial
Officers, and Office for Prosecuting Wing at District Court Complex,
Shopian’’.
Whereas, Collector Land Acquisition Shopian after obtaining the
report of the Social Impact Assessment Committee, issued preliminary
notification under Section 11(1) of the Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement Act,
2013, vide No. DCS/LAC/23-24/89-93, dated 26-05-2023 for calling
upon objections, if any, from the interested persons/land owners ; and
Whereas, in response to the said notification one joint objections
has been received by the Collector Land Acquisition Shopian with
regard to the disbursement of compensation ;
Whereas, the case has been examined and the Collector Land
Acquisition, Shopian has given due opportunity to the interested persons
and has accordingly submitted report vide No. DCS/LAC/23-24/705-07
dated 17-02-2024, which revealed that one joint objection was filed by
Dilshada Jan and Batulla Jan, Daughters of Ghulam Hassan Mir,
Residents of Baba Mohalla, Shopian within a stipulated period of time,
which stands disposed off ;
Whereas, the Appropriate Government is satisfied after considering
the report made by the Collector Land Acquisition, Shopian that the said
land is required for public purpose.

Now, therefore it is hereby declared under the provisions of
Section 19(1), of the Right to Fair Compensation and Transparency
in Land Acquisition, Rehabilitation and Resettlement Act, 2013, that

Village Batapora, Tehsil and District Shopian, for public purpose, namely
Construction of Lawyers’ Chambers, Residential Quarters for Judicial
Officers, and Office for Prosecuting Wing at District Court Complex,
Shopian.
The land statement and plan can be inspected in the office of
Collector Land Acquisition (ACR) Shopian and Tehsildar concerned.
