01-01-2023 was issued vide Government Order No. 19-JK(Rev) of 2023
dated 21-02-2023 ;
AND WHEREAS, after issuance of the said seniority list several
changes occurred on account of induction of Tehsildars into JKAS/
promotion(s)/retirement/apportionment(s) during the year 2023 and names
of such Officers need to be included/excluded from the said seniority list ;
AND WHEREAS, consequent upon the aforesaid reasons, it is
necessary to notify the seniority list of Jammu and Kashmir Revenue
(Gazetted) Service (Tehsildars) as it stood on 01-01-2024 in accordance
with the relevant provisions of Jammu and Kashmir Revenue (Gazetted)
Service Recruitment Rules, 2020 ;
Now, therefore, a tentative seniority list of the Jammu and Kashmir
Revenue (Gazetted) Service (Tehsildars) as it stood on 01-01-2024 is hereby
notified forming Annexure-A to this Circular.

period of 15 days from the date of issue of this notification, falling which, it
shall be presumed that the concerned officer(s) has/have no objection and
the final seniority list shall be notified accordingly.
The date of birth recorded in the seniority list shall be subject to
verification from Service Book/Matriculation Certificate of the concerned
officer.

record. An application is made by the Chief Investi-
gating Officer, of the Criminal Case : RC-02/2021/NIA/
JMU for offences made punishable under Sections 302
read with Section 120-8 and 121 RPC 1860, Sections
16/18/20/38/39 of the UA(P) Act, 1967 and Section 27
of Arms Act, 1959, with the prayer to issue a

proclamation requiring the accused, namely (1) Rahil @
Rafiq Nai @ Sultan S/o Afsar Khan R/o Naka Mejahari,
Mendhar, Poonch, presently at Mirpur, POK and (2)
Zafar Iqbal @ Shamsheer S/o Alif Din R/o Gunthal,
PS Surankot, District Poonch presently in POK, inter-
alia on the grounds that despite of best efforts made
by the police, the presence of the aforesaid accused
could not be secured for the purpose of investigation
and trial of the case (supra) and even the general
warrants of arrest issued against them by this Court,
vide its order dated 27-07-2021 and 23-10-2021
respectively, could not be executed, Hence, this
application.
In admission of the application made by him, the statement of
Sh. Amarnath Agre, Dy. SP. NIA/JMU, the Chief Investigating Officer
of the case (supra), has been recorded, on oath, wherein he has
reiterated the facts narrated in the application. Since the statement
(supra) is made on oath, the contents thereof are to be believed at
this stage. Taking that into account the facts and circumstances of the
case coupled with the fact that the warrants of arrest issued against
them, by this Court, have not been executed so far as the accused
are reported to be absconding. It needs no emphasis to observe that
all possible legal measures are required to be adopted/undertaken to
secure the presence of the accused for the purpose of investigation
of the case (supra).
In the circumstances, a proclamation, in terms of Section 82 of
Cr. P.C. be issued requiring the accused namely (1) Rahil @ Rafiq
Nai @ Sultan S/o Afsar Khan R/o Naka Mejahari, Mendhar, Poonch,
presently at Mirpur, POK and (2) Zafar Iqbal @ Shamsheer S/o Alif
Din R/o Gunthal, PS Surankot, District Poonch presently in POK, to
appear before this Court on 15-03-2024 during the Court hours.
Futher, the Chief Investigating Officer of the case is directed to
undertake/do the following steps, with immediate dispatch and not later
than a week’s time from the date of this Order :
i.
get the proclamation publicity read in some conspicuous place
of the town/s or the village/s in which accused persons
ordinarily resides ;

ii.
the proclamation shall be affixed to some conspicuous part
of the house/s of the home stead in which the accused
persons ordinarily reside or at some conspicuous place of

reside.
The Chief Investigating Officer shall submit the compliance report
with regarding the steps mentioned here above, by or before the 10th
of February 2024.
Office is directed to paste a copy of the proclamation on some
conspicuous part (notice board) of this Court.

Whereas, the formal indent of the land has been placed by the
Chief Education Officer Pulwama vide No. CEO/Pul/Plg/21/2209-11
dated 28-08-2021, duly signed by Director School Education Department,
for construction of Govt. High School Building at Nargistan Tehsil Aripal
District Pulwama.
On the basis of said indent, the revenue extracts for land measuring
01 Kanal 03 Marlas and 04 Sirsai falling under Khasra No. 97 min (19
Marla 04 Sirsai) and Khasra No. 92 (04 Marla) were submitted by
Tehsildar Aripal which were accordingly forwarded to the Chief
Education Officer Pulwama for authentication in token of their
corectness on spot and the same got authenticated.
Whereas, Social Impact Assessment was carried out by Social
Impact Assessment (SIA) unit and a report submitted/preliminary
investigation was conducted by a team constituted by Collector as laid
down under rule-4 of ‘‘Right to Fair Compensation and Transparency
in Land Acquisition, Rehabilitation and Resettlement Act 2013’’. The
summary of the Social Impact Assessment Report/preliminary
investigation reveals as under :—
1. That the proposed acquisition of land for the project namely
‘‘construction of Government High School Building’’ at
revenue Village Nargistan serves the Public purpose.
2. That the land proposed for the acquisition is an absolute bare-
minimum needed for the project.
3. That no owner became landless by the said acquisition.
4. That the acquisition at an alternate place has not been found
feasible by the indenting department as the school was already
functioning in a three-room building and was upgraded from
Middle School to High School under RMSA in 2011.
5. That no unutilized land has previously been acquired in the said
village/area for the said purpose.
6. Recommendation :

The establishment/construction of the said school at Nargistan,
Tehsil Aripal will surely benefit a huge population of the area,
especially the student community.
Moreover, the land identified for the construction of Government
High School building at Nargistan Tehsil Aripal does not have
any adverse social impact on local public.
Whereas, the Social Impact Assessment Report was forwarded
to Deputy Commissioner (District Collector) Pulwama vide this office
No. ADC/Tral/LA/2022-23/26-28, dated 14-05-2022 and the same got
approved for issuance of Notification under Section 11(1) of the ‘‘Right
to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement Act 2013’’by the District Collector
Pulwama vide his office No. DCP/LA/2022/41, dated 26-05-2022.
After the perusal of said social Impact Assessment report/field
report, it appears that there is no need of Administrator in the instant
case as there is no relocation, displacement and rehabilitation of any
affected person/family involved.
Therefore, it is notified for the above said project in the Nargistan
Village of Aripal Tehsil Pulwama District a piece of land measuring 01
Kanal 03 Marla and 04 Sirsai of standard measurement, whose detailed
description is as following is under acquisition :

This notification is made under the provisions of Section 11(1) of
the ‘‘Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement Act 2013’’ (Act No. 30/2013) to all
whom it may concern.
A plan of the land may be inspected in the office of District
Collector and Collector Land Acquisiton/Additional Deputy Commissioner
Tral on any working day during the working hours.
The government is pleased to authorize Tehsildar/Revenue staff,
indenting department their consultant and their staff to enter upon and
survey land, take levels of any land dig or bore into the sub-soil and
do all other acts required for the proper execution of their work as
provided and specified in Section 12 of the said Act.
Under Sub–Section (4) of Section 11 of the Act, no person shall
make any transaction or cause any transaction land/structures i.e. sale/
purchase, etc., or create any encumbrances on such land from the date
of publication of such notification without prior approval of the
concerned Collector’’.
Objections to the acquisition, if any, may be filed by the person
interested within 60 (Sixty) days from the date of publication of this

During their personal search, the Police recovered 01 Pistol with
magazine, 10 rounds and 03 hand grenades from their possession
respectively ; and
2. Whereas, based on the above a Case FIR No. 53/2022 under
section 7/25 Arms Act and the Sections 18, 23 and 39 of ULA (P) Act
was registered in the Police Station, Bomai, and the investigation
of the case was set into motion. Subsequently, during the investigation,
the offences under Sections 18-B, 20 and 38 of ULA(P) Act were
added in the case ; and
3. Whereas, during the investigation, the site plan of the place
of occurrence and the seizure memos were prepared and the statement
of witnesses acquanited with the facts and circumstances of the case
were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, six more persons identified
as Abdul Rasheed Kumar S/o Fateh Mohammad Kumar R/o Sariwarpora,
Pattan, Abdul Majeed Kumar S/o Fateh Mohammad Kumar R/o
Burnaith, Buniyar, Baramulla, Tufail Ahmad Dar S/o Gh. Hassan Dar
R/o Midoora, Tral, Bilal Ahmad Sadeeqi S/o Gh. Mohammad Sadeeqi
R/o Kursoo, Rajbagh, Srinagar, Mushtaq Ahmad Bhat @ Goga @
Mushtaq Ul Islam S/o Late Ghulam Qadir Bhat R/o Kashi Mohalla,
Batmaloo and Dawood Ahmad Dar S/o Mohammad Yousuf Dar R/o
Sariwarpora, Pattan, were found involved in the case. Subsequently, the
accused viz. Abdul Rasheed Kumar, Abdul Majeed Kumar and Dawood
Ahmad Dar, were arrested and during the investigation, 01 Pistol with
magazine, 10 rounds and 11 hand grenades were recovered at the
instances of accused viz. Abdul Rasheed Kumar and Abdul Majeed
Kumar, respectively ; and
5. Whereas, during the investigation, it was found that the
accused viz. Tufail Ahmad Dar, has been arrested by Anantnag Police
in case FIR No. 166/2022 of Police Station, Bijbehara and the accused
viz. Bilal Ahmad Sadeeqi and Mushtaq Ahmad Bhat @ Goga @
Mushtaq Ul Islam, were already arrested by Srinagar Police and
detained under the provisions of J&K Public Safety Act, 1978.
Subsequently, the custody of the accused viz. Tufail Ahmad Dar,
was changed in the instant case and the person viz. Dawood Ahmad
Dar, was not found involved in the commission of crime and accordingly,
was dropped from the case and was given benefit under Sections
169 Cr. P.C. ; and

6. Whereas, during the investigation, it was found that the accused
viz. Mushtaq Ahmad Bhat, Ishfaq Ahmad Shah, Abdul Rasheed
Kumar, Abdul Majeed Kumar, Tufail Ahmad Dar, Bilal Ahmad Sadeeqi
and Mushtaq Ahmad Bhat @ Goga @ Mushtaq Ul Islam, were in
contact with two terrorists of Ansar Gazwat-ul-Hind (AGH) banned
outfit namely Mohd Ahsan Dar S/o Mohd Subhan Dar R/o Sariwarpora,
Pattan and Javeed Ahmad Mato S/o Ab. Gani Mato R/o Khushal Mato,
Sopore, who lured/motivated the accused viz. Mushtaq Ahmad Bhat,
Ishfaq Ahmad Shah, Abdul Rasheed Kumar and Abdul Majeed Kumar,
to join the outfit and provided arms/ammunition and hand grenades to
them in order to promote terrorist activities in the area ; and
7. Whereas, during the investigation, it was established that the
accused viz. Mushtaq Ahmad Bhat, Ishfaq Ahmad Shah, Abdul Rasheed
Kumar, Abdul Majeed Kumar, Mohd Ahsan Dar and Javeed Ahmad
Mato, were affiliated with the banned terrorist organization of Ansar
Gazwat-ul-Hind (AGH) and the other accused viz. Tufail Ahmad Dar,
Bilal Ahmad Sadeeqi and Mushtaq Ahmad Bhat @ Goga @ Mushtaq
Ul Islam, were working as Over Ground Workers (OGWs) for the said
terrorists and under a well knit criminal conspiracy were providing
logistic support to them for carrying out the terrorist activities in the
area ; and
8. Whereas, on the basis of the investigation, the statements of
witnesses recorded and other evidence collected, the Investigatig
Officer, has established a prima facie involvement of the below
mentioned accused for the commission of offences punishable in terms
of the provisions of Unlawful Activities (Prevention) Act, 1967, as

documents and also taking into consideration the views of the Authority
appointed under Sub-Section (2) of Section 45 of the Unlawful Activities
(Prevention) Act, 1967, the Government is of the view that there is
sufficient material and evidence available against the above mentioned
accused for their prosecution under the provisions of law.
Now, therefore in exercise of the powers conferred by Sub-
Section (2) of Section 45 the Unlawful Activities (Prevention) Act, 1967,

SO–491—Whereas, on 30-03-2023, the Police Station, Kokernag,
received a docket to the effect that a Joint Naka was established by
the Police/Secuirty Forces at Village Nagam, Kikernag , and during the
checking a suspect while seeing the Naka Party tried to escape but
was chased down on the spot and identified as Gowhar Ahmad Kumar
S/o Ghulam Nabi Kumar R/o Soaf Shali, Kokernag. During his personal
search, the Police recovered 05 Pistal rounds and 01 hand grenade from
his possession ; and
2. Whereas, based on the above, a case FIR No. 27/2023,
under Sections 3/4 ESA, 7/25 Arms Act and Sections 13, 23 and 39 of

ULA (P) Act, was registered in the Police Station, Kokernag,
and the investigation, of the case was set into motion. Subsequently,
during the investigation, the offences under Senctions 18, 20 and 38 of
ULA (P) Act were added in the case ; and
3. Whereas, during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statements
of witnesses acquainted with the facts and circumstances of the case
were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, the accused viz. Gowhar
Ahmad Kumar, was found in contact with a terrorist of LeT banned
outfit namely Uzair Ahmad Khan S/o Bashir Ahmad Khan R/o Nagam,
Soaf Shali, Kokernag, who provided the ammunition and explosive
material to the accused viz. Gowhar Ahmad Kumar, in order to promote
terrorist activities in the area ; and
5. Whereas, during the investigation, it was established that the
accused viz. Gowhar Ahmad Kumar, was working as Over Ground
Worker (OGW) for the terrorists of LeT banned outfit particularly the
terrorist viz. Uzair Ahmad Khan, and under a well knit criminal
conspiracy was providing logistic support to them, besides, procured
ammunition and explosive material from the said terrorist for carrying
out the terrorist activities in the area ; and
6. Whereas, on the basis of the investigation, and other evidence
collected, the Investigating Officer, has established prima facie
involvement of the below mentioned accused in the commission of the
offences punishable under sections of the Unlawful Activities (Preven-
tion) Act, 1967, as shown against their names :—

7. Whereas, the accused terrorist viz. Uzair Ahmad Khan, is
absconding and the proceedings under Sections 299 Cr.PC. have been
proposed to be initiated against him ; and
8. Whereas, the Authority, appointed by the Government under
Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention)
Act, 1967, has independently examined the Case Diary File and all the
other relevant documents relating to the case and has come to the
conclusion that a prima facie case is made out against the above
accused ; and
9. Whereas, after perusing the Case Diary File, the relevant
documents and also taking into consideration the views of the Authority
appointed under Sub-Section (2) of Section 45 of the Unlawful Activities
(Prevention) Act, 1967, the Government is of the view that there is
sufficient material and evidence available against the above mentioned
accused for their prosection under the provisions of law.
Now, therefore, in exercise of the powers conferred by Sub-
Section (2) of Section 45 the Unlawful Activities (Prevention) Act, 1967,
the Government hereby accord sanction for launching prosecution
against the accused viz.Gowhar Ahmad Kumar, and Uzair Ahmad Khan,
for the commission of offences punishable under the relevant sections
of ULA (P) Act, as indicated against the each accused at para (6)

SO-507.—Whereas, on 29-03-2019, the Police Station, Nowgam,
received a docket to the effect that a reliable information was received

about the hiding of some unknown terrorists in Suthsoo Kalan area.
Subsequently, a Joint Cordon and Search Operation was launched by the
Police / Security Forces and during the search, the hiding terrorists fired
indiscriminately
upon
the
Search
Party,
with
their
illegal
arms/ ammunition with the intention to kill them. The fire was retaliated,
triggering an encounter; and
2. Whereas, based on the above, a case FIR No. 21/2019under
Section307RPC and the Section 7/27 Arms Act, was registered in the
Police Station, Nowgam, and the investigation, of the case was set into
motion.Subsequently, during the investigation, the offences under
Sections 16, 19, 20 and 39 of ULA (P) Act were added in the case; and
3. Whereas, during the investigation, the dead bodies of two
terrorists of JeM banned outfit, who were later on identified as Ali Bhai
and Idress Bhai R’s/o Pakistan, were recovered from the place of
encounter. During the investigation, arms/ ammunition viz. 01 M4 Rifle ,
01 M4 Night Sight Rifle, 05 M4 Magazine, 01 AK-56 Rifle, 03 AK
Magazines, 65 M4 Rounds, 16 AK Rounds and 04 Chinese Hand
Grenades, were also recovered from the place of occurrence : and
4. Whereas, during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statements of
witnesses acquainted with the facts and circumstances of the case were
recorded under the relevant provisions of law ;and
5. Whereas, during the investigation, it was found that on 29-03-
2019, one terrorist of JeM banned outfit identified as Sameer Ahmad Dar
S/o Mohammad Subhan Dar R/o Gundibagh, Kakapora, managed his
escape from the place of occurrence who was later killed on 29.12.2021,
in an encounter with the Security Forces at Dooru, Anantnag; and
6. Whereas, during the investigation, it was found that on the date of
occurrence the accused terrorists viz. Ali Bhai, Idress Bhai and Sameer

Ahmad Dar, were hiding in the residential house of one Fayaz Ahmad
Ganie S/o Ghulam Mohammad Ganie R/o Suthsoo Kalan, who provided
shelter/logistic support to them. Subsequently, the said accused was
arrested in the case ; and
7. Whereas, during the investigation, it was established that the
accused viz. Fayaz Ahmad Ganie, was working as Over Ground Woker
(OGW) for the terrorists of JeM banned outfit particularly the killed
terrorists viz. Ali Bhai, Idress Bhai and Sameer Ahmad Dar, and was
providing logistic support to them, besides, on the date of occurrence
voluntarily harboured the said terrorists in his residential house for
carrying out the terrorist activities in the area ; and
8. Whereas, the terrorists viz. Ali Bhai, Idress Bhai and Sameer
Ahmad Dar, have been killed in the different encounters with the
Security Forces and then proceeding under the law would abate against
them ; and
9. Whereas, on the basis of investigation, and other evidence
collected the Investigating Officer has established prima facie,
involvement of below mentioned accused in the commission of the
offences punishable under section of the Unlawful activities (Prevention)
Act, 1967, as shown against hisnames :—

WaliMohammad Malik R/o Warpora, Hatmulla, Kupwara A/P Pakistan,
who provided the said hand grenade to him through an unknown person
in order to promote terrorist activities in the area ; and
5. Whereas, during the investigation, it was established that the
accused viz. Mohammad Rafiq Khan, was working as Over Ground
Worker (OGW) for the terrorists of HM banned outfit particularly the
terrorists viz. Fayaz Ahmad Malik @ Abu Huryrah, and was providing
logistic support to him, besides, under a well knit criminal conspiracy
procured a hand grenade from the said terrorists through an unknown
person for carrying out the terrorists activities in the area; and
6. Whereas, the investigation in respect of the said unknown person
who handed over a hand grenade to the accused viz Mohammad Rafiq
Khan, shall continue to ascertain his actual identityandtobring out his

received a docket to the effect that a reliable information was received
about the hiding of some unknown terrorist in village Heff Shrimal,
Zainapora. Subsequently, a Joint Cordon and search operation was

launched by the Police/Security Forces and during the search, two
suspects while seeing the Security Forces tried to escape but were chased
down on the spot and identified as Mohd Shameem Bhat @ Shahid S/o
Gull Bhat R/o Heff, Shrimal and Zubair Asan Padder S/o Mohd Asan
Padder R/o Heff, Zainapora. During the personal search of accused viz.
Mohd Shameem Bhat @ Shahid, the Police recovered 01 Revolver and
06 rounds from his possession, besides, recovered 01AK-47 rifle, 02
magazines and 88 rounds at the instance of accused viz. Zubair Asan
Padder; and
2. Whereas, based on the above, a case FIR No.08/2020under
Section7/25 Arms Act, and the Sections18, 20 and 38 of ULA (P) Act,
was registered in the Police Station, Zainapora, and the investigation, of
the case was set into motion.Subsequently, during the investigation, the
offences under Sections 23 and 39 of ULA (P) Act were added in the
case; and
3. Whereas, during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statements of
witnesses acquainted with the facts and circumstances of the case were
recorded under the relevant provisions of law ;and
4. Whereas, during the investigation, three more persons identified as
Bilal Ahmad Teeli S/o Ab. Rahim Teeli, Showkat Ahmad Shah S/o Gh.
Hassan Shah R’s/o Heff, Zainapora and Towseef Ahmad Mir S/o Bashir
Ahmad Mir R/o Chakoora, Pulwama, were found involved in the case.
Subsequently, the accused were arrested and during the investigation,
arms/ammunition viz 01 SLR magazine, 02LMG magazines, 07 INSAS
magazines, 30 SLR rounds, 60 LMG rounds and 41 INSAS rounds and
were recovered at his instances of accused viz. Bilal Ahmad Teeli.
During the investigation, the accused viz. Showkat Ahmad Shah and
Towseef Ahmad Mir, were not found involved in the commission of
crime and accordingly, were dropped from the case and were given
benefit under Section 169 Cr. PC ; and

5. Whereas, during the investigation, it was found that theaccused
viz. Mohd Shameem Bhat @ Shahid, Zubair Asan Padder and Bilal
Ahmad Teeli, were in contact with a terrorist of HM banned outfit
namely Feroz Ahmad Dar S/o Ab. Khaliq Dar R/o Heff Shrimal,
Zainapora, who provided the arms/ammunition to them in order to
promote terrorist activities in the area; and
6. Whereas,during the investigation, it was established that the
accused viz. Mohd Shameem Bhat @ Shahid Zubair Asan Padder and
Bilal AhmadTeeli, were working as Over ground Workers (OGWs) for
the terrorists of HM banned outfit particularly the terrorist viz. Feroz
Ahmad Dar, and were providing logistic support to him, besides, under a
well knit criminal conspiracy procured arms/ammunition from the said
terrorist for carrying out the terrorist activities in the area; and
7. Whereas, the accused terrorist viz. Feroz Ahmad Dar, has been
killed in an encounter with the Security Forces and the proceeding under
the law would abate against him ; and
8. Whereas, on the basis of investigation, and other evidence
collected the Investigating Officer has established prima facie,
involvement of below mentioned accused in the commission of the
offences punishable under section of the Unlawful activities (Prevention)

SO-512.—Whereas, on 12-06-2023, the Police Station, Hajin,
received a docket to the effect that a Joint patrolling was conducted by
the Police/ Security Forces in Baharabad, Hajin, area and during the

patrolling a suspect while seeing the Police/ Security forces tried to
escape but was chased down on the spot and identified as Hafeez Ahmad
Mughal S/o Late Mohammad Yousaf Mughal R/o Chanipura Payeen ,
Karnah. During his personal search, the Police recovered 02 Hand
Grenades from his possession ; and
2. Whereas, based on the above, a case FIR No.44/2023under
Section7/25 Arms Act, 3/4 ESA and the Sections 13 and 18 of ULA (P)
Act, was registered in the Police Station, Hajin, and the investigation of
the c as was set into motion.Subsequently, during the investigation, the
offences under Section 201 IPC and the Sections20, 23 and 38 of ULA
(P) Act were added in the case; and
3. Whereas, during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statements of
witnesses acquainted with the facts and circumstances of the case were
recorded under the relevant provisions of law ;and
4. Whereas, during the investigation, it was found that the accused
viz. Hafeez Ahmad Mughal, was in contact with a terrorist of LeT
banned outfit namely Mohammad Iqbal Khan @ Haji S/o Mohammad
Hussain Khan R/o Kandi Barjala, Uri A/P Jalalabad, Muzaffarabad, PoK,
who provided two hand grenades to the accused viz. Hafeez Ahmad
Mughal, through an unknown person in order to promote terrorist
activities in the area; and
5. Whereas, during the investigation, it was established that the
accused viz. Hafeez Ahmad Mughal, was associated with the terrorist
organization of LeT banned outfit and under a well knit criminal
conspiracy procured hand grenade from the terrorists viz. Mohammad
Iqbal Khan @ Haji, through an unknown person for carrying out the
terrorist activities in the area ; and

6. Whereas, the investigation, in respect of an unknown person who
handed over the hand grenades to the accused viz. Hafeez Ahmad
Mughal, shall continue to ascertain his actual identity and to bring out his
role/involvement in the case and the supplementary charge sheet against
him would be filed in the Court of competent jurisdiction; and
7. Whereas, on the basis of investigation, and other evidence
collected the Investigating Officer has established prima facie,
involvement of below mentioned accused in the commission of the
offences punishable under section of the Unlawful activities (Prevention)
Act, 1967, as shown against their names :—

Now, therefore,in exercise of the powers conferred bySub-Section
(2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the
Government hereby accord sanction for launching prosecution against
the accused viz. Hafeez Ahmad Mughal and Mohammad Iqbal Khan @
Haji, for the commission of offences punishable under relevantsectionsof
ULA (P) Act, as indicated against the each accused at Para (7) above,
arising out of FIR No. 44/2023 of Police Station,Hajin.

SO-522.—Whereas, on 05-05-2023, the Police Station, Imamsahib,
received a docket to the effect that a Joint Naka was established by the

Police/Security Forces at Tulran, Imamsahib crossing and during the
checking a suspect while seeing the Naka Party tried to escape but was
chased down on the spot and identified as Mohd Asgar Dar S/o Mohd
Amin Dar R/o Nagisharan Payeen. During his personal search, the Police
recovered 01 Pistol with magazine and 08 Rounds from his possession;
and
2. Whereas, based on the above, a case FIR No.15/2023under
Section7/25 Arms Act and the Sections 18, 20 and 23 of ULA (P) Act,
was registered in the Police Station, Imamsahib, and the investigation of
the case was set into motion.Subsequently, during the investigation, the
offences under Sections38and 39 ofULA (P) Act was added in the case;
and
3. Whereas, during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statements of
witnesses acquainted with the facts and circumstances of the case were
recorded under the relevant provisions of law ;and
4. Whereas, during the investigation, the accused viz. Mohd Asgar
Dar, was found in contact with a terrorist of LeT banned outfit namely
Ubaid Ahmad Padder S/o Wali Mohammad Padder R/o Chakoora, who
provided the arms/ammunition to the accused viz. Mohd Asgar Dar, in
order to promote terrorist activities in the area; and
5. Whereas, during the investigation, it was established that the
accused viz. Mohd Asgar Dar, was working as Over Ground Worker
(OGW) for the terrorists of LeT banned outfit particularly the terrorists
viz. Ubaid Ahmad Padder, and was providing logistic support to him,
besides,
under
a
well
knit
criminal
conspiracy
procured
arms/ammunition from the said terrorist for carrying out the terrorist
activities in the area; and
6. Whereas, on the basis of investigation, and other evidence
collected the Investigating Officer has established prima facie,

SO−521.In exercise of the powers conferred by Section 50 of the
Jammu and Kashmir Registration of Tourist Trade Act, 1978, the
Government of Jammu and Kashmir hereby publish the draft
amendments in the Jammu and Kashmir Tourist Trade Rules, 1979, as

required by Sub-Section (3) of Section 50 of the said Act, for the
information of all persons likely to be affected thereby, and notice is
hereby given that the said draft rules will be taken into consideration
after the expiry of a period of fifteen days from the date on which copies
of the Official Gazette in which this notification is published, are made
available to the public.
Objections or suggestions, if any, may be addressed to Secretary
to Government, Tourism Department, Government of Jammu and
Kashmir,

or

at
[email protected].
The objections and suggestions, which may be received from any
person with respect to the said draft amendments before the expiry of the
period so specified, shall be considered by the Government.
1. In rule 3;
(i)
the table of fee shall be substituted by the table appended
to this notification ;
(ii)
In second proviso, the word “annual” shall be omitted ;
(iii)
Following note shall be added at the end ; namely :—
“Note :— The Government in the Tourism Department may
review and revise the fee structure after such
interval of time as it may deem appropriate.”
2. In Rule 17, the following proviso shall be added ; namely :—
“Provided that the same shall not apply in respect of the
applicants having a degree/diploma or a certificate course
(minimum

months)
in
the
tourism
and
travel
management/hospitality sector.”
3. Rule 23 shall be substituted by the following ; namely :—
“23 Every certificate of registration issued in favour of dealer,
hotel keeper, travel agent/excursion agent shall be renewed
after a period of three years. However, this shall not take away
the powers of prescribed authority to suspend/cancel the
certificate of registration in case of violation of Act/Rule, even
before the prescribed period of three years.”

4. In rule 24, sub-rule (2), for the words “annual renewal, the
words “renewal every 03 years” shall be substituted.
5. In Annexure “A” (Part B) under the heading Economy Class
Accommodation (“C” Category) the note appended thereto shall be
substituted by the following note ; namely :—
“Locality means the site approved/cleared by the Authority
competent to issue building permissions in the area.”
6. In Annexure “A” (Part D) under the heading Economy Class
Accommodation (Guest House), the note appended thereto shall be
substituted by the following note ; namely :—
“Locality means the site approved/cleared by the concerned
Competent Authority for commercial activities in light of the
Master Plan and also the area where the residential rights of
locals are not disturbed. The building means a built-up (ready to
use) structure constructed as per the building permission granted
by the Authority Competent to issue building permissions in the
concerned area.”
7. In Form II, entry 7 shall be omitted.
8. Form III shall be substituted by the Form III appended to this
notification.

received by the Police Station, Zainapora, to the effect that one person
identified as Aquib Mushtaq Lone S/o Mushtaq Ahmad Lone R/o Shed-
Check, Awneera, has been working as (OGW)for the Terrorists of Al-
Badr, a banned outfit, and is providing logistic support to them, besides,

facilitating the transportation of arms/ammunition for the terrorists from
one place to another for carrying out the terrorist activities; and
2. Whereas, based on the above, a case FIR No.14/2022under
Sections18 and 39 of ULA (P) Act, was registered in the Police Station,
Zainapora, and the investigation of the case was set into motion.
Subsequently, during the investigation, the offences under Sections20,
23, and38 of ULA (P) Act were added in the case ; and
3. Whereas, during the investigation, the seizure memos were
prepared and the statements of witnesses acquainted with the facts and
circumstances of the case were recorded under the relevant provisions of
law ;and
4. Whereas, during the investigation,the accused viz. Aquib Mushtaq
Lone, was arrested in the case and during the investigation three more
persons identified as Amir Amin Sofi @ Umer S/o Mohammad Amin
Sofi R/o Shad-Check, Awneera, Sadaf Fayaz Sheikh @ Sahil S/o Fayaz
Ahmad Sheikh R/o Urpora, Nagbal and Shakir Ahmad Thoker S/o Gh.
Mohi-ud-Din Thoker R/o Nudpora, Awneera, were found involved in the
commission of crime. Subsequently, the accused were also arrested and
during the investigation, 01 AK-47 Rifle with Magazine, 24 Rounds and
01 UBGL were recovered at the instances of accused viz. Amir Ahmad
Sofi @ Umer and Shakir Ahmad Thoker respectively; and
5. Whereas, during the investigation, it was found that the accused
viz. Aquib Mushtaq Lone, Amir Amin Sofi @ Umer, Sadaf Fayaz
Sheikh @ Sahil and Shakir Ahmad Thoker, were in contact with two
terrorists of LeT banned outfit namely Ab. Qayoom Dar S/o Gh. Mohi-
ud-Din Dar R/o Luru, Kakapora, Pulwama and Adil Ahmad Wani @
Lukman S/o Mohd Khalil Wani R/o Kutipora, who provided
arms/ammunition to them in order to promote terrorist activities in the
area; and

6. Whereas, during the investigation, it was established that the
accused viz. Aquib Mushtaq Lone, Amir Amin Sofi @ Umer, Sadaf
Fayaz Sheikh @ Sahil and Shakir Ahmad Thoker, were working as Over
Ground Workers (OGWs) for the terrorists of LeT banned outfit
particularly the terrorists viz. Ab. Qayoom Dar and Adil Ahmad Wani @
Lukman, and under a well knit criminal conspiracy were providing
logistic support to them, besides, the accused viz. Amir Amin Sofi @
Umer and Shakir Ahmad Thoker, procured arms/ammunitionand
explosive material from the said terrorists for carrying out the terrorists
activities in the area ; and
7. Whereas, the accused terrorist viz. Ab. Qayoom Dar, has been
killed in an encounter with the Security Forces and the proceedings
under the law would abate against him ; and
8. Whereas, on the basis of investigation, and other evidence
collected

Lukman, is absconding and the proceedings under Section 299 Cr. Pc.
have been proposed to be initiated against him ; and

Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention)
Act, 1967 has independently examined the Case Dairy File and all the
other relevant documents relating to the case and has come tothe
conclusion that a prima facie case is made out against the above accused

documents and also taking into consideration the views of the Authority
appointed under Sub-Section (2) of Section 45 of the Unlawful

Government hereby accord sanction for launching prosecution against
the accused viz.Aquib Mushtaq Lone, Amir Amin Sofi @ Umer, Shakir
Ahmad Thoker, and Adil Ahmad Wani @ Lukman, for the commission
of offences punishable under the relevant section of ULA (P)Act, as
indicated against the each accused at Para (8) above, arising out of
