CIRCULAR

The UT Government has consistently endeavored to expand capital

investment for rapid infrastructure upgradation in Jammu and Kashmir.

During the financial year ending 31-03-2024, capital expenditure has been

stepped up in several key sectors, like the Road Connectivity, Power

Development, Tourism, Industry, Education, Health and Medical Education,

Water Supply, etc. Simultaneously, the UT Government has undertaken

several measures to constrain non-priority revenue expenditure. The

increased Tax revenue, constrained revenue expenditure and the enhanced

central support have enabled higher capital expenditure. As per the

provisional data, the capital expenditure has increased from Rs. 14,666

crore in financial year 2022-23 to Rs. 22,400 crore in 2023-24.

During this financial year, all the Departments of the UT Government

have improved utilization of funds under centrally sponsored schemes (CSS).

This has ensured much larger receipts of CSS funds, which have crossed

Rs. 10,300 crore in 2023-24 as compared to Rs.6386 crore and Rs. 5997

crore during the financial years 2022-23 and 2021-22 respectively. The

improved execution of CSS and follow up with the Central Ministries has

ensured a healthy account balance of over Rs. 3,600 crore in various state

nodal accounts (SNA) of such CSS.

To ensure structured pace of capital expenditure, the UT Government

had ensured expenditure norms on incurring expenditure in final quarter

and the last month of the financial year. It has come to notice that in the

rush of investments in final days, some liabilities of capital works, stores,

maintenance, etc. may have remained undischarged due to such expenditure

norms for prudent financial management.

The contracting and supplying agencies who have contributed to

infrastructure development and utility services shouldn’t face difficulties in

processing their valid dues in the financial year 2024-25. The UT

Government is committed to ensure that all the duly incurred liabilities of

the Government are discharged in time bound manner. Hence it is clarified

that as per rule 57 (2) of GFR-2017, a grant of appropriation can be utilized

to cover the charges (including liabilities, if any, of the past year) which are

to be paid during the financial year of the grant and adjusted in the account

of the year.

To expedite processing of such liabilities in seamless manner, fresh

bills in lieu unpaid bills shall be prepared by the concerned DDOs in PaySys

and submitted to the concerned Treasury. The reference number of

unpaid bills shall be referred in the fresh bill prepared by the DDO. Such

bills (both Capex/Revenue) shall, after fulfillment of necessary codal

requirements by the respective DDOs, be entertained by the concerned

Treasury Officers for payment by debit to the budget allocations of the

current Financial year 2024-25 Provided :—

That the bills were within the allocated budget of the concerned

DDO for 2023-24 and were not paid during that fiscal due to the

expenditure norms of the final quarter and final month.

That the works formed part of the approved action plan/works

programmes of the departments/offices for 2023-24.

That all the required codal formalities as per the GFRs (technical

sanction, administrative approval, due process for allotment, etc.)

have been fulfilled before incurring the expenditure. Documentary

evedence, wherever required, shall be appended with the individual

claims.

That the total amount of claims preferred by individual DDO under

a head of account should not exceed the amount of budget

allocated to the DDO in 2023-24 under that head of account.

The above points shall be verified and certified by the concerned

DDO on the face of the new bill.

Treasury officers shall verify the bills before releasing payment

and tally the amount of the bill with the unpaid bill. They will

ensure that all codal formalities have been completed and financial

propriety is followed as per GFRs.

The instant application has been moved by Dy. SP Ops Pulwama

(I.O of the case) through Ld. Additional Public Prosecutor of this Court

seeking therein issuance of a declaration aimed at declaring one Ashiq

Ahmad Nengroo S/o Ghulam Ahmad Nengroo R/o Village Hanjan Bala

Tehsil Rajpora District Pulwama as proclaimed offender in connection

with the Criminal Case which is covered by Case FIR No. 50/2023

U/Ss 18, 20 and 38 UA(P) Act of P/S Rajpora. It is averred in the

application that the above named accused is an active terrorist and

is involved in the commission of crime which is covered by Case FIR

No. 50/2023 of P/S Rajpora and owing to absconding of the said

accused, this Court on the request of the applicant investigating agency

has issued a proclamiation against the said accused in terms of Section

82 Cr. P.C. but despite the issuance of the said process, the absconding

accused failed to appear before the investigating agency and is

continuously absconding.

Heard Ld. Additional Public Prosecutor, perused the application,

connected documents and C.D File of the case.

Upon the perusal of record it appears that Ministry of Home

Affairs Government of India vide Notification S.O. 1737 (E) Dated

18th of April 2022 notified the above named accused as individual

terrorist and his name has been inserted in the Fourth Schedule of UA

(P) Act. Thereafter on the request of the investigating agency this Court

issued non-bailable warrant of arrest in terms of Section 73 Cr. P.C.

against the above named accused vide order dated 14-09-2023 and when

investigating agency despite employing all efforts could not affect the

arrest of accused, a motion was laid before this Court for issuance

of proclamation against the said accused in terms of Section 82 Cr. P.C.

and this Court vide order dated 01-11-2023 issued the requisite

proclamation for the reasons stated therein. It is also evident from the

perusal of record that the proclamation issued against the above named

accused was publically read at conspicuous place in the native village

of the accused and said proclamation was also pasted at conspicuous

place of the house of accused and District Court Complex Pulwama

and also published in Daily ‘‘Srinagar News’’ and Daily ‘‘Uqab’’ in

their issue dated 11th of November 2023 but the above named accused

has not shown up before the investigating officer till date and is

continuously absconding.

Having regard to the peculiar facts and circumstances attending

the matter the application for declaring the above named accused as

proclaimed offender is allowed. Let a declaration for declaring the above

named accused as proclaimed offender be issued accorgingly and same

shall be got published at least in 02 leading News Papers and

Government Gazette.

The application is disposed off and shall form part of Charge

Sheet/ Report in terms of Section 173 Cr. P.C as and when presented

before the court of competent jurisdiction.

Whereas, one Ashiq Ahmad Nengroo S/o Ghulam Ahmad Nengroo

R/o Village Hanjan Bala Tehsil Rajpora District Pulwama whose

photograph is pasted at Mark ‘‘A’’ below is involved in the commission

of crime which is covered by Case FIR No. 50/2023 U/Ss 18, 20 and

38 UA (P) Act of P/S Rajpora.

Whereas, the above named accused presumably owing to his

involvement in terrorist activities and his association with proscribed

organization ‘‘Jaish-e-Mohammad’’ has been declared as individual

terrorist under the relevant provisions of UA (P) Act by Ministry of

Home Affairs Government of India vide Notification S.O. 1737 (E)

Dated 18th April 2022 and his name has been entered in Fourth Schedule

of UA (P) Act at Serial No. 36.

Whereas, owning to the non-cooperation of the above named

accused in the investigation of the above captioned case and owing

to his absconding, this Court on the request of investigating agency issued

a non-bailable warrant of arrest against the above named accused in

terms of Section 73 Cr. P.C. on 14-09-2023.

Whereas, investigating agency despite employing all possible and

available human and technical resources, could not affect the arrest

of the above named accused and for the reason of his continuous

absconding this Court on the request of investigating agency issued a

proclamation in terms of Section 82 Cr. P.C against the said accused

vide order dated 01-11-2023.

Whereas, the perusal of record makes it writ large that the

proclamation so issued by this Court was pasted at a conspicuous place

of the house of the accused besides at a public place in the native

village of the accused and District Court Complex, Pulwama.

Whereas, the proclamation so issued by this Court in terms of

Section 82 Cr. P.C. vide order dated 01-11-2023 has also been published

in Daily ‘‘Srinagar News’’ and Urdu Daily ‘‘Uqab’’ in their issue dated

11-11-2023.

Whereas, despite issuance of all coercive process detailed in the

fore-going paras and even after employing diligence and utilizing all

available technical and human resources, the arrest of the above named

accused could not be affected.

Whereas, this Court on the analysis of the material placed by the

investigating agency is of the opinion that to take the investigation of

the above captioned case to its logical conclusion and to advance the

course of justice, making a declaration aimed at declaring the above

named accused as proclaimed offender has become imperative.

Now, therefore through the medium of this declaration, accused

namely Ashiq Ahmad Nengroo S/o Ghulam Ahmad Nengroo R/o Village

Hanjan Bala Tehsil Rajpora District Pulwama involved in Case FIR

No. 50/2023 of P/S Rajpora is hereby declared as ‘‘Proclaimed

Offender’’.

No. 2004/LA/BMG/INDENT/59/E2 dated 27-06-2022 has authenticated

the subject Revenue papers and submitted to this Collectorate for further

action.

Whereas, the appropriate authority Deputy Commissioner Rajouri

vide Order No. DCR/CALA/NH-144A/2023-24/239-44 dated 15-01-2024

has exempted undertaking of Social Impact Assessment study under

Section 9 read with Section 40 of the Act, for the subject acquisition.

specified in column (2) of the Schedule below, in the States or

Union Territories mentioned in column (1), of the Schedule to elect

members to the House of the People, in accordance with the

Vol. 136] Jammu, Thu., the 28th March, 2024/8th Chai., 1946. [No. 52-3
