No. 2539 of 2023/RG Dated 23-10-2023.

Acting in compliance to the directions of the Hon’ble Supreme

Court of India in its order dated 31-07-2023 in the case titled Md. Asfak

Alam Vs State of Jharkhand Cr. Appeal No. 2207 of 2023, the High

Court of Jammu and Kashmir and Ladakh hereby notifies the directions

contained in the said judgment as Guidelines on Arrest, Detention and

Bail of accused, for the Guidance of the Magistrates and the Criminal

Courts subordinate to the High Court of Jammu and Kashmir and

Ladakh. The said Guidelines are enumerated as under :—

Both the Governments of Union Territory of Jammu and Kashmir

and Union Territory of Ladakh to instruct its police officers

not to automatically arrest accused when a case under Section

498-A Indian Penal Code 1860, is registered but to satisfy

themselves about the necessity for arrest under parameters laid

down and flowing from Section 41 Cr.PC.

All the police officers be provided with the check list containing

specified sub-clauses under Section 41(1)(b)(ii).

The police officers shall forward the check list duly filled and

furnish the reasons and materials which necessitated the arrest,

while forwarding/producing the accused before the Magistrate

for further detention.

The Magistrate while authorizing detention of the accused shall

peruse the report furnished by the police officer in terms

aforesaid and only after recording its satisfaction, the Magistrate

will authorize detention.

The decision not to arrest an accused, be forwarded to the

Magistrate within two weeks from the date of the institution of

the case with a copy to the Magistrate which may be extended

by the Superintendent of Police of the district for the reasons to

be recorded in writing.

Notice of appearance in terms of Section 41-A Cr.PC be served

on the accused within two weeks from the date of institution of

the case, which may be extended by the Superintendent of Police

of the District for the reasons to be recorded in writing.

Failure to comply with the directions aforesaid shall apart from

rendering the police officers concerned for departmental action,

they shall also be liable to be punished for contempt to be

instituted before High Court.

Authorizing detention without recording reasons as aforesaid by

the Judicial Magistrate concerned shall be liable for departmental

action by the High Court.

Tha aforesaid directions shall not only apply to case under Section

498-A IPC or Section-4 of the Dowry Prohibition Act, but also

to such other cases where offence is punishable with imprisonment

for a term which may be less than seven years or which may

extend to seven years, whether with or without fine.

Whereas, it appears to the appropriate Government that the total

of 05 Kanals land under Khasra No. 1145 min is required in Village

Kawa, Tehsil and District Udhampur for public purpose, namely,

construction of ‘‘Filtration Plant and other Structures ’’ which is being

executed by Industries and Commerce Jammu. Whereas, under Rule

4(1) of ‘‘Jammu and Kashmir Right to Fair Compensation and

Transparency in Land Acquisition, Rehabilitation and Resettlement, (Social

Impact Assessment and Consent) Rules, 2022’’ a preliminary committee

consisting of officers from Revenue, Agriculture, Forest, Jal Shakti, Irrrigation and Flood Control, Horticulture, Rural

Development, PWD (R&B) Departments under the chairmanship of Tehsildar Udhampur was constituted for conducting

Preliminary Enquiry regarding the subject cited above. The committee so constituted visited the spot and submitted the

Preliminary Enquiry Report to this Collectorate vide No. TUDR/Teh/2023-24/140 dated 15-12-2023.

Whereas, the committee submited that no voluntary displacement of persons and neither any adverse impact is

caused, nor any rehabilitation is required due to acquisition of land in question.

Whereas, all the land owners (interested persons) have given consent on affidavit for acquisition of land measuring

05 Kanals comprising in Khasra No. 1145 min situated at village Kawa duly notary attested vide dated 17-11-2023.

Whereas, Rule 8 of

‘‘Jammu and Kashmir Right to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement (Social Impact Assessment and Consent) Rules, 2022 ’’ provides that where no involuntary

displacement of persons due to acquisition of land with no adverse impact, and no rehabilitation is involved, then the

Collector shall obtain report of the committee as constituted under Sub-Rule (1) of Rule 4 along with the consent of

the interested persons (at least 70%) which shall be considered as SIA report and in such cases the Collector shall

proceed for issuance of preliminary notification under Section 11 of the Act within seven days.

Therefore, it is notified that for the above said project at Village Kawa, Tehsil and District Udhampur, a piece

of land measuring 05 Kanals is being acquired whose detail description is as under :

This notification is made under the provisions of Section 11(1) of

the Right to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013 (Act No. 30/2013), to all

whom it may concern.

A plan of the land may be inspected in the office of the Collector

on any working day during the working hours. The Government

authorizes Collector and his Revenue field staff to enter upon and survey

land take levels of any land, dig or bore into the sub-soil and do all

other acts required for the proper execution of their work as provided

and specified in Section 12 of the Act.

Under Sub-Section (4) of Section 11 of the Act, no person shall

make any transaction or cause any transaction of land i.e. sale/purchase,

etc., or create any encumbrances on such land from the date of

publication of such notification without prior approval of the Collector.

Objections to the acquisition, if any, may be filed by the person interested

within 60 (sixty days) from the date of publication of this notification

as provided under Section 15 of the Act before Collector.

Whereas, the formal indent of the land has been placed by the

Director School Education Kashmir vide No. DSEK/Plg/LC/Pul/425,

Dated 30-07-2022 for construction of school building P/S Pahelcheck

Khalil at Village Lalpora Tehsil Tral District Pulwama.

On the basis of said indent, the revenue extracts for land

measuring 18 Marlas were submitted by Tehsildar Tral which were

accordingly forwarded to the Director School Education Kashmir vide

this office communication No. ADC/Tral/LA/2022-23/112-16 dated 21-

07-2022 for authentication in token of their correctness on spot which

were received through Chief education Officer Pulwama vide his No.

CEO/Pul/Plg/22/606-08, dated 10-08-2022.

Whereas, Social Impact Assessment was carried out by Social

Impact Assessment (SIA) unit and a report submitted/preliminary

investigation was conducted by a team constituted by Collector as laid

down under Rule-4 of ‘‘Right to Fair Compensation and Transparency

in Land Acquisition, Rehabilitation and Resettlement Act, 2013’’. The

summary

of the Social Impact

Assessment Report/preliminary

investigation is as follows :

That the proposed acquisition of land for the porject namely

‘‘construction of school building P/S Pahelcheck’’ at revenue

Village Lalpora serves the public purpose.

That the land proposed for the acquisition is an absolute bare-

minimum needed for the porject.

That no owner became landless by the said acquisition.

That the acquisition at an alternate place has not been found

feasible by the Indenting Department.

That no unutilized land has previously been acquired in the

said Village/area for the said purpose.

Recommendations.

The establishment/construction of the said school at Lalpora, Tehsil

Tral will surely benefit a huge population of the area especially the

student community.

Moreover, the land identified for the construction of Government

Primary School building at Lalpora Tehsil Tral does not have any adverse

Social Impact on local public.

Whereas, the Social Impact Assessment Report was forwarded

to District Collector (Deputy Commissioner) Pulwama vide this office

No. : ADC/Tral/LA/2023-24/143-44, dated 03-11-2024 and the same

got approved for issuance of Notification under Section 11(1) of the

‘‘Right to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement, Act, 2013 by the District Collector Pulwama vide No. DCP/LA/2023/531-32, dated

07-12-2023.

After the perusal of said Social Impact Assessment report/field report, it appears that there is no need of Administrator

in the instant case as there is no relocation, displacement and rehabilitation of any affected person/family involved.

Therefore, it is notified for the above said project in the Lalpora Village of Tral Tehsil Pulwama District a piece

of land measuring 18 Marlas of standard measurement, whose detailed description is as following is under acquisition :

Commissioner Kashmir vide this office letter No. DCB/LAS/2022/1810-11 Dated 06-06-2022.

Whereas, Divisional Commissioner Kashmir vide communication No. Div. Com/LAS/4216/564 dated 28-09-2022

advised to explore the possibility of invoking rule 8 of S.O. 313 dated 24-06-2022 (Draft Rules) Now, rule 8 of S.O.

440 dated 24-08-2023.

Whereas, on the basis of indent placed by requiring body (Director

Urban Local Bodies, Kashmir) vide No. DULB/

Plg/214/22-23/15232-34 Dated 28-04-2022, after completing the SIA study by invoking rule 8 of S.O.-313 Dated 24-

06-2022 as no displacement or rehabilitation is involved and consideration of report, the Collector Land Acquiisition issued
