districts. However, this shall not be applicable to the officers having
been appointed to the JKAS on the basis of being Resident of
Backward Area or an Area adjoining Line of Actual Control, who
shall be posted in their respective areas in terms of Sub-Section 2
of Section 3 of the J&K Reservation Act, 2004.

97 posts of Junior Scale of JKAS are hereby transferred to the
respective Administrative Departments, for the purpose of drawl
of salary.
(iii)
The Junior Scale JKAS Officers shall join in their allotted
departments with immediate effect.

Subject :— Preliminary Notification under Section 11 of the Right to
Fair Compensation and Transparency in Land Acquisition,
Rehabilitaion and Resettlement Act, 2013 for land
measuring 78K-½M In Village Demote, Tehsil and District
Ramban required for the purpose of ‘‘construction of road
from Kunda to Bhata via Shaldan in Village Demote Tehsil
and District Ramban under NABARD’’.

Whereas, a writ petition was filed by the Petitioners namely Sagar
Singh Chib and Ors. in court case titled Sagar Singh Chib and Ors.
V/S Union Territory of J&K through Commissioner/Secretary, Public
Works Department (PWD), Civil Secretariat, Jammu/Srinagar and Ors.
in WPNo. 764 of 2022 against the respondents for completing the
process of acquisition and disbursement of compensation within the time
bound manner.

Whereas, the Division Bench of the Hon’ble High Court of Jammu
and Kashmir and Ladakh at Jammu passed an order dated 1-04-2022,
the operative part of which is reproduced as under,
‘‘3. Be that as it may, this petition is disposed of with a
direction
to
respondent

7-Chief Engineer PWD(R&B)
Department, Jammu to place an Indent with the respondent No.
6-Collector Land Acquisition (Additional Deputy Commissioner),
Ramban within one month from today and thereafter, the Revenue
Department shall initiate steps for acquisition of the land in question
and complete the process of acquisition within six months thereafter.
Any delay at any stage, can be condoned only if specific request
for extension is made by the officer concerned, failing which,
responsibility will be upon the concerned officer’’.
Whereas, the Petitioners initiated contempt proceedings in the said
court case vide CCP (No.) 23/2022 against the official respondents of
Indenting Department (respondents No. 01, 7 and 8) for not placing
an Indent as per the directions of the Hon’ble Court in the
aforementioned order.
Whereas, Chief Engineer PW (R&B) Department Jammu placed
Indent vide his No. CEJ/LA/194-96 dated 05-07-2022 for the acquisition
of land measuring 78Kls-½Mls situated in Village Demote Tehsil and
District Ramban for the purpose of ‘‘construction of road from Kunda
to Bhata via Shaldan in Village Demote Tehsil and District Ramban’’
under NABARD.
Whereas, the petitioners extended the contempt proceedings
against the official respondents of the Revenue Department (respondent
Nos. 2, 3, 4, 5 and 6) for not initiating the acquisition proceedings
thereafter.
Whereas, this Collectorate on behalf of the official respondents
No’s. 2, 3, 4, 5 and 6 submitted ‘‘Statements of Facts’’ in the Hon’ble
High Court of Jammu and Kashmir and Ladakh at Jammu wherein
it was submitted that there is legal impediment to initiate fresh land
acquisition proceedings as the Social Impact Assessment Study cannot
be conducted which is mandatory under the Right to Fair Compensation
and Transparency in Land Acquisition, Rehabilitation and Resettlement
Act, 2013 until the Government notifies the final draft rules under Section
109(c)and (d) of the Act regarding the manner and limit for carrying
out Social Impact Assessment Study report under Sub-Section (1) of
Section 6 and it was prayed that the time for initiation of fresh land
acquisition proceedings may kindly be extended till the Government
notifies the final draft rules under the said Act.

Whereas, the Government of Jammu and Kashmir Revenue
Department Civil Secretariat notifies the final draft rules i. e. ‘‘The
Jammu and Kashmir Right to Fair Compensation and Transparency in
Land Acquisition, Rehabilitation and Resettlement (Social Impact
Assessment and Consent) Rules, 2023 vide S.O.-440 dated 24th of
August, 2023.
Whereas, the Hon’ble High Court of Jammu and Kashmir and
Ladakh in an order dated 25-08-2023 while closing the contempt
proceeding in CCP(D) No. 23/2022 issued the directions which are
reporduced as under ;
4, In view of the aforesaid stand taken by the respondent no
case is made out of initiating contempt proceedings at this stage
as the judgement itself grants six months time for completing the
process of acquisition.
5. Be that as it may, the Collector Land Acquisition and other
respondents are directed to complete the process of acquisition
within six months from today.
5. We also make it clear that in case the judgement remains
unimplemented and the process of acquisition is not taken to its
logical end within the aforesaid period, the petitioner shall be
entitled to come to this Court again by way of fresh contempt
petition.
6. However, In view of the given facts and circumstances the
reasons noted above, the proceedings in this contempt petition are
closed.
Whereas, the Indent placed by the Chief Engineer PW (R&B)
Department Jammu was perused in consonance with the provision
contained in the aforementioned rules notified vide S.O.-440 of 2023
dated 24-08-2023, it was found that the Indent has not been placed
strictly as per the Rule 3(1), (3) and (5) of the Jammu and Kashmir
Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement (Social Impact Assessment and
Consent) Rules, 2023 and accordingly the matter was taken up with
District Collector (Deputy Commissioner) Ramban vide this office No.
Acq/Gen/Rbn/23/209 dated 12-09-2023. The District Collector (Deputy
Commissioner) Ramban took the matter with Chief Engineer PWD
(R&B) Jammu vide No. DCR/HQA/2023-24/634-36 dated 11-10-2023
and requested to place fresh Indent alongwith requisite documents
strictly as per the conditions outlined in S.O-440 of 2023 dated
24-08-2023.
Whereas, this Collectorate vide No. Acq/Gen/Rbn/23/296-98 dated
18-10-2023 again requested Chief Engineer PWD (R&B) Jammu to

place Indent as per conditions outlined in S.O-440 of 2023 dated
24-08-2023 alongwith funds tentatively calculated to the tune of
Rs. 10.12 Cr.
Whereas, meanwhile, this Collectorate constituted a committee vide
No. Acq/Gen/Rbn/23/199-208 dated 12-09-2023 as per Rule 4 of the
Rules notified vide S.O.-440 of 2023 to conduct preliminary enquiry in
the said land acquisition case with the directions to submit its report
within 15 days.
Whereas, the committee submitted its report duly endorsed by
Tehsildar Ramban vide his No. TR/OQ/2023-24/Misc/1960 dated 02-
11-2023 perusal of which reveals that the said road already stands
constructed upto Shaldan and alternate State/Government land cannot
be proposed for the road in question, Further, there is no involuntary
displacement involved in the acquisition of said land and accordingly,
no rehabilitation is required. Assessments of FBTs and NFBTs have
already been submitted by the respective Department. The construction
of land has no economic as well as social adverse on the local
inhabitants. Land owners have no objection on the said acquisition and
consent as required under Sub-Rule (2) of Rule 17 and Sub-Rule (1)
of Rule 20 on Form-V (Part-A) (Prior Written Consent of the Affected
Land Owners or Declaration Form) has been obtained from them.
Resolution of Gram Sabha as per Sub-Rule (7) of Rule 21 on Form-V
(Part B) has also been obtained. Moreover, the committee also submitted
that some land owners/interested persons have objections with respect
to the quantum of land involved in the said acquisition for the rectification
of which Tehsildar Ramban will demarcate the land and submit a
separate report alongwith relevant revenue papers in triplicate.
Whereas, Tehsildar Ramban conducted a joint on-spot verification
alongwith the officials concerned and requested some rectifications vide
his No. TR/OQ/2023-24/Rev/1722 dated 07-11-2023 in the Revenue
Records/Field Book already prepared in the said land acquisition case
which are given as under :—

Whereas, Chief Engineer PW (R&B) Department, Chenab Zone Batote vide his No. CEC/2395-97 dated 06-01-2024
placed a fresh Indent under the provisions of S.O-440 of 2023.
Whereas, keeping in view the findings and recommendations of the committee constituted by his Collectorate, written
consent submitted by the land owners concerned as required under Sub-Rule (2) of Rule 17 and Sub-Rule (1) of Rule
20 on Form-V (Part-A) (Prior Written Consent of the Affected Land Owners or Declaration Form), resolution submitted
by Gram Sabha as per Sub-Rule (7) of Rule 21 on Form-V (Part-B) and no family/families are likely to be displaced
due to the instant land acquisition case, this Collectorate has decided to consider the report of the committee as Social
Impact Assessment Report as required under Sections 4, 5, 6, 7 and 8 of
‘‘The Jammu and Kashmir Right to Fair
Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and Rules 9, 13, 14,
15, 16 and 17 of
‘‘The Jammu and Kashmir Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement (Social Impact Assessment and Consent) Rules, 2023
’’.
Whereas, in exercise of the powers vested in me under Section 11 of the Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, I Mr. Harpal Singh, Collector Land

This notification is made under the provisions of Section 11(1) of
the Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement Act, 2013 (30 of 2013) to all whom
it may concern.
A plan of the land may be inspected in the office of the Collector
on of 5th March at 2.00 PM sharp.
The Government is pleased to authorize, Tehsildar Ramban, other
field staff alongwith Indetning Department to enter upon and survey
land, takes levels of any land, dig or bore into the sub-soil and do
all other acts requrired for the proper execution of their work as provided
and specified in Section 12 of the said Act.
Under Section 11(4) of the Act, No person shall make any
transaction or cause any transaction of land i.e., sale/purchase, etc.,
or create any encumbrances on such land from the date of publication
of such notification without prior approval of the Collector.
Objection to the Acquisition, if any, may be filed by the person
interested within 60 (sixty days) from the date of publication of this
notification as provided under Section 15 of the Act before this
Collectorate.

Whereas, on the recommendation of Collector Land Acquisition
(Sub Divisional Magistrate) Mahore vide No. CLA/SDM/2021-22/55-
56 dated 11-11-2021, sanction was accorded vide No. DC/Rsi/SQ/22-
23/981-85 dated 19-05-2022 for the exemption from undertaking Social
Impact Assessment Study under Section 9 of invoking urgency clause
under Section 40 of the Right to Fair Compensation and Transparency
in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for the
land measuring 275 Kanals 01 Marla (Local) ; and
Whereas, Collector Land Acquisition (Sub Divisional Magistrate)
Mahore vide No. CLA/SDM/M/2022-23/247-262 dated 13-08-2023
issued preliminary notification under Section 11(1) of Right to Fair
Compensation and Transparency in Land Acquisition, Rehabilitation and
Resettlement Act, 2013 for land measuring 275 Kanals 01 Marla (local)
calling upon the objections, if any, from the interested persons/land
owners within stipulated time period from the date of issuance/publication
of the said notice ; and
Whereas, in response to said notification, 16 objections were
received from the land owners/interested persons in the Collectorate
of Sub Divisional Magistrate Mahore. Out of 16 objections 05 objections
pertain to apportionment/entitlement of the compensation 02 objections
being baseless were rejected by the Collector, 05 objections were
recommended by the Collector for rejection, 2 objections were clerical
errors and 2 objections were found genuine as reported by the Collector
that upon verification of revenue papers for acquisition it was found
that one page of the field book bearing serial Nos. 105 to 107 (total
land 06K-18M) was not incorporated in Section 11 notification due
to oversight/clerical mistake.
Whereas, Collector Land Acquisition (Sub Divisional Magistrate)
Mahore vide No. CLA/SDM/M/2023-24/493-95 dated 12-09-2023
requested this office for issuance of declaration under Section 19(1)
of the Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement Act, 2013 for the Acquisition of land
measuring 282 Kanals 04 Marlas (Local) situated at Village Jamaslan
Tehsil Mahore, District Reasi for construction/Up gradation of Budhal-
Mahore-Gool GREF Road to NHDL specifications ; and
Whereas, the case file was examined and certain observations
were raised. The file was returned to the Collector for removing the
shortcomings vide this office letter No. DC/Rsi/SQ/23-24/3429 dated
22-09-2023 ; and

Whereas, Collector Land Acquisition (Sub Divisional Magistrate)
Mahore vide No. CLA/SDM/M/2023-24/626-28 dated 05-10-2023
submitted the file after clearing the shortcomings and requested for
issuance of declaration under Section 19(1) of the Right to Fair
Compensation and Transparency in Land Acquisition, Rehabilitation and
Resettlement Act, 2013 for the Acquisition of Land measuring 282
Kanals 04 Marlas (local) situated at Village Jamaslan Tehsil Mahore,
District Reasi for construction/Up gradation of Budhal-Mahore-Gool
GREF Road to NHDL specifications ; and
Whereas, Collector Land (Sub Divisional Magistrate) Mahore vide
this office letter No. DC/Rsi/SQ/23-24/4011-12 dated 07-11-2023 was
directed to issue fresh corrigendum for acquisition of land measuring
282 Kanals 04 Marla (Local) situated at Village Jamaslan, Tehsil
Mahore, District Reasi for construction/Up gradation of Budhal Mahore-
Gool GREF Road to NHDL specifications for issuance of notification
under Section 11(1) of the Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement Act,
2013 ; and
Whereas, Collector Land Acquisition (Sub Divisional Magistrate0
Mahore has issued corrigendum vide No. CLA/SDM/M/2023-24/764-
78 dated 25-11-2023 of land measuring 282 Kanals 04 Marlas (Local)
situated at village Jamaslan, Tehsil Mahore District Reasi and Collector
Land Acquisition (Sub Divisional Magistrate) Mahore vide letter No.
CLA/SDM/M/2023-24/779-81 dated 26-11-2023 requested this office for
issuance of Declaration under Section 19(1) of the Right to Fair
Compensation and Transparency in Land Acquisition, Rehabilitation and
Resettlement Act, 2013 for the Acquisition of land measuring 282 Kanals
04 Marlas (local) situated at village, Jamaslan Tehsil Mahore, District
Reasi for construction/Up gradation of Budhal-Mahore-Gool GREF Road
to NHDL specifications ; and
Whereas, Collector Land Acquisition (Sub Divisional Magistrate)
Mahore vide No. CLA/SDM/M/2023-24/875 dated 21-12-2023 also
requested this office for granting of post facto exemption for conduct
of SIA study of the balance portion of land measuring 07 Kanals 03
Marlas on the same criteria ; and
Whereas, as per S.O. No. 17 dated 14-01-2022 issued
by Government of Jammu and Kashmir, Revenue Department,
the appropriate government as defined under Right to Fair Compensation
and Transparency in Land Acquisition, Rehabilitation and Resettlement
Act, 2013 shall be Deputy Commissioner upto 400 Kanals
(50 acre) ; and
Whereas, the appropriate Government is satisfied after considering
the report made by Collector that the land particulars of which are

Now, therefore, it is hereby declared under the provision of Section 19(1) of the Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 that the aforesaid land measuring 282 Kanals
04 Marlas (Local) situated at Village Jamaslan Tehsil Mahore, District Reasi is required for public purpose viz. for
Construction/Up gradation of Budhal-Mahore-Gool GREF Road to NHDL specifications.
Post facto, SIA exemption for acquisition of additional land measuring 07 Kanals 03 Marlas alongwith exemption
from additional compensation of 75% of the total compensation under Sub-Section (5) of Section 40 of the Act is hereby
also accorded.

Further, the Collector Land Acquisition (Sub Divisional Magistrate)
Mahore shall be specifically responsible for identification and proper
title verification of all types of land involved in the case and

Whereas, it appears to the Government that a total of 34K-05M
land is required in the Village Maitra Govindpura Tehsil and District
Ramban for public purpose, namely for the construction of road from
T.V. Tower to Gughwal via Failty.
Whereas, the said land acquisition case was earlier processed
under Jammu and Kashmir State Land Acquisition Act, SVT 1990 on
the Indent placed by Executive Engineer PWD (R&B) Division Ramban,
notification under Sections 6 and 7 was issued by the Divisional
Commissioner Jammu vide notification No. 36 Divcom of 2010 and
endorsement No. 502/1120/12-10/Acq/Rbn/4904-08 dated 22-12-2010
and tentative award was issued vide No. Acq/Gen/08 dated 06-04-2012
by the Collector Land Acquisition (ACR) Ramban.

Whereas, the land acquisition proceedings in the instant land
acquisition case could not be finalized on account of non placement
of sufficient funds by the Indenting Department and also due to non
placement of fresh Indent as per the circular issued by the Commissioner
Secretary to Governement, Revenue Department, Civil Secretariat J&K
vide No. REV/LAJK/375/2016 dated 03-12-2016 as requested by this
office vide No. Acq/Gen/17/2008-10 dated 01-03-2017.
Whereas, the petitioners namely Amar Singh and Ors. approached
Hon’ble High Court of Jammu and Kashmir and Ladakh at Jammu
in Court case vide WP(C) No. 1571/2021 titled Amar Singh and Ors.
V/S UT of J&K through Commissioner/Secretary PWD (R&B), Civil
Secretariat Jammu/Srinagar.
Whereas, the said writ petition was disposed of by the Hon’ble
Division Bench and passed an order dated 07-05-2022 with the directions
to initiate fresh land acquisition proceedings in terms of the provisions
of the Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement Act, 2013, the operative part of which
is given as under :—
‘‘Be that as it may, this writ petition is disposed of with
a direction to the respondent No. 7-Divisional Commissioner,
Jammu as also the respondent No. 8-Collector Land
Acquisition (Assistant Commissioner, Revenue), Ramban
to ensure that the proceedings under the Act are initiated
positively within one month from the date of receipt of a
certified copy of this order. in case of any default in
initiation of the proceedings, the concerned officer shall
be held responsible. However, in case of any legal
impediment the said respondents can approach this Court
for seeking extension of time, which will be permitted only
if legitimate cause is shown’’.
Whereas, Chief Engineer PW (R&B) Department Jammu placed
indent vide his No. CEJ/Legal/S/1141-44 dated 03-10-2022 for the
acquisition of land required for the purpose of construction of road from
T.V. Tower to Gughwal via Failty.
Whereas, the Government of Jammu and Kashmir, Revenue
Department Civil Secretariat, notifies the final draft rules i.e. ‘‘The
Jammu and Kashmir Right to Fair Compensation and Transparency in
Land Acquisition, Rehabilitation and Resettlement (Social Impact
Assessment and Consent) Rules, 2023, vide S.O-440 dated 24th of
August, 2023.

Whereas, the indent placed by the Chief Engineer PW (R&B)
department Jammu was perused in consonance with the provision
contained in the aforementioned rules notified vide S.O 440 of 2023
dated 24-08-2023 and it was found that the Indent has not been placed
strictly as per the Rule 3(1), (3) and (5) of the Jammu and Kashmir
Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement (Social Impact Assessment and
Consent) Rules, 2023 and accordingly the matter was taken up with
District Collector (Deputy Commissioner) Ramban vide this office
No. Acq/Gen/Rbn/23/210 dated 19-09-2023. The District Collector
(Deputy Commissioner) Ramban took the matter with Chief Engineer
PWD (R&B) Jammu vide No. DCR/HQA/2023-24/637-39 dated
11-10-2023 and requested to place fresh Indent alongwith requisite
documents strictly as per the conditions outlined in S.O.440 of 2023
dated 24-08-2023.
Whereas, this Collectorate vide No. Acq/Gen/Rbn/23/383-85 dated
01-12-2023 again requested Chief Engineer PWD (R&B) Jammu to
place indent as per conditions outlined in S.O 440 of 2023 dated
24-08-2023 alongwith sufficient funds.
Whereas, meanwhile, this Collectorate constituted a committee vide
No. Acq/Gen/Rbn/23/211-20 dated 19-09-2023 as per Rule 4 of the
Rules notified vide S.O-440 of 2023 to conduct preliminary enquiry in
the said land acquisition case with the directions to submit its report
within 15 days.
Whereas, the committee submitted its report duly endorsed by
Tehsildar Ramban vide his No. TR/OQ/2023-24/Misc/1959 dated
02-12-2023 perusal of which reveals that the said road already stands
constructed upto Failty and alternate State/Government land cannot be
proposed for the road in question. Further, there is no involuntary
displacement involved in the acquisition of said land and accordingly,
no rehabilitation is required. The construction of road has no economic
as well as social adverse impact on the local inhabitants. Land owners
have no objection on the said acquisition and consent as required under
Sub-Rule (2) of Rule 17 and Sub-Rule (1) of Rule 20 on Form-V
(Part-A) (Prior written Consent of the Affected Land Owners or
Declaration Form) has been obtained from them. Resolution of Gram
Sabha as per Sub-Rule (7) of Rule 21 on Form-V (Part B) has also
been obtained.
Whereas, Chief engineer PW (R&B) Department, Chenab Zone
Batote vide his No. CECV/1481-83 dated 14-12-2023 placed a fresh
Indent under the provisions of S.O-440 of 2023.
Whereas, keeping in view the findings and recommendations of
the committee constituted by this Collectorate, written consent submitted
by the land owners concerned as required under Sub-Rule (2) of rule
17 and Sub-rule (1) of Rule 20 on Form-V (Part-A) (Prior Written

Consent of the Affected Land Owners or Declaration Form), resolution submitted by Gram Sabha as per Sub-Rule

case, this Collectorate has decided to consider the report of the committee as Social Impact Assessment Report as
required under Sections 4, 5, 6, 7 and 8 of
‘‘the Jammu and Kashmir Right to Fair Compensation and Transparency
in Land Acquisition, Rehabilitation and Resettlement Act 2013 and Rules 9, 13, 14, 15, 16 and 17 of the Jammu and
Kashmir Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact
Assessment and Consent) Rules, 2023

This notification is made under the provisions of Section 11(1) of the Right to Fair Compensation and Transparency
in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013), to all whom it, may concern.
A Plan of the land may be inspected in the office of the Collector on 15th of March, 2024 at 2.00 PM sharp.
The Government is pleased to authorize Tehsildar Ramban, other field staff alongwith Indenting Department to
enter upon and survey land, takes levels of any land dig or bore into the sub-soil and do all other acts required for
the proper execution of their work as provided and specified in Section 12 of the said Act.
Under Section 11(4) of the Act, no person shall make any transaction or cause any transaction of land i. e.,
sale/purchase, etc., or create any encumbrances on such land from the date of publication of such notification without
prior approval of the Collector.
Objections, to the Acquisition, if any, may be filed by the persons interested within 60 (sixty days) from the date
of publication of this notification as provided under Section 15 of the Act before this Collectorate.

Bari Brahmana, the 16th of March, 2024.
In exercise of the power conferred under Sections 65, 66 and 68
of the Jammu and Kashmir Municipal Act, 2000 and Solid Waste
Management Rules, 2016 notified by the Ministry of Environment,
Forest and Climate Change, GOI vide Notification No. G.S.R 1357(E)

dated 08-04-2016 and Solid Waste Management Bye-Laws 2019
subsequently notified by Jammu and Kashmir Government in respect
of Municipal Committee, Bari Brahmana on September 2019, the
Committee has revised the User Charges which will come into force
w.e.f 01-04-2024.
