Sanction is hereby accorded to the transfer of State land measuring
208 Kanals under Khasra No.17l situated in village Kotan, Tehsil
Mendhar, District Pooch in favour of Industries and Commerce Department
for establishment of Industrial Estate.
It shall be subject to the following conditions :—
i.
The land shall be used only for the purpose for which the sanction
of transfer has been accorded.
ii.
The sanction has nothing to do with the process of allotment of
the land for Industrial Units for which Industries and Commerce
Department has to fulfill the criteria as required under the laid
down statutes. Further, the transfer of the land in favour of
Industries and Commerce Department shall not mean any
regularization of the land allotted to entrepreneurs and

Industries and Commerce Department has to fulfill the norms

of laws relating to Revenue/Forest/Housing and Urban
Development Department/J&K Water Resources (Regulation
and Management) Act, 2010 etc. If any land found part of water
course/source shall not be put to any use.
v.
It would be the responsibility of the user department to
comply with directions of the Hon'ble High Court of J&K or any
other Competent Court with regard to the usage of the said land.
vi.
No diversion of transferred land for any other purpose shall be
made without the prior approval of Competent Authority.
vii.
Litigation, if any to be contested by the indenting department.
viii.
The indenting department to take possession of the land within
30 days from the transfer order, and land to be put to use within
03 years failing which the land shall revert back to the
Government.
ix.
The Revenue Department shall not earmark or develop any
approach road for setting up of Industrial Estates.
x.
The Government reserves the right to retrieve any un-utilized
portion of the land from the department if the same is required
for any other public purpose.
xi.
This shall be without prejudice to the outcome of the writ
petition(s), if, any pending before the Competent Courts.

to search the accused in the Jammu and Kashmir State and arrest
him and then produce the accused in the Court.

Whereas, it appears to the Government that a total of 34K-05M
land is required in the village Maitra Govindpura Tehsil and District
Ramban for public purpose, namely for the construction of road from
T.V. Tower to Gughwal via Failty.
Whereas, the said land acquisition case was earlier processed
under Jammu and Kashmir State Land Acquisition Act SVT 1990 on
the Indent placed by Executive Engineer PWD (R&B) Division Ramban,
notification U/Ss 6 and 7 was issued by the Divisional Commissioner
Jammu vide notification No. 36 Divcom of 2010 and endorsement No.
502/1120/12-10/Acq/Rbn/4904-08 dated 22-12-2010 and tentative award
was issued vide No. Acq/Gen/08 dated 06-04-2012 by the then Collector
Land Acquisition (ACR) Ramban.
Whereas, the land acquisition proceedings in the Instant land
acquisition case could not be finalized on account of non placement
of sufficient funds by the Indenting Department and also due to non
placement of fresh Indent as per the circular issued by the Commissioner
Secretary to Government, Revenue Department, Civil Secretariat J&K
vide No. REV/LAJK/375/2016 dated 03-12-2016 as requested by this
office vide No. Acq/Gen/17/2008-10 dated 01-03-2017.
Whereas, the petitioners namely Amar Singh and Ors. approached
Hon’ble High Court of Jammu and Kashmir and Ladakh at Jammu
in Court case vide WP(C) No. 1571/2021 titled Amar Singh and Ors.
V/S UT of J&K through Commissioner/Secretary PWD (R&B), Civil
Secretariat Jammu/Srinagar.

Whereas, the said writ petition was disposed of by the Hon’ble
Division Bench and passed an order dated 07-05-2022 with the directions
to initiate fresh land acquisition proceedings in terms of the provisions
of the Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement Act, 2013, the operative part of which
is given as under :—
‘‘Be that as it may, this writ petition is disposed of with a
direction to the respondent No. 7-Divisional Commissioner, Jammu,
as also the respondent No. 8-Collector Land Acquisition (Assistant
Commissioner, Revenue), Ramban to ensure that the proceedings
under the Act are initiated positively within one month from the
date of receipt of a certified copy of this order. In case of any
default in Initiation of the proceedings, the concerned officer shall
be held responsible. However, in case of any legal impediment,
the said respondents can approach this Court for seeking extension
of time, which will be permitted only if legitimate cause is shown’’.
Whereas, Chief Engineer PW (R&B) Department Jammu placed
indent vide his No. CEJ/Legal/S/1141-44 dated 03-10-2022 for the
acquisition of Land required for the purpose of construction of road
from T.V. Tower to Gughwal via Failty.
Whereas, the Government of Jammu and Kashmir, Revenue
Department Civil Secretariat, notifies the final draft rules i. e. ‘‘The
Jammu and Kashmir Right to Fair Compensation and Transparency in
Land Acquisition, Rehabilitation and Resettlement (Social Impact
Assessment and Consent) Rules, 2023 vide S.O. 440 dated 24th of
August, 2023.
Whereas, the indent placed by the Chief Engineer PW (R&B)
Department Jammu was perused in consonance with the provision
contained in the aforementioned rules notified vide S.O 440 of 2023
dated 24-08-2023 and it was found that the Indent has not placed strictly
as per the rules 3(1), (3) and (5) of the Jammu and Kashmir Right
to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement (Social Impact Assessment and
Consent) Rules, 2023 and accordingly the matter was taken up with
District Collector (Deputy Commissioner) Ramban vide this office No.
Acq/Gen/Rbn/23/210 dated 19-09-2023. The District Collector (Deputy
Commissioner) Ramban took the matter with Chief Engineer PWD
(R&B) Jammu vide No. DCR/HQA/2023-24/637-39 dated 11-10-2023
and requested to place fresh Indent alongwith requisite documents strictly
as per the conditions outlined in S.O 440 of 2023 dated 24-08-2023.

Whereas, this Collectorate vide No. Acq/Gen/Rbn/23/383-85 dated
01-12-2023 again requested Chief Engineer PWD (R&B) Jammu to
place indent as per conditions outlined in S.O. 440 of 2023 dated 24-
08-2023 alongwith sufficient funds.
Whereas, meanwhile, this Collectorate constituted a committee vide
No. Acq/Gen/Rbn/23/211-20 dated 19-09-2023 as per Rule 4 of the
Rules notified vide S.O. 440 of 2023 to conduct preliminary enquiry
in the said land acquisition case with the directions to submit its report
within 15 days.
Whereas, the committee submitted its report duily endorsed by
Tehsildar Ramban vide his No. TR/OQ/2023-24/Misc/1959 dated
02-12-2023 perusal of which reveals that the said road already stands
constructed upto Failty and alternate State/Government land cannot
be proposed for the road in question. Further, there is no involuntary
displacement involved in the acquisition of said land and accordingly,
no rehabilitation is required. The construction of road has no economic
as well as social adverse impact on the local inhabitants. Land owners
have no objection on the said acquistion and consent as required
under Sub-Rule (2) of Rule 17 and Sub-Rule (1) of Rule 20 on Form-V
(Part-A) (Prior Written Consent of the Affected Land Owners or
Declaration Form) has been obtained from them. Resolution of Gram
Sabha as per Sub-Rule (7) of Rule 21 on Form-V (Part B) has also
been obtained.
Whereas, Chief Engineer PW (R&B) Department, Chenab Zone
Batote vide his No. CECV/1481-83 dated 14-12-2023 placed a fresh
Indent under the provisions of S.O. 440 of 2023.
Whereas, keeping in view the findings and recommendations of
the committee constituted by this Collectorate, written consent submitted
by the land owners concerned as required under Sub-Rule (2) of Rule
17 and Sub-Rule (1) of Rule 20 on Form-V (Part A) (Prior Written
Consent of the Affected Land Owners or Declaration Form), resolution
submitted by Gram Sabha as per Sub-Rule (7) of Rule 21 on Form-V
(Part-B) and no family/families are likely to be displaced due to the
instant land acquisition case, this Collectorate has decided to consider
the report of the committee as Social Impact Assessment report as
required under Sections 4, 5, 6, 7 and 8 of ‘‘The Jammu and Kashmir
Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement Act 2013, and Rules 9, 13, 14, 15, 16
and 17 of ‘‘the Jammu and Kashmir Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement
(Social Impact Assessment and Consent) Rules, 2023’’.

The Government is pleased to authorize, Tehsildar Ramban, other
field staffalongwith Indenting Department to enter upon and survey land,
takes levels of any land, dig or bore into the Sub-Soil and do all other
acts required for the proper execution of their work as provided and
specified in Section 12 of the said Act.
Under Section 11(4) of the Act, no person shall make any
transaction or cause any transaction of land i.e., sale/purchase, etc.,
or create any encumbrances on such land from the date of publication
of such notification without prior approval of the Collector.
Objection, to the Acquisition, if any, may be filed by the person
interested within 60 (sixty days) from the date of publication of this
notification as provided under Section 15 of the Act before this
Collectorate.

Mir S/o Mohd Rafiq Mir R/o Jumagund A/P Marhama, Awoor,
Trehgam, have received some narcotics from across the border from two
terrorists of LeT banned outfit namely Manzoor Ahmad Mir S/o Late
Abdul Rashid Mir and Assad Mir S/o Diya Mir R's/o Jumagund A/P
PoK, in order to sell the same to an unknown non local person at
Zurhama, Gujarpati area, besides, received some arms/explosive material
from the said terrorists, for carrying out the terrorist activities in the area;
and
2. Whereas,based on the above, a Case FIR No. 25/2023 under
Sections 8/21,29 NDPS Act and the Sections 13 and 23 of ULA (P) Act
was registered in the Police Station, Trehgam, and the investigation, of
the case was set into motion. Subsequently, during the investigation, the
offences under Section 7/25 Arms Act, and the offences under Sections
18,38,39 and 40 of ULA (P) Act were added in the case; and
3. Whereas,during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statement of
witnesses acquainted with the facts andcircumstances of the case were
recorded under the relevant provisions of law; and
4. Whereas, during the investigation, the accused viz Mohd Yousuf
Bokra, Showkat Ahmad Khatana, Maroof Ahmad Mir, alongwith one
non local person identified as Loba Massih @ Ajay S/o Sadiq Massih
R/o Awaan, Ramdas, Ajnala, Amritsar, Punjab, were arrested in the case
and during the investigation, 08 packets of narcotic, 02 Chinese hand
grenades and an amount of Rs. 05 lacs were recovered at their instances
respectively; and
5. Whereas,during the investigation, it was found that the accused
viz Mohd Yousuf Bokra, Showkat Ahmad Khatana and Maroof Ahmad
Mir, were in contact with the terrorists viz Manzoor Ahmad Mir and
Assad Mir, who provided the Narcotics (Heroine) and explosive material
to them in order to promote terrorist activities in the area; and

6. Whereas,during the investigation, it was established that the
accused viz Mohd Yousuf Bokra, Showkat Ahmad Khatana and Maroof
Ahmad Mir, were working as Over Ground Workers (OGWs) for the
terrorists of LeT banned outfit particularly the terrorists viz Manzoor
Ahmad Mir and Assad Mir, and under a well knit criminal conspiracy
were providing logistic support to them and procured Narcotics (Heroin)
and explosive material from the said terrorists, besides, the accused viz
Loba Massih @ Ajay, was raising funds for the terrorists for carrying out
the terrorist activities in the area; and
7. Whereas, on the basis of investigation, and other evidence
collected the Investigating Officer has established, prima facie,
involvement of below mentioned accused in the commission of the
offences punishable under Section of the Unlawful Activities
(Prevention) Act, 1967, as shown against their names:-

8. Whereas, the accused viz Manzoor Ahmad Mir and Assad Mir,
are absconding and the proceedings u/s 299 Cr.PC have been proposed to
be initiated against them; and
9. Whereas, the Authority, appointed by the Government under Sub-
Section (2) of Section 45 of the Unlawful Activities (Prevention) Act,
1967, has independently examined the case diary file and all the other
relevant documents relating to the case and has come to the conclusion
that a prima facie case is made out against the above accused; and
10. Whereas, after perusing the Case Diary File,the relevant
documents and also taking into consideration the views of the Authority
appointed under Sub-Section (2) of Section 45 of the Unlawful
Activities(Prevention) Act, 1967, the Government is of the view that
there is sufficient material and evidence available against the above-
mentioned accused for their prosecution under the provisions of law.
Now, therefore, in exercise of the powers conferred by Sub-Section
(2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967,the
Government hereby accord sanction for launching prosecution against

SO-561.—Whereas, on 10.05.2023, the Police Station,Sopore,
received a docket to the effect that a reliable information was received
regarding the presence of some suspectsat Sadipora crossing, equipped

with illegal arms/ ammunition. Subsequently, a Joint Cordon and Search
Operation was launched by the Police/ Security Forces and during the
search two suspects while seeing the Search Party tried to escape but
were chased down on the spot and identified as Muzaffar Majeed Mir S/o
Abdul Majeed Mir R/o Brath, Sopore and Kaiser Manzoor Mir S/o
Manzoor Ahmad Mir R/o Sadipora, Sopore. During their personal
search, the Police recovered 15 Pistol rounds, 01 IED, 02 Hand Grenades
and 25 AK-47 rounds from their possession respectively; and
2. Whereas, based on the above, a Case FIR No. 94/2023under
Sections 7/25 Arms Act, 4/5 ESA and the Sections 18, 23 and 39 of ULA
(P) Act, was registered in the Police Station, Sopore, and the
investigation of the case was setinto motion. Subsequently, during the
investigation, the offences under Sections 18-B, 20 and 38 of ULA
(P)Act were added in thecase; and
3. Whereas, during theinvestigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statements of
witnesses acquainted with the facts and circumstances of the case were
recorded under the relevant provisions of law ;and
4. Whereas, during the investigation, it was found that the accused
viz. Muzaffar Majeed Mir and Kaiser Manzoor Mir, were in contact with
a terrorist of LeT banned outfit namely Bilal Ahmad Mir S/o Mohammad
Hamza Mir R/o Brathkalan, Sopore, who motivated them to work for the
outfit and provided arms/ammunition and explosive material to them in
order to promote terrorist activities in the area ; and
5. Whereas, during the investigation, it was established that the
accused viz Muzaffar Majeed Mir and Kaiser Manzoor Mir, were
working as Over Ground Worker (OGW) for the terrorists of LeT banned
outfit particularly the terrorist viz. Bilal Ahmad Mir, and were providing
logistic support to him, besides, under a well knit criminal conspiracy

received adocket to the effect that during the search of a missing person
namely Basit Ahmad Dar S/o Late Ab. RashidDar R/o Redwani Payeen,

it came to learnt that the said missing person had joined the terrorist
ranks of TRF, a banned outfit, on the instigation/motivation of one
terrorist namely Muhammad Abass Sheikh S/o Gh. Hassan Sheikh R/o
Rampora, Qaimoh, for carrying out the terrorist activities in the area ;
and
2. Whereas, based on the above, a Case FIR No. 38/2021 under
Sections 13,18-B, 20 and 38 of ULA (P) Act, was registered in the Police
Station, Qaimoh and the investigation of the case was into motion.
Subsequently, during the investigation, the offence under Section 18 of
ULA (P) Act was added in thecase; and
3. Whereas, during theinvestigation, the seizure memos were
prepared and the statements of witnesses acquainted with the facts and
circumstances of the case were recorded under the relevant provisions of
law ;and
4. Whereas, during the investigation, it was found that the accused
viz. Basit Ahmad Dar, went missing from his home on 26-04-2021 and
later on joined the terrorist ranks of TRF banned outfit in order to
promote terrorist activities in the area; and
5. Whereas, during the investigation, it was established that the
accused viz Basit Ahmad Dar, is member of terrorist organization of
TRF banned outfit and was instigated/motivated by accused terrorist viz.
Muhammad Abass Sheikh, to join the outfit for carrying out the terrorist
activities in the area ; and
6. Whereas, the accused terrorist viz. Muhammad Abass Sheikh, has
been killed in an encounter with the Security Forces and the proceedings
under the law would abate against him; and

SO-563.—Whereas, on 03.10.2022, a reliable information was
received by the Police Station, Pattan, to the effect that some unknown
terrorists, fired indiscriminately upon a non local Bank employee at
Goshbugh, Pattan, with their illegal arms/ammunition, with the intention
to kill him and after the commission of crime escaped from the spot; and

2. Whereas, based on the above, a Case FIR No. 282/2022under
Sections307 IPC, 7/27 Arma Act, and the Sections 16and 20 of ULA (P)
Act was registered in the Police Station, Pattan, and the investigation, of
the case was set into motion. Subsequently, during the investigation, the
offences under Sections 18, 18-B, 23 and 38 of ULA (P) Act were added
in thecase; and
3. Whereas, during theinvestigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statement of
witnesses acquainted with the facts and circumstances of the case were
recorded under the relevant provisions of law ;and
4. Whereas, during the investigation, two persons identified as Jameel
Ahmad Parra S/o Habibullah Parra R/o Tapper, Pattan and Rizwan
Mushtaq Wani S/o Mushtaq Ahmad Wani R/o Wani Mohalla, Hamray ,
Pattan were found involved in the commission of crime who were
already arrested in case FIR No. 117/2022of Police Station, Pattan.
Subsequently, the custody of both the accused were changed in the
instant case ; and
5. Whereas, during the investigation, it was found that the accused
viz. Jameel Ahmad Parra and Rizwan Mushtaq Wani, were in contact
with a terrorist of TRF banned outfit namely Abid Qayoom Lone S/o
Abdul Qayoom Lone R/o WussanKhoie, through virtual mode, who
motivated them to work for the outfit and on the date of occurrence the
accused viz. Jameel Ahmad Parra and Rizwan Mushtaq Wani, along with
two more terrorists of the outfit namely Shakir Majeed Najar S/o Abdul
Majeed Najar and Abdul Hanan Seh S/o Farooq Ahmad Seh R’s/o
Sugan, Shopian, fired indiscriminately upon the Manager Grameen
Bank, Goshbugh namely Vivak Kumar S/o Ashok Kumar R/o Dehradun,
Utrakhand , on the directions of accused terrorist viz. Abid Qayoom
Lone ; and

6. Whereas, during the investigation, it was established that the
accused viz Jameel Ahmad Parra, Rizwan Mushtaq Wani, Shakir Majeed
Najar and Abdul Hanan Seh, were members of TRF, a banned outfit, and
on the directions of accused terrorist viz. Abid Qayoom Lone, fired
indiscriminately upon the non local Bank employee (Manager Grameen
Bank, Goshbugh) and escaped from the spot; and
7. Whereas,the accused terrorists viz. Shakir Majeed Najar and
Abdul Hanan Seh, have been killed in an encounter with the Security
Forces at Wanigam, Kreeri on 04-05-2023, and the proceedings under
the law would abate against them; and

SO-566.—Whereas,
on
04-05-2023,
the
Police
Station,
Kreeri,received a docket to the effect that a reliable information was
received about the presence of some terrorists of LeT banned outfit in

village Wanigam Payeen. Subsequently, a Joint Cordon and Search
Operation was launched by the Police/Security Forces and during the
search, the terrorists hiding in the residential house of one Farooq Ahmad
Bhat S/o Late Ghulam Mohammad Bhat R/o Wanigam Payeen, fired
indiscriminately
upon
the
Search
Party,
with
their
illegal
arms/ammunition, with the intention to kill them, resulting in serious
injuries to one police personnel on the spot. The fire was retaliated,
triggering an encounter ; and
2. Whereas, based on the above, a Case FIR No.46 /2023under
Section307 IPC, 7/27 Arms Act, and the Sections 16, 18, 19, 20 and 38of
ULA (P) Act, was registered in the Police Station, Kreeri, and the
investigation of the case was set into motion; and
3. Whereas, during theinvestigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statement of
witnesses acquainted with the facts and circumstances of the case were
recorded under the relevant provisions of law ;and
4. Whereas, during the investigation, the dead bodies of two terrorists
of LeT banned outfit who were later on identified as Shakir Majeed S/o
Abdul Majeed Najar and Abdul Hanan Sehp S/o Farooq Ahmad Seh
R’s/o Sugan, Shopian, were recovered from the place of encounter.
During the search, arms/ammunition viz. 01 AK-56 Rifle, 02 Magazines,

were also recovered from the place of occurrence ; and
5. Whereas, during the investigation, the accused house owner
namely Farooq Ahmad Bhat, was arrested in the case and it was
established that on the date of occurrence the accused voluntarily
harboured the terrorists viz. Shakir Majeed and Abdul Hanan Seh, in his
residential house for carrying out the terrorist activities in the area ; and

6. Whereas, the accused terrorists Viz. Shakir Majeed and Abdul
Hanan Seh, have been killed in the said encounter with the Security
Forces and the proceedings under the law would abate against them ; and
7. Whereas, on the basis of investigation, and other evidence
collected the Investigating Officer has established prima facie,
involvement of below mentioned accused in the commission of the
offences punishable under sectionof the Unlawful Activities (Prevention)
Act, 1967, as shown against his name:—

8. Whereas, the Authority, appointed by the Government under Sub-
Section (2) of Section 45 of the Unlawful Activities (Prevention) Act,
1967, has independently examined the Case Diary File and all the other
relevant documents relating to the case and has come to the conclusion
that a prima facie case is made out against the above accused; and
9. Whereas, after perusing the Case Diary File,the relevant
documents and also taking into consideration the views of the Authority
appointed under Sub-Section (2) of Section 45 of the Unlawful
Activities(Prevention) Act, 1967, the Government is of the view that
there is sufficient material and evidence available against the above-
mentioned accused for his prosecution under the provisions of law.
Now, therefore, in exercise of the powers conferred by Sub-Section
(2) of Section 45 the Unlawful Activities (Prevention) Act, 1967,the
Government hereby accord sanction for launching prosecution against
the accused viz.Farooq Ahmad Bhat, for the commission of offences

SO-589.—--Whereas, .on 07-08-2022, the Police Station, Shalteng,
received a written docket to the effect that a reliable information was
received about the movement of some unknown terrorists around the
general area of Lawaypora. Subsequently a Joint Naka was established
by the Police/Security Forces at Narbal Crossing, and during the
checking, a suspect while seeing the Naka Party tried to escape but
was chased down on the spot and identified as Arshid Ahmad Bhat

S/o Ab. Kareem Bhat R/o Warsangam, Budgam. During his personal
search, the Police recovered 05 Pistols with Magazines, 50 Rounds and
02 Hand Grenades from his possession ; and
2. Whereas, based on the above, a Case FIR No. 18/2022 under
Section 7/25 Arms Act, 13, 18 and 38 of ULA (P) Act, was registered
in the Police Station, Shalteng, and the investigation of the case was
set into motion. Subsequently, during the investigation, the Sections
18-B, 20, 23 and 39 of ULA (P) Act were added in the case ; and
3. Whereas, during the course of the investigation, the site plan
of the place of occurrence and the seizure memos were prepared and
the statements of witnesses acquainted with the facts and circumstances
of the case were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, the accused viz. Arshid
Ahmad Bhat, was found in contact with a terrorist of HM, a
banned outfit, namely Tariq Ahmad Pandith S/o Bashir Ahmad Pandith
R/o Karimabad, Pulwama, who was already arrested by Pulwama Police
and was lodged in District Jail, Kathua. The accused viz.
Tariq Ahmad Pandith, motivated the said accused viz. Arshid Ahmad
Bhat, to work for the outfit and connected him with another
terrorist of the HM, a banned outfit, namely Hanan-bin-Yaqoob
@ Saqib S/o Mohd Yaqoob Bhat R/o Karimabad, Pulwama.
The accused viz. Arshid Ahmad Bhat, procured arms/ammunition
from Lawaypora area from an unknown person on the directions of
the accused viz. Tariq Ahmad Pandith, in order to promote/commit
terrorist activities in the area ; and
5. Whereas, during the investigation, it was established that the
accused viz. Arshid Ahmad Bhat, was working as Over Ground Worker
(OGW) for the terrorists of HM, a banned outfit, particularly the
terrorists viz. Tariq Ahmad Pandith and Hanan-bin-Yaqoob @ Saqib,
and under a well knit criminal conspiracy was providing logistic support
to them, besides, procured arms/ammunition, from the said terrorists for
carrying out the terrorist activities in the area ; and
6. Whereas, the accused terrorist viz. Hanan-bin-Yaqoob @ Saqib,
has been killed in an encounter with the Security Forces on 05-10-
2022, at Drach, Shopian, and the proceedings under the law would
abate against him. The investigation, in respect of the accused viz.
Tariq Ahmad Pandith and unknown person from whom the accused

Arshid Ahmad Bhat, has received arms/ammunition shall continue
to bring out their role/involvement in the case and supplementary
charge sheet against the accused would be filed in the court of
competent jurisdiction ; and
7. Whereas, the sanction has already been accorded in respect
of accused viz. Arshid Ahmad Bhat, vide Notification S. O. No. 32
dated 12th January, 2023, by the Competent Authority and the
investigation, of the case was continued with respect to the other
accused ; and
8. Whereas, during the further investigation, the accused viz. Tariq
Ahmad Pandith was arrested in the case and it was established
that the accused was in contact with a terrorist of HM banned
outfit namely Zaffar Hussain Bhat S/o Sonaullah Bhat R/o Lever,
Pahalgam A/P PoK through virtual mode and on his directions
instigated/motivated the accused viz. Arshid Ahmad Bhat, to work for
the outfit and provided arms/ammunition to him through an unknown
person for carrying out the terrorist activities in the area ; and
9. Whereas, the investigation, in respect of known person who
handed over the arms/ammunition to the accused viz. Arshid Ahmad
Bhat, on the directions to terrorist Tariq Ahmad Pandith, shall continue
to ascertain his actual Identity and to bring out his role/involvement
in the case and the supplementary charge sheet against him would be
filed in the Court of competent jurisdiction ; and
10. Whereas, on the basis of the investigation, the statements of
witnesses recorded and other evidence collected, the Investigating
Officer, has established a prima facie involvement of the below
mentioned accused for the commission of offences punishable under
sections of the Unlawful Activities (Prevention) Act, 1967, as shown
against their names :—

absconding and the proceedings under section 299 Cr.PC have been
proposed to be initiated against him ; and
12. Whereas, the Authority appointed by the Government
under Sub-Section (2) of Section 45 of the Unlawful Activities
(Prevention) Act, 1967, has independently examined the Case Diary file
and all the other relevant documents relating to the case and has come
to the conclusion that prima facie case is made out against the above
accused ; and
13. Whereas, after perusing the Case Diary file, the relevant
documents and also taking into consideration the views of the Authority
appointed under Sub-Section (2) of Section 45 of the Unlawful Activities
(Prevention) Act, 1967, the Government is of the view that there is
