Competent Authority in terms of the Jammu and Kashmir Reorganisation

Act, 2019. The promotions made, if any, by exclusion of employees who

were provisionally continuing to serve on the corresponding posts, in the

Union Territory of Ladakh were to be reviewed immediately, being in

contravention to the provisions of the Jammu & Kashmir Reorganisation

Act, 2019.

SubsequentJy, clarifications were sought by the Administrative

Departments with regard to promotlon/inclusion of the employees apportioned

to the Union Territory of Ladakh against cadre strength of Union Territory

of Jammu and Kashmir, after the apportionment of employees among the

two successor Union Territories.

Accordingly, the matter was examined in the General Administration

Department and vide Circular No. 09-JK(GAD) of 2022 dated 08-03-2022,

following clarifications were notified for the information of all Administrative

Departments :

i. Consequent upon the apportionment of manpower between Union

Territory of Jammu and Kashmir and Union Territory of Ladakh,

the promotions/appointments in Jammu and Kashmir shall be

considered against the posts allocated to Union Territory of Jammu

and Kashmir only. The posts allocated to Union Territory of Ladakh

shall be excluded while considering any such exercise except for

the services failing under the ambit of S.O. 428 dated 21-12-2021.

ii. The employees apportioned to Union Territory of ladakh vide

Government Order No. 1212-JK(GAD) of 2021 dated 15-11-2021

shall be excluded from 'Seniority List/ Eligibility Ilst' and such

employees shall not be considered for promotions in the Union

Territory of Jammu and Kashmir w.e.f. 15-11-2021.

Despite the earlier instructions, it has come to notice that the

Departmental Promotion Committees, includlng the J&K Public Service

Commission, are not considering the employees apportioned to the Union

Territory of Ladakh for promotion/regularization to the post(s) on which

they have been placed in the In-charge capacity against vacancies in the

cadre prior to 15-11-2021. However, some Administrative Departments

have sought clarification in the matter. Besides, the Administration of the

Union Territory of Ladakh has also requested to resolve the issue at an

earliest, so that the Administration can place their matter before the Union

Public Service Commission/concerned DPCs for further promotions.

Accordingly, the matter has been reviewed in the General

Administration Department and the following instructions are hereby

notified for the information of J&K Public Service Commission/ all

Administrative Departments and concerned Head of Departments :

The cases for regularization/promotion of employees apportioned

to the Union Territory of Ladakh, who have been placed in the

In-charge capacity on higher post(s) prior to their apportionment

against the combined cadre strength, shall be placed before the

J&K Public Service Commission/Departmental Promotion

Committee(s), for consideration on case to case basis after

observing all the rules and vacancy position in the combined cadre

strength at the relevant period.

ii.

Thereafter, the recommendations of the Departmental Promotion

Committee(s)/J&K PSC shall be sent to the concerned

Administrative Department in the Administration of Union Territory

of Ladakh along with all relevant records/documents for issuance

of regularization order(s) and subsequent entry in the Service Book.

It shall be subject to the following conditions :—

The land shall be used only for the purpose for which the sanction

of transfer has been accorded.

ii.

The sanction has nothing to do with the process of allotment or

regularization of the land for Industrial Units or entrepreneur for

which Industries and Commerce Department has to fulfill the

criteria as required under the laid down rules.

iii.

The land shall put to use after obtaining all other permissions as

may be required for its construction from the Competent

Authority.

iv.

The user department shall strictly adhere to all such provisions of

laws relating to Revenue/Forest/Housing & Urban Development

The indenting department to take possession of the land within

30 days from the transfer order, and land to be put to use within

03 years failing which the land shall revert back to the

The Revenue Department shall not earmark or develop any

approach road for setting up of Industrial Estates.

The Government reserves the right to retrieve any unutilized portion

of the land from the department, if the same is required for any

other public purpose.

xi.

This shall be without prejudice to the outcome of the writ petition(s),

Whereas, the Revenue Team headed by Tehsildar Gund conducted

preliminary enquiry and furnished detailed report vide Letter No. 80/

Whereas, in accordance with Sub-Sections 1 and 2 of Section 4

of the Right to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013, the committee of officers

for conduct of Social Impact Assessment stands already constituted by

the Tehsildar Gund vide his office order No. 1461/OQ/TG/23/cml Dated

20-10-2023. Accordingly, the committee was directed by the Deputy

Commissioner Ganderbal vide office letter No. DCG/LAS/23/741-54

Dated 16-8-2023 to conduct social impact assessment committee.

Preliminary Notification

Whereas, Officer Commanding (EE Civ) 122 RCC(GREF) C/o

56 APO has placed an indent vide his office Letter No. 2066/MAP/

6/E2LA Dated 13-02-2024 for acquisition of land measuring 11 Kanals

for public purposes with the nomenclature ‘‘KM 1.3 Lashpathri Bridge

on Sonamarg Bypass Road, Tehsil Gund, District Ganderbal’’.

Whereas, it appears to the appropriate Authority that land

measuring 11 Kanals at village Sonamarg is required for public purpose

with the nomenclature ‘‘KM 1.3 Lashpathri Bridge on Sonamarg Bypass

Road, Tehsil Gund, District Ganderbal’’ through indenting Department

namely Boarder Roads Organization.

Whereas, vide SO 237 Dated 23-07-2020 issued by Revenue

Department J&K Government the Collector Land Acquisition (Sub

divisional Magistrate Kangan) has been designated as Collector Land

Acquisition to perform duties under the Right to Fair Compensation and

Transparency in Land Acquisition, Rehabilitation and Resettlement

Act, 2013.

Whereas, a team was constituted vide this office Letter No. 574/

SDM/KGN/LAS Dated : 29-02-2024.

Whereas, the revenue team headed by Tehsildar Gund conducted

preliminary enquiry and furnished detailed report vide Letter No. 78/

OQ/TG/4. Dated 07-03-2024 citing therein that the Indenting Department

on spot has already acquired land measuring 09 K–11 M out of the

total land measuring 20K–11M under Survey No. 33 min in estate

Sonamarg.

Whereas, the Team referred headed by Tehsildar Gund conducted

preliminary enquiry vide No. 21/TG/2024 Dated 15-03-2024 and reported

that land measuring 11 Kanals out of the total land measuring 20K-

11M under Survey No. 33 min in estate Sonamarg is required for the

public purposes with the nomenclautre ‘‘KM 1.3 Lashpathri Bridge on

Sonamarg Bypass Road, Tehsil Gund, District Ganderbal and has further

reported that no social Impact assessment is required in the instant case.

Whereas, in accordance with the Sub-Sections 1 and 2 of Section-

4 of the Right to Fair Compensation and Transparency in Land

Acquisition, Rehabilitation and Resettlement Act 2013, Tehsildar Gund

vide his office order No. 22/TG/2024 Dated 15-03-24 conducted inquiry

with regard to the Social Impact Assessment and other issues with

the following findings in general :—

1. That the proposed acquisition of land serves the public purpose.

2. That the extent of the land proposed for the Acquisition is in

the absolute bare-minimum needed for the project.

3. That no other alternate and feasible land has been found

available.

4. That no unutilized land which has been previously acquired

exists in the area is available.

Whereas, the Deputy Commissioner Ganderbal vide his office

No. DCG/LAS/24/1898-1901 Dated 04-03-2024 accorded approval and

authorized the Collector Land Acquisition (Sub Divisional Magistrate

Kangan) for issuance of Notification under Section 11 of the Right to

Fair Compensation and Transparency in Land Acquisition, Rehabilitation

and Resettlement Act 2013.

In view of above, I Nuzhat, K. Qurashi, Collector Land Acquisition

Kangan (Sub Divisional Magistrate Kangan) in terms of powers vested

in me vide Section-11(1) of the RFCTARR Act, 2013, hereby notify

सं. 464/ईपीएस/2024 (3).—यत:, भारत के रा̽ टŌपित ने लोक Ůितिनिध̝ व

अिधिनयम, 1951 (1951 का 43) की धारा 14 की उप-धारा (2) के अंतगŊत िनगŊत और

भारत के राजपũ मŐ 12 अŮैल, 2024 (शुŢवार) को Ůकािशत अिधसूचना के Ȫारा नीचे दी

गई अनुसूची के ̾ तंभ (1) मŐ उİʟİखत रा̕ यों या संघ रा̕ य-Ɨेũों मŐ, इसके ̾ तंभ (2) मŐ

िविनिदŊ̽ ट संसदीय िनवाŊचन Ɨेũों मŐ से Ů̝ येक संसदीय िनवाŊचन Ɨेũ से अपेƗा की है िक

उ̋ त अिधिनयम के उपबंधों और तदधीन बनाए गए िनयमों और िकए गए आदेशों के

अनुसार लोक सभा के िलए सद̾ य िनवाŊिचत कर दŐ ।

2. अत:, अब, उ̋ त अिधिनयम की धारा 30 और 56 के अनुसरण मŐ, भारत िनवाŊचन

आयोग एतȞ्वारा-

उ̋ त अनुसूची मŐ िविनिदŊ̽ ट Ů̝ येक संसदीय िनवाŊचन Ɨेũ से, उ̋ त

िनवाŊचन के संबंध मŐ -

(क)

नामिनदőशन करने की अंितम तारीख के ŝप मŐ 19 अŮैल,

2024 (शुŢवार) को;

(ख)

नामिनदőशनों की संवीƗा की तारीख के ŝप मŐ 20 अŮैल,

2024 (शिनवार) को;

(ग)

अ̰ यिथŊताएं वापस लेने की अंितम तारीख के ŝप मŐ 22

अŮैल, 2024 (सोमवार) को;

(घ)

नीचे दी गई अनुसूची के ̾ तंभ (3) मŐ िविनिदŊ̽ ट तारीख को

उस तारीख के ŝप मŐ, िजसको यिद आव̻ यक Šआ तो

उ̋ त अनुसूची के ̾ तंभ (2) मŐ तदनुŝप Ůिविʼ मŐ िविनिदŊ̽ ट

6 जून, 2024 (गुŜवार) को उस तारीख के ŝप मŐ, िजससे

िनवाŊचन के िलए उ̋ त अनुसूची के ̾ तंभ (2) मŐ तदनुŝप Ůिविʼ मŐ

िविनिदŊ̽ ट संसदीय िनवाŊचन Ɨेũों मŐ इसके ̾ तंभ (3) मŐ ऐसे िनवाŊचन

Representation of the People Act, 1951 (43 of 1951), the President is placed

सं. 464/ईपीएस/2024 (3).—यत:, भारत के रा̽ टŌपित ने लोक Ůितिनिध̝ व

अिधिनयम, 1951 (1951 का 43) की धारा 14 की उप-धारा (2) के अंतगŊत िनगŊत और

भारत के राजपũ मŐ 12 अŮैल, 2024 (शुŢवार) को Ůकािशत अिधसूचना के Ȫारा नीचे दी

गई अनुसूची के ̾ तंभ (1) मŐ उİʟİखत रा̕ यों या संघ रा̕ य-Ɨेũों मŐ, इसके ̾ तंभ (2) मŐ

िविनिदŊ̽ ट संसदीय िनवाŊचन Ɨेũों मŐ से Ů̝ येक संसदीय िनवाŊचन Ɨेũ से अपेƗा की है िक

उ̋ त अिधिनयम के उपबंधों और तदधीन बनाए गए िनयमों और िकए गए आदेशों के

अनुसार लोक सभा के िलए सद̾ य िनवाŊिचत कर दŐ ।

2. अत:, अब, उ̋ त अिधिनयम की धारा 30 और 56 के अनुसरण मŐ, भारत िनवाŊचन

आयोग एतȞ्वारा-

(अ)

उ̋ त अनुसूची मŐ िविनिदŊ̽ ट Ů̝ येक संसदीय िनवाŊचन Ɨेũ से, उ̋ त

िनवाŊचन के संबंध मŐ -

(क)

नामिनदőशन करने की अंितम तारीख के ŝप मŐ 19 अŮैल,

2024 (शुŢवार) को;

(ख)

नामिनदőशनों की संवीƗा की तारीख के ŝप मŐ 20 अŮैल,

2024 (शिनवार) को;

(ग)

अ̰ यिथŊताएं वापस लेने की अंितम तारीख के ŝप मŐ 22

अŮैल, 2024 (सोमवार) को;

(घ)

नीचे दी गई अनुसूची के ̾ तंभ (3) मŐ िविनिदŊ̽ ट तारीख को

उस तारीख के ŝप मŐ, िजसको यिद आव̻ यक Šआ तो

उ̋ त अनुसूची के ̾ तंभ (2) मŐ तदनुŝप Ůिविʼ मŐ िविनिदŊ̽ ट
