The Departments shall review the pace of expenditure of the
subordinate offices/DDOs especially in respect of schemes/DDOs
where the expenditure level is low.

The Departments shall prioritize their projects/works as per the
requirement including languishing projects as per the pace of
expenditure.
3.
The utilization of funds shall be subject to the detailed
conditions as stipulated vide Government Order NO.155-F of 2024

CIRCULAR
The Ministry of Health & Family Welfare, Government of India, vide OM
No. Z 16025/03/2021/CGHS-III EHS dated 13-11-2023, has extended
CG HS medical facilities to the pensioners under Union Territories' (UT's)
Administration, except the UTs of Delhi and Chandigarh.
Additional Director, CGHS, Chandigarh vide OM No. AD ICG HS/CHD/
2024/CGHS/JK(UT) Govt./Pensioners/262-70 dated 10-05-2024 has
clarified that CGHS facilities have been extended to the pensioners of J&K
(UT) Administration in respect of those pensioners who retired from service
on or after 31-10-2019 as per CGHS Rules.
The eligible pensioners of Government of J&K (UT) Administration may
be provided an option to choose among common scheme to all J&K (UT)

residents i.e. AB-PMJAY SEHAT or CGHS. As, one government employee
(serving or pensioner) should not avail medical facilities from two different
government sources.
The CGHS facilities shall be extended at par with the Central Govt.
Pensioners, on payment of requisite subscription fees as per the prevalent
CGHS guidelines, subject to the conditions that the pensioners of J&K
(UT) Administration seeking CGHS coverage should not be availing
medical benefits from any other J&K (UT) Administration State/Central
Government Health Scheme.
The Government of J&K has already covered all the families
including employees and pensioners in the AB-PMJAY SEHAT Scheme
where under free medical insurance cover of Rs 500 lakh is being
provided to every family free of cost.
The matter has been examined in the Finance Department in consultation
with State Health Agency, J&K & Health & Medical Education Department.
State Grievance Nodal Officer, State Health Agency, J&K vide letter No.
SHAI ABPM-JA Y /JK/2023-24/5275-77 dated 15-01-2024, has conveyed
that the pensioners opting for the CGHS scheme should disable the Ayushman
Card issued to them and take NOC from State Health Agency before
applying for CGHS Card in order to avoid dual benefit from both tbe
schemes.
Health and Medical Education Department has also intimated vide OM
No. HME-Acct/248/2021-02 dated 08-05-2024 that the pensioners of UT
of Jammu and Kashmir may be given an option for choosing either JK
SEHAT Scheme or CGHS for carrying out medical treatment.
Accordingly, following guidelines are issued for the eligible pensioners of
Union Territory of Jammu and Kashmir (UT) Administration who intend to
avail the CG HS facilities :—
(i)
The CGHS facilities have been extended to the pensioners of
J&K (UT) Administration in respect of those pensioners who
retired from service on or after 31.10.2019 as per CGHS Rules.

(ii) The CGHS facilities have been extended at par with the Central

fees as notified by the MoHFW, GoI, vide OM No. S.11011/11/
2016-CGHS(P)/EHS dated 09-01-2017, as per the prevalent
CGHS guidelines, subject to the conditions that the Pensioners
of Union Territories seeking CGHS coverage are not availing
medical benefits from any other J&K (UT) Administration State/
Central Government Health Scheme.
(iii) The pensioners opting for the CGHS Scheme should surrender
the medical benefits of AB-PMJAY SEHAT Scheme or any
other Government Health Scheme. They should disable the
Ayushman Card issued to them and take NOC from State Health
Agency/concerned agency before applying for CGHS Card in
order to avoid dual medical benefits from two different
Government sources.

A robust and effective mechanism for redressal of complaints against
public servants with detailed instructions, have been issued from time to

time, with a view to balance the objectives of good governance for
establishing a corruption-free, transparent and responsive administrative
system, along-with ensuring adequate safeguards for public servants to
protect them from unnecessary harassment of false/frivolous/anonymous/
pseudonymous complaints. These instructions, inter alia, contain detailed
provisions for Lodging, Handling and Verification of Complaints as also
action against such false/frivolous complainants.
Notwithstanding these elaborate instructions, cases of undue
harassment through lodging of false/frivolous/anonymous/pseudonymous
complaints are being increasingly reported. Many a times, these complaints,
after verification, have been found devoid of any merit, and disposed of
accordingly. In the process, however, public servants discharging their
bonafide duties, have to face unwarranted harassment and mental, agony,
affecting their decision-making, thereby causing administrative inertia, which
inter alia adversely affects disposal of Government business and public
service delivery.
It has accordingly been felt that the procedure for dealing with such
false/frivolous/anonymous/pseudonymous complaints, needs to be further
strengthened, in order to ensure that honest public servants are not unfairly
harassed, and Government business is not affected.
Accordingly, the following Instructions are brought to the notice of all
Administrative Departments/HoDs/Cadre Controlling Authorities/Public
servants, for dealing with such complainants :
i.
Pursuing prosecution under section 182 of the Indian Penal Code
for making a false complaint ;
ii.
Initiating prosecution under section 195(1)(a) of the Code of
Criminal Proceoure, 1973, based on a complaint filed with the
court by the concerned public servant or another superior public
servant.
iii.
Considering departmental action against public servants making
False complaints, as an alternative to prosecution.

iv.
Providing institutional support to government servants affected
by false complaints by :
a.
Assisting the affected employee to approach Crime Branch,
J&K, for initiation of criminal proceedings upon receiving a
report or request from a public servant.
b.
Facilitating Public Servants, who have suffered harm as a
result of false complaints, to file civil lawsuits seeking
damages against responsible individuals, This may include
compensation for financial losses, emotional distress, or
harm to reputation, with the provision for the public servant
to engage a lawyer as per requirement on contingency fee
arrangements, subject to available resources, for which each
case shall be decided on merits.
c.
Facilitating assistance of Law Officers from the Department
of Law, Justice & Parliamentary Affairs for appropriate legal
remedies in respect of acts done in official capacity.
d.
Arranging formal inquiries by the relevant registering
authority, where such complaints have been filed by any such
registered organizations.
e.
Issuance of formal press notes regarding complaints and
inquiries to promote transparency, preferably on a monthly
basis.
f.
Conducting of Inquiries in cases involving publications and if
found complicit, taking action, including reporting the matter
to the Press Council of India (PCI) and other measures like
cancellation of accreditation and stoppage of Government
advertisements.

invoking urgency clause read with Section 40 of the Right to Fair
Compensation and Transparency in Land Acquisition, Rehabilitation and
Resettlement Act, 2013 ; and
Whereas, Collector Land Acquisition Defence, Udhampur vide
No. CLAD/Udh/LA/490-99 dated 14-03-2022 issued preliminary
notification under Section 11(1) of Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement
Act. 2013 for calling objections if any, from the interested person/s
in respect of land measuring 09 Marlas situated at Village Roun which
is under acquisition within stipulated time period of 60 days from the
date of publication of the notification personally or through the authorized
agent ; and
Whereas, in response to notification under Section 11(1), nobody
filed any objection within stipulated time period of 60 days from the
date of publication of the notification ; and
Whereas, as per notification issued by Government of J&K
Revenue Department vide S.O No. 17 dated 14-01-2022, Deputy
Commissioner (District Collector) has been designated to be the
Appropriate Government within their respective jurisdiction for acquiring
land under the Right to Fair Compensation and Transparency in Land
Acquisition Rehabilitation and Resettlement Act, 2013, for public purpose
for an area not exceeding 400 Kanals (50 Acre) ; and
Whereas, as per Section 19(1) of Right to Fair Compensation and
Transparency in Land Acquisition Rehabilitation and Resettlement Act,
2013 the Appropriate Government (District Collector) is satisfied that
the land is required for public purpose viz. extension of main campus
of Border Security Force for providing the basic amenities and training
infrastructure.
Now, therefore, declaration under Section 19(1) of the Right to
Fair Compensation and Transparency in Land Acquisition, Rehabilitation
and Resettlement Act, 2013 is hereby accorded for acquisition of Land

Notification
Whereas, the Central Government is of the opinion that the detail
of property (land) enclosed herewith as Annexure-A which is subject
to requisition should be acquired for a defence purpose.
Whereas, Under-Secretary to Government of India vide letter
No. 46/SO(II)/D(Lands)/2024 dated 30-05-2024 intimated about the
sanction of the President for payment of Rs. 34,35,21,500/- (Rupees
Thirty four crore thirty five lakh twenty one thousand five hundered
only) towards acquisition of requisitioned land measuring 197 Kanals
03 Marlas situated at villages Rehmbal, Garnai and Khatryar, Tehsil
and District Udhampur, UT of Jammu and Kashmir under the provisions of
Requisitioning and Acquisition of Immovable Property (RAIP) Act, 1952.
Whereas, Defence Estates Officer, Udhampur vide letter No. JK/
2149/ACQ/DEO dated 06-06-2024 placed the indent to Deputy
Commissioner, Udhampur for initiating the acquisition proceedings of
land measuring 197 Kanals–03 Marlas under Requisitioning and
Acuisition of Immovable Property (RAIP) Act, 1952.
Whereas, the Ministry of Housing and Urban Affairs vide
No. GSR 447(E) dated 10-04-2023 under clause (b) Section 2 of the
Requisitioning and Acquisition of Immovable Property Act, 1952, (30
of 1952), the Central Government had authorized Deputy Commissioner
or District Collector of the UT of Jammu and Kashmir as competent
authority to perform the functions under the Act for the area within
their jurisdication in the UT of Jammu and Kashmir.

Now, therefore, in exercise of the power conferred vide GSR
447(E) dated 10-04-2023 under clause (b) Section 2 and Sub-Section (1)
of Section 7 of Requisitioning and Acquisition of Immovable Property
(RAIP) Act, 1952, I, Saloni Rai, IAS, District Collector (Deputy
Commissioner), Udhampur do hereby call upon the land owners/
interested persons of said property (land measuring 197 Kanlas-03
Marlas) to show cause as to why the said property should not be
acquired.
Objections, if any, to the acquisition of the said land shall be
received by the undersigned either individually or through authorized
agent within fifteen days from the date of issuance of this notification
in office of the District Collector (Deputy Commissioner), Udhampur.
