of Maharashtra, AIR ONLINE 2021 SC 125, hereby constitutes a dedicated
Commission to conduct contemporaneous rigorous empirical inquiry into
the nature and implications of the backwardness qua local bodies with
respect to the backward class of citizens in all local bodies within the Union
terruory of Jammu and Kashmir, and to study the nature and effects of
backwardness and to provide its recommendations.
1. Name, extent and commencement :
1.1
This Commission shall be known as ‘‘Jammu and Kashmir
Local Bodies Dedicated Backward Classes Commission’’
(hereinafter referred to as Commission).
1.2
The term of Commission will be forty-five (45) days from
the date of publication of this Order.
2. Functions of the Commission :
The Commission, after studying on the following subject, shall
submit its suggestions and recommendations to the Government of
Jammu and Kashrnir.
2.1
On the reference of the Government, empirical study and
investigation in the context of the representation of
backward classes in all Local Bodies before the upcoming
general elections of the Local Bodies in the Union Territory
and submitting its recommendations to the Government
regarding proportional reservation for backward classes,
Local Body-wise (Urban & Rural).
3. Terms of Reference :
3.1
The Commission shall conduct the contemporaneous rigorous
empirical inquiry into nature and implications of the
backwardness qua local bodies in the Union Territory of
Jammu and Kashmir.
3.2
The Commission shall, on the basis of available records,
reports, surveys, and other data, ascertain the proportion
of population of backward class of citizens in the total
population, local body-wise in order to study in light of
instructions given by Hon’ble Supreme Court and to submit
the report and recommendations to the Government.
3.3
The Commission shall submit its report to the Government
within such period which may be prescribed by the
Government.

3.4
In addition to the above, the Commission shall :—
3.4.1
take the assistance from Central and Union Territory
Government Offices, various organizations, institutions or
individuals for obtaining such information to its satisfaction
as it may consider necessary or relevant for its purpose, in
such form and manner as they may think appropriate ;
3.4.2
avail advices and researchers by holding meetings with them
and also get assistance of recognized research institutions
as and when necessary for analysis of the empirical data
and also for the efficient and effective functioning of the
Commission ; and
3.4.3
arrange visits to various Local Bodies areas in the Union
Territory of Jammu and Kashmir to achieve the above
objectives.
4. Constitution of the Commission :
4.1
The composition of the Commission will be as follows :—
(a)
The Commission shall comprise of three members to
be appointed by the Government, from amongst such
persons who may have the knowledge on the matters
related to backward classes ;
(b)
Amongst the above members, one member shall be the
Retired Judge of Hon'ble High Court, who shall be
Chairman of the Commission.
5. Tenure of the Chairman ancl Members of the Commission :
5.1
The tenure of the Chairman and Members of the Commission
will be co-terminus with the term of the Commission.
6.
Honorarium and other facilities payable to the Chairman/
Members of the Commission :
The salary and allowances payable to the Chairman and Members
of the Commission and other terms and conditions shall be such
as may be prescribed by the Guvernment.
7. Appointments in the Commission :

The services on the post of Secretary, Deputy Secretary,
Research Officer, Review Officer, Office Assistants and

other employees may be taken on deputation from other
departments or may be made available by the Administrative
Department. Wherever necessary services of retired officers
and employees can be availed by appointment on contract as
per the instructions of the Government.
7.2
Salaries, allowances payable and other service conditions of
the officers/employees of the Commission shall be as per
their parent department.
7.3
Tile Commission may take the services of experts as per the
requirement for the discharge of its work and responsibilities.
8. Meetings of the Commission :
The headquarters of the Commission will be in Srinagar/
Jammu. The Commission shall hold meetings at such places,
time and periods as the Chairman may deem fit.
9. Accounts and Audit :
9.1
The Commission shall maintain proper accounts and other
relevant records and prepare statement of accounts in such
form and manner as may be prescribed by the Government
for this purpose.
9.2
The accounts of the Commission shall be audited by
Directorate of Audit & Inspections at such intervals as may
be prescribed.
10. Reports/Recommendations :
Reports/Recommendations of the Commission shall be
presented to the Government by the Commission in relation
to its objective and work. It will contain complete details of
its activities, recommendations and works.
11. Administrative Arrangement and Budget :
The administrative arrangements and budget to
the Commission shall be provided by tile Administrative
Department.

12. Chairperson, members andemployees of the Commission
to be public servants :
The Chairperson members and employees of the Commission
shall be deemed to be public servants under section 21 of
the Indian Penal Code, 1860.
13. Administrative Department :
Rural Development Department shall be Administrative
Department for the Commission.
14. Amendments/Additions :
The Government may make any amendments, changes or
extension in this order from time to time.

iv. The user department shall strictly adhere to all such provisions of

not be put to any use.
v. It would be the responsibility of the user department to comply
with directions of the Hon'ble High Court of J&K or any other

01-03-2024, was issued vide Government Order No. 179-(Home ) of 2024
dated 24-04-2024, for inviting objections, if any, from the officers to the
inter-se-seniority position assigned to them, in said Tentative Seniority List,
within a period of 21 days from the date of its issuance ; and
3. Whereas, Director, Fire & Emergency Service, J&K, vide
communication No. DFES-ESSTOGEN/13/2021-02 (CC-64935) dated
16-05-2024, has intimated that only one objection has been received from
Shri Amit Shivgotra, Assistant Director, Fire & Emergency Services
Command Doda regarding correction in his name as ‘‘Amit Shivgotra’’
instead of ‘‘Amit Sivgotra’’ figuring at Sr. No. 07 of the said Tentative
Seniority list issued vide ibid Govt. order.
4. Now, therefore, the final seniority list of the members of J&K, Fire
and Emergency (Gazetted) Services (Assistant Directors), as it stood on
01-03-2024, forming Annexure-A, to this order, is hereby notified for
information of the concerned members of the services, which shall be
subject to the conditions that :
i.
The inter-se-seniority position of the members of the
Service, shall be without prejudice to the outcome of writ
petition(s), O. As, Appeals, if any, pending before any competent
court(s) of law ; and
ii.
The date(s) of birth reflected in the seniority list shall in no
manner be construed as final and shall be subject to the entries
recorded in the individual Service Book/Date of Birth Certificates
of the concerned Officers, issued by the Competent Authority.

Whereas, on the basis of Indent placed by Chief Engineer (R&B)
Kashmir, vide No. CE/R&B/Plg/K/43-A/2635-37 Dated 10-05-2023 for
Acquisition of land for construction of Kawhar Bala Payeen Tehsil and
District Baramulla was placed before Appropriate Government (Deputy
Commissioner, Baramulla) and in pursuance of the said Indent, the social
Impact Assessment Committee was constituted vide this office Order
No. DCB/LA/2023/521/77 Dated 31-07-2023.
Whereas, the Social Impact Assessment Committee submitted their
report before this office vide No. Teh/Bla/OQ/3216 Dated 01-12-2023
wherein the acquisition of land is found benefitted for public purpose
and feasible for the project. Moreover, as per the report of SIA carried
out under the chairmanship of Tehsildar Baramulla, neither any family
gets dislocated nor the project poses any adverse social and environment
impact i. e. livelihood of the family, assists and water resources etc.
Whereas, the revenue papers viz. Khasra Paimaish etc. has been
prepared and submitted by Tehsildar Baramulla vide his letter No. Teh/
Bla/OQ/3107 Dated 22-11-2023 for land measuring 01Kls-03Mls
in estate Bulbulabad which stands authenticated by Executive Engineer
PWD (R&B) Baramulla vide his office letter No. 14472-73 Dated
18-03-2024.
Now, therefore, in exercise of the powers conferred under Section

Whereas, an Indent has been placed by Chief Engineer (R&B) Kashmir, vide No. CE/R&B/Plg/K/61-A/34467-
69 Dated 20-02-2023 for Acquisition of land required by (R&B) Department for construction of Sheeri Malpora Larridora
Sultanpora road including Taripora Pathan Mohalla for land
measuring 12Mls in estate Taripora Tehsil and District
Baramulla before Appropriate Government (Deputy Commissioner, Baramulla) and in pursuance of the said Indent
the Social Impact Assessment Committee was constituted vide this office Order No. DCB/LA/2023/521/135 Dated
31-07-2023.
Whereas, the Social Impact Assessment Committee submitted their report before this office vide No. Teh/Bla/
OQ/3216-1 Dated 01-12-2023 wherein the acquisition of land is found
bonafide for public purpose and feasible for
the project. Moreover, as per the report of SIA carried out under the chairmenship of Tehsildar Baramulla, neither
any family gets dislocated nor the project poses any adverse social and environment impact i. e., livelihood of the
family, assests and water resources etc.

Whereas, the revenue papers viz. Khasra Paimash etc. have been prepared and submitted by Tehsildar Baramulla

which stands authenticated by Executive Engineer PWD (R&B) Baramulla vide his office letter No. 14686 Dated
22-03-2024.

SO-8.––--Whereas, on 01.08.2023, the Police Station, Baramulla,
received a docket to the effect that a reliable information was received

about the movement of some unknown terrorists in the area. Subsequently,
a Joint Naka was established by the Police/Security Forces at Azad
Gunj, Baramulla, and during the checking two suspects while seeing
the Naka Party tried to escape but were chased down on the spot
and identified as Noor-ul-Kamran S/o Mohd Akbar Ganie R/o Bagh-
e-Islam, Baramulla and Faisal Majeed S/o Ab. Majeed Ganie R/o
Bunglowbagh, Baramulla. During their personal search, the Police
recovered 01 Pistol with Magazine, 04 Rounds and 01 Hand Grenade
from their possession respectively ; and
2. Whereas, based on the above, a Case FIR No. 154/2023 under
section 7/25 Arms Act and Sections 13, 18, 23, 38 and 39 of ULA
(P) Act, was registered in the Police Station, Baramulla, and the
investigation, of the case was set into motion. Subsequently, during the
investigation, the offence under Section 38 of ULA (P) Act was dropped
and Section 20 of ULA (P) Act was added in the case ; and
3. Whereas, during the course of investigation, the site plan of
the place of occurrence and the seizure memos were prepared and
the statements of witnesses acquainted with the facts and circumstances
of the case were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, it was found that the accused
viz. Noor-ul-Kamran and Faisal Majeed, were in contact with a Pakistani
based terrorist of LeT, a banned outfit, namely Babar Bahi R/o PaK,
who provided the recovered arms/ammunition and Hand Grenade to
them through an unknown person, in order to promote terrorist activities
in the area ; and
5.
Whereas, the investigation, in respect of accused
terrorist viz. Babar Bhai and unknown person who provided the arms/
ammunition and Hand Grenade to the accused viz. Noor-ul-Kamran
and Faisal Majeed, shall continue to ascertain their actual identify and
to bring out their role/involvement in the case and the supplementary
charge sheet against them would be filed in the court of competent
jurisdiction ; and

6. Whereas, during the investigation, it was established that the
accused viz. Noor-ul-Kamran and Faisal Majeed, were working as Over
Ground Workers (OGWs) for the terrorists of LeT, a banned outfit,
and were providing logistic support to them, besides, under a well knit
criminal conspiracy procured arms/ammunition and Hand Grenade from
the terrorists for carrying out the terrorist activities in the area ; and
7. Whereas, on the basis of the investigation, the statements of
witnesses recorded and other evidence collected, the Investigating
Officer, has established a prima facie involvement of the' below
mentioned accused for the commission of offences punishable under
Sections of the Unlawful Activities (Prevention) Act, 1967, as shown

launched by the Police/Security Forces in Sathra Gali Pindi, Dana
Doiyan, Mandi, area and during the search operation, a reliable
information was received that one person identified as Mohd Rafi @
Rafi S/o Late Sher Mohd R/o Danna Doiyan, Teshil Mandi, District
Poonch, having links with Pakistani ISI, has concealed some arms/
ammunition and cash in his residential house. Subsequently, a search
was carried out and during the search, the Police recovered 07 Packets
of narcotic like substance, 05 bags containing cash of Indian currency
which could not counted for, 01 Pistol with magazine, 10 pistol rounds,
07 SLR rounds, 07 Mobile Phones and 05 SIM cards from his residential
house ; and
2. Whereas, based on the above, a Case FIR No. 18/2023 under
Sections 8(a)/21 NDPS Act, 4/25, 7/25 Arms Act, and the Sections
13, 17, 21 & 39 of ULA (P) Act, was registered in the Police Station,
Mandi, and the investigation, of the case was set into motion.
Subsequently, during the investigation, the offences under Section 22
NDPS Act, 489-C IPC and the Section 18 of ULA (P) Act were
added in the case ; and
3. Whereas, during the course of investigation, the site plan of
the place of occurrence and the seizure memos of recovered ammunition
and cash to the tune of Rs. 2,30,07,400/- and 15000 USD American
Dollars were prepared and the statements of witnesses acquainted with
the facts and circumstances of the case were recorded under the
relevant provisions of law ; and
4. Whereas, during the investigation, it was found that the accused
viz. Mohd Rafi @ Rafi, was already arrested by the Poonch Police
and was detained under the provisions of J&K Public Safety Act, 1978.
Subsequently, his custody was changed in the instant case and it was
found that the accused was in contact with some Pakistani based
terrorist organizations/ISI agents through virtual mode, who provide the
recovered ammunition and narcotic substances to the accused viz. Mohd
Rafi @ Rafi, in order to sell the same so that the money generated
could be utilized to commit terrorist activities ; and
5. Whereas, during the investigation, it was found that the accused
viz. Mohd Rafi @ Rafi. was also in contact with some Punjab based

narcotic smugglers and after procuring the arms/ammunition and narcotic
substances from across the border, was facilitating the terrorists for
selling the narcotics through the Punjab based smugglers, and was
distributing the generated money among the terrorists as per the
directions of Pakistani handlers ; and
6. Whereas, during the investigation, it was established that the
accused viz. Mohd Rafi @ Rafi, was working as Over Ground Worker
(OGW) for the terrorists of HM/LeT, a banned outfits, and was
providing logistic support to them, besides, under a well knit
criminal conspiracy was raising funds for the terrorists for carrying out
the terrorist activities and knowingly was holding the proceeds of
terrorism ; and
7. Whereas, the investigation, in respect of Pakistani based
terrorists and Punjab based smugglers shall continue to ascertain their
actual identification and to bring out their role/involvement in the case
and the supplementary charge sheet against them would be filed in the
court of competent jurisdiction ; and
8. Whereas, on the basis of the investigation, the statement of
witnesses recorded and other evidence collected, the Investigating
Officer, has established a prima facie involvement of the below

Bhat R/o Redwani and Farooq Ahmad Bhat @ Nali S/o Ab. Gani Bhat
R/o Check Dessan, Yaripora, and are providing shelter/logistic support
to them, for carrying out the terrorist activities in the area ; and
2. Whereas, based on the above, a Case FIR No. 72/2018 under
Sections 13 (2), 18, 19, 38 and 39 of ULA (P) Act, was registered
in the Police Station, Qaimoh, and the investigation, of the case was
set into motion. Subsequently, during the investigation, the offence under
Section 38 of ULA (P) Act was dropped and Section 20 of ULA (P)
Act was added in the case ; and
3. Whereas, during the course of investigation, the seizure memos
were prepared and the statements of witnesses acquainted with the
facts and circumstances of the case were recorded .under the relevant
provisions of law ; and
4. Whereas, during the investigation, the accused viz. Mateen
Ahmad Lone, Aijaz Ahmad Lone @ Ajaz Cable, Abid Ahmad Lone,
Sajad Ahmad Dar and Shahid Ahmad Ahanger @ Shahid Khar, were
arrested in the case and were found working for the terrorists in order
to promote terrorist activities in the area ; and
5. Whereas, during the investigation, it was established that the
accused viz. Mateen Ahmad Lone, Aijaz Ahmad Lone @ Ajaz Cable,
Abid Ahmad Lone, Sajad Ahmad Dar and Shahid Ahmad Ahanger @
Shahid Khar, were working as Over Ground Workers (OGWs) for the
terrorists of HM, a banned outfit, particularly the terrorists viz. Owais
Ahmad Lone @ Raja, Javid Ahmad Bhat and Farooq Ahmad Bhat @
Nali, and under a well knit criminal conspiracy were providing logistic
support to them, besides, were voluntarily harbouring the said terrorists
for carrying out the terrorist activities in the area ; and

6. Whereas, the accused terrorists viz. Owais Ahmad Lone @
Raja and Javid Ahmad Bhat, have been killed in the different encounters
with the Security Forces and the proceedings under the law would abate
against them ; and
7. Whereas, on the basis of the investigation, the statements of
witnesses recorded and other evidence collected, the Investigating
Officer, has established a prima facie involvement of the below
mentioned accused for the commission of offences punishable under
Sections of the Unlawful Activities (Prevention) Act, 1967, as shown

8. Whereas, during the investigation, the accused viz. Abid Ahmad
Lone and Shahid Ahmad Ahanger @ Shahid Khar, have been found
juvenile and in view of the Section 1(4) of the Juvenile Justice

(Care and Protection of Child) Act, 2015, the apprehension,
detention, prosecution, penalty or imprisonment shall be governed by
the said Act ; and
9. Whereas, the accused terrorist viz. Farooq Ahmad Bhat @ Nali,
is absconding and proceedings under Section 299 Cr.PC have been
proposed to be initiated against him ; and
10. Whereas, the Authority appointed by the Government
under Sub-Section (2) of Section 45 of the Unlawful Activities
(Prevention) Act, 1967, has independently examined the Case Diary File
and all the other relevant documents relating to the case and has come
to the conclusion that prima facie case is made out against the above
accused ; and
11. Whereas, after perusing the Case Diary File, the relevant
documents and also taking into consideration the views of the Authority
appointed under Sub-Section (2) of Section 45 of the Unlawful Activities
(Prevention) Act, 1967, the Government is of the view that there is
sufficient material and evidence available against the above-mentioned
accused for their prosecution under the provisions of law.
Now, therefore, in exercise of the powers conferred by Sub-Section
(2) of Section 45 the Unlawful Activities (Prevention) Act, 1967, the
Government hereby accord sanction for launching prosecution against
the accused viz. Mateen Ahmad Lone, Aijaz Ahmad Lone @ Ajaz Cable,
Sajad Ahmad Dar and Farooq Ahmad Bhat @ Nali, for the commission
of offences punishable under the relevant Sections of ULA (P) Act,
as indicated against the each accused at Para (7) above, arising out
of FIR No. 72/2018 of Police Station, Qaimoh.

received by the Police Station, Karnah, to the effect that three persons
identified as Ghulam Mustafa Mughal S/o Mohammad Abdullah Mughal,

Mohammad Qasim Mughal S/o Mohammad Abdullah Mughal and Azhar
Mehmood S/o Mohammad Yousuf Mughal R's/o Seemari, Teetwal,
Karnah, have procured illegal arms/ammunition and narcotic from across
the border and concealed the same in order to promote terrorist activities
in the area ; and
2. Whereas, based on the above, a Case FIR No. 56/2023 under
Sections 8/21, 29 NDPS Act and the Section 13 of ULA (P) Act, was
registered in the Police Station, Karnah, and the investigation, of the
case was set into motion. Subsequently, during the investigation, the
offences under Sections 120-B IPC, 7/25 Arms Act and the Sections
18,20,23,38 and 39 of ULA (P) Act were added in the case ; and
3. Whereas, during the course of investigation, the site plan of
the place of occurrence and the seizure memos were prepared and
the statements of witnesses acquainted with the facts and circumstances
of the case were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, the accused viz. Ghulam
Mustafa Mughal, Mohammad Qasim Mughal and Azhar Mehmood
Mughal, were arrested in the case and during the investigation, 01 Packet
containing narcotic like substances and 08 Pistol Rounds were recovered
at the instance of accused viz. Ghulam Mustafa Mughal and Mohammad
Qasim Mughal, respectively ; and
5. Whereas, during the investigation, it was found that the accused
viz. Ghulam Mustafa Mughal, Mohammad Qasim Mughal and Azhar
Mehmood Mughal, were in contact with a terrorist of LeT, a banned
outfit, namely Mohammad Maqbool Mughal S/o Mohammad Yousuf
Mughal R/o Seemari. Teetwal, Karnah A/P PoK, who provided the
recovered narcotics and ammunition to them in order to promote terrorist
activities in the area ; and
6. Whereas, during the investigation, it was established that the
accused viz. Ghulam Mustafa Mughal, Mohammad Qasim Mughal and
Azhar Mehmood Mughal, were working as Over Ground Workers
(OGWs) for the terrorists of LeT, a banned outfit, particularly the
terrorist viz. Mohammad Maqbool Mughal, and under a well knit criminal

about the movement of some unknown terrorists in village Wupzan,

Bijbehara area. Subsequently, a Joint Search Operation was launched
in the village by the Police/Security forces and during the search, a
suspect while seeing the Search Party tried to escape but was chased
down on the spot and identified as Liyakat Ahmad Ganie S/o Lateef
Ahmad Ganie R/o Wupzan, Bijbehara. During his personal search, the
Police recovered 01 Pistol, 02 Magazines and 14 Rounds from his
possession ; and
2. Whereas, based on the above, a Case FIR No. 175/2023 under
Saetions 7/25Arms Act and the Sections 20 and 39 of ULA (P) Act,
was registered in the Police Station, Bijbehara, and the investigation,
of the case was set into motion. Subsequently, during the investigation,
the offences under Sections 18, 23 and 38 of ULA (P) Act were added
in the case ; and
3. Whereas, during the course of investigation, the site plan of
the place of occurrence and the seizure memos were prepared and
the statements of witnesses acquainted with the facts, and circumstances
of the case were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, it was found that the accused
viz. Liyakat Ahmad Ganie, was in contact with a terrorist of HM, a
banned outfit, namely, Manzoor Ahmad Ganie S/o Gh. Ahmad Ganie
R/o Wupzan, Bijbehara, A/P PoK, through virtual mode, who provided
the recovered arms/ammunition to him through an unknown person in
order to promote terrorist activities in the area ; and
5. Whereas, during the investigation, it was establishmed that the
accused viz. Liyakat Ahmad Ganie, was working as Over Ground
Worker (OGW) for the terrorists of HM, a banned outfit, particularly
the terrorist viz. Manzoor Ahmad Ganie, and was providing logistic
support to him, besides, under a well knit criminal conspiracy procured
arms/ammunition from the said terrorist for carrying out the terrorist
activities in the area ; and
6. Whereas, on the basis of the investigation, the statements of

5. Whereas, during the investigation, three other persons identified
as Fazil Ahmad Parray S/o Sheeraz Ahmad Parray R/o Bhan, Tariq
Ahmad Naikoo @ Chawla S/o Abdul Rehman Naikoo R/o Check Watoo
and Shahid Ahmad Parray S/o Zultkar Ahmad Parray R/o Bonpora,
Bhan, were found involved in the case. Subsequently, the accused were
also arrested and during the investigation, arms/ammunition viz. 01 AK-
47 Rifle, 01 Magazine, 29 Rounds and 01 Chinese Hand Grenade were
recovered at the instance of accused viz. Fazil Ahmad Parray and Tariq
Ahmad Naikoo @ Chawla, respectively ; and
6. Whereas, during the investigation, it was found that the accused
viz. Dr. Rabanee Bashir @ Dr. Subeel, was in contact with a terrorist
of HM, a banned outfit, namely, Farooq Ahmad Bhat @ Farooq Nali
S/o Ab. Gani Bhat R/o Checki-Dessan, who provided the arms/
ammunition to him in order to promote terrorist activities in the area.
The accused viz. Dr. Rabanee Bashir @ Dr. Subeel, motivated the
accused viz. Fazil Ahmad Parray, Tariq Ahmad Naikoo @ Chawla and
Shahid Ahmad Parray, to work for the outfit and provided 01 AK-47
Rifle, 01 Magazine, 29 Rounds and 01 Chinese Hand Grenade to them,
which were later on recovered at the instance of accused viz. Fazil
Ahmad Parray and Tariq Ahmad Naikoo @ Chawla ; and

7. Whereas, during the investigation, it was established that the
accused viz. Dr. Rabanee Bashir @ Dr. Subeel, was a member of
Jamaat-i-Islami, J&K an unlawful association, besides, he alongwith the
accused viz. Fazil Ahmad Parray, Tariq Ahmad Naikoo @ Chawla and
Shahid Ahmad Parray, were working as Over Ground Workers (OGWs)
for the terrorists of HM/JeM banned outfits, particularly the terrorist
viz. Farooq Ahmad Bhat @ Farooq Nali, and under a well knit criminal
conspiracy were providing logistic support to him. The accused viz. Dr.
Rabanee Bashir @ Dr. Subeel, instigated/motivated the accused viz.
Fazil Ahmad Parray, Tariq Ahmad Naikoo @ Chawla and Shahid Ahmad
Parray, to work for the outfit and provided arms/ammunition to them
for carrying out the terrorist activities in the area ; and
8. Whereas, on the basis of the investigation, the statements of
witnesses recorded and other evidence collected, the Investigating
Officer, has established a prima facie involvement of the below
mentioned accused for the commission of offences punishable under
Sections of the Unlawful Activities (Prevention) Act, 1967, as shown
against their names :—

9. Whereas, the accused viz. Farooq Ahmad Bhat @ Farooq Nali,
is absconding and the proceedings under section 299 Cr. PC. have been
proposed to be initiated against him ; and
10. Whereas, the Authority appointed by the Government
under Sub-Section (2) of Section 45 of the Unlawful Activities
(Prevention) Act, 1967 has independently examined the Case Diary
File and all the other relevant documents relating to the case and has
come to the conclusion that prima facie case is made out against the
above accused ; and
11. Whereas, after perusing the Case Diary File, the relevant
documents and also taking into consideration the views of the Authority
appointed under Sub-Section (2) of Section 45 of the Unlawful Activities
(Prevention) Act, 1967, the Government is of the view that there is
sufficient material and evidence available. against the above-mentioned
accused for their prosecution under the provisions of law.
Now, therefore, in exercise of the powers conferred by Sub-Section
(2) of Section 45 the Unlawful Activities (Prevention) Act, 1967, the
Government hereby accord sanction for launching prosecution against
the accused viz. Dr. Rabanee Bashir @ Dr. Subeel, Fazil Ahmad Parray,
Tariq Ahmad Naikoo @ Chawla, Shahid Ahmad Parray, and Farooq
Ahmad Bhat @ Farooq Nali, for the commission of offences punishable
under the relevant Sections of ULA (P) Act, as indicated against the
each accused at Para (8) above, arising out of FIR No. 143/2023 of
Police Station, Kulgam.
