‘‘Annexure A’’

DRAFT NOTIFICATION

Dated the......June, 2024

Whereas, an application has been received from Shri Mata Vaishno

Devi Shrine Board (SMVDSB) through the Divisional Commissioner,

Jammu for grant of permission under Aerial Ropeways Act, 2002 for the

Construction of Passenger Ropeway at katra from Tarakote to Sanjichhat.

Whereas, it has been submitted that the project has been conceived

to facilitate elderly, specially-abled, medically unfit and such other pilgrims

visiting the holy shrine. The entire land falling under the alignment of the

proposed project including terminal stations and corridor belongs to Shri

Mata Vaishno Devi Shrine Board.

Whereas, the application has been endorsed by Divisional

Commissioner, Jammu vide communication number 502/Mis/Gen./24/227

dated 20-05-2024 highlighting that Rs. 200 crore investment proposal shall

boost the local economy by attracting more pilgrims and shall also expand

the commercial activities in the region. Further, it has also been mentioned

that the proposed ropeway project is environment friendly having low dust

emissions.

Whereas, a Sub-Committee Constituted by the J&K Government vide

Order No. 1276-GAD of 2018 dated 14-08-2018 has also directed for

reduction in the number of mules ferrying pilgrims on the track to the Shrine,

in the interest of environment preservation and preventing pollution of the

holy Banganga river and it has been desired by the Government that the

Board develops eco-friendly modes of transport like Battery operated

vehicles/aerial Ropeways, Cable Cars, Elevators, Escalators etc. for the

pilgrims in pursuance to the direction of the Hon’ble NGT.

Whereas, the Hon’ble Supreme Court in the matter of Shri Mata

Vaishno Devi Shrine Board v/s Gauri Mulekhi in its Order dated

26-11-2018 has constituted a Centrally Empowered Committee to examine

the issues of reduction in number of mules on the track and other allied

matters. The Committee in its report dated 12-07-2019 has recommended

creation of a Passenger Ropeway from Katra to Adhkuwari with preferable

extension upto Sanjichhat within a span of 4 years.

Whereas, M/s RITES Ltd, a PSU in Ministry of Railways, a

leading sector expert in the field of ropeways, has been engaged as the

Project Management Consultant by the Board and shall also serve as the

Independent Engineer to oversee the construction and commissioning of

the Ropeway Project.

Whereas, the application clearly describes the 2.543 Km route to be

followed for the proposed aerial ropeway supported by maps, plans, section,

diagram and other related information pertaining to the project. The tender

document has incorporated state of the art equipment and technology

confirming to CEN standards with adequate Integrated Rescue System as

a fool proof safety mechanism for the pilgrims.

Whereas, all the stakeholders of Katra and adjacent areas have been

consulted by SMVDSB for the execution of the project via detailed

interactions held from May, 2023 to February, 2024 by a High-Level

Committee constituted by Hon’ble Lt. Governor of J&K (Hon’ble Chairman,

SMVDSB) comprising two members of the Board and Divisional

Commissioner, Jammu.

Whereas the suggestions and objections of various stakeholders have

been considered by the High-Level Committee and accordingly a report

was placed before the Shri Mata Vaishno Devi Shrine Board in its 72^nd

meeting held on 03-04-2024 chaired by Honorable Lt. Governor, J&K.

wherein the same have been deliberated and subsequently, the project has

been approved in consultation with the local stakeholders and District

Administration, Reasi.

The details in respect of the terminal stations and the corridor

of the passenger ropeway project at Shri Mata Vaishno Devi Shrine in

Katra, District Reasi with the GPS coordinates are given below for the

information of the general public.

Draft Government Order for permission to construct Ropeway from

Tarakote to Sanjhichatt.

In exercise of the powers conferred by Section 6 (1) of The Jammu

and Kashmir Aerial Ropeways Act, 2002 read with Union Territory

of Jammu and Kashmir Re-organisation (Adaptation of State Laws)

Fifth Order. 2020 NO: SO 3808(E) dated 26-10-2020, and on the

recommendation of the Divisional Commissioner Jammu, the Government

of Jammu and Kashmir hereby grants permission to the Shri Mata Vaishno

Devi Shrine Board (SMVDSB) for the construction of an Aerial ropeway

at Katra from Tarakote to Sanjhichhat. This permission is granted in

consideration of the proposal submitted by SMVDSB to facilitate the

pilgrimage to Shri Mata Vaishno Devi Shrine by providing an efficient and

safe transportation system with following details :

A. Project Details:

Starting Point: Tarakote LTP.

ii.

Ending Point: Sanjhichhat UTP.

iii.

Length of Ropeway: 2.543 km.

iv.

Stations : 02 Stations i.e Tarakote LTP and Sanjhichhat UTP,

with 16 towers along the corridor.

Carrying Capacity: 1500 persons per hour.

vi.

Type of Ropeway: monocable with CEN standards.

vii,

Estimated Project Cost: Rs 200 Cr.

viii.

Mode of Execution-Build-Own-Operate-Transfer

(BOOT) Model: The project will be executed under the BOOT

model, where the contractor will Build, Own, Operate, and

subsequently Transfer the ropeway to SMVDSB after a

specified period.

ix.

Contractor Selection : SMVDSB shall engage a reputed and

experienced contractor through a transparent bidding process

using the e-tendering mode to award the contract for project

execution.

Ownership Period : Shall be decided by SMVDSB through

contract.

xi.

Revenue Sharing : Shall be decided between SMVDSB and

the Contractors. During the operation period, a revenue-sharing

agreement will be in place between SMVDSB and the

contractor, details of which will be outlined in the contract.

Terms and Conditions :

1. Time frames :

i. Capital Raising: The bidder must raise the capital required for

the construction of the aerial ropeway within six months.

ii. Commencement of Construction: The construction shall

commence within nine months from the date of issuance of this

order.

iii. Completion of Construction: The construction shall be completed

within 1035 days (two years and ten months) from the appointed

date.

Government Support : The Government shall not be liable to

give any concession, guarantee or financial assistance to

SMVDSB.

Right of Purchase : After the expiry of the concession period,

the Shrine Board will be the owner of the ropeway.

Audit and Accounts : The SMVDSB shall maintain detailed

accounts of the project as per SMVD Shrine Act, 1988.

Arbitration : Any disputes arising from this project shall be

settled through arbitration according to the rules laid in the

Arbitration and Conciliation Act, 1996.

Technical Specifications : The rope way construction must

adhere to the specified structural designs, quality of materials,

safety factors and methods of computing stresses as outlined in

the technical guidelines provided.

Construction Over Public Ways : The construction of the

aerial ropeway over roads and other public ways of

communication, excluding railways, must follow the prescribed

rules. Prior sanction of the Central Government shall be taken,

if required, for the construction over railways.

Transfer of Rights: After the expiry of the concession period,

the Shrine Board will be the owner of the ropeway.

Takeover Conditions : The Government reserves the right to

take over the aerial ropeway to be operated by SMVDSB or

any other person, if deemed necessary.

10.

Motive Power : The motive power to be used on the

aerial ropeway shall be electric, subject to conditions on its use

as specified by the relevant authorities.

11.

Minimum Headway : As per specified norms, a minimum

headway must be maintained under different parts of the rope.

12.

Bridges and Guards : To ensure safely, bridges or guards must

be constructed and maintained at specified points under the

ropeway.

13.

Traffic Regulations :

i. The ropeway is permitted to carry passengers and Material

goods within the specified operational capacity.

ii. The promoter/operator shall not carry hazardous materials in

the Ropeway.

14.

Rates and Revisions :

i. The rates shall be finalized by the Shrine Board at the time of

operationalization of the Project.

ii. Revise the rates based on significant changes in operational

costs, regulatory changes and annual economic reviews.

Security Deposit : A security deposit as specified in the tender

document shall be deposited by the bidder with SMVDSB.

16.

Environmental and Safety Standards :

i. The project shall adhere to all relevant environmental, safety

and regulatory standards as prescribed by the Government.

ii. Regular maintenance and safety checks of the ropeway

system shall be conducted by the promoter.

17.

Disaster Management : A comprehensive Disaster

Management Plan must be in place to address potential

emergencies.

18.

Cost Bearing : The promoter shall bear all costs associated

with the ropeway project’s installation, operation and

maintenance to be executed through BOOT model.

19.

Legal Jurisdiction : Any legal disputes arising from the project

implementation shall be subject to the jurisdiction of the Hon 'ble

High Court at Jammu.

20.

Validity and Revocation : This permission is valid for period of

1035 days subject to further extension of 181 days ( 6 months)

days if the promoter applies with justified reasons.

21.

The Government of Jammu & Kashmir reserves the right to

revoke this permission in case of any violation of the stipulated

terms and conditions or any other reason deemed appropriate.

specifically provided therein that the renewal/extension of

Whereas, on 24-07-2023, the applicant had submitted an

application for extension of her provisional license for the

reason that as her Absolute LL.B Degree was under process

before the concerned University.

Whereas, on 07-08-2023 she has submitted an application for

release of her original Certificate/documents for the reason

that she has to appear in an interview of Prosecuting Officer

Examination which were returned to her on the same date

at her request.

Whereas, vide Notification No. 54-PSC(DR-S) of 2023 dated

Whereas, on 18-10-2023 she submitted another application for

relaease of her original LL.B Degree certificate on the ground

that the same are required by her for some other legal

formalities regarding her selection as Prosecuting Officer (G)

in the Public Service Commission which was returned to her

on the same date at her request.

Whereas, vide High Court Notification No. 2420 of 2023/RG/

LP dated 18-10-2023, her provisional license was extended

upto 31-10-2024 as her degree verification was not received

from the concerned University at that point of time.

Whereas, vide Government Order No. 73-Home of 2024

Dated 05-02-2024 she was appointed as Prosecuting

Officer(G) under direct recruitment quota in J&K Prosecution

Service.

10. Whereas, on 28-02-2024 she has submitted an application for

grant of Absolute License in violation of Rule 49 of the Bar

Council of India Rules, as she ceases to be an advocate on

her joining Government Service and has voluntary suspended

from Legal Practice as an Advocate.

Rule 49 of Chapter II, Part VI and Rule 5(1) Chapter III, Part VI

of the Bar Council of India Rules, provides as under :

‘‘ Rule 49. An advocate shall not be a full-time salaried employee

of any person, government, firm, corporation or concern, so long

as he continues to practise, and shall, on taking up any employment,

intimate the fact to the Bar Council on whose roll his name

appears, and shall thereupon cease to practise as an advocate so

long as he continues in such employment.’’

‘‘Rule 5(1).—An advocate who voluntarily suspends his practice

for any reason whatsoever, shall intimate by registered post to

the State Bar Council on the rolls of which his name is entered,

of such suspension together with his certificate of enrolment in

original.’’

11. Whereas, the applicant has herself declared in her application

dated 28-02-2024, that she has been appointed as Prosecuting

Officer(G) in J&K Prosecution Service in Pay Level 8 (47600-

151100) vide to Government order No. 73-Home of 2024

Dated 05-02-2024, with further request that her license may

be declared absolute. However, her provisional admission

connot be declared as absolute in view of the fact that she

came to be appointed as Prosecuting Officer(G) and it is a

well settled law that whenever any advocate stands appointed

in the Government service he/she ceases to be an advocate

as per Rule 49 of Bar Council of India Rules (Supra).

12. Whereas, the application dated 28-02-2024 of the applicant

for grant of Absolute License was placed before Hon’ble the

Chief Justice and His Lordship on 03-04-2024 desired that

the matter be placed before the Hon’ble Enrolment

Committee.

13. Whereas, as per the direction of the competent Authority, the

matter was placed before the Hon’ble Enrolment Committee

on 22-04-2024.

14. Whereas, as desired by the Hon’ble Chairperson of Hon’ble

Enrolment Committee the applicant vide this office comm-

unication No. 15281/RG/LP dated 30-04-2024, was asked to

submit her order of appointment as Prosecuting Officer (G)

in J&K Government Service and intimate this registry about

the date of joining of her Government Service alongwith a

duly attested affidavit.

15. Whereas, in response to this registry communication dated

30-04-2024 the applicant has submitted her application dated

03-05-2024 alongwith an affidavit duly attested by Judicial

Magistrate 1st Class, wherein she has deposed that she has

joined the Government Service on 06-02-2024.

16. Whereas, on 06-06-2024, the matter was again placed before

the Hon’ble Enrolment Committee.

17. Whereas, on 08-07-2024, the Hon’ble Enrolment Committee,

after thorough consideration of the matter under rules, has

been pleased to recommend that :—

18. Whereas, the Competent Authority has been pleased to accord

the approval to the recommendation of the Hon’ble Enrolment

Committee dated 08-07-2024.

Now, therefore, in compliance to the recommendation of the

Hon’ble Enrolment Committee and the approval accorded by the

Competent Authority to the recommendation of the Hon’ble Enrolment

Committee the application dated 28-02-2024 of the applicant for grant

of Absolute License has been considered and found devoid of merit

hence rejected and Provisional License bearing Enrolment No. JK-423/

2022 dated 22-07-2022 of the applicant is hereby cancelled as the

applicant has joined the Government service as Prosecuting Officer(G)

on 06-02-2024, pursuant to her appointment vide Government Order
