time, with a view to balance the objectives of good governance for
establishing a corruption-free, transparent and responsive administrative

system, along-with ensuring adequate safeguards for public servants to
protect them from unnecessary harassment of false/frivolous/anonymous/
pseudonymous complaints. These instructions, inter-alia, contain detailed
provisions for Lodging, Handling and Verification of Complaints as also
Action against such false/frivolous Complainants.
Notwithstanding these elaborate instructions, cases of undue
harassment through lodging of false/frivolous/anonymous/pseudonymous
complaints are being increasingly reported. Many a times, these complaints,
after verification, have been found devoid of any merit, and disposed of
accordingly. In the process, however, public servants discharging their
bonafide duties, have to face unwarranted harassment and mental agony,
affecting their decision-making, thereby causing administrative inertia, which
inter-alia adversely affects disposal of Government business and public
service delivery.
It has accordingly been felt that the procedure for dealing with such
false/frivolous/anonymous/pseudonymous complaints, needs to be further
strengthened, in order to ensure that honest public servants are not unfairly
harassed, and Government business is not affected.
Accordingly, the following instructions are brought to the notice of all
Administrative Departments/HoDs/Cadre Controlling Authorities/Public
Servants, for dealing with such complainants :
i.
Pursuing prosecution under Section 182 of the Indian Penal Code
for making a false complaint.
ii.
Initiating prosecution under Section 195(1)(a) of the Code of
Criminal Procedure, 1973, based on a complaint filed with the
court by the concerned public servant or another superior public
servant.
iii.
Considering departmental action against public servants making
false complaints, as an alternative to prosecution.
iv.
Providing institutional support to government servants affected by
false complaints by :
a. Assisting the affected employee to approach Crime Branch,
J&K, for initiation of criminal proceedings upon receiving a
report or request from a public servant.

b. Facilitating Public Servants, who have suffered harm as a
result of false complaints, to file civil lawsuits seeking damages
against responsible individuals. This may include compensation
for financial losses, emotional distress, or harm to reputation,
with the provision for the public servant to engage a lawyer
as per requirement on contingency fee arrangements, subject
to available resources, for which each case shall be decided
on merits.
c. Facilitating assistance of Law Officers from the Department
of Law, Justice & Parliamentary Affairs for appropriate legal
remedies in respect of acts done in official capacity.
d. Arranging formal inquiries by the relevant registering authority,
where such complaints have been filed by any such registered
organizations.
e. Issuance of formal press notes regarding complaints and
inquiries to promote transparency, preferably on a monthly basis.
f. Conducting of Inquiries in cases involving publications and if
found complicit, taking action, including reporting the matter to
the Press Council of India (PCI) and other measures like
cancellation of accreditation and stoppage of Government
advertisements.

A Preliminary meeting was held on 30-07-2024 at 11 : 30 AM under
the chairpersonship of Secretary to the Government, ARI and Trainings
Department in her Office Chambers at Civil Secretariat Srinagar, regarding
laying of Rules of J&K. Government Press (Subordinate) Service rules
through Executive Order.

Proposal :
To examine draft amendments to the J&K, Government
Press (Subordinate) Service rules and issuance of the same through
Executive Order.
Deliberations :
At the outset, Secretary (Technical), ARl and Trainings Department
placed the draft agenda before the Meeting and appraised the
chair that the General Managers, Government presses, Srinagar/
Jammu have come up with the joint proposal regarding carrying
amendments to the J&K, Government Press (Subordinate) Service
Rules and issuance of the same through Executive Order taking reliance
of Government Order No. 635-JK(GAD) of 2024 dated 16-02-2024
read with the guidelines issued from the ARI & Trainings
Department’s vide Government Order No. 25-JK(ARI & Trgs.) of
2024 dated 21-06-2024.

The chair was appraised that existing rules of the said Department
were notified vide SRO-154 of 1985 dated 10-04-1985. Subsequently
from time to time various new posts were created and some of the
posts were upgraded/merged. However, no rules were prescribed
for these posts. Besides, in case of some posts, the existing
method of recruitment rendered obsolete in view of the changing
requirements and modernization of Press. The chair was further
appraised that at present, there are 250 posts of various categories,
where method of recruitment is not available or existing method
of RRs has rendered obsolete. Therefore, due to non-availability
of formal recruitment rules, these 250 posts remained vacant and
have adversely affected day to day functioning of these departments.
Furthering the discussions, the General Manager, Government
Press, Srinagar appraised the chair that, at present, both Government
Presses, Srinagar/Jammu are working with only 40% of sanctioned
staff strength in absence of Recruitment Rules, thereby they
confronts problems to cope up the work load and to complete
the printing jobs of indenting department on time. Therefore
notifing recruitment rules for above posts through an Executive
Order will immensely help these departments overcome the dearth
of staff as the departments will be in the position to fill 185 posts
through direct recruitment (JKSSB) and 65 posts through promotion
quota.
The Director Finance, ARI & Trgs. Department inquired that whether
the mechanism, as envisaged in the Govt. Order No. 635-JK( GAD)
of 2024 dated 16-02-2024, followed by the guidelines
issued from the ARI & Trainings Department's vide Govt. order
No. 25-JK(ARI & Trgs.) of 2024 dated 21-06-2024, have been
followed, while identification of Critical Posts. The General Manager
Government Presses informed the meeting that as per the said
guidelines, there are two set of criteria for identification of Critical
Posts :
a. Where no recruitment is available at all.
b. Where existing method of recruitment has become
obsolete or where there is severe ambiguity in the rules
and necessitates revision.

The Meeting, after scrutinizing the records found the proposal justified
so far it relates to the identification of Critical Posts. Thereafter,
proposal with regard to proposed method of recruitment/
qualification was also perused and found in order and in conformity
with the General Rules.
Meanwhile, General Manager, Government Press, Jammu informed
the meeting that there is a court case pending disposal with the Hon’ble
Apex Court in case of Inker Feeder and whether Department can
proceed further in the matter for that category of posts. The Secretary
(Legal), ARI & Trainings Department informed the chair that said
posts were re-designated as orderlies/Jamadars vide Govenmcnt Order
No. 11-ARI of 2015 dated 12-10-2015 and Department has got the
Stay form the Honble Apex Court. Therefore in light of the stand
taken by the Department and re-designation of the said category,
there is no legal impediment in laying rules for the said category.
The chair sensitized the meeting about the importance of laying
Recruitment Rules for any service cadre, which aims at to realign the

particular services to the overhanging organization needs and to
maintain congruence between functional needs and legitimate
aspirations of the officers/officials, as the case may be. She also
asserted that is also helps in improving efficiencies and set aside
unwanted litigations. Since, in absence of Recruitment Rules, both
Government Presses, Srinagar/Jammu is working with only 40% of
sanctioned staff strength, therefore notifying recruitment rules for
above posts through an Executive Order may immensely help them to
overcome dearth of staff and improve their working. However, chair
impressed upon the meeting to ensure that proactive approach
requires finalization of Recruitment rules within the six months, as per
the stipulations envisaged in the said guidelines.
Dicisions :
After threadbare deliberations on the issue following decisions
were taken :
1.
The proposal of amendments to the J&K, Government Press
(Subordinate) Service rules through Executive Order was agreed
to in principle and it was decided that same shall be placed before
the Standing Committee for consideration,

Whereas, the Government is of the opinion that the property

under requisition should be acquired for a public purpose, namely defence
purpose.
Now, therefore, in exercise of the powers conferred upon me by
Sub Section (1) of Section 7 of the said Requisitioning and Acquisition
of Immovable Property Act, 1952 by the Government in terms of Section
16 of the said Act, I, Abhishek Sharma, IAS, Deputy Commissioner,

application for grant of Provisional License as an Advocate
on the roll of Bar Council of Jammu and Kashmir.

Whereas, vide High Court Notification No. 1063 dated 10-01-
2020 he was admitted and enrolled as an Advocate on the
roll of Jammu and Kashmir Bar Council under S. No. JK-
664/2019 dated 31-12-2019, provisionally for a period of one
year from the date of issuance of the Notification subject to
the verification of his provisional LL.B Degree Certificate from
concerned University and verification of his character and
antecedents from C.I.D. It was specially provided therein that
the renewal/extension of Provisional License/enrolment must
be sought before the date of expiry unless the absolute/final
enrollment as an Advocate is ordered therebefore.

Whereas, on 18-01-2021 the applicant has submitted, an
application for extension of his Provisional License that has
been expired on 10-01-2021 stating therein that he has not
obtained LL.B Degree Certificate from the University till date.

Whereas, vide High Court Notification No. 1617 of 2021/RG
dated 18-12-2021 the Provisional License was extended upto
31-12-2022.

Whereas, on 31-12-2021, the applicant has submitted an
application for release of all the original documents on the
pretext that he has not received his LL.B Degree from the
concerned University.

Whereas, on 15-09-2022, the applicant has submitted another
application for release of his original Certificates/documents
for the reason that he has qualified the Prosecuting Officer
Mains Examination result of which was declared on 14-09-2022
and documents were immediately required by him for future
course of action, which were returned to him on the same
date at his request.

Whereas, on 12-10-2022 he has submitted another application
wherein he has stated that he has obtained LL.B Degree and
requested for issuance of Absolute/Final License.

Whereas, vide Notification No. PSC/Exam/2022/32 dated
19-10-2022 issued by J&K Public Service Commission
Srinagar, he was selected as Prosecuting Officer (G) as per
the Declaration of the Result of J&K Prosecuting Officer(G)
Examination 2021-Deployment of candidates for medical
Examination thereof.

Whereas, on his request this registry has issued a reminder
to the central University Ganderbal Srinagar for verificatrion
of his LL.B Degree vide No. 6780/RG/LP dated 27-02-2023.
10.
Whereas, on 28-03-2023 the applicant has taken back his
original LL.B Degree to do the legal formalities in the Public
Service Commission, Srinagar.

Whereas, vide High Court Notification No. 593 of 2023/RG/
LP dated on 27-03-2023 his provisional License was extended
upto 31-03-2024 as verification of his LL.B Degree was not
received from the concerned University at that point of time.

Whereas, on 13-03-2023, the applicant has submitted another
application for issuance of Absolute License alongwith original
verification report dated 02-03-2023 of his LL.B Degree
issued by the concerned University which is against the rules,

for Verification of the Certificates of the candidates are
confidential and secret documents and are dispatched to the
concerned department only under Confidential Cover.

Whereas, vide Government Order No. 154-Home of 2023
Dated 27-03-2023 he was appointed as Prosecuting Officer(G)
under direct recruitment quota in J&K Prosecuting Service in
Government Service.
14.
Whereas, vide this registry communication No. 22881/RG/LP
dated 20-06-2024, the applicant was asked to intimate this
office as to whether he has been appointed in Government
Service and if so, he shall submit copy of order of appointment
and date of joining in Government Service.
15.
Whereas, in response to this office communication dated
20-06-2024 the applicant has submitted an application/reply on
25-06-2024 alongwith the copy of his appointment order issued
vide Government Order No. 154-Home of 2023 Dated 27-03-2023,
wherein he has declared that he has joined the said
Government Service on 31-03-2023 as Prosecuting Officer(G)
in violation of Rule 49 of the Bar Council of India Rules, as
he ceases to be an advocate on his joining Government Service
and has voluntary suspended from Legal Practice as an
Advocate.
Rules 49 of Chapter II, Part VI, and Rule 5(1) of Chapter
III Part VI of the Bar Council of India Rules, provides as
under :
‘‘Rule 49. An advocate shall not be a full-time salaried
employee of any person, Government, firm, corporation
or concern so long as he continues to practise, and shall
on taking up any employment, intimate the fact to the
Bar Council on whose roll his name appears, and shall
thereupon cease to practise as an advocate so long
as he continues in such employment.’’
‘‘Rule 5(1).—An advocate who voluntarily suspends his
practice for any reason whatsoever, shall intimate by
registered post to the State Bar Council on the rolls

of which his name is entered, of such suspension together
with his certificate of enrolment in original.’’

Whereas, the application dated 25-06-2024 of the applicant
for grant of Absolute License was placed before Hon’ble the
Chief Justice and His Lordship on 04-07-2024 desired that the
matter be placed before the Hon’ble Enrolment Committee.

Whereas, as per the direction of the Competent Authority, the
matter was placed before the Hon’ble Enrolment Committee
on 06-07-2024.

Whereas, on 16-07-2024m the Hon’ble Enrolment Committee,
after thorough consideration of the matter under rules, has been
pleased to recommend that :—
‘‘i)
the application of the applicant for grant of Absolute
License is devoid of merit and may be rejected and the
applicant may be informed accordingly.
ii)
Provisional License bearing Enrolment No. JK-664/2019
dated 31-12-2019 which has already been expired on
31-03-2024 of the applicant may be treated as cancelled
as he has been appointed in Government Service as
Prosecuting Officer and necessary Notification may also
be issued in this behalf.’’

Whereas, the Competent Authority has been pleased to
accord the approval to the recommendation of the Hon’ble
Enrolment Committe dated 16-07-2024.
Now, therefore in compliance to the recommendation of the
Hon’ble Enrolment Committee and the approval accorded by the
Competent Authority to the recommendation of the Hon’ble Enrolment
Committee, the applications dated 13-03-2023 and 25-06-2024 of the
applicant for grant of Absolute License has been considered and found
devoid of merit, hence rejected and Provisional License bearing
Enrolment No. JK-664/2019 dated 31-12-2019 of the applicant is hereby

Whereas, it appears to the Government that a total of 02K-05M
land is required at the Village Kanthi Tehsil & District Ramban for public
purpose, namely for the “Construction of Approach Road to ISM
Dispensary at Kathagali in Village Kanthi Tehsil & District Ramban.
Whereas, Director Ayush J&K, Jammu placed an indent vid his
No. Dir-ayush/P&S/68-II/7965-67 dated 29-05-2023 for the acquisition
of private land measuring 02K-05M situated in Village Kanthi Tehsil and
District Ramban for the “Construction of Approach Road to ISM
Dispensary at Kanthagali in Village Kanthi Tehsil & District Ramban.
Whereas, Tehsildar Ramban prepared the revenue papers of land
measuring 02K-5M in consultation with the Indenting Department and
submitted to this office vide his No. TR/OQ/2023-24/Rev/247 dated
No. 27 ] The J&K Official Gazette, 3rd October, 2024/11th Asvi., 1946 951
16-05-2023 and the same were authenticated by the Indenting
Department in token of its correctness.
Whereas, the Government of Jammu and Kashmir, Revenue
Department Civil Secretariat, notified the final draft rules i.e. “The
Jammu and Right to Fair Compensation and Transparency in Land
Acquisition, Rehabilitation and Resettlement (Social Impact Assessment
and Consent) Rules, 2023 vide S.O 440 dated 24th of August, 2023.
Whereas, the Indent by the Director Ayush J&K, Jammu was
perused in consonance with the provision contained in the aforementioned
rules notified vide S.O 440 of 2023 dated 24-08-2023 and it was found
that the indent was placed as per the Rule 3(1), (3) & (5) of the Jammu
and Kashmir Right to Fair Compensation and Transparency in Land
Acquisition, Rehabilitation and Resettlement (Social Impact Assessment
and Consent) Rules, 2023.
Whereas, this Collectorate constituted a committee vide No. Acq/
Gen/Rbn/23/441-50 dateed 28-12-2023 as per Rule 4 of the Rules
notified vide S.O 440 of 2023 to conduct preliminary enquiry in the said
land acquisition case.
Whereas, the committee submitted its report duly endorsed by
Tehsildar Ramban vide his No, TR/OQ/2024-25/Rev/454 date18-07-2024
perusal of which reveals that there is no State/Common land available
which would Serve the public purpose and the only option is to acquire
the proposed patch of land. Further, there is no involuntary displacement
involved in the acquisition of said land and accordingly, no rehabilitation
is required. No Fruit bearing/Non-Fruit bearing trees are available on
the spot. The whole road alignment falls outside the demarcated forest
area. Land owenrs have no objection on the said acquisition and consent
as required under Sub-Rule (2) of Rule17 and Sub-Rule (1) of Rule
20 on From-V (Part-A) (Prior Written Consent of the Affected Land
Oweners or Declaration From) has been obtained from them, Resolution
of GramSabha as per Sub-Rule (7) of Rule 21 on From-V (Part-B) has

also been obtained, Hence, the committee recommended that this report
be considered as Social Impact Assessment (SIA) Report which is
mandated under Sections 4,5,6,7 & 8 of the Right to Fair Compensation
and the Transparency in Land Acquisition, Rehabilitation and Resettlement
Act, 2013 and Rules 9, 13, 14, 15, 16 and 17 of Jammu & Kashmir Right
to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement (Social Impact Assessment and
Consent) Rules 2023.
Whereas, keeping in view the findings and recommendations of
the committee constituted by this Collectorate, written consent
submitted by the land owners concerned as required under Sub-
Rule (2) of Rule 17 and Sub-Rule (1) of Rule 20 on Form-V (Part-A)
(Prior Written Consent of the Affected Land Owners or Declaration
Form), resolution submitted by Gram Sabha as per Sub-Rule (7) of Rule
21 on Form-V (Part-B) dully signed by the Block Development Officer,
Ramban and no family/families are likely to be displaced due to the
instant land acquisition case, this Collectorate has decided to consider
the report of the committee as Social Impact Assessment Report as
required under Sections 4,5,6,7, and 8 of ‘‘The Jammu and Kashmir
Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement Act 2013 and Rules 9, 13, 14, 15, 16
and 17 of ‘‘The Jammu and Kashmir Right to Fair Compensation and
Transparecy in Land Acquisition, Rehabilitation and Resettlement
(Social Impact Assessment and Consent) Rules, 2023’’.
Whereas, in exercise of the powers vested in me under Section
11 (1) of the Right to Fair Compensation and Transparency in Land
Acquisition, Rehabiliation and Resttlement Act, 2013, I, Mr. Harpal
Singh JKAS, Collector Land Acquisition (ACR)), Ramban do hereby

This notification is made under the provisions of Section 11(1) of
the Right to Fair Compensation and Transparency in Land Acquisition,
Rehabiliation and Resettlement Act, 2013 (30 of 2013) to all whom it
may concern.
A plan of the land may be inspected in the office of the Collector
on 20th of August, 2024 at 2.00 PM Sharp.
The Government is pleased to authorize, Tehsildar Ramban, other
field staff alongwith Indenting Department to enter upon and survey
land, takes levels of any land, dig or bore into the sub-soil and do all
other acts required for the proper execution of their work as provided
and specified in Section 12 of the said Act.
Under Section 11(4) of the Act, no person shall make any
transaction or cause any transaction of land i.e., sale/ purchase, etc,
or create any encumbrances on such land from the date of publication
of such notification without prior approval of the Collector.
Objection, to the acquisition, if any may be filed by the person
interested within 60 (Sixty days) from the date of publication of this
notification as provided under Section 15 of the Act before this
Collectorate.
