Sanction is hereby accorded to the :
(a) Resumption of land measuring 03 Kanals under Khasra
No.290 min at Village Kunkanyala, Tehsil Katra, District Reasi
from Subsidiary Intelligence Bureau (SIB), Ministry of Home
Affairs, Government of India transferred vide Government Order
No.60-JK (Rev) of 2023 dated 28-04-2023 pursuant to
Administrative Council Decision No.35/3/2023 dated 25-04-2023
to the Revenue Department. Deputy Commissioner, Reasi shall
work out modalities for proper utilization of the resumed land.
(b) Transfer of State land measuring 03 Kanals under Khasra No.351
in Village Kunkanyala, Tehsil Katra, District Reasi in favour of
Subsidiary Intelligence Bureau (SIB), Ministry of Home Affairs,
Government of India, for construction of office-cum-residence
accommodation in terms of Rule 310 of General Financial Rules,
2017 as per rates notified for the said land in terms of Market
Value Guidelines/Rules 2011 issued by the Deputy Commissioner,
Reasi for the year 2024.
It is further ordered that :—
i. The balance transfer value of the land amounting to Rs. 2.88 lac
(Rupees two lac eighty eight thousand only) shall be deposited in
the relevant account of the Deputy Commissioner, Reasi who shall
further deposit in the account head of Government of J&K, Major
Head 0029-Land Revenue, Minor Head 800- Other Receipts.
ii. The land shall be used only for the purpose for which the sanction
of transfer has been accorded.
iii. The land shall put to use after obtaining all other permissions as
may be required for its construction from the Competent Authority
and pay any charges/compensation of the said land, if applicable.
iv. The user agency shall adhere to all such provisions of laws relating
to Revenue/Forest/Housing & Urban Development Department/

J&K Water Resources (Regulation and Management) Act, 2010
etc. If any land found under water course/source shall not in any
way utilized for the construction purposes.
v. It would be the responsibility of the user agency to comply with
directions of the Hon'ble High Court of J&K or any other
Competent Court with regard to the usage of the said land and
contest the litigation, if any pending.
vi. The land is transferred on ‘as is where is basis’ and nothing in this
order shall be construed to debar any Competent Authority to take
legal action in case of violation on the field relating to usage of
land.
vii. No diversion of transferred land for any other purpose shall be
made.
viii. The user agency to take possession of the land within 30 days
from the transfer order, and land to be put to use within 03 years
failing which the land shall revert back to the Government.
ix. The Government reserves the right to retrieve any un-utilized portion
of the land, if the same is required for any other public purpose.

Sanction is hereby accorded to the transfer of State land measuring
53 Kanals 03 Marlas as per description at Annexure ‘‘A’’ in District
Baramulla in favour of Central Reserve Police Force (CRPF) for
establishing Battalion Camping Site 53 Bn CRPF in terms of provisions of
Rule 310 of General Financial Rules, 2017 on payment of transfer value of
Rs.3, 44, 94, 350/- (Rupees Three Crore Forty Four Lac Ninety Four
Thousand Three Hundred Fifty only) @ Rs.6,49,000/- per Kanal.
It is further ordered that :
i. The transfer value of the land shall be deposited in the relevant
account of the Deputy Commissioner, Baramulla, who shall further
deposit in the account head of Government of J&K, Major Head
0029-Land Revenue, Minor Head 800 - other receipts.
ii. The land shall be used only for the purpose for which the sanction
of transfer has been accorded.
iii. The land shall put to use after obtaining all other permissions as
may be required for its construction from the Competent Authority
and pay any charges/compensation of the said land, if applicable.
iv. The CRPF shall adhere to all such provisions of laws relating to
Revenue/Housing and Urban Development Department, Forest/
J&K Water Resources (Regulation and Management) Act, 2010
etc. before utilization of the land. If any land found part of water
course/source shall not be put to any use.
v. It would be the responsibility of the user force to comply with the
directions of the Hon'ble High Court of J&K or any other Competent
Court with regard to the usage of the said land and contest the
litigation, if any pending.

Sanction is hereby accorded to the transfer of State land measuring
633 Kanals 05 Marlas under Khasra No.842 situated at Estate Brah, Tehsil
Shangus, District Anantnag in favour of Industries & Commerce Department
for establishment of Industrial Estate.
It shall be subject to the following conditions :—

Dated : 23-02-2024.
Whereas, Jammu and Kashmir Government declared its intention vide
Government Order No. FST/20 of 1981 dated 4th February, 1981 to
constitute Trikuta Wildlife Sanctuary ; and
Whereas, the area of Trikuta Wildlife Sanctuary falls under the
ownership and management of Shri Mata Vaishno Devi Shrine Board ; and
Whereas, a proposal for de-notification of Trikuta Wildlife Sanctuary
was considered by the Standing Committee of the State Board for Wildlife
in its 3rd meeting held on 20th December, 2010, and was recommended for
approval by the National Board for Wildlife ; and
Whereas, the Standing Committee of the National Board for Wildlife,
in its 22nd meeting held on 25th April, 2011, recommended the proposal for
de-notification ; and

Whereas, the conditions imposed by the State Board for Wildlife
as well as the Standing Committee of the National Board for Wildlife
stand fulfilled, and in accordance with the conditions imposed by the said
Boards, the State Government vide SRO-47 of 2012 dated 30th January,
2012, constituted Tata Kuti Wildlife Sanctuary under the provision of sub-
section (1) of section 17 of the Jammu and Kashmir Wildlife (Protection)
Act, 1978 in lieu of de-notification of Trikuta Wildlife Sanctuary ; and
Whereas, the Hon’ble Supreme Court of India vide its order dated
13-03-2013 while considering the application moved by Shri Mata Vaishno
Devi Shrine Board for de-notification of the entire Trikuta Wildlife
Sanctuary granted permission for the same.
Now, therefore, the entire area of Trikuta Wildlife Sanctuary is hereby
de-notified.

Sharief, received a docket to the effect that a Joint Naka was
established by the Police/Security Forces at Check Karpora crossing
and during the checking two suspects while seeing the Naka Party tried
to escpae but were chased down on the spot and identified as Tanveer
Ahmad Bhat S/o Gh. Mohd Bhat and Yawar Maqbool Ganie S/o Mohd
Maqbool Ganie residents of Karpora, Pakherpora. During their personal

search, the Police recovered 01 Chinese Pistol, 01 Magazine and 09
Rounds from their possession respectively ; and
2. Whereas, based on the above, a case FIR No. 66/2023 under
Section 7/25 Arms Act, and Sections 18, 19, 20 and 23 of ULA(P) Act,
was registered in the Police Station, Charar-i-Sharief, and the
investigation, of the case was set into motion. Subsequently, during the
investigation, the offence under Section 19 of ULA(P) Act, was
dropped and the offences under Sections 38 and 39 of ULA(P) Act
were added in the case ; and
3. Whereas, during the course of investigation, the site plan of
the place of occurrence and the seizure memos were prepared and the
statements of witnesses acquainted with the facts and circumstances
of the case were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, it was found that the accused
viz. Tanveer Ahmad Bhat and Yawar Maqbool Ganie, were in contact
with two terrorist of LeT/TRF banned outfit namely Haris Nazir @
Qasim S/o Nazir Ahmad Dar R/o Kachipora, Pulwama and Ehsan-ul-
Haq @ Numan S/o Ab. Rashid Sheikh R/o Sheikh Mohalla, Muran,
Pulwama, who provided the recovered arms/ammunition to them in
order to promote terrorist activities in the area ; and
5. Whereas, during the investigation, it was established that the
accused viz. Tanveer Ahmad Bhat and Yawar Maqbool Ganie, were
working as Over Ground Workers (OGWs) for the terrorists of LeT/
TRF banned outfit, particularly the terrorist viz. Haris Nazir @ Qasim
and Ehsan-ul-Haq @ Numan, and were providing logistic support to
them, besides under a well knit criminal conspiracy procured arms/
ammunition from the said terrorists for carrying out the terrorist
activities in the area ; and
6. Whereas, on the basis of the investigation, the statements of
witnesses recorded and other evidence collected, the Investigating
Officer, has estagblished a prima facie involvement of the below
mentioned accused for the commission of offences punishable under
sections of the Unlawful Activities (Prevention) Act, 1967, as shown

search, the Police recovered 01 Hand Grenade, 12 AK-47 Rounds and
an amount of Rs.01 lac Indian Currency from their possession
respectively ; and
2. Whereas, based on the above, a case FIR No. 150/2023 under
Sections 7/25 Arms Act, 3/4 ESA and the Sections 20 and 38 of ULA(P)
Act, was registered in the Police Station, Bijbehara, and the
investigation, of the case was set into motion. Subsequently, during the
investigation, the offences under Sections 17, 23 and 39 of of ULA(P)
Act, were added in the case ; and
3. Whereas, during the course of the investigation, the site plan
of the place of occurrence and the seizure memos were prepared and
the statements of witnesses acquainted with the facts and circumstances
of the case were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, it was found that the accused
viz. Abrar-ul-Haq Katoo and Tawseef Ahmad Bhat, were in contact
with a terrorist of LeT banned outfit namely Haroon Rashid Ganie S/
o Ab. Rashid Ganie R/o Hassanpora Taweela, Bijbehara, who provided
the recovered Hand Grenade, AK Rounds and an amount of Rs. 1 lac
to them through an unknown person in order to promote terrorist
activities in the area ; and
5. Whereas, during the investigation, it was established that the
accused viz. Abrar-ul-Haq Katoo and Tawseef Ahmad Bhat, were
working as Over Ground Workers (OGWs) for the terrorists of LeT
banned outfit, particularly the terrorist viz. Haroon Rashid Ganie, and
were providing logistic support to them, besides, procured explosive
material/AK Rounds and an amount of Rs.1 lacs Indian Currency from
the said terrorist through an unknown person for carrying out the
terrorist activities in the area ; and
6. Whereas, the investigation, in respect of an unknown person
who handed over the recovered Hand Grenade/AK Rounds and an
amount of Rs.1 lac Indian Currency to the accused viz. Abrar-ul-Haq
Katoo and Tawseef Ahmad Bhat, shall continue to ascertain his actual
identity and to bring out his role/involvement in the case and the
supplementary charge sheet against him would be filed in the court of
competent jurisdiction ; and
7. Whereas, on the basis of the investigation, the statements of
witnesses recorded and other evidence collected, the Investigating
Officer, has established a prima facie involvement of the below

SO–615.—Whereas, the Ministry of Home Affairs, Government of
India, vide notification S.O.-4348 (E) dated 5th October, 2023, issued
under Sub-Section (1) of Section (3) of the Unlawful Activities
(Prevention) Act, 1967 (37 of 1967) declared the Jammu and Kashmir
Democratic Freedom Party (hereafter referred to as the JKDFP), an
unlawful association ; and

Whereas, subsequently, the Ministry of Home Affairs, Government
of India, in exercise of powers conferred by Section 42 of the Unlawful
Activities (Prevention) Act, 1967 vide notification S.O-4377 (E) dated
7th October, 2023, directed that all the States and Union Territory
administrations shall exercise the powers exercisable by the Central
Government uner Section 7 and Section 8 of the Act ibid. ; and
Whereas, vide Order No. 14017/13/2023-NI-MFO dated 7th
October, of 2023, issued by the Ministry of Home Affairs, Government
of India approval of the Central Government under Section 42 of the
Unlawful Activities (Prevention) Act, 1967 was conveyed to all the
States and the Union Territory administrations to the effect that the
States and Union Territory administrations may, by order in writing,
direct that any power which has been directed to be exercised by it,
shall, in such circumstances and under such conditions, as may be
specified in the direction, be exercised by any person subordinate to the
State Government or the Union Territory administrations, as the case
may be.
Now, therefore, the Government of union Territory of Jammu and
Kashmir, with the previous approval of the Central Government,
conveyed vide order No. 14017/13/2023-NI-MFO dated 7th October,
2023 issued by the Ministry of Home Affairs Government of India,
hereby directs that the powers exerciseable by the Union Territory of
Jammu and Kashmir under section 7 of the Unlawful Activities
(Prevention) Act, 1967 (37 of 1967) shall be exercised by the
Inspector(s) General of Police, Kashmir/Jammu Zones, within their
respective territorial jurisdictions and further directs that the powers
exerciseable by the Union Territory of Jammu and Kashmir under
Section 8 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967)
shall be exercised by the Divisional Commissioner(s), Kashmir/Jammu,
within their respective territorial jurisdictions.

SO–618.—Whereas, on 31-10-2015, a reliable information was
received by the Police Station, Anantnag, to the effect that some
miscreants are in close contact with terrorists and some anti-national
elements, who are lodged in local jails, with the intention to promote
terrorist activities in the area, besides motivating youth to join the
militancy ; and
2. Whereas, based on the above, a Case FIR No. 349/2015 under
section 120-B RPC and Section 13 of ULA(P) Act, was registered in

the Police Station, Anantnag, and the investigation, of the case was set
into motion. Subsequently, during the investigation, the offence under
Section 120-B RPC was dropped and the offences under Sections 18,
20, 38 and 39 of ULA(P) Act were added in the case ; and
3. Whereas, during the course of the investigation, the site plan
of the place of occurrence and the seizure memos were prepared and
the statements of witnesses acquainted with the facts and circumstances
of the case were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, nine persons identified as
Arshid Ahmad Mir S/o Ab. Rehman Mir R/o Brakpora, Anantnag,
Khursheed Ahmad Wani S/o Ab. Ahad Wani R/o Hallan, Verinag,
Anantnag, Mohd Younis Makroo S/o Gh. Nabi Makroo, Mudasir Ahmad
Makroo S/o Nazir Ahmad Makroo R’s/o Arwani, Bijbehara, Umar Gull
Khan S/o Gull Mohd Khan R/o Baba Mohalla, Bijbehara, Sahir Ahmad
Makroo S/o Mohd Akber Makroo, Showket Ahmad Lohar S/o Ab.
Rehman Lohar, Nasir Gulzar Chadoo S/o Gulzar Ahmad Chadoo and
Idress Ahmad Bhat S/o Mohd Ramzan Bhat R’s/o Arwani, Bijbehara,
Were found involved in the commission of crime. Subsequently, the
accused were arrested and during the investigation, 08 Posters of HM
banned outfit were recovered at the instances of accused viz. Arshid
Ahmad Mir and Khursheed Ahmad Wani, respectively ; and
5. Whereas, during the investigation, it was found that the accused
viz. Arshid Ahmed Mir, Khursheed Ahmad Wani, Mohd Younis Makroo,
Mudasir Ahmad Makroo, Umar Gull Khan, Sahir Ahmad Makroo,
Showket Ahmad Lohar, Nasir Gulzar Chadoo and Idress Ahmad Bhat,
were in contact with the terrorists of HM banned outfit namely, Mushtaq
Ahmad Haroo S/o Mohd Amin Haroo R/o Pushpora, Anantnag and
Mohd Abass Sheikh S/o Gh. Hassan Sheikh R/o Rampora, Qaimoh,
Kulgam, who provided the recovered posters to them in order to
promote terrorist and unlawful activities in the area ; and
6. Whereas, the accused viz. Sahir Ahmad Makroo, Showket
Ahmad Lohar, Nasir Gulzar Chadoo and Idress Ahmad Bhat, after their
release from the instant case also joined the terrorist ranks of HM a
banned outfit ; and
7. Whereas, during the investigation, it was established that the
accused viz. Arshid Ahmad Mir, Khursheed Ahmad Wani, Mohd Younis
Makroo, Mudasir Ahmad Makroo and Umar Gull Khan, were working
as Over ground Workers (OGWs) for the terrorists of HM banned outfit
No. 37-g ] The J&K Official Gazette, 18th Dec., 2023/27th Agra., 1945. 3

particularly the terrorist viz. Sahir Ahmad Makroo, Showkaet Ahmad
Lohar, Nasir Gulzar Chadoo, Idress Ahmad Bhat, Mushtaq Ahmad
Haroo and Mohd Abass Sheikh, and under a well knit criminal
conspiracy were providing logistic support to them for carrying out
unlawful and terrorist activities in the area ; and
8. Whereas, the accused terrorist viz. Sahir Ahmad Makroo,
Showket Ahmad Lohar, Nasir Gulzar Chadoo, Idress Ahmad Bhat,
Mushtaq Ahmad Haroo and Mohd Abass Sheikh, have been killed in
different encounters with the Security Forces and the proceedings under
the law would abate against them ; and
9. Whereas, on the basis of the investigation, the statements of
witnesses recorded and other evidence collected, the Investigating
Officer, has established a prima facie involvement of the below
mentioned accused for the commission of offences punishable under
Sections of the Unlawful Activities (Prevention) Act, 1967, as shown
against their names :—

10. Whereas, the Authority appointed by the Government under
Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention)

Act, 1967, has independently examined the Case Diary File and all the
other relevant documents relating to the case and has come to
the conclusion that prima facie case is made out against the above
accused ; and
11. Whereas, after perusing the Case Diary File, the relevant
documents and also taking into consideration the views of the Authority
appointed under Sub-Section (2) of Section 45 of the Unlawful Activities
(Prevention) Act, 1967, the Government is of the view that there is
sufficiant material and evidence available against the above-mentioned
accused for their prosecution under the provisions of law.
Now, therefore, in exercise of the powers conferred by Sub-
Section (2) of Section 45 of the Unlawful Activities (Prevention) Act,
1967, the Government hereby accord sanction for launching prosecution
against the accused viz. Arshid Ahmad Mir, Khursheed Ahmad Wani,
Mohd Younis Makroo, Mudasir Ahmad Makroo and Umar Gull Khan
for the commission of offences punishable under Sections 13, 18 and
39 of ULA(P) Act, arising out FIR No. 349/2015 of Police Station,
Anantnag.
