Sanction is hereby accorded to the transfer of Shamilat Deh (Mehfooz
Kahcharie) land measuring 08 Kanal under Survey No. 48-min situated at
Village Rai, Tehsil and District Shopian in favour of Home Department for
construction of Police Post.
It shall be subject to the following conditions :—
i. The land shall be used only for the purpose for which the sanction
of transfer has been accorded.
ii. The land shall put to use after obtaining all other permissions as
may be required for its construction from the Competent Authority.
iii. The user department shall adhere to all such provisions of laws
relating to Revenue/Forest/Housing & Urban Development
Department/J&K Water Resources (Regulation and Management)
Act, 2010 etc. If any land found part of water course/source shall
not be put to any use.
iv. It would be the responsibility of the user department to comply
with directions of the Hon'ble High Court of J&K or any other
Competent Court with regard to the usage of the said land.
v. No diversion of transferred land for any other purpose shall be
made.
vi. Litigation if any, to be contested by the indenting department.
vii. The indenting department to take possession of the land within 30

It shall be subject to the following conditions :—
i.
The land shall be used only for the purpose for which the sanction
of transfer has been accorded.
ii.
The sanction has nothing to do with the process of allotment of the
land or any regularization of the land allotted for Industrial Units
for which Industries & Commerce Department has to fulfill the
criteria as required under the laid down statutes.
iii.
The land shall put to use after obtaining all other permissions as
may be required for its construction from the Competent Authority.
iv.
The user department shall strictly adhere to all such provisions of
laws relating to Revenue/Forest/ Housing & Urban Development
Department etc. J&K Water Resources (Regulation and
Management) Act, 2010. If any land found part of water course/
source shall not be put to any use.
v.
It would be the responsibility of the user department to comply
with directions of the Hon'ble High Court of J&K or any other
Competent Court with regard to the usage of the said land.
vi.
No diversion of transferred land for any other purpose shall be
made.
vii.
Litigation, if any to be contested by the indenting department.
viii.

Whereas, on the basis of indent placed by XEN, PMGSY Division
Mahore vide No. EE/PMGSY/M/969 dated 02-05-2012, notification
under Section 4 (1) of the Land Acquisition Act, Smvt., 1990 was issued
by the Collector Land Acquisition (SDM), Mahore vide No. SDM/M/CLA/
2012-13/16-22 dated 11-08-2012 for acquisition of land measuring 124
Kanals 10 Marlas situated in Village Chassote, Tehsil Mahore, District
Reasi for public purpose viz. construction of road from Sungari to Bagudass
under PMGSY ; and
Whereas, on the basis of the recommendations of the District
Collector Reasi, Government issued notification under Sections 6 and 7 of
Land Acquisition Act, Samvat, 1990 vide No.97-Rev (LAJ) of 2016 dated
03-10-2016 under endorsement No. Rev/LAJ/70/2016-Chassote
dated 03-10-2016 for acquisition of subject land. Since, the final award
was not issued within two years as a result proceedings have lapsed in
terms of Section 11-B of the said Act ; and
Whereas, District Collector, Reasi vide No. DC/Rsi/18-19/ 1736-40/
SQ dated 15-01-2019 has again requested to Divisional Commissioner,
Jammu to issue fresh declaration under Sections 6 and 7 of the said Act for
acquisition of said land for public purpose viz. construction of road from
Sungari to Bagudass under PMGSY. Divisional Commissioner, Jammu, vide
NO.502/2600/Acq/PMGSY / Chassote/Rsi/19/5220-21 dated 16-03-2019
endorsed it to Financial Commissioner (Revenue), J&K, who Vide No.
FC-LS/LA-4851/2019 dated 28-03-2019 recommend the case for issuance
of fresh declaration/notification under Sections 6 and 7 of the Land
Acquisition Act, Smvt. 1990 ; and
Whereas, after examination of the case, Revenue Department vide
letter No. Rev/LAJ/70/2016 dated 28-05-2021 has requested Divisional

Commissioner, Jammu to clarify the observations regarding kind of land
involved, availability of funds which were addressed/clarified and furnished
by the Divisional Commissioner. Jammu, vide NO.502/2600/Land Acq/
PMGSY /Chassote/Rsi/23/2108 dated 06-01-2024 to the Financial
Commissioner (Revenue), J&K, who vide e-file bearing No. FCR-LAND/
239/2021-06 (77869) dated 12-04-2024 forwarded to this department for
the said purpose ; and
Whereas, report furnished by District Collector (DC), Reasi duly
endorsed by Divisional Commissioner, Jammu/financial Commissioner
(Revenue), J&K vide letter referred to above, has been examined and it
has been found that the notification under Sections 6 and 7 of the said Act,
stands issued by the department and as per the reports, the final award has
not been issued within the stipulated time ; and
Whereas, the Government is satisfied that the aforesaid land is required
for public purpose i.e. viz. construction of road from Sungari to Bagudass
under PMGSY situated in Village Chassote, Tehsil Mahore, District Reasi.
Now, therefore, in pursuance of Section 6 of the J&K Land Acquisition
Act, Samvat, 1990, it is declared that the land measuring 124 Kanals 10
Marlas situated in Village Chassote, Tehsil Mahore, District Reasi for public
purpose viz. construction of road from Sungari to Bagudass under PMGSY
Scheme. Further, the Collector Land Acquisition is directed under Section
7 of the said Act to take orders for acquisition of the said land after
giving prescribed notice to the interested person (s) as required under the
Land Acquisition Act/rules.
However, the Collector concerned shall be held specifically
responsible for identification and proper title verification of all types of
lands involved in the case for making apportionment of compensation
amongst all the interested persons /rightful claimants, in accordance with
the relevant laws/rules in force, while making the award. The Collector/
indenting department shall also ensure that no compensation shall be made
for the portion of land which has already been acquired for the road in
question.

Subject :—Conveying of UT Capex Cellings including district Capex under
BE 2024-25 (Regular Budget) for finalization and uploading of
works/activities on BEAMS portal.

The Finance Department conveys ceiling of UT Capex Budget
including District Capex under BE 2024-25 (Regular Budget) through
BEAMS portal in favour of all the Departments/District Development
Commissioners for uploading the approved Work Plans as per B12 Statement
on the said portal.
In order to ensure the timely authorization of Capex Budget as well
as expenditure thereof, the Departments/DDCs are requested to upload
the approved works plan immediately enabling Finance Department to
authorize the funds through BEAMS accordingly.
However, the ceilings so conveyed shall be subject to the following
instructions/stipulations :—
1) The Director Finance(s)/Director(s) Planning/Financial Advisor
and CAO(s)/Joint Director(s) Planning and Controlling Officers
of all the Departments shall be personally responsible for uploading
of approved Works Plan (projects/works/activities) on BEAMS
portal with the approval of competent authority by or before 15th
of August, 2024.
2) All the District Development Commissioners shall furnish the
District Plans (project/work/activity wise) after seeking approval
of competent authority by or before 15th of August, 2024. District
Development Commissioners should ensure that all activities /
works are selected after due consultations with representatives of
PRI institutions as per the guidelines already issued in this regard
by the Finance Department.
3) In respect of District sector projects, CPO(s)/AO(s) of each
District shall be responsible for uploading of the Work Plans on

BEAMS portal once the same is approved by the competent
authority within the stipulated time.
4) Planning process at Department level and District level shall
integrate to incorporate whole of the Society/whole of Government
approach.
5) All the directions given by Administrative Council and Hon'ble LG,
the recommendations of the three conferences of the Chief
Secretaries, the consultations with local government institutions
and the feedback received by Departments under B2V
programmes, Public Darbar, Public Grievances meetings, etc.
should be reviewed while framing the annual plans and shall form
part of budget outlays for 2024-25.
6) The Administrative Departments should thoroughly examine the
list of the existing works already uploaded on BEAMS. The same
should be streamlined by eliminating non-priority and non-starter
works/ activities.
7) The focus of the Departments/DDCs must be on completion of
ongoing and new works rather than starting large number of
underfunded works or spreading of resources thinly over the
number of years.
8) The new works / activities should be uploaded only if the budget
outlay in 2024-25 for such activity is at least 40% of the approved
cost of the project.
9) The timeline for completion of new works/activities taken up for
execution during the financial year 2024-25, should be between
one to two years. In rare cases of mega-projects, the Department
may extend timeline upto three years.
10) All the spillover and ongoing works/activities which are
expected to be completed during the year 2024-25 or at the
most in succeeding year shall be the first charge on Capex Budget
2024-25. The Departments/DDCs shall ensure that no ongoing
work is left out.
11) The main focus of the Departments/DDCs must be on outcomes
in terms of benefit to the public. All Departments shall prepare
their Annual Plans delineating clear outcomes.

12) The departments shall also prioritize JPKCC projects and the
balance requirements of funds for the languishing projects within
the approved Capex ceilings available on BEAMS portal and shall
upload the works accordingly with LUPCODE in the nomenclature
for clear distinction of such works.
13) The capital outlay shall not be utilized for revenue nature of
expenditure.
14) The Departments/DDCs shall strictly ensure that the ‘‘Budget
Announcement’’ and ‘‘deliverables’’ for the year 2024-25 are
included in the budget outlays and achievements on this account
shall be reviewed periodically at highest Administrative Level/
Finance Department.
15) Funding of part DPRs to be avoided by the Departments e.g.
funding for hospital without equipments, college without furniture
etc.
16) The Departments shall ensure that both Central Share as well as
UT Share of CSS shall be fully captured on BEAMS.
17) The executing agency shall ensure that the component of "Land
Compensation/Forest Compensation/Utility Shifting" must form the
part of the technically vetted DPRs and funds for the said
component shall be released as part of the project/work.
18) The Work Plans of the Departments/DDCs must be based on
tangible outcomes/impact and should indicate the number of Works
to be completed and the numbers of people to be benefited, to
Finance Department periodically.
19) The Departments/DDCs shall furnish the statement of duly
approved Work Plans uploaded on BEAMS portal in the form of
excel sheet (both hard and soft copy) as per B12 statement within
the approved Capex Ceilings enabling Finance Department to
authorize the funds through BEAMS within the timelines.
20) The Department shall re-align their Work Plans for accommodating
the need of re-allocation felt, if any during the current financial
year. Under no circumstances re-allocation proposals shall be
considered in Finance Department after the submission of current
Work Plans.

21) The execution of works shall be taken up strictly for the approved
activities only within the approved cost and no liability shall be
created ensuring financial discipline in the system. The controlling

Dated 12-02-2024.
It is hereby notified for information of all concerned employees that
submission of property returns for the year 2023 by the defaulting employees
shall be allowed through online mode on the Property Return System (PRS
Portal) for a period of 05 days w. e. f. 13-06-2024 to 17-06-2024.
All employees who have registered themselves on the Portal but not
submitted their property returns shall submit the same, besides, unregistered
employees shall get themselves registered on the portal and submit their
property returns during the stipulated period.
In case employees face issues related to OTP, they shall update their
current mobile numbers and email IDs on CPIS portal. Drawing and
Disbursing Officers (DDOs) shall ensure necessary facilitation in this regard.
In case of any other issue/technical support, employees shall forward their
concerns on [email protected] for speedy redressal.
It is further enjoined upon all the Controlling Officers/DDOs of all the
departments to submit the action taken report w.r.t, employees who have

Preliminary Notification
Whereas, it appears to the appropriate Government that a total
land measuring 102 Kanals 18 Marla of Village Chamoti Tehsil
Drabshalla District Kishtwar is required for public purpose namely,
acquisition for construction of road from Machipal to Chamoti, Tehsil
Drabshalla, District Kishtwar. The Social Impact Assessment study was
carried out by the Social Impact assessment (SIA) Unit/team and
accordingly has submitted SIA report (SIA report enclosed).
Whereas, perusal of the report reveals that no family is likely to
be displaced due to the said acquisition.

Whereas, it appears to the appropriate Government that a total of
11 Marlas of land falling under survey No. 162 Min is required in Village
Hanand, Tehsil and District Kulgam for public purpose, namely,
Construction of Service Reservoir at Kulgam Town.
Whereas, a committee was constituted by this office under Sub-
Rule (1) of Rule 4 of the Jammu and Kashmir Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement
(Social Impact Assessment and Consent) Rules 2023 vide No. 03-DCK/
NLA(ACR) of 2024 dated 27-07-2024 to visit the spot alongwith the
representatives of Requiring Body to make a preliminary enquiry.
The summary of the preliminary enquiry report is as follows :
(i)
That the indenting department was offered State/Government
land at various locations for the proposed acquisition and
have not found any suitable land and has agreed to the
proposed land which serves public purpose ;
(ii)
That the extent of land proposed for acquisition is the
absolute bare-minimum needed for the purpose/project.
(iii)
That the acquisition of land at an alternative place has been
considered and found not feasible ;
(iv)
That there is no sufficient/suitable unutilized land which has
been previously acquired in the area ;
(v)
That there is no State/Government/Common land available
which would serve the public purpose and there is only
option to acquire the proposed patch of land which also
include private land ;
(vi)
That there is no acquired unutilized land which may be used
for such purpose ;

(vii)
That the requisition is consistent to the provisions contained in Section 10 or other provisions of the
Act ; and
(viii) The committee is of view that land is absolutly required for the public purpose in order to make availability
of irrigation facility to large populace of the Tehsil Devsar and adjacent
areas, so it may be notified and
acquired for the said project.
No families are likely to be displaced due to the said land acquisition with no adverse impact and rehabilitation
involved.
The said report was considered SIA report as envisaged in Chapter III Rule 8 of the Jammu and Kashmir Fair
Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact Assessment and
Consent) Rules 2023.
Therefore it is notified that for the above said project in the Village Hanand Tehsil and District Kulgam, a piece
of Land measuring 11 Marlas whose detail description is as following, is under acquisition.

on any working day during the working hours. The Government
authorizes Collector and his Revenue field staff to enter upon and survey
land, take levels of any land, dig or bore into the sub-soil and do all
other acts required for the proper execution of their work as provided
and specified in Section 12 of the Act.
Under Sub-Section (4) of Section 11 of the Act, no person shall
make any encumbrances on such land from the date of publication of
such notification without prior approval of the Collector.
Obections to the acquisition, if any, may be filed by the person
interested within 60 (Sixty days) from the date of publication of this
notification as provided under Section 15 of the Act before Collector.

Advertisement Rate though Hoardings :
The Committee has decided that the rate of advertisement may
be fixed as Rs. 5 per sq. ft. Rs. 3 per sq. ft. (for flexes/banners),
per day for prime locations and Rs. 3 per sq. ft., Rs. 1 per sq. ft.
(for flexes/banners) per day for non-prime locations within the Town.
Proposal for enhancement of Fee with regard to
pilgrimage :
The Committee has decided that the rent from ground and fields
i.e. Permission for holding religious events may be fixed as Rs.700
per day for Municipal Committees.
However for holding events other than religious the rate may
be Rs.1400 per day for Municipal Committees.
Proposal for revision of Fee for permission to install
crackers :
The Committee has decided that the application fee for permis-
sion to install cracker stall may be fixed as Rs. 1000 per stall for
Municipal Committees.
There may be an annual increase of 50% in the above rates
after year of notification.

SO-557.—Whereas, on 10.08.2021, the Police Station, CIK,
Srinagar, received a reliable information that in the year 2019-2020,
Hawala money has been deposited/transferred by two Pakistani Nationals

namely Faizan Ishtiyaq Kharadi and Mohammad Farooq Ab Aziz, into
the account of one Hamaad Farooq S/o Farooq Ahmad Tramboo R/o
Kagazgari Mohalla, Nowshara, Srinagar and the said money has been
withdrawn and passed to kiths and kin of killed/active terrorist(s), Stone
Pelters and secessionists for carrying out the terrorist/unlawful/
secessions activities; and
2. Whereas, based on the above, a Case FIR No. 09/2021 under
Sections 13,17,18,39,40 of ULA (P) Act, was registered in the Police
Station, CIK, Srinagar and the investigation of the case was taken up.
Subsequently, during the investigation, the offences under Section 120-B
IPC and the offences under Sections 20 and 38 of ULA (P) Act were
added in thecase; and
3. Whereas, during the course of investigation, the seizure memos
were prepared and the statements of witnesses acquainted with the facts
and circumstances of the case were recorded under the relevant
provisions of law ;and
4. Whereas, during the investigation, it was found that in the year
2019 and 2020 an amount of Rs. 01 lac was transferred in the account of
accused viz Hamaad Farooq Tramboo, by two persons namely Faizan
Ishtiyaq Kharadi and Mohammad Farooq Ab Aziz, from Muscat, Oman
and
Riyadh
Saudia
Arabia
and
through
LM
Exchange
Muscatrespectively, for further distribution among the terrorist and
families of the killed terrorists, which was withdrawn by the accused for
further distribution amongst the NOK's of deceased/active terrorist(s) and
other similar minded people. Subsequently, the accused viz Hamaad
Farooq Tramboo, has been arrested in the case; and
5. Whereas, during the investigation, it was established that the
accused viz Hamaad Farooq Tramboo, was working as Over Ground
Worker (OGW) for the terrorists and under a well knit criminal

conspiracy after receiving the funds from the accused namely Faizan
Ishtiyaq Kharadi and Mohammad Farooq Ab Aziz, was distributing the
same among the terrorists and familiesof killed terrorists for promoting
terror/unlawful/secessionist activities in the valley; and
6. Whereas, the sanction has already been accorded in respect of
accused viz Hammad Farooq Tramboo S/o Farooq Ahmad Tramboo R/o
Kagazgari Mohalla, Nowshara, Srinagar, vide Notification S.O. No. 353
dated 28th July, 2022, by the Competent Authority and the investigation,
of the case was continued in respect of other accused; and
7. Whereas, during the further investigation, the accused viz Faizan
Ishtiyaq Kharadi S/o Ishtiyaq Ahmad Kharadi R/o Vicharnagh, Soura,
Srinagar, was arrested in the case and during the investigation one more
person namely Danish Ahmad Koul S/o Bashir Ahmad Koul R/o Tibti
Colony, Hawal, Srinagar, was found involved in the commission of
crime. Subsequently, the said accused was also arrested in the case; and
8. Whereas, during the investigation, it was established that the
accused viz Faizan Ishtiyaq Kharadi, Danish Ahmad Koul and Mohd
Farooq Ab. Aziz @FA Dar S/o Unknown R/o Pakistan, under a well knit
criminal conspiracy formed a "Terrorist Gang" to raise/transfer and use
the terror funds for the purpose of terrorism and transferred an amount of
Rs. 01 lac in the account of accused viz Hammad Farooq Tramboo, for
further distribution among the families of killed/active terrorists, besides,
the accused viz Danish Bashir Koul, also transferred an amount of Rs.
50,000/- in the bank account of one person identified as Yasir Ahmad
Kapra R/o Srinagar, which was later on delivered to an unknown terrorist
for carrying out the terrorist activities; and
9. Whereas, part of the investigation, pertaining to Muscat, Saudia
Arabia and Pakistan is underway and the further evidence is being

collected and same will be accordingly presented in the Court of
competent jurisdiction in terms of Section 173(8) Cr.PC; and
10. Whereas, on the basis of investigation, the statement of
witnesses recorded and other evidence collected the Investigating Officer
has established prima facie, involvement of below mentioned accused in
the commission of the offences punishable under sectionof the Unlawful
Activities (Prevention) Act, 1967, as shown against their name:—

12. Whereas, the Authority, appointed by the Government under
Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention)
Act, 1967, has independently examined the Case Diary File and all the
other relevant documents relating to the case and has come to the
conclusion that a prima facie case is made out against the above accused;
and
13. Whereas, after perusing the Case Diary File,the relevant
documents and also taking into consideration the views of the Authority
appointed under Sub-Section (2) of Section 45 of the Unlawful
Activities(Prevention) Act, 1967, the Government is of the view that

there is sufficient material and evidence available against the above-
mentioned accused for his prosecution under the provisions of law.

(2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967,the
Government hereby accord sanction for launching prosecution against
the accused viz.Faizan Ishtiyaq Kharadi, Danish Ahmad Koul and Mohd
Farooq Ab. Aziz @ F A Dar, for the commission of offences punishable
under Sections 13, 17, 18, 20, 38, 39 and 40of ULA (P) Act, arising out
of FIR No.09/2021 of Police Station,CIK, Srinagar.

SO-560.—Whereas, on 29.05.2023,the Police Station, Anantnag,
received a docket to the effect that a reliable information was received
that some unknown terrorists with the help of their OGWs fired

indiscriminately upon a non local labourer namely; Deepk Kumar S/o
Masho Kumar R/o Thial, Udhampur, at Amusement Park, Anantnag,
with their illegal arms/ammunition, with the intention to kill him,
resulting in serious injuries to him. The injured person was shifted to a
local hospital where the doctors declared him brought dead. The
unknown terrorists after the commission of crime escaped from the
spot; and
2. Whereas, based on the above, a Case FIR No. 171/2023 under
Sections 302 IPC, 7/27 Arms Act, and the Sections 16,18,20 and 39 of
ULA (P) Act was registered in the Police Station, Anantnag, and the
investigation, of the case was set into motion. Subsequently, during the
investigation, the offences under Section 23 and 38 of ULA (P) Act were
added in thecase; and
3. Whereas,during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statement of
witnesses acquainted with the facts andcircumstances of the case were
recorded under the relevant provisions of law; and
4. Whereas, during the investigation, six persons identified as Sehran

Umar Amin Thoker S/o Mohd Amin Thoker R/o Waghama, Bijbehara,
Huzaif Shabir Bhat S/o Shabir Ahmad Bhat R/o Doublepora Wachi,
Shopian, Nasir Farooq Shah S/o Farooq Ahmad Shah R/o Wanteng,
Bijbehara and Suvaid Showkat Bhat S/o Showkat Ahmad Bhat R/o
Fatehpora, Anantnag, were found involved in the commission of crime.
Subsequently, the accused were arrested in the case and during the
investigation, 02 Pistols, 02 magazines, 06 rounds, 03 hand grenades, 01
AK-47 rifle, 01 AK magazine and 45 AK rounds were recovered at their
instances respectively; and

5. Whereas, during the investigation, it was found that the accused
viz Sehran Bashir Nadaff, Ubaid Nazir Laigaroo,Umar Amin Thoker,
Huzaif Shabir Bhat, Nasir Farooq Shah and Suvaid Showkat Bhat, were
in contact with a Pakistan based terrorist of JeM banned outfit namely
Khalid Kamran R/o Pakistan, through virtual mode, who provided
arms/ammunition and explosive material to them in order to promote
terrorist activities in the area and on the date of occurrence, the accused
viz Sehran Bashir Nadaff and Ubaid Nazir Laigaroo, on the directions of
the said Pakistan based terrorist fired indiscriminately upon the deceased
and escaped from the spot; and
6. Whereas,during the investigation, it was established that the
accused viz Sehran Bashir Nadaff and Ubaid Nazir Laigaroo, were
members of the JeM banned outfit and the other accused viz Umar Amin
Thoker, Huzaif Shabir Bhat, Nasir Farooq Shah and Suvaid Showkat
Bhat, were working as Over GroundWorkers (OGWs) for the terrorists
particularly the terrorist viz Khalid Kamran, and were providing logistic
support to him and under a well knit criminal conspiracy procured arms/
ammunition and explosive material from the said terrorist for carrying
out the terrorist activities in the area, besides, the accused viz. Sehran
Bashir Nadaff and Ubaid Nazir Laigaroo, fired upon the non local
labourer which resulted death of the deceased person; and
7. Whereas, on the basis of investigation, and other evidence
collected the Investigating Officer has established, prima facie,
involvement of below mentioned accused in the commission of the
offences punishable under Section of the Unlawful Activities
(Prevention) Act, 1967, as shown against their names:-

8. Whereas, during the investigation, the accused viz Huzaif Shabir
Bhat, has been found juvenile and in view of Section 1(4) of the Juvenile
Justice (Care and Protection of Children) Act, 2015, the apprehension,
detention, prosecution, penalty or imprisonment shall be governed by the
said Act; and
9. Whereas, the accused terrorist viz Khalid Kamran, is absconding
and the proceedings under Section 299 Cr.PC have been proposed to be
initiated against him; and
10. Whereas, the Authority, appointed by the Government under
Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention)
Act, 1967, has independently examined the case diary file and all the
other relevant documents relating to the case and has come to the
conclusion that a prima facie case is made out against the above accused;
and
11. Whereas, after perusing the Case Diary File,the relevant
documents and also taking into consideration the views of the Authority
appointed under Sub-Section (2) of Section 45 of the Unlawful
Activities(Prevention) Act, 1967, the Government is of the view that
there is sufficient material and evidence available against the above-
mentioned accused for their prosecution under the provisions of law.

the Police at Sheikhpora, Wathoora crossing and during the checking two
suspects while seeing the Naka Party tried to escape but were chased

down on the spot and identified as Mohd Ishfaq Bhat S/o Mushtaq
Ahmad Bhat R/o Shahpora, Wathoora and Sajad Ahmad Ganie S/o
Farooq Ahmad Ganie R/o Gogo, Humhama. During their personal their
personal search, the Police recovered 08 posters of LeT banned outfit
from their possession respectively; and
2. Whereas, based on the above, a Case FIR No. 79/2023under
Section13of ULA (P) Act, was registered in the Police Station,
Chadoora, and the investigation of the case was set into motion.
Subsequently, during the investigation, the offence under Section 39 of
ULA (P) Act was added in thecase; and
3. Whereas, during theinvestigation, the site plan of the place of
occurrence the seizure memos were prepared and the statement of
witnesses acquainted with the facts and circumstances of the case were
recorded under the relevant provisions of law ;and
4. Whereas, during the investigation, it was established that the
accused viz. Mohd Ishfaq Bhat and Sajad Ahmad Ganie, were working
as Over Ground Workers (OGWs) for the terrorists of LeT banned outfit
and procured incriminatory material from them for carrying out the
unlawful activities in the area; and
5. Whereas, on the basis of investigation, and other evidence
collected the Investigating Officer has established prima facie,
involvement of below mentioned accused in the commission of the
offences punishable under sectionof the Unlawful Activities (Prevention)
Act, 1967, as shown against their name:—

SO-565.—Whereas, on 26.05.2023, a reliable information was
received by the Police Station, Kishtwar, to the effect that one person

identified as Mohd Yousaf Chouhan S/o Mohd Abdullah Chouhan R/o
Shar Cherji, Kishtwar, has been working for the terrorists of HM banned
outfit and procured some Hand grenades from them in order to carry out
terrorist activities in the area ; and
2. Whereas, based on the above, a Case FIR No. 117/2023under
Sections4/5 ESA and the Sections 13,18 and 39of ULA (P) Act, was
registered in the Police Station, Kishtwar and the investigation of the
case was set into motion. Subsequently, during the investigation, the
offences under Sections 20 and 23 of ULA (P) Act was added in thecase;
and
3. Whereas, during theinvestigation, the seizure memos were
prepared and the statements of witnesses acquainted with the facts and
circumstances of the case were recorded under the relevant provisions of
law ;and
4. Whereas, during the investigation, the accused viz. Mohd Yousaf
Chouhan, was arrested in the case and 01 Hand Grenade was recovered
at his instances. The accused was found in contact with a terrorist of HM
banned outfit namely Mohd Amin @ Jahangir S/o Mohd Anwar Butt R/o
Badhat, Saroor, Kishtwar, who provided the recovered Hand Grenade to
him in order to promote terrorist activities in the area; and
5. Whereas, during the investigation, it was established that the
accused viz Mohd Yousaf Chouhan, was working as Over Ground
Worker (OGW) for the terrorists of HM banned outfitparticularly the
terrorist viz. Mohd Amin @ Jahangir, and was providing logistic support
to them besides, under a well knit criminal conspiracy procured a Hand
Grenade from the said terrorist for carrying out the terrorist activities in

Qaimoh, Muhammad Aslam Dar S/o Muhammad Rafiq Dar, Basit
Ahmad Dar S/o Ab. Rashid Dar R's/o Redwani, and Aijaz Ahmad Lone
S/o Muhammad Abdullah Lone R/o Hawoora, with the help of their
OGWs fired indiscriminately upon some non-local labourers at Larm,
Ganjipora, with their illegal arms/ammunition, with the intention to kill
them, resulting in the death of two labourers identified as Youginder
Reshi Dev S/o Mahavir Rashi Dev and Raja Kumar S/o Dayanand Rashi
R's/o Bihar and injuries to one Chunin Reshi S/o Shaju Reshi R/o Bihar.
The terrorists after the commission of crime escaped from the spot; and
2. Whereas,on the above, a Case FIR No.252/2021 under
Sections302, 307 IPC, 7/27 Arms Act and Sections 16, 18, 20, 38 and 39
of ULA (P) Act, was registered in the Police Station, Qazigund, and the
investigation of the case was set into motion. Subsequently, during the
investigation, the offences under Section 39 of ULA (P) Act wasdropped
from thecase ; and
3. Whereas, during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statements of
witnesses acquainted with the facts and circumstances of the case were
recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, the accused viz. Aijaz Ahmad
Lone, was arrested in the case and the accused viz. Hafiz Abdullah
Malik, was also arrested by the Anantnag Police in case FIR No.
103/2021 of Police Station, Srigufwara. Subsequently, his custody was
changed in the instant case; and
5. Whereas,during the investigation, it was established that the
accused viz Hafiz Abdullah Malik, Zubair Ahmad Mir, Muhammad
Aslam Dar, Basit Ahmad Dar and Aijaz Ahmad Lone, were members of
the LeT/HM banned outfits and on the date of occurrence took three non

local labourers from their rented accommodation at Larm, Ganjipora on
the pretext of harvesting paddy in nearby fields and fired
indiscriminately upon them which resulted death of two persons and
injuries to one person; and
6. Whereas,the accused terrorists viz Muhammad Aslam Dar and
Zuair Ahmad Mir, have been killed in different encounters with the
Security Forces and the proceedings under the law would abate against
them; and
7. Whereas, on the basis of investigation, and other evidence
collected the Investigating Officer has established, prima facie,
involvement of below mentioned accused in the commission of the
offences punishable under sections of the Unlawful Activities
(Prevention) Act, 1967, as shown against their names:-

2. Rule 22 (U) shall be substituted by the following ; namely :—
22-U. Financial Assistance for Marriage
(1)
Financial assistance of Rs 50,000/- (rupees fifty thousand)
shall be paid by the Board for the marriage of construction
worker or his/ her dependent real daughters and sons.
However, the assistance will be restricted to two dependents
only .
(2)
The age of the beneficiary should be as per the existing laws
in vogue.
(3)
The registered beneficiary shall have to produce certificate
from Tehsildar concerned certifying that the beneficiary has
not married in life time prior to the date of applying for marriage
assistance.
(4)
Certificate of dependence, to be issued by the competent
revenue authority concerned, shall have to be produced and
appended with the form.
(5)
The beneficiary will submit a certificate to be issued by the
competent authority in the Revenue Department.
(6)
As an additional proof, a muslim beneficiary will submit a

The beneficiary shall, at the time of submission of application
form enclose NOC of Social Welfare Department or the
Board, as a case may be to the effect that ‘‘he/ she has not
availed any financial assistance for marriage either from the
Social Welfare Department or from the Board for the
purpose.’’
(8)
An application for financial assistance for marriage shall have
to be submitted by the applicant along with the prescribed
documents and in the prescribed format, to be devised by the
Board, at least three months in advance from the actual date
of marriage or within two months from the actual date when
the marriage has taken place.
(9)
The officer authorized by the Board, on detection of any fraud
or wrong payment, may start proceedings of the recovery of
the amount paid as if these were arrears of land revenue.

SO-582.—-Whereas, on 15-05-2023, the Police Station, Bijbehara,
received a docket to the effect that a Naka was established by the
Police at Kirkadal, Bijbehara, and during the checking two suspects
while seeing the Naka Party tried to escape but were chased down
on the spot and identified as Muzamil Ahmad Wani S/o Ghulam Nabi
Wani R/o Gadiseer, Bijbehara and Junaid Ahmad Dar S/o Mohammad

Yousuf Dar R/o Hassanpora, Bagh. During their personal search, the
Police recovered 01 Pistol with magazine 08 rounds from their
possession respectively ; and
2. Whereas, based on the above, a Case FIR No.104/2023 under
section 7/25 Arms Act and the Section 13, 20 and 38 of ULA (P)
Act, was registered in the Police Station, Bijbehara, and the investigation,
of the case was set into motion. Subsequently, during the investigation,
the offences under Section 18, 23 and 39 of ULA (P) Act were added
in the case ; and
3. Whereas, during the investigation, the site plan of the place
of occurrence and the seizure memos were prepared and the statement
of witnesses acquainted with the facts and circumstances of the case
were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, two more persons identified
as Shakir Ahmad Sofi S/o Ahmadullah Sofi, and Junaid Ahmad Dar
S/o Abdul Hamid Dar R's/o Subhanpora, Bijbehara, were found involved
in the case. Subsequently, the accused were arrested and during the
investigation, 12 Pistol rounds and 08 AK rounds were recovered at
their instances respectively ; and
5. Whereas, during the investigation, it was found that the accused
viz Muzamil Ahmad Wani, Junaid Ahmad Dar, Shakir Ahmad Sofi and
Junaid Ahmad Dar, were in contact with a terrorist of HM banned
outfit namely Basit Amin Bhat S/o Mohammad Amin Bhat R/o Frisal,
Yaripora, Kulgam, who provided the recovered arms/ammunition to them
in order to promote terrorist activities in the area ; and
6. Whereas, during the investigation, it was established that
the accused viz. Muzamil Ahmad Wani, Junaid Ahmad Dar, Shakir
Ahmad Sofi and Junaid Ahmad Dar, were working as Over Ground
Workers (OGWs) for the terrorists of HM banned outfit
particularly the terrorist viz. Basit Amin Bhat, and were providing logistic
support to him, beside, under a well knit criminal conspiracy procured
arms/ammunition from the said terrorist for carrying out the terrorist
activities in the area ; and
7. Whereas, the accused terrorist viz. Basit Amin Bhat, has been
killed in an encounter with the Security Forces and the proceedings
under the law would abate against him ; and

8. Whereas, on the basis of investigation, and other evidence
collected, the Investigating Officer has established, prima facie,
involvement of below mentioned accused in the commission of the
offences punishable under section of the Unlawful Activities (Prevention)
Act, 1967, as shown against their names :—

9. Whereas, the Authority, appointed by the Government under
Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention)
Act, 1967, has independently examined the Case Diary File and all
the other relevant documents relating to the case and has come to
the conclusion that a prima facie case is made out against the above
accused ; and
10. Whereas, after perusing the Case Diary File, the relevant
documents and also taking into consideration the views of the Authority
appointed under sub-section (2) of Section 45 of the Unlawful Activities
(Prevention) Act, 1967, the Government is of the view that there is
sufficient material and evidence available against the above mentioned
accused for their prosecution under the provisions of law.
Now, therefore, in exercise of the powers conferred by Sub-Section
(2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967,
the Government hereby accord sanction for launching prosecution
against the accused viz Muzamil Ahmad Wani, Junaid Ahmad Oar, Shakir
Ahmad Sofi and Junaid Ahmad Dar, for the commission of offences

missing person had joined the terrorist ranks for carrying out the terrorist
activities in the area ; and

2. Whereas, based on the above, a Case FIR No. 23/2022 under
Sections 18 and 20 of ULA (P) Act, was registered in the Police Station,
Imamsahib, and the investigation, of the case was set into motion.
Subsequently, during the investigation, the offences under Sections 18
and 38 of ULA (P) Act were added in the case ; and
3. Whereas, during the investigation, the site plan of the place
of occurrence and the seizure memos were prepared and the statements
of witnesses acquainted with the facts and circumstances of the case
were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, the accused viz. Adil Ahmad
Dar, was arrested by a Joint team of Police/Security Forces during
a Naka checking at village Mohandpora, Trenz, alongwith arms/
ammunition, for which a separate case FIR No. 47/2022 under
Sections 7/25 Arms Act, Sections 18, 20 and 38 of ULA (P) Act was
registered in the Police Station, Imamsahib. Subsequently, the custody
of the accused was changed in the instant case ; and
5. Whereas, during the investigation, it was found that the accused
viz Adil Ahmad Dar, went missing from his home on 31.05.2022, and
joined the terrorist ranks of LeT banned outfit on the instigation/
motivation of three terrorists namely Shakir Ahmad Waza S/o Gulzar
Ahmad Waza R/o Herapora, Shopian, Danish Khursheed Bhat
S/o Khursheed Ahmad Bhat R/o Ladi, Imamsahib and Towseef Ahmad
Bhat S/o Gh. Nabi Bhat R/o Cheirmarg, Zainapora ; and
6. Whereas, during the investigation, it was established that the
accused viz Adil Ahmad Dar, was member of LeT banned outfit and
under a well knit criminal conspiracy joined the terrorist ranks on the
instigation/motivation of terrorists viz Shakir Ahmad Waza, Danish
Khursheed Bhat and Towseef Ahmad Bhat, for carrying out the terrorist
activities in the area ; and
7. Whereas, the accused terrorists viz Shakir Ahmad Waza, Danish
Khursheed Bhat and Towseef Ahmad Bhat, have been killed in the
different encounters with the Security Forces and the proceedings under
the law would abate against them ; and
8. Whereas, on the basis of investigation, and other evidence

Commissioner Reasi to be the Executive Magistrate, who shall exercise all
the powers of an Executive Magistrate within his territorial jurisdiction of
District Reasi. The Government further in exercise of the powers conferred
as contained in sub-section (2) of section 20 of the said Code appoints the
aforesaid Executive Magistrate as Additional District Magistrate within his
territorial jurisdiction of District Reasi who shall have all the powers of
District Magistrate under the said Code.
