of Maharashtra, AIR ONLINE 2021 SC 125, hereby constitutes a dedicated
Commission to conduct contemporaneous rigorous empirical inquiry into
the nature and implications of the backwardness qua local bodies with
respect to the backward class of citizens in all local bodies within the Union
Territory of Jammu and Kashmir, and to study the nature and effects of
backwardness and to provide its recommendations :—
1. Name, extent and commencement :
1.1
This Commission shall be known as ‘‘Jammu and Kashmir
Local Bodies Dedicated Backward Classes Commission’’
(hereinafter referred to as Commission).
1.2
The term of Commission will be forty-five (45) days from
the date of publication of this Order.
2. Functions of the Commission :
The Commission, after studying on the following subject, shall
submit its suggestions and recommendations to the Government of
Jammu and Kashmir.
2.1
On the reference of the Government, empirical study and
investigation in the context of the representation of
backward classes in all Local Bodies before the upcoming
general elections of the Local Bodies in the Union Territory
and submitting its recommendations to the Government
regarding proportional reservation for backward classes,
Local Body-wise (Urban & Rural).
3. Terms of Reference :
3.1
The Commission shall conduct the contemporaneous rigorous
empirical inquiry into nature and implications of the
backwardness qua local bodies in the Union Territory of
Jammu and Kashmir.
3.2
The Commission shall, on the basis of available records,
reports, surveys, and other data, ascertain the proportion
of population of backward class of citizens in the total
population, local body-wise in order to study in light of
instructions given by Hon’ble Supreme Court and to submit
the report and recommendations to the Government.
3.3
The Commission shall submit its report to the Government
within such period which may be prescribed by the
Government.

3.4
In addition to the above, the Commission shall :—
3.4.1
take the assistance from Central and Union Territory
Government Offices, various organizations, institutions or
individuals for obtaining such information to its satisfaction
as it may consider necessary or relevant for its purpose, in
such form and manner as they may think appropriate ;
3.4.2
avail advices and researchers by holding meetings with them
and also get assistance of recognized research institutions
as and when necessary for analysis of the empirical data
and also for the efficient and effective functioning of the
Commission ; and
3.4.3
arrange visits to various Local Bodies areas in the Union
Territory of Jammu and Kashmir to achieve the above
objectives.
4. Constitution of the Commission :
4.1
The composition of the Commission will be as follows :—
(a)
The Commission shall comprise of three members to
be appointed by the Government, from amongst such
persons who may have the knowledge on the matters
related to backward classes ;
(b)
Amongst the above members, one member shall be the
Retired Judge of Hon'ble High Court, who shall be
Chairman of the Commission.
5. Tenure of the Chairman and Members of the Commission :
5.1
The tenure of the Chairman and Members of the Commission
will be co-terminus with the term of the Commission.
6.
Honorarium and other facilities payable to the Chairman/
Members of the Commission :
The salary and allowances payable to the Chairman and Members
of the Commission and other terms and conditions shall be such
as may be prescribed by the Guvernment.
7. Appointments in the Commission :

The services on the post of Secretary, Deputy Secretary,
Research Officer, Review Officer, Office Assistants and

other employees may be taken on deputation from other
departments or may be made available by the Administrative
Department. Wherever necessary services of retired officers
and employees can be availed by appointment on contract as
per the instructions of the Government.
7.2
Salaries, allowances payable and other service conditions of
the officers/employees of the Commission shall be as per
their parent department.
7.3
The Commission may take the services of experts as per the
requirement for the discharge of its work and responsibilities.
8.
Meetings of the Commission :
The headquarters of the Commission will be in Srinagar/
Jammu. The Commission shall hold meetings at such places,
time and periods as the Chairman may deem fit.
9. Accounts and Audit :
9.1
The Commission shall maintain proper accounts and other
relevant records and prepare statement of accounts in such
form and manner as may be prescribed by the Government
for this purpose.
9.2
The accounts of the Commission shall be audited by
Directorate of Audit & Inspections at such intervals as may
be prescribed.
10. Reports/Recommendations :
Reports/Recommendations of the Commission shall be presented
to the Government by the Commission in relation to its objective
and work. It will contain complete details of its activities,
recommendations and works.
11. Administrative Arrangement and Budget :
The administrative arrangements and budget to
the Commission shall be provided by the Administrative
Department.

12. Chairperson, members andemployees of the Commission
to be public servants :
The Chairperson members and employees of the Commission
shall be deemed to be public servants under section 21 of the
Indian Penal Code, 1860.
13. Administrative Department :
Rural Development Department shall be Administrative
Department for the Commission.
14. Amendments/Additions :
The Government may make any amendments, changes or
extension in this order from time to time.

Whereas, it appears to the appropriate Government that a total
of 78Kls–½Mls land in the Village Demote Tehsil Ramban District
Ramban is required for public purpose namely, Kunda (Kanthi) to Bhata
via Shaldan Road Under NABARD RDIF-XXI.
Whereas, on the basis of indent placed by Chief Engineer
PW(R&B) Department Chenab Zone Batote vide No. CEC/2395-97
dated 06-01-2024, the Collector Land Acquisition (ACR), Ramban
constituted a committee vide No. Acq/Gen/Rbn/23/199-208 dated
12-09-2023 as per Rule 4 of the Rules notified vide SO-440 of 2023
to conduct preliminary enquiry in the said land acquisition case.
Whereas, the committee submitted its report duly endorsed by
Tehsildar Ramban vide his No. TR/OQ/2023-24/Misc/1960 dated
02-11-2023 wherein it has been reported that the said road already
stands constructed upto Shaldan and alternate State/ Government land
cannot be proposed for the road in question. Further, there is no
involuntary displacement involved in the acquisition of said land and
accordingly, no rehabilitation is required. The construction of land has
no economic as well as social adverse on the local inhabitants. Land
owners have no objection on the said acquisition and consent as required
under Sub-Rule (2) of Rule 17 and Sub-Rule (1) of Rule 20 on Form-V
(Part-A) (Prior Written Consent of the Affected Land Owners or
Declaration Form) has been obtained from them, Resolution of Gram
Sabha as per Sub-Rule (7) of Rule 21 on Form-V (Part-B) has also
been obtained.
Whereas, the Collector Land Acquisition (ACR) Ramban issued
a preliminary notification for the said land vide No. Acq/Gen/24/Rbn/
469-480 dated 15-02-2024 for calling upon the objections from the
interested persons ; and
Whereas, no objections were received within stipulated time,
However, one interested person has submitted a written objection after
expiry of stipulated time which after due examination found meritless
and rejected ;
Whereas, the Government is satisfied after considering the report
made by the Collector that the land particulars which are given below
is required for public purposes ;

SO–570.—Whereas, on 28-07-2023, a reliable information was
received by the Police Station, Ganderbal, to the effect that one person
identified as Amir Muzafar Sofi S/o Mohd Muzafar Sofi R/o
Duderhama, Ganderbal, has defaced the National Flag and hidden the
same in his residential house ; and
2. Whereas, based on the above, a Case FIR No. 219/2023
under section 2 Prevention of Insults to National Honour (PINH) Act,
1971, was registered in the Police Station, Ganderbal, and the
investigation, of the case was set into motion. Subsequently, during the

ULA (P) Act were added in the case ; and
3. Whereas, during the investigation, the site plan of place of
occurrence and seizure memos were prepared and the statements of
witnesses acquainted with the facts and circumstances of the case were
recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, the accused viz. Amir
Muzafar Sofi, was arrested in the case and 02 defaced/mutilated
National Flags alongwith some incrimnatory material were recovered
at his instances ; and
5. Whereas, during the investigation, two more persons identified
as Irfan Ahmad Sofi S/o Mohd Muzafar Sofi R/o Duderhama, Ganderbal
and Shabir Ahmad Bhat S/o Noor Din Bhat R/o Tehlipora, Harran, were
found involved in the case who are presently on anticipatory bail
and charge sheet against them would be filed in the Court of competent
jurisdiction for the commission of offence punishable under Section
256 IPC ; and
6. Whereas, the investigation, it was established that the accused
viz. Amir Muzafar Sofi, defaced and mutilated the National Flag, thereby
intended to commission of unlawful activities with the intention to cause
disaffection against the Union of India ; and
7. Whereas, on the basis of the investigation, the statement of
witnesses recorded and other evidence collected, the Investigating
Officer, has established prima facie involvement of the below
mentioned accused in the commission of the offences punishable under
Section of the Unlawful Activities (Prevention) Act, 1967, as shown

received a docket to the effect that a Joint Naka was established by
the Police/Security Forces at Sharanz Crossing, Nagbal, and during
the checking a suspect while seeing the Naka Party tried to escape but
was chased down on the spot and identified as Mohd Ashraf Mir
S/o Mohd Shafi Mir R/o Laridora, Lalpora, Chandoosa. During his
personal search, the Police recovered 01 hand grenade from his
possession ; and

2. Whereas, based on the above, a Case FIR No. 23/2023
under section 7/25 Arms Act, and the Sections 13, 23 and 39 of ULA(P)
Act was registered in the Police Station, Chandoosa, and the
investigation, of the case was set into motion ; and
3. Whereas, during the investigation, the site plan of place of
occurrence and seizure memos were prepared and the statements of
witnesses acquainted with the facts and circumstances of the case were
recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, it was found that the
accused viz. Mohd Ashraf Mir, was working for the unknown terrorists
of LeT banned outfit who provided the recovered hand grenade to him
in order to promote terrorist activities in the area ; and
5. Whereas, during the investigation, it was established that the
accused viz. Mohd Ashraf Mir, was working as Over Ground Worker
(OGW) for the terrorists of LeT banned outfit and was providing logistic
support to them, besides, procured a hand grenade from the unknown
terrorists for carrying out the terrorist activities in the area ; and
6. Whereas, the investigation, in respect of unknown terrorist(s)
who provided a hand grenade to the accused viz. Mohd Ashraf Mir, shall
continue to ascertain their identity and to bring out their role/involvement
in the case and the supplementary charge sheet against them would be
filed in the Court of competent jurisdiction ; and
7. Whereas, on the basis of the investigation, and other evidence
collected the Investigating Officer has established, a prima facie
involvement of below mentioned accused in the commission of

during the investigation, the offence under Section 212 RPC and
the Sections, 18, 19, and 39 of ULA(P) Act were dropped in the
case ; and
3. Whereas, during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statement
of witnesses acquainted with the facts and circumstances of the case
were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, role of three persons
identified as Javaid Ahmad Shan S/o Gh. Mohi-ud-Din Shan R/o
Sudsunoo, Qaisar Ahmad Lone S/o Fayaz Ahmad Lone R/o Budroo and
Rouf Bashir Allaie S/o Bashir Ahmad Allaie R/o Batapora, Hangalbush,
came to fore in the commission of crime. Subsequently, the accused
were arrested in the case ; and
5. Whereas, during the investigation, it was established that on the
date of occurrence, the accused viz. Javaid Ahmad Shan, Qaisar Ahmad
Lone and Rouf Bashir Allaie raised anti-national slogans and instigated
the general public against the sovereignty and the territorial integrity of
the Union of India besides, the accused terrorist viz. Farooq Ahmad
Bhat @ Nali, Hilal Ahmad Wani, Ishfaq Ahmad Itoo and Faisal Rashid
Rather, fired some gun shots in order to create terror among the general
public : and
6. Whereas, the accused terrorists viz. Hilal Ahmad Wani, Ishfaq
Ahad Itoo and Faisal Rashid Rather, have been killed in the different
encounters with the Security Forces and the proceedings under the law
would abate against them ; and
7. Whereas, on the basis of the investigation, the statements of

Subsequently, during the investigation, the offence under Sections 19
of ULA (P) Act, was dropped and the offences under Sections 18, 18-B
and 38 of ULA (P) Act, were added in the Case ; and
3. Whereas, during the investgation, the site plan of the place of
occurrence and the seizure memos were prepared and the statements
of witnesses acquainted with the facts and circumstances of the case
were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, it was established that the
accused viz. Mushtaq Ahmad Itoo and Waqar Farooq Itoo, went missing
from their residential houses on the different dates and under a well
knit criminal consparacy joined the terrorist ranks of HM banned outfit
on the instigation/motivation of accused terrorist viz. Sheeraz Ahmad
Lone @ Molvi, for carrying out the terrorist activities in the area ; and
5. Whereas, the accused terrorists viz. Waqar Farooq Itoo and
Sheeraz Ahmad Lone @ Molvi, have been killed in the different
encounters with rhe Secuirty Forces and the procedings under the law
would abate against them ; and
6. Whereas, on the basis of the investigation, the statements of

Jammu, the 6th November, 2023.
SO–576.—Whereas, the use of Aadhaar as an identity document
for delivery of services or benefits or subsidies simplifies the
Government delivery processes, brings in transparency and efficiency,
and enables beneficiaries to get their entitlements directly in a
convenient and seamless manner by obviating the need to produce
multiple documents to prove one’s identity ; and

Whereas, the J&K Building and other Construction Workers
Welfare Board is administering the Welfare Schemes to provide
financial assistance, which is being implemented through Labour
Department, J&K at the UT level ; and
Whereas, under the Scheme, education assistance, marriage
assistance, death cum-funeral assistance, medical assistance (for
injury/temporary disability/permanent disability/chronic disease/maternity)
is given to the registered building and other construction workers by
the Implementing Agency as per the extant Scheme guidelines ; and
Whereas, the aforesaid Scheme involves recurring expenditure
incurred from the Cess Fund collected from Building and other
Constructions.
Now, therefore, in pursuance of Section 7 of Aadhaar (Targeted
Delivery of Financial and Other Subsidies, Benefits and Services) Act,
2016 (18 of 2016) (hereinafter referred to as the said Act) read with
Section 142 of the Code on Social Security 2020, the Government of
Jammu and Kashmir hereby notifies the following, namely :—
1.
(1) An individual eligible for receiving the benefits under the
scheme shall hereby be required to furnish proof of possession
of the Aadhaar Number or undergo Aadhaar authentication.
(2) Any individual desirous of availing benefits under the
Scheme, who does not possess the Aadhaar Number or, has
not yet enrolled for Aadhaar, shall be required to make
application for Aadhaar enrollment before registering for the
Scheme provided that he is entitled to obtain Aadhaar as per
Section 3 of the Said Act, and such individuals shall visit any
Aadhaar enrollment centre (list available at the Unique
Identification Authority of India (UIDAI) websitewww.uidai.
gov.in) to get enrolled for Aadhaar.
(3) As per Regulation 12 of the Aadhaar (Enrolment and
Update) Regulations, 2016, the Department through its
Implementing Agency, is required to offer Aadhaar enrollment
facilities for the beneficiaries who are not yet enrolled for
Aadhaar and in case there is no Aadhaar enrollment centre
located in the respective Block or Tehsil, the Department
through its implementing Agency shall provide Aadhaar
enrollment facilities at convenient locations In coordination
with the existing Registrars of UIDAI or by becoming a
UIDAI Registrar themselves :

Provided that till such time Aadhaar is assigned to the individual
benefits under the scheme shall be given to such individual, subject to
the production of the following documents, namely :—
(a) if he/she has enrolled, his/her Aadhaar Enrollment Identification
slip ; and
(b) any one of the following documents, namely :—
(i)
Bank or Post Office Passbook with photo ; or
(ii)
Permanent Account Number (PAN) Card ; or
(iii)
Passport ; or
(iv) Ration Card ; or
(v)
Voter Identity Card ; or
(vi) MGNREGA Card ; or
(vii) Kissan Photo Passbook ; or
(viii) Driving license issued by the Licensing Authority under the
Motor Vehicles Act, 1988 (59 of 1988) ; or
(ix) Certificate of identity having photo of such person issued
by a Gazetted Officer or a Tehsildar on an official letter
head ; or
(x)
any other documents as specified by the Department.
Provided further that the above documents may be
checked by an officer specifically designated by the
Department for that purpose.
2. In order to provide benefits to the beneficiaries under the
Scheme and to the maximum number of them, the Department through
its Implementing Agency shall ensure wide publicity of the same through
the media to make them aware of the said requirement.
3. In all cases, where Aadhaar authentication fails due to poor bio-
metrics of the Beneficiaries or due to any other reason, the following
remedial mechanisms shall be adopted namely :—
(a)
In case of poor fingerprint quality, iris scan or face
authentication facility shall be adopted for authentication,
thereby the department through its Implementing Agency
shall make provisions for iris scanners or face authentication
along with finger-print authentication for delivery of
benefits in seamless manner ;

(b)
In case the bio metric authentication through finger prints
or iris scan or face authentication is not successful,
wherever feasible and admissible authentication by Aadhaar
one Time Password or Time-based One-Time Password
(OTP) with limited time validity, as the case may be shall
be offered ;
(c)
In all other cases where bio metric or Aadhaar One Time
Pa ssword or Time-b ased One-Time Pa ssword
authentication is not possible, benefits under the Scheme
may be given on the basis of physical Aadhaar letter
whose authenticity can be verified through the Quick
Response (QR) code printed on the Aadhaar letter and the
necessary arrangement of QR code reader shall be
provided at the convenient locations by the Department
through its Implementing Agency.
4. The exceptional cases of authentication not covered in Rule 1
and 2 hereinabove, shall be disposed by following mechanism in
conformity with the Act and regulations issued thereunder.

Section 11, Sub-Section (5) of Section 15, Sub-Section (1) of Section 16
and Section 148 of the Jammu and Kashmir Goods and Services Tax Act,
2017 (Act No. V of 2017), the Government, on being satisfied that it is
necessary in the public interest so to do, on the recommendations of the
Council, hereby makes the following further amendments in the notification
of the Government of Jammu and Kashmir, Finance Department SRO-
GST11/2017, dated the 08th July, 2017, namely :—
In the said notification,—
(A) in the Table,
(i) against serial number 8, in column (3), in item (vi), after the
condition in column (5) against the rate of 2.5 percent, the
following condition shall be inserted, namely :—
‘‘Provided further that where the supplier of input service in
the same line of business charges State tax at a rate higher
than 2.5%, credit of input tax charged on the input service in
the same line of business in excess of the tax paid or payable
at the rate of 2.5%, shall not be taken.
Illustration :— ‘A’ engages ‘B’ for transport from New Delhi to Jaipur in a
motor cab for Rs. l000. ‘B’, for supplying the said service,
hires a motor cab with operator from ‘C’ for Rs. 800. 'C'
charges ‘B’ State tax at the rate of 6% (Rs.48). If ‘B’
charges 'A' State tax at the rate of 2.5%, he shall be entitled
to take input tax credit on the input service in the same line
of business supplied by 'C' only to the extent of Rs.20 (2.5%
of Rs.800) and not Rs.48.’’;
(ii) against serial number 10, in column (3), in item (i), after the
condition in column (5) against the rate of 2.5 percent, the
following condition shall be inserted, namely:—
‘‘Provided further that where the supplier of input service in
the same line of business charges State tax at a rate higher
than 2.5%, credit of input tax charged on the input service in
the same line of business in excess of the tax paid or payable
at the rate of 2.5%, shall not be taken.

and not Rs.48.’’;
(iii) against serial number 34,—
(a) in column (3), in item [iv], for the words ‘‘totalisator or a license
to’’, the words ‘‘licensing a’] shall be substituted ;
(b) in column (3), item (v) and the entries relating thereto shall be
omitted;
(B) in the Annexure: Scheme of Classification of Services, -
(i) serial number 696 and the entries relating thereto shall be omitted;
(ii) serial number 698 and the entries relating thereto shall be omitted.
2. This notification shall deemed to have come into force with effect
from the 20th day of October, 2023.

Government of Jammu and Kashmir, Finance Department, SRO-GST 15/
2017, dated the 08th July, 2017, namely :—
In the said notification, in opening paragraph, for the words, brackets,
letters and figures ‘‘specified in sub-item- (b) of item 5 of Schedule II of
the Jammu and Kashmir Goods and Services Tax Act’’, the words, ‘‘of
construction of a complex, building or a part thereof, intended for sale to a
buyer, wholly or partly, where the amount charged from the recipient of
service includes the value of land or undivided share of land, as the case
may be, except where the entire consideration has been received after
issuance of completion certificate, where required, by the competent authority
or after its first occupation, whichever is earlier’’, shall be substituted.
2. This notification shall deemed to have come into force with effect
from the 20th October, 2023.

SO-51.—In exercise of the powers conferred by Sub-Section (5)
of Section 9 of The Jammu and Kashmir Goods and Services Tax Act,
2017 (Act No. V of 2017), the Government on the recommendations
of the Council, hereby makes the following further amendments in the
notification of the Government of Jammu and Kashmir, Finance

In the said notification,
i.
in clause (i), for the words ‘‘omnibus or any other motor
vehicle’’ the words ‘‘or any other motor vehicle except
omnibus’’ shall be substituted ;
ii.
after clause (i), the following clause shall be inserted,
namely :—
‘‘(ia) services by way of transportation of passengers by an
omnibus except where the person supplying such service
through electronic commerce operator is a company.’’ ;
iii.
in the Explanation, after item (c), the following item shall be
inserted, namely,—
‘‘(d) ‘‘Company’’ has the same meaning as assigned to it in
clause (20) of section 2 of the Companies Act, 2013 (18 of
2013)’’.
2. This notification shall deemed to have come into force with
effect from the 20th day of October, 2023.

2017 (Act No. V of 2017), the Government on the recommendations
of the Council, hereby makes the following further amendments in the
notification of the Government of Jammu and Kashmir, Finance
Department, SRO-GST 13/2017, dated the 08th July, 2017, namely :—
In the said notification, in the Table,–
i.
against serial number 5, in column (2), in item (2), in sub-item
(i), after the words ‘‘Department of Posts’’, the words and
brackets’’ and the Ministry of Railways (Indian Railways)’’
shall be inserted ;
ii.
against serial number 5A, in column (2), after the words

SO–54.—Whereas, on 09/10-08-2023, the Police Station, Kokernag,
received a docket to the effect that a reliable information was received
about the hiding of a terrorist namely Uzair Ahmad Khan, in Village
Loher Senzi, Gadoole. Subsequently, a Joint Cordon and Search
Operation was launched by the Police/Security Forces in the Village and
during the search, the terrorist hiding in the residential house of one

Rayaz Ahmad Bhat S/o Gh. Nabi Bhat R/o Loher Senzi, Gadoole, hurled
a grenade upon the Search Party, with the intention to kill them, resulting
in injuries to some Army personnel and two civilians. The terrorist after
the commission of the crime managed his escape from the spot ; and
2. Whereas, based on the above a case FIR No. 109/2023 under
Sections 307 IPC, 3/4 ESA Act, and the Sections 16, 18, 19, 20, 23,
38 and 39 of ULA(P) Act, was registered in the Police Station,
Kokernag, and the investigation, of case was set into motion. Subsequently,
during the investigation, the offences under Section 7/25 Arms Act, was
added in the case ; and
3. Whereas, during the course of investigation, the site plan of the
place of occurrence and the seizure memos were prepared and the
statements of witnesses acquainted with the facts and circumstances
of the case were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, the accused house owner,
viz. Reyaz Ahmad Bhat, was arrested in the case and during the
investigation, four more persons identified as Ishfaq Ahmad Rather S/o
Mohd Iqbal Rather R/o Rather Pora Gadoole, Mudasir Ahmad Bhat S/o
Gh. Nabi Bhat R/o Bhatpora Gadoole, Mohd Ubaid Dar S/o Ab. Rashid
Dar R/o Darpora, Gadoole and Basit Ahmad Rather S/o Gh. Hassan
Rather R/o Ratherpora, Gadoole, were found involved in the case.
Subsequently, the accused were also arrested and during the investi-
gation, 40 AK-47 Ronds were recovered at their instance ; and
5. Whereas, during the investigation, it was found that the accused
viz. Reyaz Ahmad Bhat, Ishfaq Ahmad Rather, Mudasir Ahmad Bhat,
Mohd Ubaid Dar and Basit Ahmad Rather, were in contact with the
terrorist viz.Uzair Ahmad Khan, who provided the recovered ammuni-
tion to them in order to promote terrorist activities in the area ; and
6. Whereas, during the investigation, it was established that the
accused viz. Revaz Ahmad Bhat Ishfaq Ahmad Rather, Mudasir Ahmad
Bhat, Mohd Ubaid Dar and Basit Ahmad Rather were working as Over
Ground Workers (OGWs) for the terrorists of LeT a banned outfit
particularly the terrorist viz. Uzair Ahmad Khan, and were providing
logistic support to him, besides under a well knit criminal conspiracy
procured ammunition from the said terrorist and on date of occurrence
the accused viz. Reyaz Ahmad Bhat, voluntarily harboured the said
terrorist in his residential house for carrying out the terrorist activities
in the area ; and

7. Whereas, the accused terrorist viz. Uzair Ahmd Khan, has been
killed in an encounter with the secuirty Forces and the proceedings
under the law Would abate against him ; and
8. Whereas, on the basis of the investigation, the statements of
witnesses recorded and other evidence collected, the Investigating
Officer, has established a prima facie involvement of the below
mentioned accused for the commission of offences punishable under
Sections of the Unlawful Activities (Prevention) Act, 1967, as shown

Mudasir Ahmad Bhat, Mohd Ubaid Dar and Basit Ahmad Rather, for
the commission of offences punishable under the relevant Sections
of ULA(P) Act, as indicated against the each accused at Para (8)

of banned HM/Let outfits, on the social media, intimate general public
not to participate in upcoming election ; and

2. Whereas, based on the above a case FIR No. 45/2018 under
Sections 506 171(F0 RPC and the Section 13 of ULA(P) Act, was
registered in the Police Station, Larnoo, and the investigation, of the
case was set into motion. Subsequently, during the investigation, the
offences under Section 39 of ULA (P) Act, was added in the case ; and
3. Whereas, during the course of investigation, the seizure memos
were prepared and the statements of witness acquainted with the
facts and circumstances of the case were recorded under the relevant
provisions of law ; and
4. Whereas, during the investigation, the accused viz. Jahangir
Ahmad Bhat, was arrested in the case and was found working for the
terrorists in order to promote terrorist activities in the area ; and
5. Whereas, during the investigation, it was established that the
accused viz. Jahangir Ahmad Bhat, was working as Over Ground
Worker (OGW) for the terrorists of Let/HM, banned outfits, and on
the date of occurrence uploaded the Panchayat election boycot posters,
incite the commission of unlawful activities intend to disrput the
sovereignty and territorial integrity of India ; and
6. Whereas, on the basis of the investigation, the statements of
witnesses recorded and other evidence collected, the Investigating
Officer, has established a prima facie involvement of the below

activities in the area ; and

Sections 13, 18-B, 20 and 38 of ULA(P) Act, was registered in the
Police Station, Qaimoh, and the investigation, of case was set into
motion ; and
3. Whereas, during the course of investigation, the site plan of the
place of occurrence and the seizure memos were prepared and the
statements of witnesses acquainted with the facts and circumstances
of the case were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, it was found that the
accused viz. Yawar Bashir Dar, was in contact with a terrorist of HM,
a banned outfit, namely, Muhammad Abass Sheikh S/o Ghulam Hassan
Sheikh R/o Rampora, Qaimoh, who motivated the accused viz. Yawar
Bashir Dar, to join the terrorist ranks in order to promote terrorist
activities in the area ; and
5. Whereas, during the investigation, it was found that the accused
viz. Yawar Bashir Dar, left his home on 24-05-2021, and later on joined
the terrorist ranks of HM, a banned outfit, on the instigation/motivation
of accused terrorist viz. Muhammad Abass Sheikh, for carrying out the
terrorist/unlawful activities ; and
6. Whereas, the accused terrorist viz. Muhammad Abass Sheikh,
has been killed in an encounter with the Security Forces and the
proceedings under the law would abate against him ; and
7. Whereas, on the basis of the investigation, the statements of
witnesses recorded and other evidence collected, the Investigating
Officer, has established a prima facie involvement of the below
mentioned accused for the commission of offences punishable under

TRF banned outfit, namely, Basit Amin Bhat S/o Muhammad Amin Bhat
R/o Palpora, Frisal, who motivated the accused viz. Irfan Yaqoob Lone,
to join the terrorist ranks in order to promote terrorist activities in the
area ; and
5. Whereas, during the investigation, it was established that the
accused viz. Irfan Yaqoob Lone, left his home on 27-06-2022, and later
on joined the terrorist ranks of LeT/TRF banned outfit, on the instigation/
motivation of accused terrorist viz. Basit Amin Bhat, for carrying out
the terrorist/unlawful activities in the area ; and
6. Whereas, the accused terrorist viz. Basit Amin Bhat, has been
killed in an encounter with the Security Forces and the proceedings
under the law would abate against him ; and
7. Whereas, on the basis of the investigation, the statements of
witnesses recorded and other evidence collected, the Investigating
Officer, has established a prima facie involvement of the below
