the average Consumer Price Index for Industrial workers reaching
402.09 from 399.70 as on 30-06-2024 (Base 2016=100) and thereby

The VDA has been rounded off to the next higher rupee as per the
decision of the Minimum Wages Advisory Board.
The classification of workers under different categories will
be same as in Part-I of the notification, whereas classification of cities will
be same as in the Part-II of the notification dated 19th January, 2017.

The VDA has been rounded off to the next higher rupee as per the
decision of the Minimum Wages Advisory Board.
The classification of workers under different categories
will be same as in Part-I of the notification, whereas classification of cities
will be same as in the Part-II of the notification dated 19th January, 2017.
The present classification of cities into areas A, B & C is enclosed at
Annexure I for ready reference.

In exercise of the powers conferred by Central Government
vide Notification No. S.O. 189(E) dated 19th January, 2017 of
the Ministry of Labour and Employment the undersigned hereby
revise the rates of Variable Dearness Allowance on the basis of the
average Consumer Price Index for Industrial workers reaching
402.09 from 399.70 as on 30-06-2024 (Base 2016=100) and thereby
resulting in an increase of 2.40 points. The revised Variable Dearness
Allowance as under shall be payable from 01-10-2024 :—

Whereas, it appears to the Government that a total of 13K-02M
land is required in the Village Neera Tehsil and District Ramban for
public purpose, namely for the ‘‘Construction of road from Ramban

to Adwah via Sahrgali’’ in Village Neera Tehsil and District
Ramban.
Whereas, Chief Engineer PW (R&B) Department, Chenab Zone
Batote vide No. CECV/1294-96 dated 09-05-2024 placed an indent for
the acquisition of private land/Shamlath Land measuring 13Kls-02Mls
situated in Village Neera Tehsil and District Ramban for the purpose
of ‘‘Construction of road from Ramban to Adwah via Sahrgali’’ in
Village Neera Tehsil and District Ramban.
Whereas, Tehsildar Ramban prepared the revenue papers of land
measuring 13Kl-02Mls in consultation with the Indenting Department
and submitted the same to this office vide his No. TR/OQ/2024-25/
Acq/809 dated 03-10-2023 and the same were authenticated by the
Indenting Department in token of its correctness.
Whereas, the Government of Jammu and Kashmir, Revenue
Department Civil Secretariat, notified the final draft rules i.e. ‘‘The
Jammu and Kashmir Right to Fair Compensation and Transparency in
Land Acquisition, Rehabilitation and Resettlement (Social Impact
Assessment and Consent) Rules 2023 vide S.O-440 dated 24th of
August, 2023.
Whereas, this Collectorate constituted a committee vide No. Acq/
Gen/Rbn/24/54-63 dated 16-05-2024 as per Rule 4 of the Rules notified
vide S.O.-440 of 2023 to conduct preliminary enquiry in the said land
acquisition case with the directions to submit its report within 15 days.
Whereas, the committee submitted its report duly endorsed
by Tehsildar Ramban vide his No. TR/OQ/2024-25/Acq/808 dated
03-10-2024 perusal of which reveals that the said road already stands
completed upto BT Status for a length of 1Km in all respects and scheme
stands physically closed as well as financially, no structure has been
affected during the construction of said road. Further, there is no
involuntary displacement involved in the acquisition of said land and
accordingly, no rehabilitation is required. The construction of road has
no economic as well as social adverse impact on the local inhabitants.
Land owners have no objection on the said acquisition and consent as
required under Sub-Rule (2) of Rule 17 and Sub-Rule (1) of Rule 20

on Form-V (Part-A) (Prior Written Consent of the Affected Land
Owners or Declaration Form) has been obtained from them, resolution
of gram Sabha duly attested by Block Development Officer, Ramban
as per Sub-Rule (7) of Rule 21 on Form-V (Part B) has also been
obtained.
Whereas keeping in view the findings and recommendations of
the committee constituted by this Collectorate written consent submitted
by the land owners concerned as required under Sub-rule (2) of Rule
17 and Sub-Rule (1) of Rule 20 on Form-V (Part-A) (Prior Written
Consent of the Affected Land Owners or declaration Form), resolution
submitted by Gram Sabha as per Sub-Rule (7) of Rule 21 on Form-
V (Part-B) duly attested by the Block Development Officer, Ramban
and no family/families are likely to be displaced due to the instant land
acquisition case, this Collectorate has decided to consider the report
of the committee as Social Impact Assessment Report as required under
Sections 4, 5, 6, 7, and 8 of ‘‘The Jammu and Kashmir Right to Fair
Compensation and Transparency in Land Acquisition Rehabilitation and
Resettlement Act, 2013 and Rules 9, 13, 14, 15, 16, and 17 of ‘‘The
Jammu and Kashmir Right to Fair Compensation and Transparency in
Land Acquisition, Rehabilitation and Resettlement (Social Impact
Assessment and Consent) Rules, 2023’’.
Whereas, in exercise of the powers vested in me under Section
11(1) of the Right to Fair Compensation and Transparency in Land
Acquistion, Rehabilitation and Resettlement Act, 2013, I Mr. Harpal

This notification is made under the provisions of Section 11(1) of
the Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement Act, 2013 (30 of 2013), to all whom
it, may concern.
A plan of the land may be inspected in the office of the Collector
on 6th of November, 2024 at 2.00 PM sharp.
The Government is pleased to authorize, Tehsildar Ramban, other
field staff along with Indenting Department to enter upon and survey
land, take levels of any land, dig or bore into the sub-soil and do all
other acts required for the proper execution of their work as provided
and specified in Section 12 of the said Act.
Under Section 11(4) of the Act, no person shall make any
transaction or cause any transaction of land i.e., sale/purchase, etc.,
or create any encumbrances on such land from the date of publication
of such notification without prior approval of the Collector.
Objection to the acquisition, if any, may be filed by the person
interested within 30 (thirty days) from the date of publication of this
notification as provided under Section 15 of the Act before this
Collectorate.

Order
1.
Vide order dated 31-01-2024 proclamation was issued against
accused persons requiring them to appear before the Court within
30 days from the date of publication of the proclamation. The
Sr. SP Jammu was directed to publish the proclamation in the
daily newspaper(s) having wide circulation in the locality where
the accused persons are ordinarily residing. He was also directed
to affix the proclamation on some conspicuous part of the houses
of the accused persons in which they ordinarily reside or some
conspicuous place or such town or village as also shall be affixed
outside the Court house.

Today when the application was taken up. The I/O of the case
has already submitted the execution compliance report with
respect to proclamation notices isssued in terms of Sections 82
of Cr. PC. The report is supported by the copies of the local Daily
newspapers in which the same was published and the report of
the tamilis of the concerned police stations who have affixed the
notice in the house, village or town of the accused where they
ordinarily reside.

I have perused the compliance report and its supporting
documents and they reveal that the proclamation was published
in the daily Newspapers ‘‘Rising Kashmir’’ dated 13-02-2024,
and ‘‘Daily Roshni Srinagar’’ dated 13-02-2024 in their editions
mentioned above. Perusal of the reports of Tamilis of the
concerned police stations also reveal that proclamation notices
were affixed in the house, village or town of the accused where
they ordinary reside. The proclamation notice was also affixed
outside the Court Complex. Beside this the statements of the
Nambardar of halqa Panchayat (Gunthal) Musrat Iqbal Khan and
Chowkidar, Nasar Ahmad Khan of Naka Manjhari and Sh.
Amarnath Agre, Dy. SP, NIA/JMU, CIO of the case were
recorded who have unanimously stated that the accused Rahil
@ Rafiq Nai @ Sultan and Zafar Iqbal @ Shamsheer are
absconding and have been residing in Pakistan.

In view of what has been discussed hereinabove and the material
placed on record, it is apparent that the accused have neither
turned up to appear before the Court nor their arrest could be
affected within stipulated period of 30 days in light of the order
dated 31-01-2024. As such the accused above said are declared

as proclaimed offenders and the warrants of arrest are issued
against the above named accused which shall remain in vogue
till the arrest of accused and subsequent production before the
Court of law.
5.

SO-233.—Whereas, on 02-06-2022, a reliable information was
received by the Police Station, Kulgam, to the effect that some unknown
terrorists entered in ElaquaiDehati Bank, Arreh, Kulgam, and fired

indiscriminately upon Manager of the Bank namely; Vijay Kumar S/o
Om Prakash R/o Bagwa, Rajasthan, with their illegal arms/ammunition,
with the intention to kill him, resulting in serious injuries to the Manager,
who was shifted to hospital for treatment, where, he succumbed to his
injuries. The unknown terrorists after the commission of crime escaped
from the spot; and
2. Whereas, based on the above, a case FIR No.65/2022under
Sections452, 302 IPC, 7/27 Arms Act, and Sections16, 18, 24 and 38 of
ULA (P) Act, was registered in the Police Station, Kulgam, and the
investigations, of the case was set into motion. Subsequently, during the
investigation, the offence under Section 24 of ULA (P) Act was dropped
and Section 20 of ULA (P) Act was added in the case ; and
3. Whereas, during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statements of
witnesses acquainted with the facts and circumstances of the case were
recorded under the relevant provisions of law ;and
4. Whereas, during the investigation, four terrorists of LeT, a banned
outfit, identified as Jan Mohammad Lone S/o Ab. Rashid Lone R/o
Braripora, Shopian; Bilal Ahmad Bhat S/o Gh. Rasool Bhat; Sameer
Ahmad Sheikh @ Kamran Bhat S/o Farooq Ahmad Sheikh residents of
Chaki Cholend, Shopian and Abid Ramzan Sheikh S/o Mohd Ramzan
Sheikh R/o Chotipora, Shopian, were found involved in the commission
of crime ; and
5. Whereas, during the investigation, it was found that the accused
viz. Jan Mohammad Lone, with the assistance of other accused viz. Bilal
Ahmad Bhat, Sameer Ahmad Sheikh @ Kamran Bhai and Abid Ramzan
Sheikh, entered in the ElaquaiDehati Bank, Arreh, Kulgam, on the
directions of terrorist namely, Arjumand Gulzar @ Hamza Burhan S/o
Gulzar Ahmad Dar R/o Kharbatpora, Ratnikpora, Pulwama, and fired

indiscriminately upon the deceased Manager and escaped from the
spot ; and
6. Whereas, during the investigation, it was established that the
accused viz. Jan Mohammad Lone, Bilal Ahmad Bhat, Sameer
AhmadSheikh @ Kamran Bhai and Abid Ramzan Sheikh, were members
of LeT, a banned outfit, and on the date of occurrence, the accused viz.
Jan Mohammad Lone, entered in the Bank and fired upon the deceased
Manager, and under a well knit criminal conspiracy with other accused
viz. Bilal Ahmad Bhat, Sameer Ahmad Sheikh @ Kamran Bhai and Abid
Ramzan Sheikh, facilitated the accused viz. Jan Mohammad Lone, to
carry out the said attack which resulted death of the deceased Manger;
and
7. Whereas, the investigation, in respect of accused terrorist viz.
Arjumand Gulzar @ Hamza Burhan, shall continue to bring out his
role/involvement in the case and the Supplementary Charge sheet against
him would be filed in the court of competent jurisdiction ; and
8. Whereas, the accused terrorists viz. Jan Mohammad Lone, Bilal
Ahmad Bhat and Sameer Ahmad Sheikh @ Kamran Bhai, have been
killed in the different encounters with the Security Forces and the
proceedings under the law would abate against them ; and
9. Whereas, on the basis of investigation, the statements of witnesses
recorded and the other evidence collected, the Investigating Officer has
established aprima facie involvement of below mentioned accused for
the commission of the offences punishable under section of the Unlawful
activities (Prevention) Act, 1967, as shown against hisname:—

10. Whereas, the accused viz. Abid Ramzan Sheikh, is absconding

appointed under Sub-Section (2) of Section 45 of the Unlawful

mentioned accused for his prosecution under the provisions of law.
Now, therefore,in exercise of the powers conferred bySub-Section
(2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the
Government hereby accord sanction for launching prosecution against
the accused viz. Abid Ramzan Sheikh, for the commission of offences
punishable underSections 16, 18, 20 and 38 of ULA (P) Act, arising out
of FIR No. 65/2022 of Police Station,Kulgam.

SO-234.—Whereas, on 20-10-2023, the Police Station, Sopore,
received a docket to the effect that a reliable information was received
about the movement of some unknown terrorists in the area.
Subsequently, a joint Naka was established by the Police/Security Forces

at Pattri Nowgam, Sopore. During the checking, a suspect while seeing
the Naka Party tried to escape but was chased down on the spot and
identified as Hayder Showkat Wani S/o Showkat Ahmad Wani R/o
Chinar Lane, Gulbarg Colony, Buchpora, Srinagar. During search, the
Police recovered 01 Pistol with magazine and 18 rounds from a bag
carried by the accused; and
2. Whereas, based on the above, a case FIR No.259/2023under
Sections121, 121-A, 122 IPC, 7/25 Arms Act, and Sections 18, 20 , 23
and 38 of ULA (P) Act, was registered in the Police Station, Sopore, and
the investigations, of the case was set into motion ; and
3. Whereas, during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statements of
witnesses acquainted with the facts and circumstances of the case were
recorded under the relevant provisions of law ;and
4. Whereas, during the investigation, it was found that the accused
viz. Hayder Showkat Wani, was in contact with a terrorist of LeT, a
banned outfit,namely,Bilal Hamza Mir S/o Mohammad Hamza Mir R/o
Brath Kalan, Sopore, who provided the recovered arms/ammunition to
the accused viz. HayderShowkat Wani, in order to promote terrorist
activities in the area ; and
5. Whereas, during the investigation, it was found that on 11-10-
2023, the accused viz. Hayder Showkat Wani, went missing from his
home and joined the terrorist ranks of LeT, a banned outfit ; and
6. Whereas, during the investigation, it was established that the
accused viz. Hayder Showkat Wani, was associated with the terrorist
organization of LeT, a banned outfit and under a well knit criminal
conspiracy procured arms/ammunition from the terrorist viz. Bilal
Hamza Mir, for carrying out the terrorist activities in the area and to
wage war against the Government of India; and

7. Whereas, the investigation, in respect of accused terrorist viz.
Bilal Hamza Mir, shall continue to bring out his role/involvement in the

SO-239.—Whereas, the Ministry of Home Affairs, Government of
India, vide notification S.O. 924 ( E) dated 27th, February, 2024, issued
under Sub-Sections (1) of Section3 of the Unlawful Activities

(Prevention) Act, 1967 (37 of 1967) declared the Jamaat-e- Islami (JeI),
Jammu and Kashmir as an unlawful association ; and
Whereas, subsequently, the Ministry of Home Affairs, Government
of India, in exercise of powers conferred by section 42 of the Unlawful
Activities (Prevention) Act, 1967, vide Notification S.O 1185 (E) dated
8th March, 2024 directed that the State Government and Union territory
administrations shall exercise all the powers exercised by the Central
Government under Section 7 and Section 8 of the Act ibid; and
Whereas, vide order No. 14017/17/2024-NI-MFO dated 11th March,
2024, issued by the Ministry of Home Affairs, Government of India,
approval of the Central Government under Section 42 of the Unlawful
Activities (Prevention) Act, 1967 has been conveyed to all the States and
the Union Territory administrations to the effect that the States and
Union Territory administrations may, by order in writing, direct that any
power which has been directed to be exercised by it, shall, in such
circumstances and under such conditions , as may be specified in the
direction be exercised by any person subordinate to the State
Government or the Union Territory administrations, as the case may be.
Now, therefore,the Government of Union territory of Jammu and
Kashmir, with the previous approval of the Central Government,
conveyed vide Order No. 14017/17/2024-NI-MFO dated 11th March,
2024, issued by the Ministry of Home Affairs Government of India,
hereby directs that the powers exercisable by the Union territory of
Jammu and Kashmir under Section 7 of the Unlawful Activities
(Prevention) Act, 1967 (37 of 1967) shall be exercised by the Additional
Director General of Police, Jammu/Inspector General of Police Kashmir
Zone, within their respective territorial jurisdictions and further directs
that the powers exercisable by the Union territory of Jammu and
Kashmir under Section 8 of the Unlawful Activities (Prevention) Act,
1967 (37 of 1967) shall be exercised by the Divisional Commissioner (s),
Jammu/Kashmir, within their respective territorial jurisdictions.

Whereas, vide order No. 14017/22/2024-NI-MFO dated 11th
March, 2024 issued by the Ministry of Home Affairs, Government of
India, approval of the Central Government under Section 42 of the
Unlawful Activities (Prevention) Act, 1967 has been conveyed to all the
States and the Union Territory administrations to the effect that the
States and Union Territory administrations may, by order in writing
direct that any power which has been directed to be exercised by it,
shall in such circumstances and under such conditions, as may be
specified in the direction, be exercised by any person subordinate to the
State Government or the Union Territory administrations, as the case
may be.
Now, therefore, the government of Union Territory of Jammu and
Kashmir with the previous approval of the Central Government,
conveyed vide order No. 14017/22/2024-NI-MFO dated 11th March,
2024, issued by the Ministry of Home Affairs, Government of India
hereby directs that the powers exerciseable by the Union Territory of
Jammu and Kashmir under Section 7 of the Unlawful Activities
(Prevention) Act, 1967 (37 of 1967) shall be exercised by the Additional
Director General of Police, Jammu/Inspector general of Police Kashmir
Zone, within their respective territorial jurisdictions and further directs
that the powers exerciseable by the Union Territory of Jammu and
Kashmir under Section 8 of the Unlawful Activities (Prevention) Act,
1967 (37 of 1967) shall be exercised by the Divisional Commissioner(s),
Jammu/Kashmir, within their respective territorial jurisdictions.

Kashmir Peoples Political League and JKPL (Aziz Sheikh) led by

Whereas, subsequently, the Ministry of Home Affairs, Government
of India, in exercise of powers conferred by Section 42 of Unlawful
Activities (Prevention) Act, 1967, vide Notification S.O. 1581 (E)

Srinagar, the 1st May, 2024.
SO−274. Whereas, on 25-11-2023, the Police Station, Uri,
received a docket to the effect that a Joint Naka was established by the
Police/Security Forces at Jhula Bridge, Uri. During the checking, two
suspects while seeing the Naka Party tried to escape but were chased

down on the spot and identified as Mohammad Zameer Khanday
S/o Azeem Khanday and Mohammad Naseem Khanday S/o Abdul
Majeed Khanday residents of Madiyan, Kamalkote. During the search,
the Police recovered 03 Hand Grenades and cash to the tune of
Rs. 2,50,000/- Indian Currency, from the bags carrying by the accused
respectively ; and
2. Whereas, based on the above, a case FIR No. 144/2023 under
Sections 120-B IPC, 7/25 Arms Act, 3/5 ESA and Sections 13, 17, 18,
20, 23, 38 and 39 of ULA (P) Act, was registered in the Police Station,
Uri, and the investigation of the case was set into motion. Subsequently,
during the investigation, the offence under Section 3/4 ESA was dropped
from the case ; and
3. Whereas, during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statements of
the witnesses acquainted with the facts and circumstances of the case
were recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, one more person identified as
Mohammad Manzoor Bhatti S/o Karam Din Bhatti R/o Madiyan,
Kamalkote, was found involved in the case. Subsequently, the accused
was also arrested and during the investigation, 01 Hand Grenade and
cash to the tune of Rs. 2,17,000/- Indian currency was recovered at his
instance ; and
5. Whereas, during the investigation, it was found that the accused
viz. Mohammad Manzoor Bhatti, was in contact with his brother namely,
Mohammad Din Bhatti S/o Karam Din Bhatti R/o Madiyan, Kamalkote,
A/P PoK, through social media, who crossed the LoC in the year 1990
and is presently operating from PoK with the terrorist organization of
LeT/TRF, banned outfit ; and
6. Whereas, during the investigation, it was found that the accused
viz. Mohammad Din Bhatti, send 04 Hand Grenades and cash to the tune
of Rs. 4,67,000/- Indian currency, to his brother viz. Mohammad
Manzoor Bhatti, through an unknown person, for promotion of terrorist
activities in the area. The accused viz. Mohammad Manzoor Bhatti,
handed over 03 Hand Grenades and cash to the tune of Rs. 2,50,000/- to
the accused viz. Mohammad Zameer Khanday and Mohammad Naseem
Khanday, for carrying out the terrorist activities ; and

7. Whereas, during the investigation, it was established that the
accused viz. Mohammad Zameer Khanday, Mohammad Naseem
Khanday nd Mohammad Manzoor Bhatti, were working as Over Ground
Workers (OGWs) for the terrorists of Let/TRF, banned outfit,
particularly the Pakistani based terrorist viz. Mohammad Din Bhatti, and
were providing logistic support to him, besides, under a well knit
criminal conspiracy procured Hand Grenades and cash from the said
terrorist through an unknown person for carrying out the terrorist
activities in the area ; and
8. Whereas, the investigation in respect of unknown person who
handed over the Hand Grenades and cash to the accused viz. Mohammad
Manzoor bhatti, shall continue to ascertain his identity and to bring out
his role/involvement in the case and supplementary charge sheet against
him would be filed in the Court of competent jurisdiction ; and
9. Whereas, on the basis of the investigation, the statements of
witnesses recorded and other evidence collected, the Investigating
Officer, has established a prima facie involvement of the below
mentioned accused for the commission of offences punishable under
Sections of the Unlawful Actvities (Prevention) Act, 1967, as shown

10. Whereas, the accused terrorist viz. Mohammad Din Bhatti, is
absconding and the proceedings under Section 299 Cr.PC have been
proposed to be initiated against him ; and
11. Whereas, the Authority, appointed by the Government under
Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention)
Act, 1967, has independently examined the Case Diary File and all
the other relevant documents relating to the case and has come to
the conclusion that prima facie case is made out against the above
accussed ; and
12. Whereas, after perusing the Case Dairy File, the relevant
documents and also taking into consideration the views of the Authority
appointed under Sub-Section (2) of Section 45 of the Unlawful Activities
(Prevention) Act, 1967, the Government is of the view that there is
sufficient material and evidence available against the above-mentioned
asccused for their prosecution under the provisions of law.
Now, therefore, in exercise of the powers conferred by
Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention)
Act, 1967, the Government hereby accord sanction for launching
prosecution against the accused viz. Mohammad Zameer Khanday,
Mohammad Naseem Khanday, Mohammad Manzoor Bhatti and
Mohammad Din Bhatti, for the commission of offences punishable under
the relevant Sections of ULA(P) Act, as indicated against each accused at
Para (9) above, arising out of FIR No. 144/2023 of Police Station, Uri.

SO−276. Whereas, on 08-11-2024, the Police Station, D.H.Pora,
received a docket to the effect that a Naka was established by the Police
at Nehama-Samnoo Road. During the checking, two suspects while
seeing the Naka Party tried to escape but were chased down on the spot

and identified as Zakir Ahmad Wagay S/o Bashir Ahmad Wagay R/o
Odura, Kulgam and Muheed Mashooq Bhat S/o Mashooq Ahmad Bhat
R/o Khudwani, Kulgam. During their personal search, the Police
recovered 21 AK Rounds and 01 Hand Grenade from thier possession
respectively ; and
2. Whereas, based on the above, a case FIR No. 109/2023 under
Section 7/25 Arms Act, and Sections 13, 18, 20 and 39 of ULA (P) Act,
was registered in the Police Station, D.H. Pora, and the investigation of
the case was set into motion. Subsequently, during the investigation, the
offence under Sections 23 and 38 of ULA(P) Act, were added in the case
; and
3. Whereas, during the investigation, the site plan of the place of
occurrence and the seizure memos were prepared and the statements of
witnesses acquainted with the facts and circumstances of the case were
recorded under the relevant provisions of law ; and
4. Whereas, during the investigation, four other persons identified
as Kamran Ayoub Pandith S/o Mohd Ayoub Pandith R/o Wanpora,
Kulgam, Arif Ahmad Wani S/o Abdul Karim Wani, Jaleel Ahmad Dar
S/o Abdul Ahad Dar residents of Nawbal, Batpora and Ather Yousuf Dar
S/o Mohd Yousuf Dar R/o Dar Mohalla, Khudwani, Kulgam, were found
involved in the case. Subsequently, the accused were also arrested and
during the investigation, 02 Hand Grenades, 01 AK-47 Magazine and 41
AK Rounds, were recovered at their instances respectively ; and
5. Whereas, during the investigation, it was found that the accused
viz. Zakir Ahmad Wagay, Muheed Mashooq Bhat, Kamran Ayoub
Pandith, Arif Ahmad Wani, Jaleel Ahmad Dar and Ather Yousuf Dar,
were in contact with a terrorist of leT/TRF, banned outfit, namely, Yasir
Bilal S/o Bilal Ahmad Bhat R/o Wanpoh, Kulgam, who on the directions
of a Pakistani based terrorist namely, Firdous Ahmad Bhat S/o Abdul
Salam Bhat R/o Thokerpora, Qaimoh A/P PoK, provided the recovered
Hand Grenades and AK ammunition to the accused viz. Zakir Ahmad
Wagay, Muheed Mashooq Bhat, Kamran Ayoub Pandith, Arif Ahmad
Wani, Jaleel Ahmad Dar and Ather Yousuf Dar, in order to promote
terrorist activities in the area ; and
6. Whereas, during the investigation, it was established that the
accused viz. Zakir Ahmad Wagay, Muheed Mashooq Bhat, Kamran

Ayoub Pandith, Arif Ahmad Wani, Jaleel Ahmad Dar and Ather Yousuf
Dar, were working as Over Ground Workers (OGWs) for the terrorists of
LeT/TRF, banned outfit, particularly the terrorists viz. Yasir Bilal and
Firdous Ahmad Bhat, and were providing logistic support to them,
besides, under a well knit criminal conspiracy procured Hand Grenades
and AK ammunition from the terrorists viz. Yasir Bilal, for carrying out
the terrorist activities in the area ; and
7. Whereas, the accused terrorist viz. Yasir Bilal has been killed in
an encounter with the Security Forces and the proceedings under the law
would abate against him ; and
8. Whereas, on the basis of the investigation, the statements of
witnesses recorded and other evidence collected, the Investigating
Officer, has established a prima facie involvement of the below
mentioned accused for the commission of offences punishable under
Sections of the Unlawful Actvities (Prevention) Act, 1967, as shown

Ex-parte Award
This is to dispose an application filed by the petitioner applicant
under section 15 of the P.W.Act, 1936 read with S-33-c (2) of the
I. D. Act, 1947 claiming there that he was employed by respondent
in her industrial unit located at Zainakote near SICOP Office, Srinagar
w. e. f. September 2021, Respondent is manufacturing various kinds
of the ISM products including the sanitary pads. The applicant
has further sttated that he was working as a salesman and was
marketing the products of the respondent's Industrial establishment.
Initially his monthly salary/wages were fixed at Rs. 10.000/- P.M. but
after putting hard work he gained the experience and confidence
of his employer and his monthly wages were raised to Rs. 12000/-
P. M. The respondent paid his salary initially for some months but
thereafter did not pay his wages w. e. f. June, 2022 till September,
2022 and withheld his legal wages without any reason or justification.
He further submitted that he approached his employer with request to
pay his legitimate withheld dues but she did not take any step to liquidate
the applicant balance and withheld wages with the result the applicant
was left with no option but to resign from the job and employement
of the respondent. With regard to his due wages, applicant had served
a legal notice to the respondent/employer through his counsel Mr. Talib
Hussain and Snober Azad Advocates dated 29-04-2023 and provided
15 days time to pay the withheld wages of the applicant, but still she
did not bother about the legal notice and did not pay the wages of
the applicant. After exhausting all his efforts to recover his lawful wages
from his employer respondent, he approached this forum for
recovering his pending wages from his employer/respondent and filed
the instant application.
This court on receipt of the petition, issued notice to the respondent
on her industrial unit address at Zainakote HMT, Srinagar through
Registered Post but the respondent refused to accept and receive the
notice as per delivery report dated 19-06-2023. Respondent did not
bother to appear before this court either in person/representative,

or any legal counsel and despite wait of respondent for 2/3 dates
of hearing when she failed to appear in person or any agent
or representative, this court was left with no option but to set
her ex-parte and applicant was directed to produce evidence in
ex-parte in support of his claim application.
In pursuance to the court order the applicant produced
two witnesses namely, Danish Shafi Pandow 2. Suhail Ahamd
besides applicant himself. The petitioner himself entered in the witness
box and fully corroborated his petition. He has in his evidence affidavit
stated that Initially he was paid Rs 10000/- monthly and he worked
with zeal and dedication so the respondent increased his salary to
Rs. 12000/-. However, subsequently the salary of the petitioner was
not paid from June 2022 to September 2022. The respondent despite
request did not pay his due salary forcing petitioner to give up his Job
and avoided payment on one pretext or the other. An amount of
Rs 48000/- is due to petitioner from respondent. He even served notice
for clearing his dues but despite that the respondent did not discharge
her liability so he approached the court. The petitioner to substantiate
his claim has annexed copy of notice, photocopy of receipt of notice
and photocopies of bank record which reveals that from time to time
salary of Rs. 10000/= and Rs. 12000/- has been credited to his account.

2. Suhail Ahamd in their statements on affidavit have deposed that
they know the applicant as they are in the business occupation. The
applicant was working as a salesman in the business establishment of
the non-applicant since 2021 but he left the service and employment
of the respondent employer w.e.f September, 2022 as his employer did
not pay his monthly wages from June, 2022 till September, 2022 for
unknown reasons that the applicant was being paid monthly wages of
Rs. 10000/- which was later increased to Rs. 12000/- per month. As
such the total amount of Rs. 48000/- four months’ salary of the applicant
are in arrears to be paid by the respondent along with the compensation
and interest thereon.
The respondent on the other hand has not chosen to appear before
this court and has instead refused to accept the notice which is part

of the file. She has not even replied the notice sent to her for making
the payment due to the petitioner.
The petitioner by adducing evidence on affidavits and documentary
evidence on record has proved sufficiently that the claimed amount of
Rs. 48000/- is due to him which the respondent failed to clear. On
the other hand, silence to the notice and non-appearance of respondent
in this petition proves that the claim of the petitioner is justified and
She has nothing to object about it. Thus there is no reason to disallow
the petition of the petitioner.
Accordingly, the petition in hand is allowed and Petitioner is held
entitled to his unpaid salary of Rs. 48000/- from the month of June,
2022 to September, 2022. The amount due shall be paid to the petitioner
by respondent within the period of two months failing which petitioner
shall be entitled to interest @ 8% from the date it become due till
realization.
