The Meteorological Department has forecasted the onset of cold wave

conditions over Jammu and Kashmir and these conditions may lead to

significant drops in temperature, particularly in the higher reaches of the

region. posing a potential risk to health, infrastructure, and transportation.

The seasonal outlook issued by IMD on the occurrence of cold waves over

northwest. central, east and northeastern parts of the country during

December 2024 is likely to be below normal.

In view of the approaching severe winter season, this circular outlines

measures to ensure safety and uninterrupted essential services across the

Union Territory of Jammu and Kashmir.

SO-42.—~.-In exercise of the powers conferred by Section 148 of

the Jammu and Kashmir Goods and Services Tax Act, 2017 (Act No. V of

2017) (hereinafter referred to as the said Act), the Government, on the

recommendations of the Council, hereby notifies taxable persons who could

not file an appeal against the order passed by the proper officer on or

before the 31st day of March, 2023 under Section 73 or 74 of the said Act

(hereinafter referred to as the said order), within the time period specified

in Sub-Section (1) of section 107 read with Sub-Section (4) of Section 107

of the said Act, and the taxable persons whose appeal against the said

order was rejected solely on the grounds that the said appeal was not filed

within the time period specified in Section 107, as the class of persons

(hereinafter referred to as the said person) who shall follow the following

special procedure for filing appeals in such cases.

2. The said person shall file an appeal against the said order in

FORM GST APL-0l in accordance with Sub-Section (l) of Section 107

of the said Act, on or before 31st day of January 2024 :

Provided that an appeal against the said order filed in accordance

with the provisions of Section 107 of the said Act, and pending before

the Appellate Authority before the issuance of this notification, shall

be deemed to have been filed in accordance with this notification, if it

fulfills the condition specified at para 3 below.

3. No appeal shall be filed under this notification, unless the

appellant has paid,—

a. in full, such part of the amount of tax, interest, fine, fee and

penalty arising from the impugned order, as is admitted by

him ; and

b. a sum equal to twelve and a half per cent of the remaining

amount of tax in dispute arising from the said order, subject to a

maximum of twenty-five crore rupees, in relation to which the

appeal has been filed, out of which at least twenty percent

should have been paid by debiting from the Electronic Cash

Ledger.

4. No refund shall be granted on account of this notification till the

disposal of the appeal, in respect of any amount paid by the appellant, either

on their own or on the directions of any authority (or) court, in excess of

the amount specified in para 3 of this notification before the issuance of

this notification, for filing an appeal under Sub-Section(l) of Section 107 of

the said Act.

5. No appeal under this notification shall be admissible in respect of a

demand not involving tax.

makes the following rules further to amend the Jammu and Kashmir Goods

and Services Tax Rules, 2017, namely :—

1. Short title and commencement.—

(1) These rules may be called the Jammu and Kashmir Goods and

Services Tax (Fourth Amendment) Rules, 2023.

(2) Save as otherwise provided in these rules, they shall deemed to

have come into force from 26th October, 2023.

2. In the Jammu and Kashmir Goods and Services Tax Rules, 2017

(hereinafter referred to as the said rules), rule 28 shall be renumbered as

sub-rule (1) and after the sub-rule as so renumbered, the following sub-rule

shall be inserted, namely :—

‘‘(2) Notwithstanding anything contained in sub-rule (1), the value of

supply of services by a supplier to a recipient who is a related person, by

way of providing corporate guarantee to any banking company or financial

institution on behalf of the said recipient, shall be deemed to be one per

cent of the amount of such guarantee offered, or the actual consideration,

whichever is higher.’’.

3. In the said rules, in rule 142, in sub-rule (3), for the words "proper

officer shall issue an order", the words "proper officer shall issue an

intimation" shall be substituted.

4. In the said rules, in rule 159, in sub-rule (2), after the words

"Commissioner to that effect’’, the words "or on expiry of a period of one

year from the date of issuance of order under sub-rule (1), whichever is

earlier," shall be inserted.

5. In the said rules, in FORM GST REG-01, in PART-B, in

serial number 2, after clause (xiv), the following clause shall be

inserted, namely :—

‘‘(xiva) One Person Company’’.

SO–54.—Whereas, on 09/10-08-2023, the Police Station, Kokernag,

received a docket to the effect that a reliable information was received

about the hiding of a terrorist namely Uzair Ahmad Khan, in Village

Loher Senzi, Gadoole. Subsequently, a Joint Cordon and Search

Operation was launched by the Police/Security Forces in the Village and

during the search, the terrorist hiding in the residential house of one

Rayaz Ahmad Bhat S/o Gh. Nabi Bhat R/o Loher Senzi, Gadoole, hurled

a grenade upon the Search Party, with the intention to kill them, resulting

in injuries to some Army personnel and two civilians. The terrorist after

the commission of the crime managed his escape from the spot ; and

2. Whereas, based on the above a case FIR No. 109/2023 under

Sections 307 IPC, 3/4 ESA Act, and the Sections 16, 18, 19, 20, 23,

38 and 39 of ULA(P) Act, was registered in the Police Station,

Kokernag, and the investigation, of case was set into motion. Subsequently,

during the investigation, the offences under Section 7/25 Arms Act, was

added in the case ; and

3. Whereas, during the course of investigation, the site plan of the

place of occurrence and the seizure memos were prepared and the

statements of witnesses acquainted with the facts and circumstances

of the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, the accused house owner,

viz. Reyaz Ahmad Bhat, was arrested in the case and during the

investigation, four more persons identified as Ishfaq Ahmad Rather S/o

Mohd Iqbal Rather R/o Rather Pora Gadoole, Mudasir Ahmad Bhat S/o

Gh. Nabi Bhat R/o Bhatpora Gadoole, Mohd Ubaid Dar S/o Ab. Rashid

Dar R/o Darpora, Gadoole and Basit Ahmad Rather S/o Gh. Hassan

Rather R/o Ratherpora, Gadoole, were found involved in the case.

Subsequently, the accused were also arrested and during the investi-

gation, 40 AK-47 Ronds were recovered at their instance ; and

5. Whereas, during the investigation, it was found that the accused

viz. Reyaz Ahmad Bhat, Ishfaq Ahmad Rather, Mudasir Ahmad Bhat,

Mohd Ubaid Dar and Basit Ahmad Rather, were in contact with the

terrorist viz.Uzair Ahmad Khan, who provided the recovered ammuni-

tion to them in order to promote terrorist activities in the area ; and

6. Whereas, during the investigation, it was established that the

accused viz. Revaz Ahmad Bhat Ishfaq Ahmad Rather, Mudasir Ahmad

Bhat, Mohd Ubaid Dar and Basit Ahmad Rather were working as Over

Ground Workers (OGWs) for the terrorists of LeT a banned outfit

particularly the terrorist viz. Uzair Ahmad Khan, and were providing

logistic support to him, besides under a well knit criminal conspiracy

procured ammunition from the said terrorist and on date of occurrence

the accused viz. Reyaz Ahmad Bhat, voluntarily harboured the said

terrorist in his residential house for carrying out the terrorist activities

in the area ; and

7. Whereas, the accused terrorist viz. Uzair Ahmd Khan, has been

killed in an encounter with the secuirty Forces and the proceedings

under the law Would abate against him ; and

a docket to the effect that a Joint Patrolling was conducted by the

Police/Security Forces in Butgran/Churunda area, and during the

checking a suspect while seeing the Police/Security Forces tried

to escape but was chased down on the spot and identified as

search, the Police recovered 01 hand grenade from a bag carried by

the accused ; and

2. Whereas, based on the above, a Case FIR No. 103/2023 under

section 7/25 Arms Act and Sections 13 and 16 of ULA (P) Act, was

registered in the Police Station, Uri, and the investigation, of the case

was set into motion. Subsequently, during the investigation, the

offence under Section 16 of ULA (P) Act was dropped and the

offences under Sections 18, 23 and 39 of ULA (P) Act were added

in the case ; and

3. Whereas, during the course of investigation, the site plan of

the place of occurrence and the seizure memos were prepared and

the statements of witnesses acquainted with the facts and circumstances

of the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, two other persons identified

as Ahmad Din Khatana S/o Shakoor Din Khatana and Mohammad

Sadeeq Khatana S/o Umar Din Khatana residents of Churunda, Uri,

were found involved in the case. Subsequently, the accused were

arrested and during the investigation, 02 Hand Grenades, 01 Pistol with

magazine and 04 rounds were recovered at their instance respectively,

and 01 more hand grenade was also recovered at the instance of

accused viz. Showkat Ali Awan ; and

5. Whereas, during the investigation, it was found that the accused

viz. Showkat Ali Awan, Ahmad Din Khatana and Mohammad Sadeeq

Khatana, were working for the terrorists of LeT/JeM banned outfits

who provided the recovered arms/ammunition and hand grenades to

them in order to promote terrorist activities in the area ; and

6. Whereas, during the investigation, it was established that the

accused viz. Showkat Ali Awan, Ahmad Din Khatana and Mohammad

Sadeeq Khatana, were working as Over Ground Workers (OGWs) for

the terrorists of LeT/JeM banned outfits and were providing logistic

SO-70.—In partial modification to notification SRO-63 of 2018 dated

05-02-2018 regarding the Budgetary support to the manufacturing units in

the shape of reimbursement of State Taxes paid under Jammu and Kashmir

Goods and Service Tax Act, 2017, for promotion of small/medium/ large

scale industries in the State of Jammu and Kashmir, the Government hereby

notifies the following amendments, namely :—

1. For the words ‘‘Commercial Taxes’’ wherever appearing in the

SRO-63 dated 05-02-2018 the words ‘‘State Taxes’’ shall be substituted.

2. The Clause 4.1 is re-casted as under :

The Commissioner State Taxes shall select 33% of the reimbursement

claims received in a quarter for the purpose of inspection by a team

constituted for this purpose. The inspection report shall be made available

to the Jurisdictional Assistant Commissioner/State Taxes Officer within

seven days from the date of inspection. It shall be ensured that each eligible

unit claiming reimbursement shall be inspected at least once in a financial

year and selection of the unit which are repeated shall be based on higher

turnover on random basis or any specific input. The reimbursement claims

of eligible units selected for inspection in a particular quarter shall not be

processed unless the report from the inspection teams is received.

3. In Clause 5.1, the words and figures ‘‘15th day’’ shall be substituted

by words and figures ‘‘last day of the succeeding month’’.

4. In clause 5.1, after the 4th proviso, the 5th proviso shall be inserted,

namely :—

‘‘Provided further that the eligible industrial units who have filed their

claims beyond the prescribed timelines, before the issuance of this

notification, can avail the benefit of the scheme provided that they

have filed all the due returns under section 39 of Jammu and Kashmir

Goods and Service Tax Act, 2017 and paid the tax due thereon in

time.’’

5. After Clause 5.1, the clause 5.1 (A) shall be inserted, namely :—

‘‘5.l (A) The Assistant Commissioner/State Taxes Officer, as the case

may be, after examination of the application, if satisfied on such examination

that it is necessary to call for any clarification/documents like invoices,

statements etc. before processing the case, he may call for such information/

documents from the claimant dealer through registered email id available

on the reimbursement portal and the unit holder shall provide the same

within 07 days from the receipt of the intimation by return mail, failing

which his claim to that extent shall not be sanctioned.’’

6. In Clause 5.2, the words and figures "within one week after

the receipt of application", the words and figures shall be substituted,

namely :—

‘‘Within

A) fifteen days after the receipt of application in case of units not

selected for inspection in a particular quarter.

B) fifteen days from the date of receipt of inspection report in case of

units selected for inspection in a particular quarter.’’

7. After Clause 5.2, the clause 5.2 (A) shall be inserted, namely :—

‘‘5.2 (A) The Assistant Commissioner/State Taxes Officer, as the

case may be, who has passed an order, may rectify any error which are

apparent on the face of record in such order, either on its own motion or

where such error is brought to his/ her notice by a superior Authority or by

claimant dealer within a period of six months from the date of issue of such

order.

For the purpose of this clause, the rectification shall be limited to

arithmetical and typographical errors only.

No rectification for the past issues shall be enabled/reopened, which

are prior to the date of issuance of this notification’’

8. In the Clause 5.3, for the words "by the end of the month in which

application is received", the words and figures "within 15 days from the

receipt of sanction order’’, shall be substituted.

9. After Clause 6.6, the following clause shall be inserted as

‘‘6.7(a) Any industrial unit claiming reimbursement under this scheme

who is aggrieved by an order passed by the Assistant Commissioner / State

Taxes Officer shall file an Appeal against such order before the Additional

Commissioner, State Taxes (Administration & Enforcement) of concerned

division within 30 days from the date of receipt of such order. The Appellate

Authority after giving opportunity of being heard to the aggrieved industrial

unit, and after examination of records available with the Jurisdictional

Authority shall pass appropriate order within six months from receipt of

Appeal and shall forward sanctioned amount, if due, to the Nodal Officer

b) The order passed by the Appellate Authority shall be final and fully

binding on the Appellants.’’

This notification shall come in to force w.e.f. 23-01-2024.

Jammu, the 24th January, 2024.

SO–71.—In partial modification to notification SRO-519 of 2017

dated 21-12-2017 regarding the Budgetary support to the manufacturing

units in the shape of reimbursement of State Taxes paid under Jammu

and Kashmir Goods and Services Tax Act, 2017, for promotion of small/

medium/large scale industries in the State of Jammu and Kashmir, the

Government hereby notifies the following amendments, namely :—

For the words ‘‘Commercial Taxes’’Wherever appearing in the

SRO-519 dated 21-12-2017 the words ‘‘State Taxes’’ shall be

substituted.

The Clause 4.1 is re-casted as under :

The Commissioner State Taxes shall select 33% of the

reimbursement claims received in a quarter for the purpose of inspection

by a team constituted for this purpose. The inspection report shall be

made available to the Jurisdictional Assistant Commissioner/State Taxes

Officer within seven days from the date of inspection. It shall be

ensured that each eligible unit claiming reimbursement shall be inspected

at least once in a financial year and selection of the unit which are

repeated shall be based on higher turnover on random basis or any

specific input.

The reimbursement claims of eligible units selected for inspection

in a particular quarter shall not be processed unless the report from the

inspection teams is received.

In Clause 5.1, the words and figures ‘‘15th day’’ shall be

substituted by words and figures ‘‘last day of the succeeding

month’’.

In clause 5.1, after the 4th proviso, the 5th proviso shall be

inserted, namely :—

‘‘Provided further that the eligible industrial units who have

filed their claims beyond the prescribed timelines, before the

issuance of this notification, can avail the benefit of the scheme

provided that they have filed all the due returns under Section

39 of Jammu and Kashmir Goods and Service Tax act, 2017

and paid the Tax due thereon in time.’’

After Clause 5.1, the clause 5.1 (A) shall be inserted, namely :—

‘‘5.1(A) The Assistant Commissioner/State Taxes Officer, as

the case may be, after examination of the application, if

satisfied on such examination that it is necessary to call for

any clarification/documents like invoices, statements etc.

before processing the case, he may call for such information/

documents from the claimant dealer through registered email

id available on the reimbursement portal and the unit holder

shall provide the same within 07 days from the receipt of the

intimation by return mail, failing which his claim to that extent

shall not be sanctioned.’’

In Clause 5.2, the words and figures ‘‘Within one week after

the receipt of application’’, the words and figures shall be

substituted, namely :–

‘‘Within

A) Fifteen days after the receipt of application in case of units

not selected for inspection in a particular quarter.

B) Fifteen days after the receipt of application in case of units

not selected for inspection in a particular quarter.’’

After Clause 5.2, the clause 5.2 (A) shall be inserted, namely :—

‘‘5.2(A) The Assistant Commissioner/State Taxes Officer, as

the case may be, who has passed an order, may rectify any

error which are apparent on the face of record in such order,

either on its own motion or where such error is brought to his/

her notice by a superior Authority or by claimant dealer within

a period of six months from the date of issue of such order.

For the purpose of this clause, the rectification shall be limited

to arithmetical and typographical errors only.

No rectification for the past issues shall be enabled/reopened,

which are prior to the date of issuance of this notification’’.

In the Clause 5.3, for the words ‘‘by the end of the month in

which application is received’’, the words and figures ‘‘ within

15 days from the receipt of sanction order’’, shall be

substituted.

After Clause 6.6, the following clause shall be inserted as

‘‘6.7(a) Any industrial unit claiming reimbursement under this

scheme who is aggrieved by an order passed by the Assistant

Commissioner/State Taxes Officer shall file an Appeal against

such order before the Additional Commissioner State

Taxes (Administration and Enforcement) of concerned

division within 30 days from the date of receipt of such order.

The Appellate Authority after giving opportunity of being

heard to t he aggr ieved indus tria l unit, and aft er

examination of records available with the Jurisdictional

Authority shall pass appropriate order within six months

from receipt of Appeal and shall forward sanctioned amount,

if due, to the Nodal Officer designated by Commissioner

This notification shall come into force w.e.f. 23-01-2024.

SO–74.—Whereas, on 13-07-2023 a reliable information was

received by the Police Station, Shopian, to the effect that some unknown

terrorists with the help of their OGWs fired indiscriminately upon some

non-local laboures, who were putting up as tenants in a shop of one

illegal arms/ammunition with the intention to kill them, resulting

–iniinjuries to some labourers, who were shifted to a local hospital for

treatment. The unknown terrorists after the commission of crime

escaped from the spot ; and

2. Whereas, based on the above, a Case FIR No. 126/2023 under

Senctions 307 IPC, 7/27 Arms Act, and Sections 16,18, 20, 38 and 39

of ULA (P) Act, was registered in the Police Station, Shopian, and the

investigation, of the Case was set into motion. Subesequently, during

the investigation, the offences under Sections 120-B IPC, 7/25 Arms

Act, and Section 23 of ULA (P) Act were added in the Case ; and

3. Whereas, during the course of investigation, four persons

identified as Adnan Shafi S/o Mohammad Shafi Shah, Zahid Ahmad

Shah S/o Abdul Gaffar Shah R’s/o Rawalpora, Shopian, Hazim Rashid

Sheikh S/o Abdul Rashid Sheikh and Midhat Ahmad Dar S/o Mohd

Yaqoob Dar R’s/o Bemnipora, Shopian, were found invoved in the

commission of crime. Subsequently, the accused were arrested in the

case and during the investigation, 01 hand Grenade was recovered at

the instance of accused viz. Adnan Shafi ; and

4. Whereas, during the investigation, four persons identified as

Adnan Shafi S/o Mohammad Shafi Shah, Zahid Ahmad Shah S/o Abdul

Gaffar Shah R’s/o Rawalpora, Shopian, Hazim Rashid Sheikh S/o Abdul

Rashid Sheikh and Midhat Ahmad Dar S/o Mohd Yaqoob Dar R’s/o

Bemnipora, Shopian, were found involved in the commission of crime.

Subsequently, the accused were arrested in the case and during the

investigation, 01 Hand Grenade was recovered at the instance of

accused viz. Adnan Shafi ; and

5. Whereas, during the investigation, it was found that the accused

viz. Adnan Shafi, Zahid Ahmad Shah, Hazim Rashid Sheikh and Midhat

Ahmad Dar, were in contact with two terrorists of LeT, a banned outfit,

namely Hanzil Yaqoob Shah S/o Mohammad Yaqoob Shah R/o

Rawalpora, Shopian and Danish Hameed Thoker @ Muslim Bai S/o

Abdul Hameed Thoker R/o Chakora, Shopian, who carried out the

attack upon the non-local labourers and provided a Hand Grenade to

the accused viz. Adnan Shafi, in order to promote terrorist activities in

the area ; and

6. Whereas, during the investigation, it was established that the

accused viz. Adnan Shafi, Zahid Ahmad Shah, Hazim Rashid Sheikh and

Midhat Ahmad Dar, were working as Over Ground Workers (OGWs)

for the terrorists of LeT, a banned outfit, Particularly the terrorists viz.

Hanzil Yaqoob Shah and Danish Hammeed Thoker @ Muslim Bai, and

were providing logistic support to them, besides, on the date of

occurrence under a well knit criminal conspiracy facilitated the said

terrorists to carry out the attack upon the non-local labourers which

resulted injuries to some labourers on the spot. The accused viz. Adnan

Shafi, also procured a Hand Grenade from the terrorists for carrying

out the terrorist activities in the area ; and

7. Whereas, the accused terrorists viz. Hanzil Yaqoob Shah and

Danish Hameed Thoker @ Muslim Bai. have been killed in an encounter

with the Security Forces and the proceedings under the law would abate

against them ; and

8 Whereas, on the basis of the investigation, the statements of

witnesses recorded and other evidence collected, the Investigating

Officer, has established a prima facie involvement of the below

mentioned accused for the commission of offences punishable under

Sections of the Unlawful Activities (Prevention) Act, 1967, as shown

Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention)

Act, 1967, has independently examined the Case Diary File and all the

other relevant documents relating to the case and has come to

the conclusion that prima facie case is made out against the above

accused ; and

10. Whereas, after perusing the Case Diary File the relevant

documents and also taking into consideration the views of the Authority

appointed under Sub-Section (2) of Section 45 of the Unlawful Activities

(Prevention) Act, 1967, the Government is of the view that there is

sufficient material and evidence available against the above-mentioned

accused for their prosecution under the provisions of law.

Now, therefore, in exercise of the powers conferred by Sub-

Section (2) of Section 45 the Unlawful Activities (Prevention) Act, 1967,

the Government hereby accord sanction for launching prosecution

against the accused viz. Adnan Shafi, Zahid Ahmad Shah, Hazim Rashid

Sheikh and Midhat Ahmad Dar, for the commission of offences

punishable under the relevant Sections of ULA (P) Act, as indicated

against the each accused at Para (8) above, arising out FIR No. 126/

2023 of Police Station, Shopian.

SO–75.—Whereas, on 03-09-2023 the Police Station, Kreeri,

received a docket to the effect that a reliable informantion was received

about the movement of some unknown terrorists in the area.

Subsequently, a Joint Naka was established by the Police/Security

Forces at Shrakwara crossing. During the checking two suspects while

seeing the Naka Party tried to escape but were chased down on the

–spot and identified as Moien Amin Bhat S/o Mohammad Amin Bhat and

Tawseef Ramzan Bhat S/o Mohammad Ramzan Bhat residents of Bada

Mulla, Sheeri, Baramulla. During their personal search, the Police

recovered 01 Pistol with Magazine, 15 AK-47 Rounds and 01 Chinese

Hand Grenade from their possession respectively ; and

2. Whereas, based on the above, a Case FIR No. 111/2023 under

Senction 7/25 Arms Act, and Sections 13,18, 20, 23, 38 and 39 of ULA

(P) Act, was registered in the Police Station, Kreeri, and the

investigation, of the Case was set into motion ; and

3. Whereas, during the course of investigation, the site plan of

the place of occurrence and the seizure memos were prepared and the

statements of witnesses acquainted with the facts and circumstances

of the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, it was found that the accused

viz. Moien Amin Bhat and Tawseef Ramzan Bhat, were in contact with

a terrorist of LeT, a banned outfit, namely Usman Bai R/o Pakistan,

who provided the recovered arms/ammunition and Hand Grenade to

them in order to promote terrorist activities in the area ; and

5. Whereas, during the investigation, it was found that the accused

viz. Moien Amin Bhat and Tawseef Ramzan Bhat, were working as

Over Ground Workers (OGWs) for the terrorists of LeT, a banned outfit,

and were providing logistic support to them. besides, under a well knit

criminal conspiracy procured arms/ammunition and Hand Grenade from

the terrorists for carrying out the terrorist/unlawful activities in the

area ; and

6. Whereas, during the investigation, in respect of accused

terrorist viz. Usman Bai, shall continue to ascertain his actual identity

and to bring out his role/involvement in the case and the supplementary

charge sheet against him would be filed in the court of competent

Jurisdiction ; and

7. Whereas, on the basis of the investigation, the statements of

witnesses recorded and other evidence collected, the Investigating

Officer, has established a prima facie involvement of the below

mentioned accused for the commission of offences punishable under

SO–76.—In exercise of the powers conferred by Article 233 read

with proviso to Article 309 of the Constitution of India, the Lieutenant

Governor in consultation with the High Court of Jammu and Kashmir

and Ladakh hereby make the following amendments in the Jammu and

Kashmir Higher Judicial Service Rules, 2009 ; namely :—

In rule 2(c), for the words ‘‘Common High Court of Jammu

and Kashmir’’ the words ‘‘High Court of Jammu and Kashmir

and Ladakh’’ shall be substituted.

In rule 18, in clause (i), the sign full stop (.) at the end shall

be substituted by sign colon (:) and thereafter the following

proviso shall be inserted :—

‘‘Provided that w.e.f. 01-01-2020 there shall be 35% of the

total number of posts in the cadre of the service carrying

Selection Time Scale Pay’’.

In rule 19, in clause(i), the sign full stop (.) at the end shall

be substituted by sign colon (:) and thereafter the following

proviso shall be inserted :—

‘‘Provided that w.e.f. 01-01-2020 there shall be 15% of the

total number of posts in the cadre of District Judges carrying

Super Time Scale of Pay’’.

In rule 25, after entry 3, the following proviso shall be

inserted :—

‘‘Provided that for the figure and sign ‘‘25%’’ appearing in

entry 2 and figure and sign ‘‘10% ’’ appearing in entry 3, the

figure and sign ‘‘35%’’ and ‘‘15%’’ shall be substituted

respectively’’.

SO–77.—Whereas, on 10-09-2023, the Police Station, Kreeri,

received a docket to the effect that a reliable information was received

about the movement of some unknown terrorists in Village Check-e-

Tapper, Kreeri. Subsequently, a Joint Naka was established by the

Police/Security Forces in the Village and during the checking three

suspects while seeing the Naka Party tried to escape but were chased

down on the spot and identified as, Lateef Ahmad Dar S/o Mohd Yosuf

Dar R/o Najibatt, Showkat Ahmad Lone S/o Ghulam Rasool Lone and

Ishrat Rasool D/o Ghulam Rasool Lone residents of Posnagh. During

their personal search, the Police recovered 03 Hand Grenades and 30

AK-47 Rounds from their possession respectively ; and

2. Whereas, based on the above a case FIR No. 116/2023 under

Section 7/25 Arms act and the Sections 13, 18, 20 and 23 of ULA(P)

Act, was registered in the Police Station, Kreeri, and the investigation,

of the case was set into motion. Subsequently, during the investigation,

the offence under Section 20 of ULA(P) Act was dropped and the

Section 39 of ULA(P) Act was added in the case ; and

3. Whereas, during the course of investigation, the site plan of the

place of occurrence and the seizure memos were prepared and the

statements of witnesses acquainted with the facts and circumstances

of the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, it was found that the

accused viz. Lateef Ahmad Dar, Showkat Ahmad Lone and Ishrat

Rasool, were in contact with some unknown terrorist of LeT, a banned

outfit, and procured Hand Grenades and AK ammunition from them in

order to promote terrorist activities in the area ; and

5. Whereas, during the investigation, it was established that the

accused viz. Lateef Ahmad Dar, Showkat Ahmad Lone and Ishrat

Rasool, were working as Over ground Workers (OGWs) for the

terrorists of LeT, a banned outfit, and were providing logistic support

to them, besides, under a well knit criminal conspiracy procured Hand

Grenades and AK ammunition from the terrorists for carrying out the

terrorist/unlawful activities in the area ; and

6. Whereas, the investigation, in respect of unknown terrorists

who provided the Hand Grenade and ammunition to the accused viz.

Lateef Ahmad Dar, Showkat Ahmad Lone and Ishrat Rasool, shall

continue to ascertain their actual identity and to bring out their role/

involvement in the case and the supplementary chargesheet against

them would be filed in the Court of competent jurisdiction ; and

7. Whereas, on the basis of the investigation, the statements of

witnesses recorded and other evidence collected, the Investigating

Officer, has established a prima facie involvement of the below

mentioned accused for the commission of offences punishable under

Sections of the Unlawful Activities (Prevention) Act, 1967, as shown

8. Whereas, the Authority appointed by the Government under

Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention)

Act, 1967, has independently examined the Case Diary File and all

the other relevant documents relating to the case and has come to

the conclusion that prima facie case is made out against the above

accused ; and

9. Whereas, after perusing the Case Diary File the relevant

documents and also taking into consideration the views of the Authority

appointed under Sub-Section (2) of Section 45 of the Unlawful Activities

(Prevention) Act, 1967, the Government is of the view that there is

sufficient material and evidence available against the above-mentioned

accused for their prosecution under the provisions of Law.

Now, therefore, in exercise of powers conferred by Sub-Section

(2) of Section 45 of Unlawful Activities (Prevention) Act 1967, the

Government hereby accord sanction for launching prosecution against

the accused viz. Lateef Ahmad Dar, Showkat Ahmad Lone and Ishrat

Rasool, for the commission of offences punishable under Sections 13,

18, 23 and 39 of ULA(P) Act, arising out of FIR No. 116/2022 of

Police Station, Kreeri.

2. Whereas, based on the above a case FIR No. 104/2023 under

Section 120-B IPC, 7/25 Arms Act and Sections 13, 16, 18 and 23 of

ULA(P) Act, was registered in the Police Station, Uri, and the

investigation, of the case was set into motion. Subsequently, during the

investigation, the offence under Section 16 of ULA(P) Act was dropped

and the Sections 18-B, 20 and 40 of ULA(P) Act were added in the

case ; and

3. Whereas, during the course of investigation, the site plan of the

place of occurrence and the seizure memos were prepared and the

statements of witnesses acquainted with the facts and circumstances

of the case were recorded under the relevant provisions of law ; and

4. Whereas, during the investigation, it was found that the

accused viz. Muneer Ahmad, was in contact with his maternal uncle

namely ; Mohd Hassan Awan S/o Raj Mohd Awan R/o Dharkote, Uri,

A/P Bagh Azad, PoK, who crossed the LoC in the year 1990 and is

presently operating from the PoK ; and

5. Whereas, during the investigation, it was found that the accused

viz. Muneer Ahmad, on the directions of Pakistani based accused

viz. Mohd Hassan Awan, motivated the accused viz. Mohammad Aslam

Khatana, for transportation of Arms/Ammunition and narcotics

from across the border in order to promote terrorist activities in the

valley ; and

6. Whereas, the investigation, it was found that as per the

directions of the accused viz. Mohammad Aslam Khatana, procured

arms/ammunition and narcotics from across the border and handed over

the same to the accused viz. Muneer Ahmad, who concealed the arms/

ammunition and Hand Grenades in Village Powdiyan Nallah, and

sold the narcotics to one Atiqullah R/o Sopore, against an amount

of Rs. 3,30,000/- which was later on distributed by the accused among

themselves ; and

7. Whereas, during the further investigation, it was found that on

11-08-2023, the accused viz. Bilal Ahmad Dar, alongwith the accused

viz. Akhtar Neyaz Bhat and Mudasir Yousuf Gaknu, collected Arms/

Ammunition and Hand Grenades viz. 02 Pistol, 02 Magazines and 04

Hand Grenades from the accused viz. Muneer Ahmad, and Mohammad

Aslam Khatana, at Village Powdiyan Nallah, and handed over an

amount of Rs. 50,000/- to the accused viz. Muneer Ahmad, against the

total sale of the said Arms/Ammunition and Hand Grenades to the tune

of Rs. 2,50,000/- and on their way were arrested by the Police/Security

Forces alongwith the arms/ammunition and Hand Grenades and cash

to the tune of Rs. 50,000/- ; and

8. Whereas, during the investigation, it was established that the

accused Viz. Muneer Ahmad, Mohammad Aslam Khatana, Bilal Ahmad

Dar, Akhtar Neyaz Bhat and Mudasir Yousuf Gaknu, were working for

the terrorists particularly the terrorist viz. Mohd Hassan Awan, and

under a well knit criminal conspiracy were facilitating the terrorists for

transportation of arms/ammunition and narcotics from one place to

another for carrying out the terrorist activities in the valley ; and

9. Whereas, the investigation, in respect of accused viz. Atiqullah

R/o Sopore, shall continue to ascertain his actual identity and to bring

out his role/involvement in the case and the supplementary chargesheet

against him would be filed in the Court of competent jurisdiction ; and

10. Whereas, on the basis of the investigation, the statement of

witnesses recorded and other evidence collected, the Investigating

Officer, has established prima facie involvement of the below

mentioned accused for the commission of offences punishable under

Sections of the Unlawful Activities (Prevention) Act, 1967, as shown
