Wheres, it appears to the appropriate Government that a total of

06 marlas land under Khasra No. 2116/757 min is required in Village

Jib, Tehsil and District Udhampur for public purpose, namely construction

of “30000 glns GSR under WSS Jib” which is being executed by Deputy

Director (Plg), Jal Shakti (PHE) Department, Jammu. Whereas, under

rule 4(1) of Jammu and Kashmir right to Fair Compensation and

Transparency in Land Acquistion, Rehabilitation and Resettlement

(Social Impact Assessment and Conset) Rules 2022” a preliminary

committee consisting of officers from Revenue, Agriculture, Forest, Jal

Shakti, Irrigation & Flood Control, Horticulture, Rurel Develoment,

PWD (R&B), Departments under the Chairmanship of Tehsildar

Udhampur was constituted for conducting Preliminary Enquiry regarding

the subject cited above. The committee so constituted visited the spot

and submitted the Preliminary Enquiry Report to the Collectorate vide

No. TUDR/OQ/2023-24/3431 dated 11-03-2024.

Whereas, the comittee submitted that no voluntry displacement of

persons and neither any adverse impact is caused, nor any rehabilitation

is required due to acquisition of land in question ;

Whereas, the land owner (interested person) has given consent on

affidavit for acquisition of land measuring 06 marlas comprising in

Khasra No. 2116/757 min situated at Village Jib ;

Whereas, Rule 8 of the “Jammu and Kashmir Right to Fair

Compensation and Transparency in Land Acquisition, Rehablitation and

Resettlment (Social Impact Assessment and Consent) Rules,

2022”provides that where no involuntry displacement of persons due to

acquisition of land with no adverse impact, and no rehabilitation is

involved, then the Collector shall obtain report of the committee as

constituted under Sub-Rule (1) of Rule 4 along with the consent of the

interested persons (at least 70%) Which shall be considered as SIA

Report and in such cases the Collector shall proceed for issuance of

Prliminary Notification under section 11 of the Act within seven days.

Therefore, it is notified that for the above said project at Village

Jib, Tehsil and District Udhampur a piece of land measuring 06 marlas

is being acquired whose detail description is as under :

This notification is made under the provisions of Section 11(1) of the Right to Fair Compensation and Transparency

in Land Acquisition, Rehabilittion and Resettlement Act, 2013 (Act No. 30/2013), to all whom it may concern.

A plan of the land may be inspected in the office of the Collector on any working day during the working hours.

The Goverment authorizes Collector and his Revenue Field Staff to enter upon and survey land, take levels of any land,

dig or bore in to the sub-soil and do all other acts required for the proper execution of their work as provided and specified

in Section 12 of the Act.

Under Sub Section (4) of Section 11 of the Act, no person shall make any transaction or cause any transaction

of land i.e. sale/purchase, etc, or create any encumbrances on such land from the date of publication of such notification

without prior approval of the Collector.

Perusal of record reveals that Accused no. 2 has been

continuously absent in the present case. Non-bailable

warrants were issued against the accused which was

received back with report that he has left the country.

Statement of Tamili namely, Sgct, Sanvir Singh no. 2304/J/

of Police Post Chinore stands recorded in the case who has

also deposed that the accused has gone to some other state.

Upon perusal of the file and the statements of Tamili Sanvir

Singh no. 2304-J of P/P Chinore I am satisfied that accused

No. 1 has absconded and there is no immediate prospect of

arresting him.

Under these circumstances, I deem it proper to proceed
