(D+6) od 220 KV D/C Zainakote Alastang Mirbazar Transmission Line at

Village Rakhi Rabitar Tehsil Wakura, District Ganderbal.

Whereas, it appereas to the appropriate Authority that land measur-

ing 05 Marlas-03 Sirsai-21 Sft. under survey no. 52 min at Village Rakhi

Rabitar is required for public purpose for the construction of Tower No. 83

(D+6) of 220 KV D/C Zainakote Alastang Mirbazar Transmission Line at

Village Rakhi Rabita Tehsil Wakura, District Ganderbal.

Whereas vide S.O. 237 Dated 23-07-2020 issued by the Revenue

Department Jammu and Kashmir Government, the Collector Land

Acquisition (Assistant Commissioner Revenue, Ganderbal) has been

designated as Collector Land Acquisition to perform duties under the Right

to Fair Compensation and Transparency in Land Acquisition, Rehabilitation

and Resettlement Act, 2013.

Whereas, this office constituted a Committee headed by Tehsildar

vide order no. 28/DCG/LAS/24 Dated : 03-06-2024 issued under

endorsement No. DCG/LAS/24 Tower 83/313 Dated 07-06-2024 to con-

duct preliminary enquiry.

Whereas, the Committee headed by Tehsildar Wakura conducted

preliminary enquiry and furnished detailed report vide no. TW/OQ/2024/

504-08 Dated 09-07-2024 revealing that land measuring 05 Marlas-03 Sirsai

-21 Sft. under survey no. 52 min, in estate Rakhi Rabitar is required for

public purpose for the construction of Tower No. 83 (D+6) of 220 KV/DC

Zainakote Alastang Mirbazar Transmission Line Tehsil Wakura, District

Ganderbal and has further reported.

1.

That the proposed acquisition of land serves the public purpose.

2.

That the extent of the land proposed for the acquisition is

the absolute bare-minimum needed for the project.

3.

That no other altermate and feasible land has been found

available.

4.

That no unutilized land which has been previously acquired

exists in the area is available.

Whereas, the appropriate Government has accorded approval and authorized the Collector Land Acquisition (Assistant

Commissioner Revenue Ganderbal) for the issuance of Notification under Section 11 of the Right to Fair Compensation and

Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

INTRODUCTION :

These proceedings are under provisions of Section 23 of the Right

to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013 for determination of

compensation in respect of net area of land proposed to be acquired

measuring 00 Kanals–06 Marlas for Construction of Disposal Drain for

Upgradation of Road from Gurian to Pochhal in Village Matta, Tehsil

and District Kishtwar. The land acquisition proceedings were initiated

with the publication of Preliminary Notification under Section 11 of the

Right to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013.

The Chief Engineer PMGSY Department, Jammu vide No. CEJ/

PMGSY/23519-21 Dated 16-03-2020, submitted proper letter of indent

for acquisition of land for Construction of Disposal Covered Drain of

Link Road from House of Lakhmi Chand to Upper Malipeath linking

Petrol Pump NH-244 of Village Kishtwar, Tehsil and District Kishtwar.

Accordingly, the Tehsildar Kishtwar vide No. 26-28/OQT Dated 14-07-

2020 had submitted the land acquisition papers to this duly completed

in all respect for further necessary action.

PUBLICATION OF NOTIFICATIONS AND ISSUE OF

NOTICES :

The local SIA team was notified as Social Impact Assessment

Team (SIA) under Section 4 of the Right to Fair Compensation and

Transpaency in Land Acqusition, Rehabilitation and Resettlement Act,

2013 for conducting Social Impact Assessment Team (SIA) vide No.

ACR/LA/2022-23/161-66 Dated 04-06-2022. Accordingly, the concerned

committee members has submitted the Social Impact Assessment Study

report vide No. BDO/Estt/2022-23/1198 Dated 31-01-2023 and the

same was submitted to the District Collector Kishtwar for appraisal

under Under Section 7 of the RFCTLARR Act, 2013 vide No. ACR/

LA/2022-23/399 Dated 08-02-2023.

The District Collector Kishtwar, constituted a committee of

expert group for appraisal of Social Impact Assessment Study

report. Accordingly, the Multi-Disciplinary Expert Group for appraisal

constituted vide Notification No. DCK/LA/22/F.No. 102/514 Dated

25-02-2023 submitted its recommendation vide No. EE/R&B/K/491

Dated 24-04-2023.

The SIA report and the recommendation of Multi-Disciplinary

Expert Group was then approved and a Preliminary Notification

No. ACR/LA/2023-24/82-88 Dated 09-05-2023 was issued under

Section 11 of the Act stating that the land described in the schedule

thereto (thereafter referred to as the said land) was needed or likely

to be needed for the public purpose. The notification issued for inviting

objections within 60 days.

No objections were received against the Preliminary Notification.

The proposal was then submitted to the Appropriate Government i.e.

Deputy Commissioner (District Collector) Kishtwar vide No. ACR/LA/

2023-24/352 Dated 05-08-2023, seeking approval to proceed with

acquisition process and the same was approval.

Further, on approval of Appropriate Government i.e. Deputy

Commissioner (District Collector) Kishtwar, vide Declaration No. 11 of

2023 Dated 07-08-2023 read with endorsement No. DCK/LA/23/F.No.

294/194 Dated 07-08-2023. It was declared under the provisions of

Section 19 of the Right to Fair Compensation and Transparency in Land

Acquisition, Rehabilitation and Resettlement Act, 2013 that the land was

required for the public purpose namely Construction of Disposal

Covered Drain of Link Road from House of Lakhmi Chand to Upper

Malipeath linking Petrol Pump NH-244 of Village Kishtwar, Tehsil and

District Kishtwar. To facilitate causation of the above requirements,

Notice vide No. ACR/LA/2023-24/385-91. Dated 08-08-2023 was

served under Section 21 of the RTFCLARR Act, 2013, stating that all

person having interest in the said land may submit their objections within

30 days and may appear personally or through an agent.

Under Section 21 of the RTFCLARR Act, 2013, the Government

intended to take the possession of the land in 30 days from the date

of issue of the Notice and claims to compensation for all interests in

the land as well as objections to the measurement of land under Section

20 to be submitted to the Collector for disposal within 30 days from the

date of issue of the Notice. No objections were received against the

Notice under Section 21 of the Act.

The case file was as such submitted to the Deputy Commissioner

(Appropriate Government) Kishtwar in the shape of Tentative award

vide No. ACR/LA/2024/603 Dated 16-11-2024 and No. : ACR/LA/

2024/608 Dated 22-11-2024 for approval of rates. The rates so

recommended have been approval by the Deputy Commissioner

(Appropriate Government) Kishtwar and conveyed to this office vide

No. : DCK/LA/24/F.No. 80(a) 480 Dated 26-11-2024.

OWNERSHIP :

Name of the persons of whose land under acquisition is standing

in the record of rights was ascertained from the revenue records and

the same are shown in Award Statement.

4.

SITUATIONM, DESCRIPTION AND LOCATION OF

THE LAND :

The total acquired land measuring 00 Kanals-06Marlas, under

acquisition is un-irrigated agricultural land and situated in Village Matta

of Tehsil Kishtwar District Kishtwar.

5.

VALUATION OF THE LAND :

The Principal for assessing the amount of compensation to be

awarded has been laid down under Section 26(1) of the Right to Fair

Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013 read with endorsement No. REV/LAJK/254/

2020 Dated 26-08-2020 and accordingly the market value of the land

was determined for further determination of compensation.

DETERMINATION OF COMPENSATION :

As per the provisions of the Section 30 of the Right to Fair

Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013, 100% of the Compensation Amount (including

market value multiplied by Multiplication Factor) is to be awarded as

Solatium as has been determined in the Award Statement.

COMPENSATION OF LAND :

The compensation of land is to be paid to land interested persons.

The total amount of Award Workout to be Rs. 24,42,780/- (Rupees

Twenty Four Lakhs Forty Two Thousand Seven Hundered and Eighty

Only).

MUTATION OF OCCUPANCY IN RESPECT OF THE

SAID LAND BEING ACQUIRED :

The acquiring department shall ensure that the record of rights and

all the relevant documents related to the ownership/occupancy of the

said land are accordingly modified and show the transfer of the said

land solely in the name of Government consequent to taking over

possession of the said land and the payment of the compensation to the

concerned interested parties.

10.

CORRECTION OF THE RECORD IN THE RECORD OF

RIGHTS :

The Tehsildar, Kishtwar shall carry out necessary mutation in the

Record of Rights in the name of Indenting Department in respect of

land so acquired as per the enclosed Award Statement.

11.

APPORTIONMENT :

The amount of compensation payable to interested persons as

shown in the Apportionment Statement is in accordance with the

provisions of Agr. Reform Act, 1976 and the guidelines given by the

revenue vide No. REV (LB) 10/80 Dated 23-02-1980 and the latest

Girdawari entries in the Field Book as well as in Girdawari Copies.

However, in case of any dispute, which is not settled within reasonable

time, the amount of compensation will be remitted to the Court under

Section 64 of the Right to Fair Compensation and Transparency in Land

Acquisition, Rehabilitation and Resettlement Act, 2013 for jurisdiction.

12.

ENCUMBRANCES :

The land under acquisition is free from all encumbrances and it

has been mentioned in the Award Statement.

13.
