PRELIMINARY NOTIFICATION
No. : ACR/LA/2024-25/873-81 Dated : 24-01-2025.
Whereas, it appears to the appropriate Government that a total of 46 Kanals 15¾ Marlas of land is required
in the Village Feller of Tehsil and District Kishtwar for public purpose, namely, Construction of link road namely
KCS to Lohidar Village Feller of Tehsil and District Kishtwar, Social Impact Assessment study was carried out by
the Social Impact Assessment (SIA) Unit and a report submitted/preliminary investigation was conducted by a team
constituted by Collector is as follows : (SIA report enclosed).
Whereas, as per the SIA report submitted by the committee constituted Deputy Commissioner Kishtwar vide
No. : DCK/LA/24/F. No. 294/380 Dated 29-10-2024 that no family is likely to be displaced due to the said acquistion.
Therefore, it is notified that for the above said project in Village Feller of Tehsil and District Kishtwar a piece of
land measuring 46 Kanals 15¾ Marlas, whose detail description is as following, is under acquisition :

This notification is made under the provisions of Section 11(1) of the Right to Fair Compensation and Transparency
in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013), to all whom it may concern.

A plan of the land may be inspected in the office of the Collector
Land Acquisition, ACR Kishtwar on any working day during the
working hours.
The Government is pleased to authorize Officers of Indenting
Department and his staff to enter upon and survey land, take levels
of any land, dig or bore into the sub-soil and do all other acts required
for the proper execution of their work as provided and specified in
Section 12 of the said Act.
Under Section 11(4) of the Act, no person shall make any
transaction or cause any transaction of land i.e. sale/purchase etc.
or create any encumbrance on such land from the date of publication
of such notification without prior approval of the Collector.
Objections to the acquisition, if any, may be filed by the persons
interested within 60 (sixty days) from the date of publication of this
notification as provided under Section 15 of the Act before the Collector.

ORDER
30-04-2025 :

Learned APP present.

None present for the accused.

Learned APP presents the compliance report in respect of
the proclamation under Section 82/83 Cr. PC read with 84
BNSS, issued by this Court. It is reported that the SHO P/S
Miran Sahab has issued the publication of proclamation in
respect of absconding accused namely Ashok Kumar @ Shoka
S/o Mool Raj R/o Kirpind Tehsil RS Pura Jammu, in compliance
to the order of this Court.

The report submitted by the applicant/SHO Miran Sahab reveals
that the copy of proclamation was affixed on the house of
accused, at the premises of Police Station Miransahab Jammu.
The publicity is also reported to have been given through drum
beating and publishing of proclamation in daily news papers in its
issue dated 08-04-2025, whereby the accused was required to
attend this Court on 30-04-2025.

Despite publication of proclamation in the manner noted above,
the accused namely Ashok Kumar @ Shoka S/o Mool Raj R/o
Kirpind Tehsil RS Pura Jammu, has failed to appear/attend this
Court on today, As such, his absence seems to be intentional and
deliberate. So, the accused Ashok Kumar @ Shoka is declared
proclaimed offender.

In view of the situation that the accused has chosen not to
appear in this Trial Court despite wide publication notice for
appearance, , and is avoiding the trial intentionally and
deliberately, applicant SHO P/S Miransab shall obtain the list of
movable and immovable properties of the accused Ashok Kumar
@ Shoka S/o Mool Raj R/o Kirpind Tehsil R.S. Pura, Jammu,
from the Tehsildar R.S. Pura, Jammu on or before the next date
of hearing.

APP present.

APP presents a report wherein it is stated that the notice
issued on the previous date has been affixed on the wall of the
house of accused Jasbir Singh. It is further reported that his wife
was informed about the reason why the affixing of notice was
made as such.

Since the proclamation stands duly issued under Section 87
Cr. PC alongwith affixing of a notice after the initial affixing in
terms of Section 87 Cr. PC second time again directing the
accused to cause appearance. But the accused has not caused
appearance in this Court. It appears that he is deliberately and
intentionally avoiding the appearance in this Court.

It is noted that the accused stands convicted vide judgement dated
11-12-2022 which has been upheld by the Hon’ble High Court
vide judgement dated 26-02-2016 whereby the accused has been
directed to surrender in the trial Court before 10-03-2016 which
was to be followed by action by this Court to excute the sentence.
But the accused has not appeared till date and is avoiding the
presence intentionally and deliberately despite issuance and

the accused namely Ashok Kumar @ Shoka S/o Mool Raj R/o
Kirpind Tehsil RS Pura Jammu, has failed to appear/attend this
Court on today. As such, his absence seems to be intentional
and deliberate. So, the accused Ashok Kumar @ Shoka is
declared proclaimed offender.

In view of the situation that the accused has chosen not to
appear in this Trial Court despite wide publication of proclamation
notice for appearance, and is avoiding the trial intentionally and
deliberately, applicant SHO P/S Miran Sahib, shall obtain the list
of mobvable and immovable properties of the accused Ashok
