It is hereby notified for the information of all concerned that, in

furtherance of the "Mediation for the Nation 2.0" initiative and with a view

to strengthening the culture of mediation, ensuring effective functioning of

mediation mechanisms, and achieving maximum disposal of cases through

amicable settlement, the following Standard Operating Procedure (SOP)

for the District Judiciary are hereby adopted in connection with the Mediation

2.0 Drive :

(i)

All the pending cases viz. Matrimonial Disputes Cases, Accident

Claims Cases, Domestic Violence Cases, Cheque Bounce Cases,

Commercial Disputes Cases, Service Matters Cases, Consumer

Disputes Cases, Debt Recovery Cases, Eviction Cases (Civil

Revisions), Land Acquisition Cases, will be shown/listed under a

new list type i.e. “For Referral to the Special Mediation Drive-

Mediation For the Nation 2.0” before all the Courts.

(ii)

All the cases referred in clause (1) and pending in Ordinary motion

cause list after 25.02.2026, can also be preponed and listed in the

“For Referral to the Special Mediation Drive-Mediation For the

Nation 2.0” list.

(iii)

All the cases which are not referred will be listed as per their last

listing status.

(iv)

The phone numbers of the Advocates and that of the parties shall

be reflected in the referral order.

(v)

In case, any Court finds it appropriate for referring any matter

listed in the cause list to Medistion in which there is an element of

settlement listed before that Court on a particular day can refer

the same.

(vi)

Ld. Advocates/Party-in-person will also provide the details of cases

in which there exists an element of settlement in the concerned

Court, so that the same could also be listed in “For Referral to the

Special Mediation Drive-Mediation For the Nation 2.0” list.

(vii) In case no report is received within 90 days of referral and the

time is not extended by the Court on request of the parties or

otherwise, the mediation shall be treated as failed and the file shall

be listed in due course and should not be kept awaiting report.

(viii) Judicial Officers may be requested to take up the settled matters

on priority. For this, the settled cases will be listed atop the cause

list or under a separate heading so that these cases are taken up

before regular matters so as to avoid inconvenience to the parties

who have already reached a settlement through Mediation ensuring

a prompt disposal.

(ix)

The Coordinator, District Mediation Centers shall be entitled to

empanel temporary Mediator under Rule 3(b) of MCPC Rules,

2015 for the limited duration of Mediation for the Nation 2.0 Drive

in the district headquarters as well as at taluka level.

(x)

The honorarium to the Mediators already on the panel or

empanelled under Rule 3(b) shall be paid accordance with Rule

26 of MCPC Mediation Rules, 2015 readwith MCPC resolution

dated 15-12-2021 for the duration of Mediation For The Nation

2.0 Drive. (Reference - High Court Order No. 119 of 2026/RG

dated 30-01-2026).

It is hereby notified for the information of all concerned that inpursuance

of “Mediation For the Nation 2.0” drive launched under theguidance of

Hon'ble Mr. Justice Surya Kant, Chief Justice of India and Hon'ble

Mr. Justice Vikram Nath, Judge, Supreme Court of India & Executive

Chairman, NALSA and Chairman, MCPC, Hon'ble the Chief Justice,

High Court of J&K and Ladakh, has been pleased to adopt the following

strategy :

(1)

All the pending Ordinary and Admitted (On/Off Board) cases

viz. Matrimonial Disputes Cases, Accident Claims Cases,

Domestic Violence Cases, Cheque Bounce Cases, Commercial

Disputes Cases, Service Matters Cases (except Referred to

Division Bench matters and Cases wherein validity of any Act,

Rules or Notification has been challenged), Consumer Disputes

Cases, Debt Recovery Cases, Eviction Cases (Civil Revisions),

Land Acquisition Cases, will be shown/listed under a new list

type i.e. “For Referral to the Special Mediation Drive-Mediation

For the Nation 2.0” before all the Hon'ble Judges Sitting singly

w.e.f. 27-01-2026, irrespective of the subject matter assigned in

the roster.

(ii)

All the cases referred in clause (i) and pending in Ordinary motion

cause list after 27.01.2026, shall also be preponed and listed in

the “For Referral to the Special Mediation Drive-Mediation For

the Nation 2.0” list.

(iii)

All the Hon'ble Judges sitting in Hon'ble Division Benches are

requested to sit singly everyday at their Lordship's convenience

and take up the cases listed in "For Referral to the Special

Mediation Drive-Mediation "Mediation For the Nation 2.0” list.

(iv)

The cases which are required to be listed in the “For Referral to

the Special Mediation Drive-Mediation For the Nation 2.0” list

and the cases, which are also fixed for hearing in the Ordinary

motion cause list during this period, will be listed alongwith Cause

List Remarks “For Referral to the Special Mediation Drive-

Mediation For the Nation 2.0” list for the kind perusal of Hon'ble

Bench.

(v)

The per day limit of cases required to be listed in the for Referral

to the Special Mediation Drive--Mediation For the Nation 2.0”

list shall not more than 50 in addition to Urgent/Ordinary/Taken

Up etc. cases per Hon'ble Division/Single Bench per day.

Moreover, the cases listed before Hon'ble Division Benches under

heading “For Referral to the Special “Mediation Drive-Mediation

For the Nation 2.0” Division Bench list' should also be taken into

account at the time of listing single bench cases before the judges

sitting in the said Hon'ble Division Bench.

(vi)

All the cases which will be returned without referral order with

regard to mediation will be listed as per their last listing status i.e.

Urgent/Ordinary/Admitted.

The unlisted cases which were listed only for the purpose of

referral to the mediation without any last listing status will be

listed as per their turn/roster.

(vii)

All the other cases viz. Criminal Compoundable Cases, Criminal

Disputes Cases (Misc. Writ Petitions), Partition Cases (RSAs

and Writ Petitions-Land Law Single Bench) and Eviction Cases

(Writ Petitions-Land Law Division/Single Bench), after physical

verification by the Grouping Cell, will also be listed as per above

directions, as and when the same are verified by the Grouping

Cell.

(viii) The phone numbers of the Advocates and that of the parties shall

be reflected in the referral order or at the time of listing the matter

for referral so that the same gets reflected in the referral order.

(ix)

In case, any Hon'ble Bench finds it appropriate for referring any

matter listed in Urgent/Ordinary motion cause list to Mediation in

which there is an element of settlement listed before that bench

on a particular day can refer the same.

(x)

(xi)

Whereas it appears to the Government of UT of Jammu & Kashmir

that land measuring 17 Kanals 02 Marlas at Village Suchetgarh, Tehsil and

District Samba is required for construction of Axial Road from BOP (Saroj)

to Fence at Village Suchetgarh. It is as such hereby notified that land in the

area specified is required for above purpose.

The notification is made under the provisions of section 11(1) of Right

to Fair compensation and Transparency in Land Acquisition, Rehabilitation

and Resettlement Act, 2013, to all whom it may concern.

2026 dated 28-02-2026 issued under endorsement No. DCS/LAS/2025-26/

134-40 dated 28-02-2026 exempted social impact Assessment study along

with exemption of an additional Compensation of 75% of the total

compensation under sub-section 5 of section 40 of the Act, as the project

affects the security and strategic interest of the State/UT.

In exercise of powers vested in me under Sections 11 of Sub-Section

(1) of the Right to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013, I, Ajay Bharti, JKAS, Collector

Land Acquisition, Samba do hereby notify that the land whose particulars

are given herein above is required for construction of Axial Road from BOP

(Saroj) to Fence at Village Suchetgarh, Tehsil and District Samba.

Further under Section 11(4) of the Act, no person shall make

any transaction or cause any transaction of land i.e. Sale/ purchase etc. or

create any encumbrance on such land from the date of publication of this

notification without prior approval of the Collector.

Objection to the acquisition, if any, may be filled by the person (s)

interested within 60 days from the date of publication of notification as

provided under Section 15 of the Act, before the Collector Land Acquisition,

Assistant Commissioner Revenue, Samba.

Any objection statement which is received after the due date or which

does not clearly explain the nature of the senders interest in the land is liable

to be summarily rejected.

Objection received within the due date, if any, will be enquired into

where the objectors will be at liberty to appear in person or by advocate and

to adduce any oral or documentary evidence in support of their objections.

Declaration

Whereas, Deputy Commissioners/District Collectors, vide S.O-17

Dated -19-01-2022, were designated as 'Appropriate Government' within

their respective jurisdictions for acquiring land for public purposes under

“Right to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act 2013”, for an area not exceeding

400 Kanals ;

Whereas, it appears to the appropriate Government that a total of

07 Marlas of land under survey No.300/1 at Village Panzan, Tehsil Chadoora,

District Budgam is required for public purpose, namely Expansion of

Government Higher Secondary School, Panzan ;

Whereas, on the basis of indent placed by requiring body (Director

School Education, Kashmir), vide No. DSEK/Plg/LC/Bud/405/I dated

01-05-2023 for Expansion of Government Higher Secondary School

Panzan, the Collector Land Acquisition/SDM Chadoora constituted a

committee vide order No. 01 of 2024 dated 27-07-2024 under rule 4(1) of

“Right to Fair Compensation & Transparency in Land Acquisition,

Rehabilitation & Resettlement (Social Impact Assessment and Consent)

Rules, 2023, issued vide S.O-440 dated 24.08.2023”. The report submitted

by the committee reveals that no displacement or rehabilitation is involved

in the acquisition, therefore the Collector invoked rule 8 and considered the

report of the committee along with consent of the land owners as Social

Impact Assessment report. The Collector Land Acquisition/SDM Chadoora

issued a preliminary notification under section 11(1) rule 25(1) for the said

land vide No. SDMC/LAS/24-25/202-07 Dated 31-12-2024 for calling upon

the objections from the interested persons ;

Whereas, an objection was received within stipulated time, the Collector

has provided opportunity of being heard to the objector as required under

section 15(2) of the Act and has conducted further enquiry in respect of

inclusion of some non-fruit bearing trees and plinth area situated within the

land under acquisition and same were incorporated in the acquisition as

communicated by Collector vide letter No. SDMC/LAC/2025-26/176-79

dated 19-11-2025 ;

Whereas, the appropriate Government is satisfied after considering

the report made by the Collector vide No. SDMC/LAC/2025-26/176-79

dated 19-11-2025 under section 15(2) & rule 25(6) that the land particulars

Proclamation requiring the appearance of accused person namely Arun

Sikadar S/o Kamali Sikadar R/o Punsia Basti Kamalpur Bihar.

Whereas the challan titled above has been presented on

02-12-2025 in absence of accused and the same is pending for disposal

before this Court and that the accused person in the said case namely

Arun Sikadar S/o Kamali Sikadar R/o Punsia Basti Kamalpur Bihar has

alleged to have committed offence punishable U/S 279, 304(A) PRC, 207

M. V Act.

And whereas it has been shown to my satisfaction that the

accused person above-said challan is concealing himself and cannot be

found in routine process, therefore, proceeding U/S 512 is initiated against

the said accused person.
