NOTIFICATION No-4/2018 State Tax (Rate)

S.O. No. 19 Dated - 5^th March, 2018 -- In exercise of the powers conferred by section 148 of the

Jharkhand Goods and Services Tax Act, 2017 (12 of 2017), the State Government, on the recommendations of

the Council, hereby notifies the following classes of registered persons, namely :-

(a) registered persons who supply development rights to a developer, builder, construction company or

any other registered person against consideration, wholly or partly, in the form of construction service

of complex, building or civil structure; and

(b) registered persons who supply construction service of complex, building or civil structure to supplier

of development rights against consideration, wholly or partly, in the form of transfer of development

rights,

as the registered persons in whose case the liability to pay state tax on supply of the said services, on the

consideration received in the form of construction service referred to in clause(a) above and in the form of

development rights referred to in clause(b) above, shall arise at the time when the said developer, builder,

construction company or any other registered person, as the case may be, transfers possession or the right in the

constructed complex, building or civil structure, to the person supplying the development rights by entering

into a conveyance deed or similar instrument (for example allotment letter).

2. This notification shall be deemed to be effective from 25^th January, 2018.

नमा@ण संरचना के 5लए नमा@ण सेवा के Kप मI Lवकास के अधकार को देते हM; और

(ख) ऐसे पंजीकृत : यि,त जो Cकसी Lवकास के अधकार को देने वाले को Cकसी 'तफल के एवज

मI, पूण@त: या अंशत: Lवकास के अधकार के अंतरण के Kप मI Cकसी का; पलै, स, भवन या

नमा@ण संरचना के नमा@ण क# सेवा क# आपूत@ करते हM,

को ऐसे पंजीकृत : यि,तय- के Kप मI अधसूचत करती है िजनके मामले मI उपयु@, त उपवा, य

(क) मI संद5भ@त नमा@ण सेवा के Kप मI 'ाR त 'तफल पर और उपयु@, त उपवा, य (ख) मI

संद5भ@त Lवकास के अधकार के Kप मI 'ाR त 'तफल पर, उ, त सेवा क# आपूत@ पर रा1 य कर के

भुगतान का दाय) व उस समय पैदा होगा जब उ, त डेवलपर, DबF डर, नमा@ण कंपनी या अG य

कोई पंजीकृत : यि,त, जैसी भी िSथत हो, ऐसे न5म@त का; पलै, स, भवन या 5सLवल

नमा@ण काय@ के कT जे या अधकार का अंतरण उस : यि,त को करता है िजसने क# Cकसी अंतरण

Lवलेख या इसी 'कार के अG य Cकसी Lवलेख (जैसे Cक आबंटन पW) मI हS ताXर करके अंत3रत

करता है ।

2. यह अधसूचना 25 जनवर, 2018 से 'वृत्त होगी ।
