उAतर देश तथा Cबहार, झारखड, केरल, महारा>, मेघालय, पंजाब, उAतराखड, उAतर देश एवं

पिHचम बंगाल कI राय Jवधान सभाओं के उप-MनवाNचनO हेतु कायNQम कI घोषणा कI जा चुकI है;

यत:, आयोग वारा इस कार से घोJषत कायNQम के अनुसार महारा>, नागालैड, उAतर

देश, Cबहार, झारखड, केरल, मेघालय, पंजाब, उAतराखड एवं पिHचम बंगाल राय के उप-

MनवाNचन मV मतदान 28 मई, 2018 को कराया जाना है; एवं

यत:, लोक Mत1धA व अ1धMनयम 1951 कI धारा 126क के ावधानO के अनुसार, इस अव1ध

के दौरान कोई एिXजट पोल आयोिजत करना और उसका पZरणाम काशत करना एवं चाZरत

करना, आयोग वारा यथा अ1धसू1चत अव1ध तक Mतबि[धत है ।

अब, इसलए, लोक MतMन1धA व अ1धMनयम, 1951 कI धारा 126क कI उप धारा (1) के

अधीन शाि]तयO का योग करते हुए, भारत MनवाNचन आयोग, उ] त धारा कI उप-धारा (2)(ख) के

उपबंधO के ^िटगत, एत_वारा 28 मई, 2018 (सोमवार) को पूवाN`न 07.00 बजे से अपरा`न 06.30

बजे के बीच कI अव1ध को ऐसी अव1ध के bप मV अ1धसू1चत करता है िजसके दौरान आयोग वारा

26 अैल, 2018 के ेस नोट वारा घोJषत महारा> के 11-भडारा-गO7दया, 22-पालघर (अ.ज.जा.)

संसदcय MनवाNचन dेeO एवं 285- पलुस कंडेगांव Jवधान सभा MनवाNचन dेe, नागालfड के नागालfड

संसदcय MनवाNचन dेe, उAतर देश के 2-कैराना संसदcय MनवाNचन dेe एवं 24-नूरपुर Jवधान सभा

dेe तथा Cबहार के 50-जोकIहाट Jवधान सभा MनवाNचन dेe, झारखड के 34-गोमया एवं 61-सgलc

Jवधान सभा MनवाNचन dेeO, केरल के 110-चेनगा[नूर Jवधान सभा MनवाNचन dेe, मेघालय के

53-आमपाती(अ.ज.जा.) Jवधान सभा MनवाNचन dेe, पंजाब के 32-शाहकोट Jवधान सभा MनवाNचन dेe,

उAतराखड को 05-थरालc(अ.जा.) Jवधान सभा dेe और पिHचम बंगाल के 155-महेशतला Jवधान

सभा MनवाNचन dेe से उप-MनवाNचनO के संबंध मV hकसी भी कार के एिXजट पोल का संचालन करने

तथा Jंट या इले] >ॉMनक मीjडया वारा इसके पZरणाम के काशन या चार अथवा hकसी भी अ[ य

तरcके से उसका सार करने पर Mतबंध होगा ।

इसके अMतZर] त यह भी k प ट hकया जाता है hक लोक MतMन1धA व अ1धMनयम, 1951 कI

धारा 126(1)(ख) के अधीन, उपयुN] त साधारण MनवाNचनO के संबंध मV A येक चरण मV मतदान कI

समािlत के लए Mनयत समय पर समाl त होने वाल 48 घंटO के दौरान hकसी भी इले] >ाMनक

मीjडया मV hकसी भी ओपीMनयन पोल या अ[ य hकसी मतदान सवmdण के पZरणामO स7हत, hकसी भी

कार के MनवाNचन संबंधी मामले के दशNन पर Mतबंध होगा ।

इसके वारा काशत hकया जाता है जो भारतीय संJवधान के अनुqछेद 348 के खड (3) के अधीन

अंnेजी भाषा मV उसका ा1धकृत पाठ समझा जायगा।

No. 576/EXIT/ECI/LET/FUNC/JUD/SDR/Vol.I/2018-- Whereas, the schedule for the Bye-

Elections to the House of the People in the States of Maharashtra, Nagaland & Uttar Pradesh and

State Legislative Assemblies of Bihar, Jharkhand, Kerala, Maharashtra, Meghalaya, Punjab,

Uttarakhand, Uttar Pradesh and West Bengal, have been announced by the Commission vide Press

Note No. ECI/PN/32/2018, dated 26^th April, 2018.

Whereas, as per the schedule so announced by the Commission, poll for the bye-election in

the State of Maharashtra, Nagaland, Uttar Pradesh, Bihar, Jharkhand, Kerala, Meghalaya, Punjab,

Uttarakhand and West Bengal is to be taken on 28 May, 2018; and

Whereas, as per the provisions of Section 126A of the R.P. Act, 1951, there shall be

restrictions on conduct of any exit poll and publication and dissemination of result of such exit poll

during such period as may be notified by the Election Commission in this regard;

Now, therefore, in exercise of the powers under sub-Section (1) of section 126A of the R.P.

Act, 1951, the Election Commission, having regard to the provisions of Sub-Section (2)(b) of the said

Section, hereby notifies the period between 7.00 A.M. and 6.30 P.M. on 28 May, 2018 (Monday), as

the period during which conducting any exit poll and publishing or publicizing by means of the print

or electronic media or dissemination in any other manner whatsoever, the result of any Exit Poll in

connection with the said bye-elections announced vide the Commission’s Press Note No.

ECI/PN/32/2018, dated 26th April, 2018 from 11-Bhandara-Gondiya, 22-Palghar(ST)

Parliamentary Constituencies & 285-Palus Kadegaon Assembly Constituency in Maharashtra,

Nagaland Parliamentary Constituency in Nagaland, 2-Kairana Parliamentary Constituency &

24-Noorpur Assembly Constituency in Uttar Pradesh, 50-Jokihat Assembly Constituency in

Bihar, 34-Gomia & 61-Silli Assembly Constituencies in Jharkhand, 110-Chengannur Assembly

Constituency in Kerala, 53-Ampati(ST) Assembly Constituency in Meghalaya, 32-Shahkot

Assembly Constituency in Punjab, 05-Tharali(SC) Assembly Constituency in Uttarakhand and

155-Maheshtala Assembly Constituency in West Bengal, shall be prohibited.

It is further clarified that under Section 126(1)(b) of the R.P. Act, 1951, displaying any

election matter including results of any opinion poll or any other poll survey, in any electronic media,

would be prohibited during the period of 48 hours ending with the hour fixed for conclusion of poll

for the aforesaid bye-elections.
