1. संMNOत नाम, PवQतार तथा ारGभ :- (1) झारखड भूमगत जल/गैस/4ेनेज पाइप

लाइन (भूम क? उपयोBता के अ2धकार< का अज;न) FनयमावलS, 2018 है।

(2) इनका PवQतार संपूण; झारखड राय पर होगा।

(3) यह FनयमावलS अ2धसूचना क? Fत2थ से भावी होगी।

2. प0रभाषाएं :- इन Fनयम< म8, जब तक Vक संदभ; से अWयथा अपेMNत न हो:-

(क) “अ=यादेश” से अभेत है, झारखड भूमगत जल/गैस/4ेनेज पाइप लाइन (भूम

क? उपयोBता के अ2धकार< का अज;न) अ=यादेश, 2018।

(ख) “सNम ा2धकारS” से अभेत है, अ=यादेश क? धारा 3 के अधीन सNम

ा2धकारS के Yप म8 ा2धकृत अ2धकारS।

(ग) “ाYप” से अभेत है, इन Fनयम< से संल[न ाYप।

(घ) उन श]द< तथा अभ^यिBतय< के, जो इसम8 युBत हुए ह_ VकWतु प`रभाPषत नहSं

Vकए गए ह_, वे हS अथ; ह<गे जो अ=यादेश म8 उनके लए bदए गए है।

3. स3म 4ा*धकार/ क% .नयुि(त - अ=यादेश के अधीन भूमगत जल/गैस/4ेनेज पाइप

लाइन हेतु Fनजी भूम म8 उपयोग के अ2धकार अिज;त करने हेतु PवFनbद;ट Nेc के

लए “झारखड भूम अज;न, पुनवा;सन और पुन^य;Qथापन म8 उ2चत Fतकर और

पारदश;ता का अ2धकार अ2धFनयम 2013” के अWतग;त घोPषत सNम ा2धकार जो उप

समाहता; से अWयून Qतर का अ2धकारS हो, सNम ा2धकारS होगा।

4. आवेदन 9कया जाना - यथािQथFत, राय सरकार या Fनगम वारा भूमगत पाइप

लाइन हेतु Fनजी भूम के उपयोग के अ2धकार अिज;त करने के लए आवेदन पc Yप

– “क” के सNम ा2धकारS को Qतुत Vकया जाएगा। आवेदन पc म8 संबं2धत gाम< के

नाम, भूम-Qवामी/अ2धभोगी का नाम तथा Pपता/पFत का नाम, खसरा hमांक, भूम के

उपयोग के अ2धकार अिज;त करने हेतु QताPवत Nेcफल तथा अव2ध िजसम8 भूमगत

जल/गैस/4ेनेज पाइप लाइन का काय; Vकया जाएगा, क? जानकारS अंतPव;ट क? जाएगी

तथा नBशा िजसम8 Nेc अंVकत Vकए गए ह<, भी संल[न Vकए जाएंगे।

5. अ*धसूचना का 4काशन तथा =वामी को सूचना - (1) आवेदन ाOत होने के पjचात्

सNम ा2धकारS, आवेदक से ाथमक Yप से अनुमाFनत Fतकर क? अQसी Fतशत

राश जमा करने क? मांग करेगा।

(2) उपFनयम (1) के अधीन मांगी गई राश जमा कर bदए जाने के पjचात् सNम

ा2धकारS अपने इस आशय क? घोषणा, राजपc म8, Yप-ख म8, अ2धसूचना वारा करेगा

Vक भूमगत जल/गैस/4ेनेज पाइप लाइन के लए जनbहत म8, भूम म8 उपयोग के

अ2धकार अिज;त Vकया जाना आवjयक है। यह अ2धसूचना, राजपc म8 काशत करने

के साथ-साथ FनGनांVकत Qथान< पर भी चQपा कराई जाएगी:-

(क) कलBटर काया;लय के सूचना पटल पर,

(ख) सNम ा2धकारS के काया;लय के सूचना पटल पर,

(ग) उस Nेc म8 प`रचालत होने वाले दैFनक समाचार-पc< म8, िजनम8 से एक

bहWदS म8 होगा।

(3) सNम ा2धकारS, भूमQवामी/अ2धभोगी को Fनजी भूम म8 उपयोग के अ2धकार

अिज;त करने के संबंध म8 सूचना देगा। “Yप – ग” म8 दS जाने वालS सूचना :-

(क) भूमQवामी/अ2धभोगी को ^यिBतगत Yप से, अथवा,

(ख) भूमQवामी/अ2धभोगी के प`रवार के Vकसी वयQक ^यिBत को, अथवा

(ग) भूमQवामी/अ2धभोगी को रिजQटड; डाक से, तथा

(घ) भूमQवामी/अ2धभोगी के Fनवास म8 अथवा उसके अंFतम kात Fनवास

Qथान पर 2चपका करके, दS जा सकेगी,

6. स3म 4ा*धकार/ >वारा घोषणा का 4काशन - धारा 4 क? उपधारा (1) के अधीन

काशत घोषणा म8 Pवbहत कालाव2ध के भीतर ाOत आपि@तय< के Fनपटारे के

पjचात्, सNम ा2धकारS, धारा 5 क? उपधारा (1) के अधीन राजपc मे, अ2धसूचना

वारा, घोषणा ’Yप-घ’म8 काशत कराएगा। धारा 5 क? उपधारा (1) के अधीन

घोषणा के काशन क? तारSख से उसम8 उिlलHखत भूम के उपयोग के अ2धकार

समQत Pवlलंगम< से मुBत राय सरकार म8 Fनbहत हो जाएंगे।

7. 4.तकर का .नधा,रण - (1) धारा 5 क? उपधारा (1) के अधीन घोषणा काशत होने के

पjचात्, सNम ा2धकारS भूमगत जल/गैस/4ेनेज पाइप लाइन क? अव2ध के लए

उसम8 उिlलHखत भूम से होने वालS फसल से आय क? NFत, वृN< का Fतकर एवं

अWय हाFन का PवFनjचत FनGनलHखत रSFत म8 करेगा:-

(क) Vकसी असं2चत भूम को एक फसलS तथा सं2चत भूम को दो फसलS माना जाएगा,

यbद भूम म8 Pवगत भूम तीन वषm म8 कोई फसल नहSं लS गई हो तो उस भूम को

’’परती भूम’’ माना जाएगा तथा ऐसी भूम के लए फसल से आय क? NFत क?

गणना

नहSं क? जाएगी। फसल से आय क? NFत क? गणना FनGनानुसार क?

जाएगी:-

फसल से आय क% गणना = फसल क% 4माCणक पैदावार x फसल का Eयूनतम समथ,न मूFय x 2

(ख) वृN< का Fतकर वन Pवभाग/उयाFनक? Pवभाग के मत पर संगHणत Vकया जाएगा,

(2) उपFनयम (1) के अधीन यथाFनbद;ट Fतकर के अFत`रBत, यbद कोई हो, धारा 5 क?

उपधारा (1) के अधीन घोषणा के काशन के bदनांक को उस भूम के बाजार मूlय के दस

Fतशत क? दर से देय होगा। भूम का बाजार मूlय भू-अज;न अ2धFनयम 2013, िजसका

उlलेख यहाँ Fनयम 3 म8 Vकया गया है, म8 वHण;त Vhया एवं Fनदेश का पालन करते हुए

Fनधा;`रत Vकया जायेगा।

8. 4.तकर क% राश क% संगणना - (1) राय सरकार या Fनगम, Fतकर क? ऐसी राश को

मुजरा करने के पjचात्, जो Vक Fनयम 5 के उपFनयम (1) के अनुसार पूव; म8 हS जमा कर दS

गई है, Fनयम 7 के अधीन Fनधा;`रत Fतकर क? राश, सNम ा2धकारS को धारा 5 क?

उपधारा (1) के अधीन घोषणा क? तारSख से तीस bदन क? कालाव2ध के भीतर चेक वारा

जमा कर8गे।

(2) यbद Fतकर क? राश तीस bदन के भीतर जमा नहSं क? जाती है तो यथािQथFत,

राय सरकार या Fनगम उस पर, उस तारSख से, िजसको Vक Fतकर जमा Vकया जाना

था, उसे वाQतPवक Yप से जमा करने क? तारSख तक, नौ Fतशत वाPष;क दर से ]याज

के भुगतान का दायी होगा तथा एक वष; बीत जाने पर 15 Fतशत वाPष;क दर से

]याज देने के दायी ह<गे।

9. अ*धकार के अज,न पर कGजा हटाना - सNम ा2धकारS, धारा 10 क? उपधारा (3) के अधीन

भूमQवामी/अ2धभोगी को Fतकर का भुगतान करते समय भूमगत जल/गैस/4ेनेज पाइप

लाइन हेतु PवFनbद;ट कालाव2ध के लए भूम के उपयोग का अ2धकार अिज;त करने के लए

’Yप-च’ म8 भूमQवामी/अ2धभोगी से माण पc ाOत करेगा।

10. कGजे का वापस Jदलाया जाना - यथािQथFत राय सरकार या Fनगम वारा भूमगत

जल/गैस/4ेनेज पाइप लाइन के काय; समािOत पjचात् भूम समतल क? जाएगी और अपने

मूल Yप म8 लाई जाएगी तथा सNम ा2धकारS वारा भूमQवामी/अ2धभोगी को भूम का

क]जा वापस bदया जाएगा। इस संबंध म8, भूमQवामी/अ2धभोगी से सNम ा2धकारS वारा

क]जा वापसी माण-पc ’Yप-छ’ म8 लया जाएगा।

11. .नर/3ण आJद हेतु 4वेश का अ*धकार - (1) भूमQवामी/अ2धभोगी को भूम का क]जा वापस

देने के पjचात्, भूमगत जल/गैस/4ेनेज पाइप लाइन Fनगम एवं Fनगम वारा अ2धकृत

^यिBतय< का भूमगत जल/गैस/4ेनेज पाइप लाइन के FनरSNण, संधारण, सुधार उWह8 बदलने

या हटाने के लये जब आवjयकता हो, भूम म8 वेश करने एवं काय; करने क? शिBत होगी।

(2) यbद भूमQवामी/अ2धभोगी Vकसी ाYप, िजसम8 उसके हQताNर क? आवjयकता है, म8

हQताNर करने से मना करता है, तो उस ाYप पर उसके Qथान पर सNम ा2धकार

वारा हQताNर Vकया जायेगा बशतq Vक संगत Fनयम< का पालन Vकया गया हो।

12. अ*धयाचक >वारा उपयोग के अ*धकार+ के अज,न क% लागत:- (1) अ2धयाचक वारा

अ2धकार< के अज;न म8 Qथापना ^यय एवं आकिQमक ^यय Fनयम 7 म8 आकलत कुल

मुआवजे का 5 Fतशत होगा।

(2) Fनयम 12 (1) म8 आकलत Qथापना ^यय एवं आकिQमक ^यय क? राश ब_क 4ाrट के

मा=यम से अ2धयाचक वारा समाहता; के पास जमा क? जायेगी। समाहता; इस राश को

िजला कोषागार के sडपोिजत खाता म8 अथवा Vकसी सरकारS ब_क खाता, जो इस हेतु सNम

ा2धकार एवं उपायुBत वारा संयुBत Yप से प`रचालत हो, म8 जमा कर8गे।

13. अनुदेश जार/ 9कया जाना - राय सरकार के समय-समय पर, बनाए गए

अ=यादेश/अ2धFनयम या उसके अधीन बनाए गए Fनयम< के उपबंध< के VhयाWवयन के संबंध

म8 VकWहSं कbठनाईय< के Fनराकरण के लए अनुदेश जारS कर सकेगी।

Ordinance ‘2018. (Jharkhand Ordinance No-4, 2018), the Government of Jharkhand hereby makes the

following Rules :-

Rules, 2018

1. Short title, extent and commencement.-

(1) These rules may be called the Jharkhand Water, Gas and Drainage Pipelines (Acquisition of Right of

User in Land) Rules, 2018.

(2) They extend to the whole of Jharkhand.

(3) These rules come into force from the date of notification.

2. Definitions.- In these rules, unless the context other wise requires;

(a) "Ordinance" means the Jharkhand Water, Gas and Drainage Pipelines (Acquisition of Right of

User in Land) Ordinance, 2018 (Jharkhand Ordinance No.4, 2018)

(b) “Competent Authority" means the officer authorized as Competent Authority under rule

(d) The words and expressions used but not defined in these rules shall have the same

meaning assigned to them in the Ordinance and the General Clauses Act.

3. Competent authority under the Act :- For the acquisition of right of user in private land to lay

the Water, Gas or Drainage Pipelines under the Ordinance any officer, not below the rank of Deputy

Collector, who has been notified as the competent authority for the specified area under "The Right

to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act

2013" by State Government, shall be the competent authority for this purpose.

4. Filing of Application.- The application for the acquisition of right of user to lay the Water, Gas or

Drainage Pipelines in Form A shall be submitted to the competent authority by the State Government

or the Corporation, as the case may be. The application shall contain the information of the names of

concerned villages, land owner/ occupier of the land and name of father / husband, Khasra number

and area proposed for acquisition of right of user and the period for the laying of Water, Gas or

Drainage Pipelines and shall also contain the area marked on the map.

5. Publication of notiﬁcation and notice to the owner.-

(1) After the receipt of application, the competent authority shall ask the applicant to deposit

eighty percent amount of preliminary estimated compensation.

(2) After payment of such amount as demanded under sub-rule (1), the competent authority

shall declare his intention by notification in the official gazette in Form B that in the public

interest the acquisition of right of user is necessary to lay the Water, Gas or Drainage

Pipelines. This notification shall be published and affixed in the following places as well as

in the official Gazette:-

(a) on the notice board of the office of the Collector;

(b) on the notice board of the office of the Competent Authority;

Hindi.

(3) The Competent Authority shall serve the notice to the landowner / occupier regarding the

acquisition of right of user in private land. The notice in Form-C may be served :-

(a) in person to the land owner/ occupier; or

(b) in person to any adult person of family of land owner/ occupier; or

(d) by pasting notice on the house or his last known residence of the land owner/

occupier.

6. Publication of declaration by competent authority.- After the disposal of objections received

within the prescribed period of the publication under sub—section (1) of section 4, the Competent

Authority shall publish the declaration in Form ‘D’ by notification in official Gazette under sub-

section (1) of section 5. The right of user in the land mentioned therein shall be vested in the State

Government / Corporation free from all the encumbrances from the date of publication of the

declaration under sub-section (1) of section 5.

7. Assessment of Compensation.- (1) After the publication of declaration under sub—section (1) of

section 5, the competent authority shall decide the loss of crop income, compensation of trees and

other losses from the land mentioned therein for the period of laying of Water, Gas or Drainage

Pipelines in the following manner :-

(a) Any unirrigated land shall be considered as single cropped and irrigated land shall be

considered as double cropped. If no crops are taken in last three years, the land shall be

deemed as "fallow land" and the loss of crop income shall not be calculated for such land. In

other cases, the loss of crop income shall be calculated as follows :-

(b) The compensation of trees shall be calculated based on the opinion of Forest/Horticulture

Department.

(2) In addition to the compensation as referred under rule (1), if any, the compensation shall

be payable at the rate of Ten Percent of the value of that land on the date of publication of the

declaration under sub-section (1) of section 5. The value of the land shall be determined

following the same procedures and guidelines, as are followed while acquiring the land under

the Act of 2013, mentioned in rule 3.

Computation of compensation amount.

(1) The State Government or the

Corporation shall, after setting off the amount which has been already deposited in

accordance with sub-rule (1) of rule 5, deposit the compensation amount determined under

Rule 7 to the Competent Authority by cheque within the period of thirty days from the date of

declaration under sub-section (1) of section 5.

(2) If the amount of compensation is not deposited within thirty days, the State Government

or the Corporation, as the case may be, shall be liable to pay interest thereon at the rate of

nine percent per annum from the date on which the compensation had to be deposited till the

date of the actual deposit: and at the rate of 15 percent per annum after lapse of one year.

9. Taking of possession on acquisition of right.- The Competent Authority shall obtain the

possession certiﬁcate in Form 'E‘ for acquisition of right of user to lay Water, Gas or

Drainage Pipeline for the specified period from the land owner/ occupier at the time of

payment of compensation to the land owner / occupier under sub-section (3) of

section 10 of the ordinance.

10. Restoration of possession.- After laying the Water, Gas or Drainage Pipelines, the land

shall be levelled and restored as good as before, by the State Government, or the Corporation,

as the case may be, and the possession of land shall be handed over by the Competent

Authority. In this regard, the Competent Authority shall restore the possession handing over

certiﬁcate in Form ‘F’ to the landowner / occupier.

11. Right of entering for inspection etc.- (1) After handing over the possession of land to

the land owner / occupier, the Corporation who laid the Water, Gas or Drainage Pipelines the

persons authorized by the Corporation shall have the power to enter in the land and do the

work as found necessary for inspection, maintenance, repair, replacement or removal of the

Water, Gas or Drainage Pipelines.

(2) If the land owner or occupier refuses to sign any form, which he or she is required to sign

under these rules, the same shall be signed by the Completent Authority, provided the

procedure under these rules has been followed.

12. Cost of acquisition of right of user by requisitioning body

(1) The establishment charge and contingency cost for the right of user by requisitioning

body / corporation shall be 5 percent of the total value of compensation assessed under rule 7.

(2) The requisitioning body / corporation shall deposit the establishment charge and the

contingency cost, as calculated under rule 12 (1) by way of bank draft to the Collector and

the Collector shall deposit the cost of user land in the Deposit account in the district treasury

or in a scheduled bank account maintained separately for this purpose to be jointly operated

by Competent Authority and Deputy Commissioner.

13. Issue of instructions.- The State Government may issue instructions for removal of any

difficulties regarding implementation of the provisions of the Act / Ordinace and the Rules

framed thereunder from time to time.
