झारखड रा7य मF नेताजी सुभाष 2वव2वयालय क= Gथापना एवं समावेश के लए और उससे

स,बK एक 4नजी 2वव2वयालय के आनुषं0गक मामलM क= िGथ4त दान करने हेतु एक अ0ध4नयम ;

जबCक यह समयो0चत है Cक पटना, Oबहार से सृिजत एवं पंजीकृत sitwanto Devi Mahila

Kalyan संGथान सूरज पथ, Bariddih, ईGट संहभूम, जमशेदपुर, सोसायटR रिजGSेशन एTट, 21,

1860 (पंजीयन सं$या-209/1996-97 8दनांक-11.12.1996) वारा ायोिजत नेताजी सुभाष

सं,-.त नाम, व'तार एवं &ारंभः-

यह अ0ध4नयम ” नेताजी सुभाष व वव!यालय अध#नयम, 2018“ कहा जाएगा ।

इसका 2वGतार स,पूणA झारखड रा7य मF होगा ।

यह उस 4त0थ से वृत होगा जैसा Cक रा7य सरकार वारा शासक=य राजप_ मF

अ0धसूचना जारR कर 4नयत Cकया जाय ।

प1रभाषा:-

अगर इस अ0ध4नयम के संदभA मF अZयथा अपे`aत/आवयक होः

(क)

’अकादमक पcरष’ का अथA है 2वव2वयालय क= अकादमक पcरष जैसा Cक

अ0ध4नयम क= धारा-24 मF व5णAत है;

(ख)

‘वा2षAक 4तवेदन’ का आशय है 2वव2वयालय का वा2षAक 4तवेदन जैसा अ0ध4नयम

क= धारा-39 मF संदभAत है;

(ग)

‘बंधन’ बोडA’ का अथA है, इस अ0ध4नयम क= धारा-23 के तहत ग8ठत 2वव2वयालय

का बंधन बोडA;

(घ)

‘पcरसर’ का आशय है 2वव2वयालय का aे_फल जहाँ यह अविGथत है;

(ङ)

‘कुला0धप4त’ से आशय है 2वव2वयालय के कुला0धप4त, जो इस अ0ध4नयम क= धारा-

के अधीन 4नयुTत हM;

(च)

’मु$य 2वiत एवं लेखा पदा0धकारR’ का अथA है 2वव2वयालय के मु$य 2वiत एवं लेखा

पदा0धकारR जो अ0ध4नयम क= धारा-18 के अधीन 4नयुTत हM;

(छ)

‘परRaा 4नयं_क’ का अथA है 2वव2वयालय के परRaा 4नयं_क, िजनक= 4नयुिTत

अ0ध4नयम क= धारा-19 के अधीन हुई हो;

(ज)

‘अंगीभूत महा2वयालय’ से आशय है वैसे महा2वयालय अथवा संGथान जो

2वव2वयालय वारा संपो2षत हM;

‘Gथायी 4न0ध’ का अथA है 2वव2वयालय क= Gथायी 4न0ध िजसक= Gथापना अ0ध4नयम

क= धारा-37 के तहत हुई हो;

(ट)

‘संकाय’ से आशय है समान अनुशासनM के अकादमक 2वभाग;

(ठ)

‘शुmक’ का आशय है 2वव2वयालय वारा 2वया0थAयM से उगाहR गयी राश, जो Cकसी

पाnयoम तथा उससे संबं0धत हो;

(ड)

‘सामाZय 4न0ध’ से आशय है 2वव2वयालय क= सामाZय 4न0ध, िजसक= Gथापना

अ0ध4नयम क= धारा-38 के अZतगAत हुई हो;

(ढ)

‘शासी 4नकाय’ का अथA है 2वव2वयालय का शासी 4नकाय, िजसका गठन अ0ध4नयम

क= धारा-22 के तहत हुआ हो;

(ण)

‘राqSRय मूmयांकन एवं iयायन पcरष से आशय है राqSRय मूmयांकन एवं iयायन

पcरष, बFगलुX, 2वव2वयालय अनुदान आयोग क= एक Gवायiत संGथा;

(त)

‘2व8हत’/’4नयत’ का अथA है इस अ0ध4नयम के तहत 2व8हत/4नयत पcर4नयम और

4नयमावलR;

(थ)

‘4त-कुलप4त’ का अथA है 2वव2वयालय के 4त कुलप4त, िजनक= 4नयुिTत

अ0ध4नयम क= धारा-15 के तहत हुई हो;

(द)

‘कुलस0चव’ का अथA है 2वव2वयालय के कुलस0चव, िजनक= 4नयुिTत अ0ध4नयम क=

धारा-17 के तहत हुई हो;

(ध)

‘4नयं_ी 4नकाय’ का आशय है भारत सरकार वारा उsच शaा के अकादमक Gतर के

सु4नचयन हेतु मानकM एवं शतt के 4नधाAरण के लए Gथा2पत 4नकाय, यथा-

2वव2वयालय अनुदान आयोग, अ5खल भारतीय तकनीक= शaा पcरष, राqSRय

शaक शaा पcरष, भारतीय 0चCकiसा पcरष, बार काउंसल ऑफ इंvडया, फामwसी

काउंसल ऑफ इंvडया, राqSRय मूmयांकन एवं iयायन पcरष, भारतीय नसxग पcरष,

भारतीय कृ2ष अनुसंधान पcरष, वैyा4नक एवं औयो0गक शोध पcरष आ8द तथा

इसके अलावा सरकार अथवा कोई वैसा 4नकाय, जो भारत सरकार या रा7य सरकार

वारा ग8ठत Cकया गया हो;

(न)

‘4नयमावलR’ से आशय है इस अ0ध4नयम के अZतगAत 4नमAत 4नयमावलR;

(प)

‘अनुसूची’ का अथA है इस अ0ध4नयम के तहत संलzन अनुसूची;

(फ)

2वव2वयालय से संबं0धत ‘वतAक 4नकाय’ का अथA हैः-

झारखडगजट(असाधारण) सोमवार, 24 सत,बर, 2018

(i)

सोसाइटRज रिजGSेशन एTट, 1860 के अZतगAत कोई संGथा, अथवा

(ii)

इंvडयन SGट एTट, 1882 के अधीन पंजीकृत कोई लोक Zयास, अथवा

(iii)

Cकसी रा7य क= 2व0ध के अनुXप पंजीकृत कोई संGथा या Zयास।

(ब)

‘रा7य सरकार’ से आशय है झारखड क= रा7य सरकार;

(भ)

‘पcर4नयम’ ’अ|यादेश’ और ‘2व4नयम' का oमशः आशय है, पcर4नयम, अ|यादेश और

2व4नयम जो इस अ0ध4नयम के अZतगAत 2वव2वयालय वारा 4नमAत हM;

(म)

‘2वव2वयालय के 2वयाथ~’ का अथA है 2वव2वयालय मF उपा0ध, vडलोमा अथवा

2वव2वयालय वारा Gथा2पत अZय अकादमक 2वशqटता ात करने हेतु एक

पाnयoम मF नामांCकत €यिTत, िजसमF शोध-उपा0ध भी शामल है;

(य)

‘शaक’ से आशय है ोफेसर, एसोसएट ोफेसर, असGटेZट ोफेसर अथवा इस तरह

के अZय €यिTत, िजनक= 4नयुिTत 2वव2वयालय या Cकसी अंगीभूत महा2वयालय या

संGथा मF 4नदwशत करने (शaण) अथवा शोधकायA संचालन हेतु हुई हो, इसके तहत

अंगीभूत महा2वयालय अथवा संGथान के धानाचायA भी सि,मलत हk, िजनक= संपुिqट

2वव2वयालय अनुदान आयोग वारा 4नधाAcरत 4नयमM के अZतगAत हुई हो;

(र)

‘2वव2वयालय अनुदान आयोग’ से आशय है 2वव2वयालय अनुदान आयोग

अ0ध4नयम, 1956 के अधीन Gथा2पत 2वव2वयालय अनुदान आयोग;

(ल)

‘2वव2वयालय’ का अथA है इस अ0ध4नयम के अZतगAत झारखड मF Gथा2पत नेताजी

सुभाष 2वव2वयालय;

(व)

‘कुलप4त’ से आशय है 2वव2वयालय के कुलप4त, िजनक= 4नयुिTत इस अ0ध4नयम

क= धारा-13 के तहत हुई हो;

(श)

‘2विजटर’/‘अ4त0थ’/’आगंतुक’ से आशय है 2वव2वयालय के 2विजटर/अ4त0थ/आगंतुक

यथा इस अ0ध4नयम क= धारा-10 मF व5णAत है।

व वव!यालय क4 'थापना:-

(1)

2वव2वयालय क= Gथापना नेताजी सुभाष 2वव2वयालय के नाम से होगी।

(2)

2वव2वयालय का मु$यालय झारखड रा7य के अZतगAत होगा तथा यह पोखार8, ई'ट

)संहभूम, जमशेदपुर मF अविGथत होगा।

(3)

वतAक 4नकाय को रा7य सरकार वारा ा0धकार प_ जारR Cकये जाने के बाद हR

2वव2वयालय का संचालन आरंभ Cकया जायेगा।

(4)

इस अ0ध4नयम क= अनुसूची ’ए’ मF सि,मलत शतt को 2वव2वयालय 4नधाAcरत

समयाव0ध मF पूरा करेगा।

2वव2वयालय के शासी 4नकाय, बंधन बोडA, अकादमक पcरष, कुला0धप4त,

कुलप4त, 4त कुलप4त, कुलस0चव, शaक, मु$य 2वiत एवं लेखा पदा0धकारR एवं

अZय अ0धकारR यासदGय या ा0धकारR एतYवारा 2वव2वयालय के नाम से ग8ठत

4नकाय बनाएंगे जब तक वे इस पद पर है अथवा उनक=सदGयता बनी रहेगी।

(6)

2वव2वयालय एक अस,बK 2वव2वयालय के Xप मF कायA करFगे और वे Cकसी भी

महा2वयालय या संGथान मF नामांCकत 2वया0थAयM को उपा0ध (vडी), vडलोमा और

माण-प_ दान करने हेतु सबKता नहRं दे सकF गे।

(7)

इस अ0ध4नयम के भावी होने के पूवA वतAक 4नकाय के अंगीभूत महा2वयालय और

संGथान, जो स,बKता ात हk और 2वव2वयालय के 2वशेषा0धकार का उपयोग कर

रहे हk वे इस अ0ध4नयम के भावी होने के साथ हR उस 2वव2वयालय से अस,बK हो

जाएंगे, उनक= ऐसी सु2वधाएँ इस अ0ध4नयम के लागू होने के साथ समात हो जाएंगी

और नेताजी सुभाष 2वव2वयालयके वतAक 4नकाय वारा दiत सु2वधाओं के साथ

ऐसे महा2वयालय और संGथान उस नेताजी सुभाष 2वव2वयालय के अंगीभूत

महा2वयालय या संGथान बन जाएंगे।

(8)

नेताजी सुभाष 2वव2वयालय नाम से एक 4नकाय होगा और इस अ0ध4नयम के

ावधानM के अनुXप उसके पास सतत् पद-ाित अनुoम और सामाZय 4तyा माणन

क= शिTत होगी, स,प4त हण करने व उस पर आ0धपiय रखने, उसे अनुबंध/सं2वदा

पर देने अथवा क0थत नाम से वाद चलाने के अ0धकार हMगे या िजस पर वाद दायर

Cकया जा सकेगा।

2वव2वयालय रा7य सरकार अथवा केZ… सरकार से Cकसी भी कार के अनुदान

अथवा 2वiतीय सहायता ात नहRं कर सकF गे।

बशतw Cक रा7य सरकार अथवा केZ… सरकार अनुदान या अZय तरRके से 2वiतीय

सहायता दे सकती हैः

(a)

शोध 2वकास और अZय ग4त2व0धयM के लए जैसे रा7य सरकार के अZय संगठनM को

2वiतीय सहायता उपल‡ध करायी जाती है अथवा

(b)

2वशqट शोध अथवा कायAoम आधाcरत कोई ग4त2व0ध;

व वव!यालय क4 स?प#त एवं इसके अनु&योग:-

(1)

2वव2वयालय क= Gथापना हो जाने पर भूम और अZय चल एवं अचल स,प4तयाँ, जो

झारखड रा7य मF 2वव2वयालय के उŠेय (पू4तA) के लए अ0ध8हत, सृिजत,

€यविGथत या 4नमAत क= जाती हk, वे 2वव2वयालय मF 4न8हत हMगी।

(2)

2वव2वयालय वारा भूम, भवन और अZय अ0ध8हत स,प4तयाँ Cकसी अZय उŠेय

के लए इGतेमाल नहRं हMगी सवा िजस उŠेय के लए वे अ0ध8हत क= गयी हk।

2वव2वयालय क= चल अथवा अचल स,प4तयM का बंधन शासी 4नकाय वारा

2व4नयमM मF दiत रR4त के अनुXप Cकया जायेगा।

(4)

उप धारा-(1) के अZतगAत 2वव2वयालय के नाम से हGतांतcरत स,प4त को

2वव2वयालय के 2वघटन अथवा समापन के फलGवXप 4नधाAcरत ढंग से 4नयमावलR

मF व5णAत तरRके से युTत Cकया जाएगा।

व वव!यालय के #नबCधन/अवरोध और बाEयताएँ:-

(1)

2वव2वयालय के €यावसा4यक पाnयoमM, यथा-अभयं_ण एवं ौयो0गक=, 0चCकiसा-

शाG_, बंधन आ8द के लए शaण-शुmक का 4नधाAरण 2वव2वयालय के वारा रा7य

सरकार वारा अ0धसू0चत समय-समय पर 4नयामक 4नकाय, जैसा वह उ0चत समझेगी,

के पयAवेaण मF Cकया जाएगा।

(2)

2वव2वयालय मF नामांकन पूरR तरह योzयता के आधार पर होगा। 2वव2वयालय मF

नामांकन क= योzयता का 4नधाAरण ातांक या अहAता परRaा मF ात ेड और

पाnयेतर और अ4तcरTत पाnयचयाA ग4त2व0धयM अथवा रा7य Gतर पर 2वव2वयालय

या

2वव2वयालयM

के

संगठन

या

रा7य

सरकार

के

Cकसी

अभकरण

वारा समान पाnयoमM के लए संचालत वेश परRaा मF ात अंकM या ेड के

आधार पर Cकया जाएगा।

बशतw Cक 2वव2वयालय के €यावसा4यक शaण महा2वयालयM अथवा संGथानM

मF नामांकन 4नयं_ी 4नकाय के ावधानM वारा शासत/4नयमत हो।

(3)

4नधAन एवं आ0थAक Œिqट से 2पछड़े वगt के 2वया0थAयM के लए 2वव2वयालय

कोशaण शुmक मF पूरR aमता के कम से कम पाँच 4तशत को मेधा छा_वृ4त क=

अनुम4त देनी होगी। 4नधAनता तथा आ0थAक Œिqट से 2पछड़े वगt क= कसौटR का

4नधाAरण रा7य सरकार वारा समय-समय पर Cकया जा सकेगा।

(4)

2वव2वयालय के 2वया0थAयM क= कुल सं$या के कम से कम पsचीस 4तशत सीटM

पर झारखड रा7य के अ0धवासी 2वया0थAयM के लए आर`aत करने का ावधान

2वव2वयालय को करना होगा। सीटM के आरaण का 4नयमन झारखड सरकार के

4नयम और समय-समय पर जारR आदेशM के वारा Cकया जायेगा।

(5)

2वव2वयालय को 2वव2वयालय के शaकेतर पदM के कम से कम पचास 4तशत

शaकेतर पदM को झारखड रा7य के अ0धवासी लोगM के लए आर`aत करने का

ावधान रखना होगा। सीटM के आरaण का 4नयमन झारखड सरकार के 4नयम और

समय-समय पर जारR आदेशM के वारा Cकया जायेगा।

(6)

2वव2वयालय को अकादमक Gतर को बनाये रखने के लए यथेqट/पयाAत सं$या मF

शaकM एवं अ0धकाcरयM क= 4नयुिTत करनी होगी और यह सु4निचत करना होगा Cक

झारखडगजट(असाधारण) सोमवार, 24 सत,बर, 2018

उन शaकM या अ0धकाcरयM क= योzयता ासं0गक 4नयामक 4नकाय वारा 4नधाAcरत

मानक से 4न,न न हो।

(7)

2वव2वयालय को 2वव2वयालय से जुड़ी तमाम सूचनाएँ 2वया0थAयM एवं

अZयपणधाcरयM के 8हत मF सावAज4नक करनी होगी, जैसे Cक संचालत पाnयoम,

अलग-अलग को8ट (Žेणी) के तहत सीटF, शुmक एवं अZय पcर€यय, दत सहूलयतF एवं

सुख सु2वधाएँ, उपल‡ध संकाय/ा|यापक वगA एवं अZय ासं0गक सूचनाएँ।

पcर4नयमM मF व5णAत रR4त के अनुXप 2वव2वयालय iयेक अकादमक वषA मF उपा0ध,

vडलोमा दान करने एवं अZय उŠेय से दRaांत समारोह आयोिजत कर सकेगा।

(9)

2वव2वयालय को Gथापना के पाँच वषt के भीतर राqSRय मूmयांकन एवं iयायन

पcरष (NAAC) से iयायन ात करना होगा और भारत सरकार क= अZय 4नयामक

संGथाएँ, जो 2वव2वयालय वारा संचालत पाnयoमM से स,बK हk, के वारा दiत

ेड क= सूचना रा7य सरकार को देनी होगी। 2वव2वयालय को समय-समय पर ऐसे

iयायन का नवीकरण कराना होगा।

(10) इतना होते हुए भी इस अ0ध4नयम क= अनुसूची ’A’ मF उिmल5खत शतt और भारत

सरकार क= 4नयामक संGथाओं के 4नयमM, 2व4नयमM, मानदडM आ8द का इन संGथाओं

वारा दiत सहूलयतM तथा सहयोग व कतA€यM के 4नqपादन एवं कायA को जारR रखने

के लए उन संGथाओं को जैसी आवयकता होगी, 2वव2वयालय के लए इनका

अनुपालन बा|यकारR होगा।

व वव!यालय के उIे य:-

2वव2वयालय का उŠेय अनुदेशनाiमक, शोध तथा सार एवं ऐसी अ0धगम क=

शाखाओं के वारा जैसा वो उपयुTत समझे, yान तथा कौशलM को बढ़ाना तथा 2वGतार

करना होगा और 2वव2वयालय यह यiन करेगा Cक 2वया0थAयM तथा शaकM को

4न,नल5खत के लए आवयक माहौल तथा सु2वधाएँ उपल‡ध करायी जायF:-

(क)

पाnयoम का मु$य शaा मF पुन4नAमाAण एवं नवाचार, शaण के नवीन तरRके,

शaण तथा अ0धगम ऑनलाइन अ0धगम स8हत, सि,म0Žत अ0धगम, सतत् शaा

एवं अZय तरRके तथा एक=कृत एवं €यिTतiव का 8हतकर 2वकास;

(ख)

2व2वध अनुशासनM मF अ|ययन;

(ग)

अंतर अनुशास4नक अ|ययन;

(घ)

राqSRय अखंडता, धमA4नरपेaता एवं सामािजक समता तथा अZतरराqSRय मेल मलाप

एवं नी4तशाG_।

व वव!यालय )लंग, धमK, वगK, रंग, पंथ, अथवा मत से परे सबके )लए खुला होगा:-

Cकसी भी €यिTत को 2वव2वयालय के Cकसी कायाAलय अथवा उसके Cकसी अZय ा0धकार

क= सदGयता से अथवा Cकसी vडी, vडलोमा अथवा अZय अकादमक वैशqय पाnयoम मF नामांकन

से लंग, मत, वगA, जा4त, जZम के Gथान और धामAक 2ववास अथवा राजनी4तक या अZय मतवाद

के आधार पर पaपात या भेदभाव कर वं0चत नहRं Cकया जाएगा।

व वव!यालय के कायK एवं शिMतयाँ:-

(i)

2वव2वयालय का शासन एवं बंधन, इसके अंगीभूत महा2वयालयM का शासन एवं

बंधन तथा शोध, शaण, शaण के केZ…M का 2वGतार एवं सतत् शaा, दूरGथ

अ0धगम एवं ई-ल4नxग के 2वGतार एवं पहुँच को इसके झारखड रा7य मF अविGथत

पcरसर मF संचालन व बंधन;

(ii)

2वyान, ौयो0गक=, मान2वक=, समाज 2वyान, शaा-शाG_, बंधन, वा5ण7य, 2व0ध,

फामwसी, GवाG‘य सेवा एवं अZय aे_M मF शोध, उsच शaा, €यावसा4यक

शaा, शaण- शaण, सतत् शaा, दूरGथ अ0धगम एवं ई-ल4नxग के संसाधनM को

उपल‡ध कराना;

(iii)

शै`aक ौयो0गक=, शaण एवं अ0धगम Coया मF नवाचारR योग, राqSRय एवं

अZतरराqSRय संGथाओं के साथ सहयोग एवं वैसी संGथाओं को संयुTत कायAoमM का

Gताव देना िजससे शaा के 2वतरण एवं अZतरराqSRय मानकM को 2वकसत एवं ात

करने मF 4नरंतरता रहे;

(iv)

शaा दान करने मF लचीलेपन के लए 4नधाAcरत पाnयoम, पाnयचयाA एवं णालR मF

इलेTSा4नक एवं दूरGथ अ0धगम 2व8हत करना;

(v)

परRaा का आयोजन तथा Cकसी €यिTत के नाम 2वव2वयालय वारा तय शतt के

साथ उपा0ध, vडलोमा या माण-प_ और अZय अकादमक 2वशqटता दान करना

अथवा 2व4नयमM मF व5णAत तरRके से उस उपा0ध, vडलोमा या माण-प_ और अZय

अकादमक 2वशqटता या नाम को वापस लेना;

(vi)

फेलोशप (शaावृिiत), छा_वृिiत, पदक और पुरGकार Gथा2पत एवं दान करना;

(vii)

पcर4नयम मF व5णAत तरRके के अनुXप मानद उपा0ध या अZय 2वशqटता दान करना;

(viii) उŠेयM क= ाित मF आवयक सहायता के लए Gकूल, केZ…, संGथान, महा2वयालय

क= Gथापना और 2वव2वयालय के मतानुसार कायAoमM तथा पाnयoमM का आयोजन;

(ix)

2वव2वयालय के मतानुसार शaा दान करने व योजनM के ोiसाहन के लए Cकसी

महा2वयालय, केZ…, संGथान को अंगीभूत महा2वयालय घो2षत करना या नये

अंगीभूत महा2वयालय, केZ…, संGथान क= Gथापना करना;

के शै`aक एवं अZय संGथानM, 2वव2वयालयM के साथ 2वया0थAयM, शोधा0थAयM,

शaकM, कमAचाcरयM के आदान-दान के वारा संबंध अथवा सहयोग बनाना जैसा वो

उ0चत समझे;

(xvii) अनुसंधान, शaण, परामशA तथा इस कार क= अZय सेवाएँ देना, जो 2वव2वयालय

के योजन के लए आवयक हो;

(xviii) शaकM, शोधा0थAयM, शासकM एवं 2वyान, ौयो0गक=, मान2वक=, समाज 2वyान,

शaा, बंधन, 2व0ध, वा5ण7य, फामwसी, GवाG‘य सेवा एवं स,बK aे_ के 2वशेषyM के

बीच 2वव2वयालय के ल”यM क= ाित के लए संबंध बनाये रखना;

(xix) म8हलाओं एवं अZय वं0चत 2वया0थAयM के लए 2वव2वयालय वारा यथासंभव

वांछनीय 2वशेष €यवGथा करने पर 2वचार;

(xx) 2वव2वयालय के €यय का 4नयमन, 2वiत का बंधन एवं लेखा का रख-रखाव;

(xxi) 2वव2वयालय के उŠेय एवं ल”य ाित के लए हGतांतरण वारा 4न0ध, चल एवं

अचल स,पिiत, उपGकर, सॉ–टवेर एवं अZय संसाधनM को €यवसाय, उयोग, समाज

के अZय वगt, राqSRय एवं अZतरराqSRय संगठनM अथवा Cकसी अZय —ोत से उपहार,

दान, उपकार या वसीयत के Xप मF ात करना;

(xxvii) 2वव2वयालय आवयकता या योजन को पूरा करने क= Œिqट से Cकसी भूम या

भवन को खरRदने, प˜े पर लेने या उपहारव वसीयत, 2वरासत या अZय तरRके से कायA

हेतु ात कर सकेगा और यह उन 4नयमM व शतt के Xप मF GवीकायA हो सकता है,

िजससे Cकसी भवन को बनाने या कायA करने, उसमF पcरवतAन करने और रख-रखाव

हेतु उ0चत हो;

(xxviii) 2वव2वयालय के 8हत, ग4त2व0धयM एवं उŠेयM क= संग4त क= Œिqट से जो माZय हो,

उसके अनुXप 2वव2वयालय क= चल या अचल स,पिiत या उसके Cकसी 8हGसे को

बेचने, 2व4नमय, प˜ा या अZय तरRके से बं0धत करना;

(xxix) 4नमाAण और समथAन, कटौती और वाताA, वचनप_ नोट, 2व4नयम Oबल, चेक और अZय

2व4नमेय उपGकर आक2षAत और Gवीकार करना;

(xxx) 2वव2वयालय के सभी खचt को पूरा करने के लए 2वव2वयालय क= 4न0ध को

बढ़ाना और बांड पर उधार लेना, बंधक, वचनप_ नोट या अZय दा4यiवM या 4तभू4तयM

क= Gथापना या स,पूणA अथवा 2वव2वयालय क= Cकसी संपिiत और पcरस,पिiत

अथवा Oबना Cकसी 4तभू4त और माZय 4नयमM और शतt के अनुXप करना;

स?बOता के अवरोधक:-

(1)

2वव2वयालय को Cकसी महा2वयालय या संGथा को स,बKता देने का 2वशेषा0धकार

नहRं होगा।

(2)

2वव2वयालय अनुदान आयोग अथवा सरकार वारा Gथा2पत ऐसे अZय 4नयामक

4नकायM अथवा केZ… या रा7य सरकार, जैसा भी हो, के वारा पूवA Gवीकृ4त के पचात्

हR 2वव2वयालय अपने पcरसर के अलावा कोई दूरवत~ पcरसर, अपतट पcरसर,

अ|ययन केZ…, परRaा केZ… झारखड रा7य के अZदर या बाहर शुX कर सकेगा।

(3)

दूरGथ णालR से पाnयoमM क= शुXआत केवल 2वव2वयालय अनुदान आयोग अथवा

सरकार वारा Gथा2पत ऐसी 4नयामक संGथा क= पूवA Gवीकृ4त के बाद क= जाएगी।

10.

आगंतुक (विजटर):-

(1)

झारखड के रा7यपाल 2वव2वयालय के 2विजटर (आगंतुक) हMगे।

(2)

आगंतुक (2विजटर) जब दRaांत समारोह मF vडी (उपा0ध), vडलोमा, चाटAर, ओहदा

(पदनाम) और माण-प_ दान करने के लए मौजूद रहFगे तो उसक= अ|यaता करFगे।

(3)

2वव2वयालय अथवा 2वव2वयालय वारा संपो2षत Cकसी संGथान के शaा के Gतर,

अनुशासन, शqटाचार और समु0चत Coयाशीलता को सु4निचत करने क= Œिqट से

आगंतुक को 2वव2वयालय के ™मण/दौरे का अ0धकार होगा।

12.

कुलाधप#त:-

(1)

कुला0धप4त क= 4नयुिTत वतAक 4नकाय वारा पाँच वषt क= अव0ध के लए आगंतुक

(2विजटर) के अनुमोदन के पचात् 4नधाAcरत Coयाओं तथा एतसंबंधी 4नयमM एवं

शतt के अनXप क= जाएगी। कायAकाल पूरा होने के पचात् कुला0धप4त आगंतुक क=

सलाह के बाद वतAक 4नकाय वारा पुन4नAयुTत Cकये जा सकF गे।

(2)

कुला0धप4त अपने कायाAलय पद के अ0धकार से 2वव2वयालय के धान हMगे।

(3)

कुला0धप4त शासी 4नकाय क= बैठकM क= अ|यaता करFगे और जब आगंतुक

(2विजटर)मौजूद नहRं रहFगे तब उपा0ध (vडी), vडलोमा या अZय अकादमक 2वशqटता

दान करने हेतु दRaांत समारोह क= अ|यaता करFगे।

(4)

कुला0धप4त अपने हाथ से ल5खत व वतAक 4नकाय को संबो0धत कर अपने पद से

इGतीफा दे सकते हk।

(5)

कुला0धप4त को 4न,नल5खत अ0धकार हMगे, यथाः-

(क)

Cकसी भी जानकारR या अभलेख क= माँग करने;

(ख)

कुलप4त क= 4नयुिTत;

(ग)

इस अ0ध4नयम के ावधानM के अनुXप कुलप4त को हटानेऔर

(घ)

इस अ0ध4नयम या पcर4नयमM के वारा दiत अZय शिTतयाँ।

13.

कुलप#त:-

(1)

कुलप4त क= 4नयुिTत कुला0धप4त 2वव2वयालय अनुदान आयोग वारा 4नधाAcरत

योzयताओं के अनुXप करFगे और ये पाँच साल क= अव0ध के लए अपने पद पर बने

रहFगे। बशतw Cक कुलप4त पाँच वषA क= अव0ध पूरR होने के पचात् पाँच वषA के एक और

कायAकाल के लए पुन4नAयुिTत के पा_ हMगे। शतA यह रहेगी Cक कुलप4त के Xप मF

4नयुTत €यिTत 70 वषA क= आयु पूरR करने के बाद अपने पद से, कायAकाल के दौरान

या 2वGताcरत कायAकाल से सेवा4नवृत हो जाएगा।

(2)

कुलप4त 2वव2वयालय के मु$य कायAकारR और अकादमक अ0धकारR हMगे और

2वव2वयालय के मामलM मF सामाZय अधीaण और 4नयं_ण का योग करFगे

तथा2वव2वयालय के 2वभZन ा0धकारM वारा लए गए फैसलM पर अमल करFगे।

(3)

आगंतुक (2विजटर) और कुला0धप4त क= गैर मौजूदगी मF 2वव2वयालय के दRaांत

समारोह क= अ|यaता करFगे।

कुलप4त य8द यह अनुभव करF Cक Cकसी मामले पर तiकाल कारAवाई आवयक है, तो

वे 2वव2वयालय के Cकसी ा0धकार का इस अ0ध4नयम के तहत दiत शिTतयM का

इGतेमाल कर सकते हk और उस ा0धकार को संबK मामले मF कृत कारAवाई क=

जानकारR दे सकते हk।

बशतw Cक 2वव2वयालय का ा0धकार या 2वव2वयालय क= सेवा का अZय

€यिTत य8द कुलप4त वारा कृत कारAवाई से €य0थत है तो इस उप धारा के तहत इस

4नणAय के संे2षत होने क= 4त0थ के एक माह के भीतर कुला0धप4त के समa अपील

कर सकता है। कुला0धप4त, कुलप4त वारा क= गयी कारAवाई को संपुqट, संशो0धत या

पcरव4तAत कर सकते हk।

(5)

कुलप4त ऐसी शिTतयM का योग करFगे और इस तरह के अZय कायA करFगे जो 2व8हत

Cकया जाय l

14.

कुलप#त क4 पदSयु#त:-

(1)

कुला0धप4त को य8द Cकसी समय Cकसी जाँच के पचात् आवयक लगे या तीत हो

Cक कुलप4तः

(क)

इस अ0ध4नयम, पcर4नयम, अ|यादेश के तहत दiत कतA€यM के 4नवAहन मF

2वफल रहे हM; अथवा

(ख)

2वव2वयालय के 8हतM के 2वपरRत पूवाAह से ेcरत होकर कायA Cकये हM, या

(ग)

2वव2वयालय के मामलM को सुलझाने मF अaम हM, तो कुला0धप4त इस बात

के होते हुए भी Cक कुलप4त का कायAकाल पूरा नहRं हुआ है, कारण बताते हुए 4नधाAcरत 4त0थ

से पद से इGतीफा देने के लए ल5खत आदेश दे सकते हk।

(2)

उप धारा (1) के तहत 2वशेष आधार पर कारAवाई के Cकसी Gताव क= सूचना 8दए Oबना

कोई आदेश पाcरत नहRं Cकया जाएगा, Gता2वत आदेश के 5खलाफ कारण बताने का एक

समु0चत अवसर कुलप4त को 8दया जाएगा।

15.

&#त-कुलप#त:-

(1)

4त-कुलप4त क= 4नयुिTत कुला0धप4त वारा इस तरRके से क= जाएगी और वह ऐसी

शिTतयM का योग करेगा तथा ऐसे कायt का 4नqपादन करेगा जो 2व8हत Cकया जाय ।

(2)

4त कुलप4त उप धारा-1 के तहत 4नयुTत एक ोफेसर के Xप मF अपने कतA€यM के

अलावा अपने कतA€य का 4नवAहन करFगे।

(3)

4तकुलप4त कुलप4त को उनक= आवयकतानुसार उनके कतA€यM के 4नवAहन मF सहायता

करFगे।

(4)

4तकुलप4त वतAक 4नकाय वारा 4नधाAcरत राश मानदेय के Xप मF ात करFगे।

16.

#नदेशक/&धानाचायK :-

4नदेशकM/धानाचायt क= 4नयुिTत 4न8दAqट ढंग से तथा दiत शिTतयM का योग कर क= जा

सकेगी।

कुलसचव :-

(1)

कुलस0चव वतAक 4नकाय के अ|यa वारा पcर4नयम मF 4न8दAqट ावधानM के अनुसार

4नयुTत Cकये जाएंगे। कुलस0चव 2वव2वयालय अनुदान आयोग वारा 4नधाAcरत

योzयता को धारण करFगे।

(2)

कुलस0चव को 2वव2वयालय क= ओर से अभलेखM, दGतावेजM को अभमा5णत करने,

माण-प_M पर हGताaर करने तथा समझौता करने क= शिTत होगी तथा वे ऐसी दूसरR

शिTतयM का योग एवं कायt को पूरा करFगे जो उनके लए 4न8दAqट Cकया गया हो।

(3)

कुलस0चव कायAकारR पcरष एवं अकादमक पcरष के पदेन सदGय स0चव हMगे लेCकन

उZहF मत देने का अ0धकार नहRं होगा।

18.

मुय वUत तथा लेखा अधकार8 :-

(1)

वतAक 4नकाय के अ|यa वारा मु$य 2वiत तथा लेखा पदा0धकारR क= 4नयुिTत इस

कार क= जाएगी, जैसा पcर4नयम मF 4न8दAqट हो।

(2)

मु$य 2वiत एवं लेखा पदा0धकारR ऐसी शिTतयM का योग तथा दा4यiवM का 4नवAहन

कर सकF गे जैसा Cक पcर4नयम मF 4न8दAqट है।

19.

पर8-ा #नयंVक:-

(1)

परRaा 4नयं_क 2वव2वयालय का पूणAकालक पदा0धकारR होगा तथा पcर4नयम के

अनुXप कुला0धप4त वारा 4नयुTत Cकया जाएगा।

(2)

परRaा 4नयं_क के दा4यiव हMगेः-

(क)

परRaा को अनुशासत एवं कुशल तरRके से संचालत करना;

(ख)

स$त गोपनीयता क= Œिqट से न-प_M के चयन क= €यवGथा करना;

(ग)

4नधाAcरत समय-साcरणी के अZतगAत उiतर पुिGतकाओं के मूmयांकन क=

€यवGथा करना;

(घ)

परRaा-णालR क= 4नqपaता और 2वषय4नqठता को उZनत बनाने तथा

2वया0थAयM क= योzयता के सहR आकलन क= Œिqट से बेहतर साधन अपनाने के

लए सतत् समीaा करना;

(ङ)

कुलप4त के वारा समय-समय पर स›पे गए उन सारे दा4यiवM का 4नवAहन

करना जो परRaा से संबं0धत हM।

20.

अWय अधकार8:-

अZय अ0धकाcरयM के दा4यiव, शिTतयM और 4नयुिTत का तरRका वैसा होगा, जैसा 4न8दAqट Cकया

सरकार के स0चव, उsच एवं तकनीक= शaा 2वभाग, झारखंड अथवा उनका

कुला0धप4त वारा नामत 2वव2वयालय के बाहर से एक €यिTत, जो बंधन

और ौयो0गक= के 2वशेषy के Xप मF हMगे।

(च)

कुला0धप4त वारा नामत एक 2वiत 2वशेषy।

(2)

शासी 4नकाय 2वव2वयालय का सवœsच ा0धकार एवं मु$य शासी 4नकाय होगा।

2वव2वयालय के अZय 4नणAयM क= समीaा करना य8द वे अ0ध4नयमM,

पcर4नयमM, अ|यादेश, 2व4नमय या 4नयमावलR के ावधानM के अनुXप नहRं हो;

(ग)

2वव2वयालय के वा2षAक 4तवेदन तथा बजट को अनुमो8दत करना;

(घ)

2वव2वयालय वारा अनुपालन हेतु 2वGतृत नी4तयM का 4नमाAण;

(ङ)

2वव2वयालय के 2वघटन के लए वतAक 4नकाय को अनुशंसा करना, य8द

संपूणA यास के बाद भी 2वव2वयालय ठक ढंग से कायA संपZन करने क=

िGथ4त मF नहRं हो;

(च)

पcर4नयमM वारा 4न8दAqट अZय शिTतयM का योग करना।

(3)

शासी 4नकाय क= बैठक एक कैलFडर वषA मF कम-से-कम तीन बार होगी।

(4)

बैठक का कोरम चार होगा;

बशतw उsच एवं तकनीक= शaा 2वभाग, झारखंड सरकार के स0चव या उनक=

अनुपिGथ4त मF 4नदेशक, उsच शaा iयेक बैठक मF उपिGथत हM, िजसमF सरकारR नी4तयM या 4नदwशM

23.

&बंधन बोडKः-

24.

अकाद)मक प1रष!:-

(1)

अकादमक पcरष कुलप4त तथा वैसे सदGयM के योग से बनेगा, जैसा पcर4नयम मF

4न8दAqट है ।

(2)

अकादमक पcरष के अ|यa कुलप4त हMगे ।

(3)

आकादमक पcरष 2वव2वयालय क= मु$य अकादमक 4नकाय होगी, जैसा Cक

अ0ध4नयम, पcर4नयमM, अ|यादेशM मF ावधान है और यह 2वव2वयालय क=

अकादमक नी4तयM का संयोजन तथा पयAवेaण करेगी।

(4)

अकादमक पcरष क= बैठक का कोरम पcर4नयम के 4नदwशM के अनुXप होगा।

25.

वUत स)म#त:-

(1)

2वiत सम4त 2वव2वयालय क= मु$य 2वiतीय 4नकाय होगी, जो 2वiत संबंधी मामलM

क= देख-रेख करेगी।

(2)

2वiत सम4त का सं2वधान, शिTतयाँ और कायA के अनुXप हMगे जैसा क= 2व8हत Cकया जाय ।

26.

योजना बोडK:-

(1)

योजना बोडA 2वव2वयालय का धान योजना 4नकाय होगा और यह सु4निचत करेगा

Cक बु4नयादR ढाँचा और अकादमक समथAन णालR 2वव2वयालय अनुदान आयोग

तथा अZय पcरषदM वारा 4नधाAcरत मानदंडM को पूरा करती है ।

(2)

योजना बोडA का सं2वधान, उसके सदGयM का कायAकाल तथा उनक= शिTतयM एवं कायt

का 4नधाAरण वैसा होगा जैसा क= 2व8हत Cकया जाय ।

27.

अWय &ाधकार:-

2वव2वयालय के अZय ा0धकारM का गठन, शिTतयाँ तथा कायA वैसा होगा जैसा क= 2व8हत

Cकया जाय ।

28.

Yकसी &ाधकार अथवा #नकाय क4 सद'यता के )लए अयोZयता:-

कोई €यिTत 2वव2वयालय के Cकसी ा0धकार या 4नकाय क= सदGयता के योzय नहRं होगा,

य8द वह अGवGथ मानस का है और उसे सaम Zयायालय वारा ऐसा घो2षत Cकया

गया है;

(ख)

1रिMतयाँ व वव!यालय के &ाधकार अथवा #नकाय के गठन या कायKवाह8 को अमाWय नह8ं

स)म#तयR का गठन:-

2वव2वयालय के ा0धकार ऐसी शतt के साथ जो 2वशेष काम के लए आवयक हM तथा जो

पcर4नयमM वारा अनुमो8दत हM, ऐसी सम4तयM का गठन कर सकF गे ।

प1र#नयम, अEयादेश और व#नयम

31.

&थम प1र#नयम:-

(1)

इस अ0ध4नयम के ावधानM तथा इसके अंतगAत बनाये गए 4नयमM के अनुकूल पहला

पcर4नयम 4न,नल5खत मामलM मF से सभी या Cकसी एक का 4नधाAरण करेगा, यथा-

(क)

2वव2वयालय के ा0धकारM और अZय 4नकायM के लए समय-समय पर गठन,

शिTतयM और कायt का 4नधाAरण;

(ख)

कुला0धप4त, कुलप4त क= 4नयुिTत क= शतt और उनक= शिTतयM तथा अ0धकारM

का 4नधाAरण;

(ग)

कुलस0चव और मु$य 2वiत तथा लेखा पदा0धकारR क= 4नयुिTत क= Coया और

शतt तथा उनक= शिTतयM और कायA का 4नधाAरण;

(घ)

अZय अ0धकाcरयM तथा शaकM क= 4नयुिTत क= पK4त और शतt तथा शिTतयM

और कायA का 4नधाAरण;

(ङ)

2वव2वयालय के कमAचाcरयM क= सेवा-शतt का 4नधाAरण;

(च)

कमAचाcरयM अथवा 2वया0थAयM और 2वव2वयालय के बीच Cकसी कार के

2ववाद क= िGथ4त मF म|यGथता क= Coया का 4नधाAरण;

(छ)

मानद उपा0धयाँ दान करना;

(ज)

2वया0थAयM के शaण शुmक क= अदायगी मF छूट और छा_वृिiत तथा फेलोशप

दान करने क= Coया का 4नधाAरण;

(झ)

सीटM के आरaण के 4नयम स8हत वेश क= नी4त का 4नधाAरण; तथा

(ञ)

2वया0थAयM से लया जाने वाला शुmक ।

(2)

2वव2वयालय का पहला पcर4नयम शासी 4नकाय वारा बनाया जाएगा और Gवीकृ4त

हेतु रा7य सरकार को सम2पAत Cकया जाएगा ।

(3)

2वव2वयालय वारा सम2पAत Cकए गए पहले पcर4नयम पर रा7य सरकार 2वचार

करेगी और यथासंभव इसक= ाित के साठ 8दनM के भीतर इसक= Gवीकृ4त, संशोधनM अथवा Oबना

संशोधन के जैसा वह आवयक समझे, देगी ।

रा7य सरकार वारा Gवीकृत पहले पcर4नयमM पर 2वव2वयालय अपनी सहम4त

संे2षत करेगा, अथवा रा7य सरकार वारा उप धारा-3 के अंतगAत Cकये गये Cकसी

संशोधन या सभी संशोधनM को नहRं लागू करने पर कारण बतायेगा । रा7य सरकार

2वव2वयालय के सुझावM को माZय या अमाZय कर सकती है ।

रा7य सरकार ने पहले पcर4नयम को िजस Xप मF अंततः Gवीकार Cकया है उसे

शासक=य राजप_ मF काशत करेगी और यह काशन क= 4त0थ से लागू माना जाएगा ।

32.

परवत] प1र#नयम:-

(1)

इस अ0ध4नयम और इसके बाद बनाये गये 4नयमM, 2वव2वयालय के परवत~

पcर4नयमM मF 4न,नल5खत सभी या Cकसी एक के बारे मF €यवGथा दे सकता है, यथा-

(क)

2वव2वयालय के नये ा0धकारM का सृजन;

(ख)

लेखा नी4त और 2वiतीय Coया;

(ग)

2वव2वयालयM के 0धकारM मF शaकM का 4त4न0धiव;

(घ)

नए 2वभागM का 4नमाAण और वतAमान 2वभागM का उZमूलन अथवा पुनगAठन;

(ङ)

पदकM और पुरGकारM का 4नधाAरण;

(च)

पदM के 4नमाAण और 2वलोपन क= Coया;

(छ)

शुmकM का पुनरRaण;

(ज)

2वभZन 2वषयM मF सीटM क= सं$या मF बदलाव तथा

(झ)

अZय सभी मामलM का पcर4नयम वारा 4नधाAरण, जो इस अ0ध4नयम मF व5णAत

ावधान के अंतगAत आवयक हM ।

(2)

पहले पcर4नयम से इतर 2वव2वयालय के पcर4नयमM का 4नमाAण शासी 4नकाय क=

सहम4त से बंधन बोडA वारा Cकया जाएगा ।

(3)

उप धारा (2) के अंतगAत 4नमAत पcर4नयम को रा7य सरकार के समa Gतुत Cकया

जाएगा, िजसे वह Gवीकृत करेगी अथवा य8द आवयक समझे तो कुछ संशोधन के लए

परामशA, पcर4नयम क= ित क= 4त0थ से यथासंभव दो महRने के भीतर देगी ।

(4)

रा7य सरकार वारा सुझाये गये संशोधनM पर शासी 4नकाय 2वचार करेगा और

पcर4नयमM मF Cकये गये पcरवतAन के 4त सहम4त अथवा रा7य सरकार वारा सुझाये

संशोधनM पर 8टपणी के साथ उसे वापस कर देगा ।

(5)

रा7य सरकार शासी 4नकाय वारा क= गयी 8टप5णयM पर 2वचार करेगी तथा

पcर4नयमM को Oबना संशोधन अथवा संशोधनM के साथ Gवीकृत करेगी और इसे

शासक=य राजप_ मF काशत करायेगी जो काशन क= 4त0थ से भावी होगा ।

33.

&थम अEयादेश:-

(1)

इस अ0ध4नयम के ावधानM के अधीन 4नमAत 4नयमM, पcर4नयमM के तहत, थम

अ|यादेश सभी मामले या 4न,नल5खत मF से कोई एक अथवा सभी क= €यवGथा कर

सकता है, यथा-

(क)

2वव2वयालय मF 2वया0थAयM का वेश और इस Xप मF नामांकन;

(ख)

2वव2वयालय क= vडी, vडलोमा एवं माण प_ के लए अ|ययन हेतु

पाठयoम का 4नधाAरण;

(ग)

vडी, vडपलोमा, माण प_ और अZय अकादमक वैशqय दान करने हेतु

Zयूनतम योzयता;

(घ)

फेलोशप, छा_वृिiत,वजीफा, पदक और पुरGकार हेतु शतž;

(ङ)

कायाAलय के 4नयमM और परRaण 4नकाय, परRaकM तथा म|यGथM क= 4नयुिTत

के तरRके स8हत परRaाओं का संचालन;

(च)

2वभZन पाठयoमM क= परRaाओं, उपा0धयM और vडलोमा के लए

2वव2वयालय वारा लया जाने वाला शुmक;

(छ)

2वव2वयालय के 2वया0थAयM के 4नवास क= शतž;

(ज)

2वया0थAयM के 2वXK अनुशासनाiमक कारAवाई संबंधी ावधान;

(झ)

2वव2वयालय के अकादमक जीवन क= उZन4त के लए आवयकता अनुभव

Cकये जाने पर Cकसी 4नकाय के सृजन, संयोजन और कायA पर 2वचार;

(ञ)

उsच शaा के अZय 2वव2वयालयM एवं संGथानM के साथ सहकाcरता और

सहयोग के तरRके;

(ट)

ऐसे अZय मामले िजनक= €यवGथा अ|यादेश के वारा इस अ0ध4नयम के

अZतगAत आवयक है;

(2)

2वव2वयालय का थम अ|यादेश बंधन बोडA वारा अनुमोदन के बाद कुला0धप4त

वारा बनाया जाएगा, िजसे अनुमोदन हेतु रा7य सरकार को Gतुत Cकया जाएगा ।

(3)

उप धारा (2) के तहत रा7य सरकार कुला0धप4त वारा स›पे गये अ|यादेश पर 2वचार

करेगी और जहाँ तक संभव होगा इसक= ाित के साठ 8दनM के भीतर वह इसे Gवीकृत

करेगी या इसमF संशोधन हेतु सुझाव भी देगी ।

(4)

कुला0धप4त अ|यादेश के संदभA मF 8दये गये संशोधन के सुझावM को शामल करFगे

अथवा रा7य सरकार वारा 8दये गये सुझावM को शामल नहRं करने के कारण बताते

हुए थम अ|यादेश को वापस भेजFगे, य8द कुछ हो । रा7य सरकार इसक= ाित के

बाद कुला0धप4त क= 8टपणी पर 2वचार करेगी और संशोधन के साथ या Oबना Cकसी

संशोधन के 2वव2वयालय के थम अ|यादेश को रा7य सरकार शासक=य राजप_ मF

काशत करेगी, और यह काशन क= 4त0थ से भावी होगा ।

34.

परवत] अEयादेश:-

(1)

थम अ|यादेशM के अलावा अZय सभी अ|यादेश अकादमक पcरषद वारा बनाये

जाएँगे जो शासी 4नकाय वारा अनुमो8दत Cकये जाने के बाद रा7य सरकार के समa

अनुमोदन हेतु Gतुत Cकये जाएँगे ।

(2)

उपधारा (1) के तहत अकादमक पcरष वारा स›पे गये अ|यादेश पर जहाँ तक संभव

हो रा7य सरकार इसक= ाित के दो माह के भीतर 2वचार करेगी और इसे Gवीकृत कर

सकती है या इसमF संशोधन हेतु सुझाव दे सकेगी ।

(3)

अकादमक पcरष या तो रा7य सरकार के सुझावM के अनुXप अ|यादेशM को संशो0धत

करेगी या सुझावM को रा7य सरकार को पुनः उसे वापस स›पेगी, य8द कोई हो । रा7य

सरकार अकादमक पcरष क= 8टपणी पर 2वचार करेगी और अ|यादेशM को संशोधन

झारखडगजट(असाधारण) सोमवार, 24 सत,बर, 2018

के साथ या Oबना संशोधन के शासक=य राजप_ मF काशत करेगी, और यह काशन

क= 4त0थ से भावी हो जाएगा ।

35.

व#नयम:-

ऐसे iयेक ा0धकार और ऐसे ा0धकार वारा बनायी गयी सम4तयM के लए शासी

4नकाय क= पूवA Gवीकृ4त से 2वव2वयालय के ा0धकारR इस अ0ध4नयम के अनुकूल 4नयम,

पcर4नयमM और अ|यादेशM के संगत 2व4नयम बना सकF गे ।

36.

#नद^श देने के रा_य सरकार के अधकार:-

(1)

शaण के Gतर, परRaा और शोध तथा 2वव2वयालय से संबंK Cकसी अZय मामले मF

रा7य सरकार ऐसे लोगM, िजZहF वह उपयुTत समझती है, के वारा मूmयांकन

करा सकेगी ।

(2)

ऐसे मूmयांकन के आधार पर सुधार के लए रा7य सरकार अपनी अनुशंसाएँ

2वव2वयालय को संे2षत करेगी । 2वव2वयालय ऐसे सुधाराiमक उपाय और यiन

करेगा ताCक इन अनुशंसाओं का अनुपालन सु4निचत Cकया जा सके ।

(3)

य8द 2वव2वयालय उपधारा (2) के अंतगAत रा7य सरकार वारा क= गयी अनुशंसा का

पालन करने मF उ0चत समयाव0ध मF 2वफल रहता है तो रा7य सरकार उसे ऐसा 4नदwश

दे सकेगी जैसा वह उपयुTत समझे । रा7य सरकार वारा 8दये गये 4नदwशM का

अनुपालन 2वव2वयालय अ2वलंब करेगा ।

व वव!यालय क4 #नधयाँ

37.

'थायी #नध:-

(1)

उदे्दय-प_ मF 4न8दAqट राश के साथ वतAक 4नकाय 2वव2वयालय के लए एक

Gथायी कोष क= Gथापना करेगा ।

(2)

2वव2वयालय के इस अ0ध4नयम का अनुपालन तथा अ0ध4नयम, पcर4नयम तथा

अ|यादेशM के अनुसार संचालन को सु4निचत करने हेतु Gथायी 4न0ध का उपयोग

जमानत जमा राश के Xप मF होगा । य8द 2वव2वयालय अथवा वतAक 4नकाय इन

अ0ध4नयम, पcर4नयमM और अ|यादेशM के अनुकूल ावधानM का अनुपालन नहRं करता

है तब रा7य सरकार को यह पूरR राश अथवा इसका एक 8हGसा/अंश ज‡त कर लेने का

अ0धकार होगा ।

(3)

2वव2वयालय इस Gथायी कोष से हुई आमदनी का उपयोग 2वव2वयालय के

आधारभूत ढाँचे के 2वकास के लए कर सकेगा, 2वव2वयालय के 8दनानु8दन €यय के

लए नहRं ।

(4)

2वव2वयालय के 2वघटन तक Gथायी कोष क= राश ऐसे साधनM मF 4नवेशत क=

जाएगी जैसा सरकार वारा 4नवेश हेतु 4नदwशत Cकया जाएगा ।

(5)

दRघाAव0ध क= 4तभू4त क= िGथ4त मF, 4तभू4तयM का माण-प_ सरकार के सुर`aत

संरaण मF रखा जाएगा और €यिTतगत जमा खातM के ‡याज को सरकारR खजाने मF

जमा Cकया जाएगा । शiतA यह है Cक सरकार के आदेश के Oबना यह राश 4नकालR

नहRं जा सकेगी ।

38.

सामाWय #नध:-

(1)

2वव2वयालय एक कोष क= Gथापना करेगा, िजसे सामाZय कोष कहा जाएगा, िजसमF

4न,नांCकत राशयाँ जमा हMगी:

(क)

2वव2वयालय वारा ात शaण एवं अZय शुmक;

(ख)

वतAक 4नकाय वारा दiत कोई भी राश;

(ग)

अपने ल”य-स2K के oम मF 2वव2वयालय के Cकसी भी उपoम, यथा-परामशA

आ8द से ात कोई भी राश;

(घ)

ZयासM, वसीयतM, दान, वृिiतदान और Cकसी भी अZय कार का अनुदानतथा

(ङ)

2वव2वयालय वारा ात अZय सारR धनराश ।

(2)

सामाZय कोष का उपयोग 4न,नल5खत मदM मF Cकया जाएगा, यथा -

(क)

इस अ0ध4नयम और पcर4नयमM, अ|यादेशM और शासी 4नकाय क= पूवA Gवीकृ4त

के साथ 2वव2वयालय वारा लये गये ऋण तथा उसके ‡याज के भुगतान हेतु;

(ख)

2वव2वयालय क= पcरसंप4तयM के रख-रखाव हेतु;

(ग)

धारा 37 एवं 38 के अंतगAत 2व4नमAत 4न0धयM के लेखा-परRaण के लए

भुगतान Cकया गया शुmक;

(घ)

2वव2वयालय के पa अथवा 2वपa मF दायर वादM पर हुए खचA के 4नqपादन हेतु ;

(ङ)

अ0धकाcरयM, कमAचाcरयM, शaकM एवं शोध-अ0धकाcरयM के वेतन, भiते, भ2वqय-

4न0ध अंशदान, ैsयूटR और अZय सु2वधाओं के भुगतान हेतु;

(च)

शासी 4नकाय, कायAकारR पcरषद, अकादमक पcरषद और अZय ा0धकारM तथा

वतAक 4नकाय के अ|यa अथवा Cकसी सaम अ0धकारR वारा Cकये गये या_ा-

€यय एवं अZय भiतM के भुगतान हेतु;

(छ)

फेलोशप, 4नःशुmक शaण, छा_वृिiतयM, असGटFटशप तथा समाज के कमजोर

आ0थAक वगA के छा_M को 8दये गये पुरGकारM और शोध सहायकM, शaुओं

अथवा जैसी िGथ4त हो अ0ध4नयमM, पcर4नयमM और 4नयमM के अनुकूल Cकसी

भी अहAता ात 2वयाथ~ के भुगतान हेतु;

(ज)

अ0ध4नयम के ावधानM, पcर4नयमM, अ|यादेशM, 2व4नयमM के अनुपालन मF

2वव2वयालय वारा €यय क= गयी Cकसी भी राश के भुगतान हेतु;

(झ)

वतAक 4नकाय वारा 2वव2वयालय क= Gथापना और इस संदभA मF Cकये गये

4नवेशM क= मूल लागत, जो समय-समय पर भारतीय Gटेट बkक के ऋण दान

क= दर से अ0धक नहRं हो, के भुगतान के लए ।

(ञ)

इस अ0ध4नयम के पcर4नयमM, 4नयमM, अ|यादेशM के पालन मF 2वव2वयालय

वारा Cकये गये €यय के भुगतान हेतु;

(ट)

Cकसी संGथान वारा 2वशेष सेवा देने के दा4यiव, 2वव2वयालय को बंधन-

सेवा स8हत शासी 4नकाय वारा 2वव2वयालय के लए Gवीकृत ऐसे €ययM

अथवा संबंK अZय कायt के भुगतान हेतु;

लेखा, अंके-ण एवं वाषKक &#तवेदन

39.

वाषKक &#तवेदन:-

2वव2वयालय का वा2षAक 4तवेदन 2वव2वयालय वारा तैयार Cकया जाएगा िजसमF

अZय मामलM समेत, 2वव2वयालय वारा उŠेयM क= पू4तA के लए उठाये गये कदम शामल

हMगे और इसे रा7य सरकार को स›पा जाएगा ।

40.

अंके-ण एवं वाषKक &#तवेदन:-

(1)

2वव2वयालय का वा2षAक लेखा बkलेस शीट स8हत 2वव2वयालय वारा तैयार Cकया

जाएगा और वा2षAक लेखा का अंकेaण वषA मF कम से कम एक बार 2वव2वयालय

वारा इस उŠेय से 4नयुTत अंकेaकM वारा कराया जाएगा ।

(2)

वा2षAक लेखा क= एक 4त अंकेaण 4तवेदन के साथ रा7य सरकार को Gतुत करनी होगी ।

व वव!यालय को समेटना

41.

व वव!यालय का समापनः-

(1)

य8द वतAक 4नकाय 2व0ध स,मतढंग से इसके गठन तथा 4नगमीकरण के ावधानM के

अZतगAत Gवयं को भंग करना चाहे तो इसक= सूचना कम से कम छह महRने पहले

रा7य सरकार को देनी होगी ।

रा7य सरकार ऐसी सूचना (भंग करने संबंधी) ात करने के पचात्, जैसी आवयकता

होगी उसके अनु प भंग Cकये जाने क= 4त0थ से 2वव2वयालय के शासन क=

€यवGथा वतAक 4नकाय के 2वघटन के बाद आ5खरR स_ के 2वया0थAयM, जो

2वव2वयालय मF नामांCकत हk, के पाnयoम पूरा होने तक करेगी और सरकार वतAक

4नकाय के Gथान पर 2वव2वयालय के संचालन के लए एक शासक क= 4नयुिTत

कर सकेगी, िजसे वतAक 4नकाय के अ0धकार, कतA€य और कायA स›पे जाएँगे, जैसा इस

अ0ध4नयम मF व5णAत है ।

42.

व वव!यालय का वघटन:-

(क)

वतAक 4नकाय य8द 2वव2वयालय को भंग करने क= इsछा रखता है, तो उसे रा7य

सरकार को एत-संबंधी सूचना 4नधाAcरत तरRके से देनी होगी । रा7य सरकार वारा

यथो0चत 2वचार के पचात् 4नधाAcरत तरRके से 2वव2वयालय को 2वघ8टत Cकया जा

सकेगा ।

बशiतw Cक 2वव2वयालय का 2वघटन तभी भावी होगा जब तक Cक 4नयमत

पाnयoम के 2वया0थAयM का आ5खरR स_ अपना पाnयoम पूरा नहRं कर लेता है और

उन सबको vडी (उपा0ध), vडलोमा अथवा िजस तरह के 2वषय हM, ात हो जाएँ ।

(ख)

जैसा Cक तरRका 4नधाAcरत हो 2वव2वयालय का 2वघटन होने पर उसक= सभी संप4तयाँ

और देनदाcरयाँ वतAक 4नकाय मF 4न8हत हMगी ।

(ग)

उप-धारा (1) के तहत रा7य सरकार य8द 2वव2वयालय को 2वघ8टत करने का 4नणAय

लेती है, तो 2व8हत तरRके से समान उŠेय वालR सोसाइ8टयM मF 2वव2वयालय के

2वघटन तक उप-धारा (1) के ावधानM के तहत इसके शासी 4नकाय क= शिTतयाँ

4न8हत कर सकेगी ।

43.

वशेष प1रि'थ#तयR म\ रा_य सरकार क4 व)शbट शिMतयाँ:-

(1)

रा7य सरकार क= य8द यह राय है Cक 2वव2वयालय ने अ0ध4नयमM, 4नयमM,

पcर4नयमM अथवा अ|यादेशM मF से Cकसी का उmलंघन Cकया है और 2वiतीय कुबंधन

अथवा कु-शासन क= िGथ4त 2वव2वयालय मF उiपZन हो गयी है, तो वह

2वव2वयालय को कारण बताओ सूचना जारR कर पkतालRस 8दनM के भीतर इस आशय

का उiतर मांगेगी Cक TयM नहRं एक शासक क= 4नयुिTत कर दR जाय ।

(2)

2वव2वयालय वारा उपधारा (1) के अंतगAत दR गयी सूचना पर 8दये गये उiतर से

य8द रा7य सरकार संतुqट है Cक इस अ0ध4नयम, 4नयमM, पcर4नयमM और अ|यादेशM

के Cकसी भी ावधान का थम Œqटया उmलंघन हुआ है अथवा इस अ0ध4नयम के

वारा 8दये गये 4नदwशM के 4तकूल 2वiतीय कुबंधन अथवा कु-शासन है तो वह ऐसी

जाँच करायेगी, िजसे वह आवयक समझे ।

(3)

उप-धारा (2) के तहत रा7य सरकार ऐसी Cकसी जाँच के उŠेय से जाँच-अ0धकारR या

अ0धकाcरयM को 4नयुTत करेगी, जो Cकसी भी आरोप पर अपना 4तवेदन Gतुत करFगे।

(4)

उप-धारा (3) के अंतगAत 4नयुTत जाँच अ0धकारR या अ0धकाcरयM के पास वहR शिTतयाँ

हMगी जो दRवानी अदालत वारा दRवानी वाद के मामलM क= सुनवाई के दौरान दRवानी

Coया सं8हता, 1908 मF दiत हk, यथा-

(a)

Cकसी €यिTत को बुलाने और उसक= हािजरR को अ4नवायA करने और शपथ

8दलाकर उनक= जाँच करना;

(b)

माण के लए आवयक खोज और ऐसे दGतावेज या दूसरR अZय सामी

Gतुत करने का 4नदwश देना;

(c)

Cकसी भी अदालत या कायाAलय से कोई दGतावेज मंगाना ।

(5)

उप-धारा (3) के अंतगAत 4नयुTत अ0धकारR या अ0धकाcरयM क= जाँच cरपोटA ात होने

के बाद य8द रा7य सरकार संतुqट है Cक 2वव2वयालय ने इस अ0ध4नयम के ावधान

के सभी अथवा Cकसी ावधान का उmलंघन Cकया है, 4नयमM, पcर4नयमM अथवा

अ|यादेशM का उmलंघन Cकया है अथवा सरकार वारा दiत 4नदwशM का उmलंघन Cकया

है या 2वiतीय कु-बंधन और कुशासन क= िGथ4त 2वव2वयालय मF ऐसी हो गयी है

Cक उसके अकादमक Gतर पर न-0च¢न खड़ा हो गया हो, तो सरकार एक शासक

4नयुTत कर सकती है ।

(6)

उप-धारा (5) के अंतगAत 4नयुTत शासक इस अ0ध4नयम के तहत बनाये गये शासी

अWयाWय

44.

#नयम बनाने के )लए रा_य सरकार क4 शिMत:-

(1)

इस अ0ध4नयम के उŠेयM के 4नवAहन के लए शासक=य राजप_ मF अ0धसूचना जारR

करके रा7य सरकार 4नयम बनाएगी ।

(2)

रा7य 2वधानमंडल के समa इस धारा के अंतगAत बनाये गये सारे 4नयमM को कम से

कम 30 8दनM के लए रखा जाएगा और रा7य 2वधानमंडल को यह अ0धकार होगा Cक

वह इसका 4नरसन कर दे अथवा अपे`aत पcरवतAन कर दे अथवा ऐसे पcरवतAन िजसे

2वधानमंडल के उसी स_ मF या उसके ठक बाद वाले स_ मF Cकया गया हो ।

45.

व!याथKयR के पाcयdम का समापन:-

इस अ0ध4नयम अथवा पcर4नयम मF Cकसी बात के होते हुए भी अंगीभूत महा2वयालयM

अथवा 2वव2वयालय क= अनुसूची मF 2व4न8दAqट इस अ0ध4नयम के लागू होने के तुरत पहले

कोई भी अ|ययनरत 2वयाथ~ या जो इस 2वव2वयालय क= Cकसी परRaा मF सि,मलत होने

का अ0धकारR था उसे अपना पाnयoम पूरा करने क= अनुम4त दR जाएगी और ऐसे 2वया0थAयM

के शaण, शaण और परRaा क= िज,मेदारR संबK 2वव2वयालय पर तब तक होगी जैसा

4न8दAqट Cकया गया हो ।

46.

कeठनाइयR को दूर करने क4 शिMत:-

(1)

य8द इस अ0ध4नयम के Cकसी ावधान को लागू करने मF क8ठनाई उपिGथत हो रहR हो

तो शासक=य राजप_ मF काशत आदेश के वारा रा7य सरकार इस अ0ध4नयम के

ावधानM को |यान मF रखते हुए क8ठनाइयM को शी£ दूर करने के लए आवयक कदम

उठायेगी ।

बशiतw इस अ0ध4नयम के ारंभ के तीन वषt के बाद उप धारा (1) के अंतगAत

ऐसा कोई आदेश पाcरत नहRं Cकया जाएगा ।

(2)

इस अ0ध4नयम के अंतगAत पाcरत iयेक आदेश को अ2वलंब रा7य 2वधानमंडल के

समa रखा जाएगा ।

THE NETAJI SUBHAS UNIVERSITY ACT, 2018

(JHARKHAND ACT, 11, 2018)

An Act to provide for the establishment and incorporation of the NETAJI SUBHAS UNIVERSITY

in the State of Jharkhand, and to confer the status of a Private University thereon and for matters

connected therewith and incidental thereto;

WHEREAS it is expedient to provide for the establishment and incorporation of the NETAJI

SUBHAS UNIVERSITY at Pokhari, East Singhbhum, JAMSHEDPUR, Jharkhand promoted by

Sitwanto Devi Mahila Kalyan Sansthan, Suraj Path, Baridih, East Singbhum, Pokhari, Jamshedpur and

registered under Patna Society Registration Act, 21, 1860 (Registration No. 209/1996-97 dated

11.12.1996) and to confer the status of a Private University thereon and for the matters connected

therewith and incidental thereto;

It is hereby enacted in the Sixty-Nineth year of the Republic of India, by the Legislature of Jharkhand,

as follows:

1. Short Title, Extent and Commencement.

(1) This Act may be called "THE NETAJI SUBHAS UNIVERSITY Act, 2018".

(2) It shall extend to the whole of the State of Jharkhand.

(3) It shall come into force on such date as the State Government may, by notification in the

Official Gazette, appoint.

2. Definitions.

In this Act, unless the context otherwise requires:

(a) "Academic Council" means the Academic Council of the University as specified in section 24

of the Act;

(b) "Annual Report" means the Annual report of the University as referred to in section 39 of the Act;

under section 23 of the Act;

(d) "Campus” means the area of the University in which it is established;

(e) "Chancellor" means the Chancellor of the University appointed under section 12 of the Act;

(f) "The Chief Finance and Accounts Officer" means the Chief Finance and Accounts Officer" of

the University appointed under section 18 of the Act;

(g) "Controller of Examinations” means the Controller of Examinations of the University

appointed under section 19 of the Act;

(h) "Constituent College" means a college or an institution maintained by the University;

(i) "Employee" means employee appointed by the University; and includes teachers and others

staff of the University or of a constituent college;

(j) "Endowment fund" means the endowment fund of the University established under section 37

of the Act;

(k) "Faculty" means group of academic departments of similar disciplines;

(l) "Fee" means collection made by the University from the students for the purpose of any course

of study and incidental thereto, in the University;

(m) "General Fund" means the General fund of the University established under section 38 of the Act;

(n) "Governing Body" means the Governing Body of the University constituted under section 22 of

the Act;

(o) "National Assessment and Accreditation Council" means National Assessment and

Accreditation Council, Bengaluru, an autonomous institution of the University Grants

Commission;

(p) "Prescribed" means prescribed by the Statutes and the rules made under this Act;

(q) "Pro-Vice-Chancellor" means the Pro-Vice-Chancellor of the University appointed under

section 15 of the Act;

(r) "Registrar" means the Registrar of the University appointed under section 17 of the Act;

(s) "Regulatory Body" means a body established by the Government of India for laying down

norms and conditions for ensuring academic standards of higher education, such as University

Grants Commission, All India Council for Technical Education, National Council for Teacher

Education, Medical Council of India, Bar Council of India, Pharmacy Council of India,

National Assessment and Accreditation Council, Indian Nursing Council, Indian Council of

Agriculture Research, Council of Scientific and Industrial Research, etc. and includes the

Government or any such body constituted by the Government of India or the State

Government;

(t) "Rules" means the rule of the University made under this Act;

(u) "Schedule" means schedule appended to this Act;

(v) "Sponsoring Body" in relation to the University means(i) a society registered under Societies

Registration Act 1860, or (ii) a public trust registered under Indian Trust Act 1882, or (iii) a

society or trust registered under the law of any other State;

(w) "State Government" means the State Government of Jharkhand;

(x) "Statutes","Ordinances", and "Regulations" mean respectively, the Statutes, Ordinances and

Regulations of the University made under this Act;

(y) "Student of the University" means a person enrolled in the University for taking a course of

study for a degree, diploma, or other academic distinction duly instituted by the University,

including a research degree;

(z) "Teacher" means a Professor, Associate Professor, Assistant Professor or such of the other

person as may be appointed for imparting instruction or conducting research in the University

or in a Constituent College or Institution and includes the Principal of a Constituent College or

institution, in conformity with the norms prescribed by the University Grants Commission;

(aa)

"University Grants Commission" means the University Grants Commission established

under the University Grants commission Act, 1956;

(ab)

"University" means the NETAJI SUBHAS UNIVERSITY, Jharkhand established

under this Act.

(ac)

"Vice-Chancellor" means the Vice-Chancellor of the University appointed under

section 13 of the Act;

(ad)

"Visitor" means the Visitor of the University referred to in section 10 of the Act.

Establishment of University.

(1)

There shall be establishment of the University by the name ‘NETAJI SUBHAS

UNIVERSITY’

(2)

The headquarters of the University shall be within the State of Jharkhand and shall be

situated at Pokhari, East Singhbhum, Jamshedpur, Jamshedpur.

(3)

The University shall start operation only after the State Government issues the letter of

authorization.

(4)

The university shall meet the conditions mentioned in the schedule A of the Act within

the stipulated time.

(5)

The Governing Body, the Board of Management, the Academic Council, the

Chancellor, the Vice Chancellor, the Pro Vice Chancellor, the Registrar, the Teachers,

the Chief Finance and Accounts Officer and such other officers or members or

authorities so long as they continue to hold such office or membership of the University

hereby constitute a body corporate by the name of the University.

(6)

The University shall function as non-affiliating University and they shall not affiliate

any other college or institute for the conferment of degree, diploma and for grant of

certificate to the students admitted therein.

(7)

The constituent colleges and institutions of the Sponsoring Body affiliated to and

enjoying the privileges of any University immediately before the commencement of this

Act shall cease to be affiliated from that University and shall be deemed to be

withdrawn from such privileges from the date of commencement of this Act and shall

be deemed to be admitted to the privileges of NETAJI SUBHAS UNIVERSITY.

University of the Sponsoring Body and all such colleges and institutions shall be the

constituent colleges and institutions of NETAJI SUBHAS UNIVERSITY.

(8)

The University shall be a body corporate by the name ‘NETAJI SUBHAS

UNIVERSITY’ and will have perpetual succession and common seal with power,

subject to the provisions of this Act, to acquire and hold property, to contract and shall,

by the said name, sue or be sued.

(9)

The University shall not receive any grant-in-aid or other financial assistance from the

State Government or the Central Government.

Provided that, the State Government or the Central Government may provide

financial support, including through grants or otherwise

(a) for research, development and other activities for which other State Government

organizations are provided financial assistance, or

(b) for any specific research or programme based activity.

Properties of the University and its Application.

(1)

On the establishment of the University the land and other movable and immovable

properties acquired, created, arranged, or built by the University for the purpose of the

University in the State of Jharkhand shall vest in the University.

(2)

The land, building and other properties acquired for the University shall not be used for

any purpose other than that for which the same is acquired.

(3)

The properties, movable or immovable, of the University shall be administered by the

Governing Body in such manner as may be provided for by the regulations.

(4)

The properties in the name of the University under sub-section (1) shall be applied for

meeting the liabilities of the university in the event of dissolution or winding up of the

University in such manner as may be prescribed in the rules.

Restrictions and obligations of the University.

(1)

The tuition fees for professional courses such as Engineering & Technology, Medicine,

Management, etc., in the University shall be determined by the University under the

supervision of the regulatory body notified by the State Government from time to time.

(2)

Admission in the University shall be strictly on the basis of merit. Merit for admission

in the University may be determined either on the basis of marks or grade obtained in

the qualifying examination and achievements in co-curricular and extra-curricular

activities or on the basis of marks or grade obtained in the entrance test conducted at

State level either by the University or an association of the Universities conducting

similar courses or by any agency of the State Government.

Provided that the admission in professional educational colleges or institutions

of the University shall be governed under the provisions of the Regulatory Bodies.

(3)

The University shall allow merit scholarship to at least five percent of the total strength,

to the students belonging to poor and economically backward classes. The relevant

criteria for determining the poor and economically backward classes shall be such as

may be determined by the State Government from time to time.

(4)

The University shall compulsorily make provisions for reservation of seats for the

students domiciled in the State of Jharkhand to the extent of at least twenty five percent

of the total students in the university. The reservation of seats shall be regulated by the

laws and orders of the State Government from time to time.

(5)

The university shall make provisions for reservation of non-teaching posts in the

university for the persons domiciled in the State of Jharkhand to the extent of at least

fifty percent of the total number of non-teaching posts of the University The reservation of seats

shall be regulated by the laws and orders of the State Government from time to time.

(6)

The University shall appoint adequate number of teachers and officers in the University

for maintaining the academic standards specified and shall ensure that the qualifications

of such teachers or officers of the university shall not be lower than prescribed by the

relevant Regulatory Bodies.

(7)

The University shall compulsorily place in the public domain every information in

relation to the University which would be of interest to the students and other

stakeholders inter alia, including the courses offered , number of seats under different

categories, fees and other charges, facilities and amenities offered, faculty in place and

such other relevant information.

(8)

The Convocations of the University may, for conferring degrees, diplomas or for any

other purpose, be held in every academic year in the manner as may be prescribed by

the Statutes.

(9)

The University shall obtain accreditation from the National Council of Assessment and

Accreditation (NAAC) within five years of its establishment and such other regulating

bodies of Government of India which are connected with the courses taken up by the

University and inform the State Government about the grade provided to the University.

The University shall get renewed such accreditation from time to time.

(10)

Notwithstanding anything contained in this Act, the University shall be bound to

comply the conditions mentioned in Schedule A of this Act, and all the rules,

regulations, norms, etc. of the regulating bodies of Government of India and State

Government and provide all such facilities and assistance to such bodies as are required

by them to discharge their duties and carry out their functions.

Objects of the University.

The objects of the University shall be to disseminate and advance knowledge and skill by

providing instructional, research and extension of facilities and in such branches of learning as it may

deem fit and the University shall endeavour to provide to students and teachers the necessary

atmosphere and facilities for the promotion of:

(a) Innovations in education leading to restructuring of courses, new methods of teaching,

training, and learning including online learning, blended learning, continuing education and

such other modes and integrated and wholesome development of personality;

(b) Studies in various disciplines;

(d) National integration, secularism and social equity and International understanding and ethics.

University open to all irrespective of sex, religion, class, colour, creed, or opinion.

No person shall be discriminated against or be excluded from any office of the

University or from membership of any of its authorities or from admission to any course of

study leading to a degree, diploma or other academic distinction on the grounds of sex, race,

creed, class, caste, place of birth and religious belief or political or other opinion.

Powers and functions of the University.

(i)

To administer and manage the University, establish, administer and manage its

constituent colleges and centres for research, education, training, extension and

outreach including continuing education, distance learning and e-learning at its campus

within the State of Jharkhand;

(ii)

To provide for research, higher education, professional education, teaching training,

extension and outreach including continuing education, distance learning and e-learning

in the fields of science, technology, humanities, social sciences, education,

management, commerce, law, pharmacy, healthcare and any other fields;

(iii)

To conduct innovative experiments in educational technologies, teaching and learning

methods, to collaborate with national and international institutions and to offer joint

programmes with such institutes to constantly improve the delivery of education and to

achieve international standards of education;

(iv)

To prescribe courses, curricula and methodologies including electronic and distance

learning and provide for flexibility in the delivery of education.

(v)

To hold examination and confer degree, diploma or grant certificate and other

academic distinctions or title on persons subject to such condition as the University may

determine and to withdraw or cancel any such degree, diploma or certificates and other

academic distinction or titles in the manner prescribed by the Regulations;

(vi)

to institute and award Fellowships, Scholarships, Medals and Prizes;

(vii)

to confer honorary degrees or other distinction on the manner prescribed by the Statutes;

(viii) to establish schools, centres, institutes, college and conduct the programme and courses

of study as are in the opinion of the University, necessary for the furtherance of its

objects;

(ix)

To declare as a constituent college any college, centre, institution imparting education

as are in the opinion on the University necessary for the furtherance of its objects or to

establish a new constituent college, centre, institution for the purpose;

(x)

To provide for printing, publication and reproduction of research, educational material

and other works and to organize exhibitions, conferences, workshops and seminars;

(xi)

To establish knowledge resource centre;

(xii)

To sponsor and undertake research and educational programmes in the fields of science,

technology, humanities, social sciences, education, management, commerce, law,

pharmacy, healthcare and any other allied areas;

(xiii) To collaborate or associate with any educational institution with like or similar objects;

(xiv) To establish campuses including virtual campus for the purpose of achieving the

objectives of the University;

(xv)

To undertake research and to obtain registration in respect of such research in the nature

of patents, design rights and such or similar rights with the competent authorities;

(xvi) To maintain linkages and collaborate with educational or other institutions in any part

of the world having objects wholly or partially similar to those of the University,

through exchange of students, researchers, faculty and staff and generally in such

manner as may be conducive to their common objects;

(xvii) To render services of research, training, consultancy and such other services as required

for the purposes of the University;

(xviii) To develop and maintain relationships with faculty, researchers, administrators and

domain experts in science, technology, humanities, social sciences, education,

management, law, commerce, pharmacy, healthcare and allied area for achieving the

objects of the University;

(xix) to make special arrangement in respect to women and other disadvantaged students as

the University may consider desirable;

(xx)

To regulate the expenditure and to manage the finances and to maintain the accounts of

the University;

(xxi) To receive funds, movable and immovable properties, equipments, software and other

resources from business, industry, other sections of society, national and international

organization or any other source by transfers or as gifts, donations, benefactions or

bequests for the purposes and objects of the University;

(xxii) To establish, maintain and manage halls, hostels for students and quarters for the

residence of faculty and staff;

(xxiii) To construct, manage and maintain centres, complexes, auditorium, buildings, stadium

for the advancement of sports, cultural, co-curricular and extra-curricular activities;

(xxiv) To supervise and control the residence and regulate the discipline of students, faculty

and staff of the University and to make arrangements for promoting their health, general

welfare, social and cultural activities;

(xxv) To fix, demand and receive or recover fees and such other charges as may be prescribed

by the Statutes;

(xxvi) To institute and award fellowships, scholarships, prizes, medals and other awards;

(xxvii) To purchase or to take on lease or accept as gifts, bequests, legacies or otherwise any

land or building or works which may be necessary or convenient for the purpose of the

University and on such terms and conditions as it may think fit and proper and to

construct or alter and maintain any such building or works;

(xxviii)To sell, exchange, lease or otherwise dispose of all or any portion of the properties of

the University, movable or immovable, on such terms as it may think fit and consistent

with the interest, activities and objects of the University;

(xxix) To draw and accept, to make and endorse, to discount and negotiate promissory notes,

bills of exchange, cheques and other negotiable instruments;

(xxx) To raise and borrow money on bond, mortgages, promissory notes or other obligations

or securities founded or based upon all or any of the properties and assets of the

University or without any securities and upon such terms and conditions as it may think

fit and to pay all expenses out of the funds of the University,

Bar to affiliation.

(1)

The University shall not admit any college or institution to the privilege of affiliation.

(2)

The University may open any off campus, offshore campus, and study centre,

examination centre in or out of the State of Jharkhand only after the prior approval of

University Grants Commission or such regulatory body established by the Government

or State or Central Government, as the case may be.

(3)

Courses under Distance mode can be started only after the prior approval of University

Grants Commission or such regulatory body established by the Government.

10.

The Visitor.

(1)

The Governor of Jharkhand will be the Visitor of the University

(2)

The Visitor shall, when present, preside at the convocation of the University for

Conferring Degrees, Diplomas, charters, Designation and certificates.

(3)

The Visitor shall have the right to visit the University or any institution maintained by

the University to ensure the standard of education, discipline, decorum and proper

functioning of the university.

11.

Officers of the University.

The following shall be the officers of the University:

(a) The Chancellor

(b) The Vice Chancellor

(d) Director/Principal

(e) The Registrar

(f) The Chief Finance and Accounts Officer

(g) The Controller of Examinations

(h) The Dean of Students Welfare

(i) The Dean of Faculty

(j) The Proctor, and

(k) Such other officers as may be declared by the Statute to the officers of the University.

12.

The Chancellor:

(1)

The Chancellor shall be appointed by the Sponsoring Body for a period of five years

with the approval of the Visitor by following such procedures and on such terms and

conditions as may be prescribed. On the expiry of the term, the Chancellor may be

reappointed by the Sponsoring Body in consultation with the Visitor.

(2)

The Chancellor by virtue of his office shall be the head of the University.

(3)

The Chancellor shall preside over the meetings of the Governing Body and shall, when

the Visitor is not present, preside over the convocation of the University for conferring

degrees, diplomas, or other academic distinctions.

The Chancellor may in writing under his hand addressed to the head of the sponsoring

body resign his office.

(5)

The Chancellor shall have the following powers, namely:

(a)

to call for any information or record;

(b)

to appoint the Vice Chancellor;

(c)

to remove the Vice Chancellor in accordance with the provisions of this Act;

and

(d)

such other powers as may be conferred on him by this Act or Statutes made

thereunder.

13.

The Vice Chancellor:

(1)

The Vice Chancellor shall be appointed by the Chancellor as per the qualifications

prescribed by the University Grants Commission and shall hold office for a period of

five years .Provided that a person appointed as Vice Chancellor shall retire from office

during tenure of his office or extension thereof, if any when he completes the age of 70 years.

Provided further that after the expiry of the term of five years, the Vice

Chancellor shall be eligible for re-appointment for another term of five years.

(2)

The Vice Chancellor shall be the Principal executive and Academic officer of the

University and shall exercise general superintendence and control over the affairs of the

University and shall execute the decisions of various authorities of the University.

(3)

In the absence of both the Visitor and the Chancellor, the Vice Chancellor shall preside

over the convocation of the University.

(4)

The Vice Chancellor may, if he/she is of the opinion that immediate action is necessary

on any matter, exercise any power conferred on any authority of the University by or

under this Act and shall convey to such authority the action taken by him on such matters;

Provided that if the authority of the University or any person in the service of

the University who is aggrieved by the action taken by the Vice Chancellor under this

sub section may prefer an appeal to the Chancellor within one month from the date of

communication of such decision. The Chancellor may confirm, modify or reverse

action taken by the Vice Chancellor.

The Vice Chancellor shall exercise such powers and perform such other functions as

may be prescribed.

14.

Removal of the Vice Chancellor.

(1)

If at any time and after such inquiry as may be considered necessary, it appears to the

Chancellor that the Vice Chancellor:

(a)

has failed to discharge any duty imposed upon him by or under this Act, the

Statutes, the Ordinances, or

(b)

has acted in a manner prejudicial to the interests of the University, or

(c)

is incapable of managing the affairs of the University, then the Chancellor may,

notwithstanding the fact that the term of office of the Vice Chancellor has not

expired, require the Vice Chancellor, by an order in writing stating the reason

therefore, to resign his post from the date as may be specified in the order.

No orders under sub –section (1) shall be passed unless a notice stating the specific

grounds on which such action is proposed , has been served and a reasonable

opportunity to show cause against the proposed order has been given to the Vice

Chancellor.

15.

The Pro Vice-Chancellor:

(1)

The Pro Vice-Chancellor shall be appointed by the Chancellor in such manner and shall

exercise such powers and perform such functions as may be prescribed.

(2)

The Pro Vice-Chancellor appointed under sub section (1) shall discharge his duties in

addition to his duties as a Professor.

(3)

The Pro Vice-Chancellor shall assist the Vice Chancellor in discharging his duties as

and when required by the Vice Chancellor.

(4)

The Pro Vice-Chancellor shall get Honorarium of such amount as may be determined

by the sponsoring body.

16.

Director(s)/Principal(s):

The Director/Principal shall be appointed in such manner and shall exercise such powers and

perform such functions as may be prescribed.

17.

Registrar:

(1)

The Registrar shall be appointed by the Chairperson of the Sponsoring Body in such

manner, as may be specified in the Statutes. The Registrar shall possess the

qualifications prescribed by the University Grants Commission.

(2)

The Registrar shall have the power to enter into agreements, sign documents and

authenticate records on behalf of the University and shall exercise such other power and

perform such other functions as may be prescribed.

(3)

The Registrar shall be the ex-officio Member Secretary of the Executive Council and

the Academic Council but shall not have a right to vote.

18.

The Chief Finance and Accounts Officer:

(1)

The appointment of the Chief Finance and Accounts Officer shall be made by the

Chairperson of the Sponsoring Body in such manner as may be specified by the Statutes.

(2)

The Chief Finance and Accounts Officer shall exercise such powers and perform such

duties as may be specified by the Statutes.

19.

The Controller of Examinations:

(1)

The Controller of Examinations shall be whole time officer of the University and shall

be appointed by the Chancellor in accordance with the Statutes.

(2)

it shall be the duty of the Controller of Examinations:

(a)

to conduct examinations in a disciplined and efficient manner;

(b)

to arrange for the setting of question papers with strict regards to secrecy;

(c)

to arrange for the evaluation of answer sheets in accordance with the planned time

schedule for results;

(d)

to constantly review the system of examinations in order to enhance the level of

impartiality and objectivity with a view to make it better instrument for assessing the

attainments of students;

(e)

to deal with any other matter connected with examinations which may, from time to

time be assigned to him by the Vice Chancellor.

20.

Other Officers: Manner of appointment and power and duties of the other officers of the

University including the Dean of Students Welfare, Dean of faculty, and Chief Proctor shall be

such as may be prescribed.

21.

Authorities of the University:

The following shall be the authorities of the University:

(a)

The Governing Body

(b)

The Board of Management

(c)

The Academic Council

(d)

The Finance Committee

(e)

The Planning Board

(f)

Such other authorities as may be declared by the Statutes to be the authorities of the

University.

22.

The Governing Body:

(1)

The Governing Body shall have the following members, namely:

(a)

the Chancellor;

(b)

the Vice-Chancellor;

(c)

the Secretary to the Government, Department of Higher and Technical

Education, Jharkhand, or his nominee;

(d)

five persons nominated by the sponsoring body, out of which two shall be

eminent educationists;

(e)

one expert of management or technology from outside the University,

nominated by the Chancellor; and

(f)

one expert of finance, nominated by the Chancellor.

(2)

The Governing Body shall be the supreme authority and principal governing body of

the University. It shall have the following powers, namely:

(a)

to provide general superintendence and directions and to control the functioning

of the university by using all such powers as are provided by this Act, Statutes,

Ordinances, Regulations or Rules;

(b)

to review the decisions of other authorities of the university in case they are not

in conformity with the provisions of Act, Statutes, Ordinances, Regulations or Rules;

(c)

to approve the budget and annual report of the University;

(d)

to lay down the extensive policies to be followed by the University;

(e)

to recommend to the sponsoring body for the dissolution of the University if a

situation arises when there is no smooth functioning of the University in spite of

best efforts; and

(f)

such other powers as may be specified by the Statutes.

(3)

The Governing Body shall meet at least three times in a calendar year.

(4)

The quorum of the meeting shall be four;

Provided that the Secretary to the Government, Department of Higher and

Technical Education, Jharkhand, or in his absence, Director, Higher Education shall be

present in each meeting in which decisions on issues involving Government policies/

instructions are to be taken.

23.

The Board of Management.

(1)

The Board of Management shall consist of the following members, namely:

(a)

the Vice-Chancellor;

(b)

the Secretary to the Government, Department of Higher and Technical

Education, Jharkhand or his nominee;

(c)

two members of the Governing Body, nominated by the sponsoring body;

(d)

three persons, who are not the members of the Governing Body, nominated by

the sponsoring body;

(e)

three persons, from amongst the teachers, nominated by the sponsoring body;

(f)

two teachers, nominated by the Vice Chancellor.

(2)

The Vice Chancellor shall be the Chairperson of the Board of Management.

(3)

The powers and functions of the Board of Management shall be such as may be

specified by the Statutes.

(4)

The quorum for the meeting of the Board of Management shall be five;

Provided that the Secretary to the Government, Department of Higher and

Technical Education, Jharkhand, or in his absence, Director, Higher Education shall be

present in each meeting in which decisions on issues involving Government policies/

instructions are to be taken.

24.

The Academic Council.

(1)

The Academic Council shall consist of the Vice Chancellor and such members as may

be specified by the Statutes.

(2)

The Vice-Chancellor shall be the Chairperson of the Academic Council.

(3)

The Academic Council shall be the principal academic body of the university and shall,

subject to the provisions of this Act, Statutes, Ordinances, Regulations or Rules,

coordinate and exercise general supervision over the academic policies of the

University.

(4)

The quorum for meetings of the Academic Council shall be such as may be specified by

the Statutes.

25.

The Finance Committee.

(1)

The Finance Committee shall be the principal financial body of the University to take

care of the financial matters.

(2)

The constitution, powers and functions of the Finance Committee shall be such as may

be prescribed

26.

The Planning Board.

(1)

The Planning Board shall be the principal planning body of the University and shall

ensure that the infrastructure and academic support system meets the norms of the

University Grants Commission or the respective Councils.

(2)

The constitution of the planning board, term of office of its members and its power and

functions shall be such as may be prescribed.

27.

Other Authorities.

The constitution, powers and functions of other authorities of the University, shall be

such as may be prescribed.

28.

Disqualification for membership of an authority or body.

A person shall be disqualified from being a member of any of the authorities or bodies

of the university, if he/she:

(a)

is of unsound mind and stands so declared by a competent court;

(b)

is an undischarged insolvent;

(c)

has been convicted of any offence involving moral turpitude;

(d)

has been punished for indulging or in promoting unfair practice in the conduct of any

examination , in any form, anywhere.

29. Vacancies not to invalidate the constitution of, or the proceedings of any authority or body of

university.

No act or proceedings of any authority of the University shall be invalid merely by

reason of any vacancy in or defect in the constitution of any authority or body of the

University.

30.

Constitution of Committees.

The authorities of the University may constitute such committee with such terms of

reference as may be necessary for specific tasks to be performed shall be such as may be

prescribed by the Statutes.

STATUTES, ORDINANCE AND REGULATIONS

31.

First Statute.

(1) Subject to the provisions of this Act, and the rules made thereunder, the First Statutes may

provide for all or any of the following matters, namely:

(a)

the constitution, powers and functions of the authorities and other bodies of the

University as may be constituted from time to time;

(b)

the terms and conditions of appointment of the Chancellor, the Vice Chancellor and

their powers and functions;

(c)

the manner and terms and conditions of appointment of the Registrar and Chief

Finance and Accounts Officer, their powers and functions;

(d)

the manner and terms and conditions of appointment of other officers and teachers

and their powers and functions;

(e)

the terms and conditions of service of employees of the University;

(f)

the procedure for arbitration in cases of disputes between employees or students and

the University;

(g)

the conferment of Honorary degrees;

(h)

the provisions regarding exemption from payment of tuition fee and awarding

scholarships and fellowships to the students;

(i)

framing of policy for admission, including regulation of reservation of seats; and

(j)

fees to be charged from students.

(2)

The First Statutes of the University shall be made by the Governing Body and shall be

submitted to the State Government for its approval.

(3)

The State Government shall consider the First Statutes, submitted by the University and

shall approve it within sixty days from the date of its receipt, with or without

modifications as it may deem necessary.

(4)

The University shall communicate its agreement to the First Statutes as approved by the

State Government, and if it desires not to give effect to any or all the modifications

made by the State Government under sub-section (3), it may give reasons therefore and

after considering such reason, the State Government may or may not accept the

suggestions made by the University.

(5)

The State Government shall publish the First Statutes, as finally approved by it, in the

Official Gazette, and thereafter it shall come into force from the date of such

publication.

32.

Subsequent Statutes.

(1)

Subject to the provisions of this Act and the rules made thereafter, the subsequent

Statutes of the University may provide for all or any of the following matters, namely :-

(a)

Creation of new authorities of the University;

(b)

Accounting policy and financial procedure;

(c)

Representation of teachers in the authorities of the University;

(d)

Creation of new departments and abolition or restructuring of existing

departments;

(e)

Institution of medals and prizes;

(f)

Procedure for creation and abolition of posts;

(g)

Revision of fees;

(h)

Alteration of the number of seats in different disciplines; and

(i)

All other matters which by or under the provision of this Act required to be

prescribed by the Statutes.

(2)

The Statutes of the University other than the First Statutes shall be made by the Board

of Management with the approval of the Governing Body.

(3)

The Statutes made under sub-section (2) shall be submitted to the State Government

and it may approve or, if considers necessary, give suggestions for modification as far

as possible within two months from the date of receipt of the Statutes.

(4)

The Governing Body shall consider the modifications suggested by the State

Government and return the Statutes to it with its agreement to such changes or with its

comments on the suggestions made by the State Government.

(5)

The State Government shall consider the comments of the Governing Body and may

approve the Statutes with or without modifications and it shall be published by it in the

Official Gazette, and shall come into force from the date of such publication.

33.

First Ordinance.

(1)

Subject to the provisions of this Act, the rules and the Statutes made thereunder, the First

Ordinances may provide for all or any of the following matter, namely :-

(a) The admission of students to the University and their enrolment as such;

(b) The courses of study to be laid down for degrees, diplomas and certificates of the University;

minimum qualifications for the same;

(d) The conditions for award of fellowships, scholarships, stipends, medals and prizes;

(e) The conduct of examinations, including the terms of office and manner of appointment

and the duties of examining bodies examiners and moderators;

(f) Fees to be charged for the various courses examinations, degrees or diplomas of the

University;

(g) The conditions of residence of the students of the University;

(h) Provision regarding disciplinary action against the students;

(i) The creation, composition and functions of any other body which is considered

necessary for improving the academic life of the University;

(j) The manner of co-operation and collaboration with other Universities and institutions of

higher education;

(k) Such other matters which are required to be provided by the Ordinances by or under

this Act.

(2)

The First Ordinances of University shall be made by the Chancellor which after being

approved by the Board of Management, shall be submitted to the State Government for

its approval.

(3)

The State Government shall consider the First Ordinance submitted by the Chancellor

under sub-section (2) within sixty days from the date of its receipt and may approve it

or give suggestions for modifications therein.

(4)

The Chancellor shall either modify the Ordinances incorporating the suggestion of the

State Government or give reasons for not incorporating any of the suggestions made by

the State Government and shall return the First Ordinances along with such reasons, if

any, to the State Government and on receipt of the same, it shall consider the comments

of the Chancellor and may approve the First Ordinances of the University with or

without such modifications and it shall be published by the State Government in the

Official Gazette, and it shall come into force from the date of such publication.

34.

Subsequent Ordinances.

(1)

All Ordinances other than the First Ordinances shall be made by the Academic Council

which after being approved by the Governing Body shall be submitted to the State

Government for its approval.

(2)

The State Government shall consider the Ordinances submitted by the Academic

Council under sub-section (1) as far as possible within two months from the date of its

receipt and may approve it or give suggestions for modifications therein.

(3)

The Academic Council shall either modify the Ordinances incorporation the suggestion

of the State Government or give reasons for not incorporating any of the suggestions

made by the State Government and shall return the Ordinances along with reason, if

any, to the State Government and on receipt of the same, it shall consider the comments

of the Academic Council and may approve the Ordinances with or without

modifications and it shall be published by it in the Official Gazette, and shall come into

force from the date of such publication.

35.

Regulations.

The authorities of the University may, subject to the prior approval of the Governing

Body make Regulation, consistent with this Act, the Statutes and the Ordinances made

thereunder, for the conduct of business of the each such authority and committee constituted by

each such authority.

36.

Powers of State Government to give directions.

(1)

The State Government may, for the purpose of ascertaining the standards of teaching,

examination and research or any other matter relating to the University, cause an

assessment to be made in such manner as may be prescribed, by such person or persons

as it may deem fit.

(2)

The State Government shall communicate its recommendations to the University on the

basis of such assessment for corrective action. The University may adopt such

corrective measures and make efforts so as to ensure the compliance of the

recommendations.

(3)

The State Government may give such directions as it may deem fit if the University

fails to comply with the recommendation made under sub-section(2) within a

reasonable time. The directions given by the State Government shall be immediately

complied by the University.

FUNDS OF UNIVERSITY

37.

Endowment Fund.

(1)

The sponsoring body shall establish an Endowment Fund for the University with an

amount specified in the Letter of Intent.

(2)

The Endowment Fund shall be used as security deposit to ensure that the University

complies with the provisions of this Act and functions as per the provisions of this Act,

the Statutes and the Ordinances. The State Government shall have the power to forfeit ,

a part or whole of the Endowment Fund in case the university or the Sponsoring Body

contravenes the provisions of this Act, Statutes, the Ordinances, the regulations or the

rules made there under.

The University may utilize the income from the Endowment Fund for the development

of infrastructure of the university and not to meet the recurring expenditure of the

university.

(4)

The amount of Endowment Fund shall be invested in such instruments as the

Government may prescribe and kept invested until the dissolution of the university.

(5)

In case of investment in long term security, the certificates of the securities shall be kept

in the safe custody of the Government and in case of deposit in the interest bearing

Personal Deposit account in the Government Treasury, deposit shall be made with the

condition that the amount shall not be withdrawn without the permission of the

Government.

38.

General Fund.

(1) The University shall establish a fund, which shall be called the General Fund to which the

following shall be credited, namely:

(a)

Fees and other charges received by the University;

(b)

Any contribution made by the sponsoring body;

(c)

Any income received from consultancy and other work undertaken by the

University in pursuance of its objective;

(d)

Trusts, bequests, donations, endowments and any other grants; and

(e)

All other sums received by the University.

(2)

The General Fund shall be utilized for the following objects, namely:

(a)

For the repayment of debts including interest charges thereto incurred by the

University for the purposes of this Act and the Statutes, the Ordinances, the

Regulations, and the Rules made there under with the prior approval of the

Governing Body;

(b)

To upkeep the assets of the University;

(c)

For the payment of the fee for audit of the funds created under sections 37 and

38;

(d)

To meet with the expenses of any suit or proceedings by or against the

university;

(e)

For the payment of salaries, allowances, provident fund contributions, gratuity

and other benefits to officers, employees, and members of the teaching and

research staff;

(f)

For the payment of travelling and other allowances of the members of the

Governing Body, the Executive Council, the Academic Council, other

authorities and the members of any committee appointed by any of the authority

or the Chairperson of the sponsoring body or the Chancellor;

(g)

For the payment of fellowships, freeships, scholarships, assistantships and other

awards to the students belonging to economically weaker sections of the society

or research associates, trainees or, as the case may be, in any student otherwise

eligible for such awards under the Statutes, the Ordinances, the Regulations or

the Rules;

(h)

For the payment of any expenses incurred by the University in carrying out the

provisions of Act, Statutes, the Ordinances, the regulations or the Rules;

(i)

for the payment of cost of capital, not exceeding the prime lending rate from

time to time of the State Bank of India, incurred by the Sponsoring Body for

setting up the University and the investments made therefore;

(j)

for the payment of charges and expenditure relating to the consultancy work

undertaken by the university in pursuance of this Act, Statutes, the Ordinances,

the regulations or the rules;

(k)

for the payment of any other expenses including service fee payable to any

organization charged with the responsibility of providing any specific service,

including the managerial services to the University, on behalf of the sponsoring

body, as approved by the Governing Body to be an expense for the purposes of

the university;

Provided that no expenditure shall be incurred by the university in

excess of the limits for total recurring expenditure and total non-recurring

expenditure for the year, as may be fixed by the Governing Body, without prior

approval of the Governing Body.

ACCOUNTS, AUDIT AND ANNUAL REPORT

39.

Annual Report.

The Annual Report of the University shall be prepared by the University which shall

include among other matters, the steps taken by the University towards the fulfillment of its

objects and shall be submitted to the State Government.

40.

Audit and Annual Accounts.

(1)

The annual accounts including balance sheet of the University shall be prepared by the

University and the annual accounts shall be audited at least once in every year by the

auditors appointed by the University for this purpose.

(2)

A copy of the annual accounts together with the audit report shall be submitted to the

State Government.

WINDING UP OF UNIVERSITY

41.

Winding up of University.

(1)

If the sponsoring body proposes to dissolve itself according to the provisions of law

governing its constitution or incorporation; it shall give at least six months prior notice

to the State Government.

(2)

The State Government shall, on receipt of such notice make such arrangements as may

be necessary, for the administration of the University from the date of dissolution of the

sponsoring body till the completion of syllabus by the last batch of students admitted to

the University and may also cause the functioning of the University to continue by

appointing an administrator in place of the sponsoring body, who shall be entrusted

with the powers, duties and functions of the Sponsoring body, duties and functions of

the Sponsoring Body as prescribed under this Act.

42.

Dissolution of University.

(1)

The Sponsoring Body who intends to dissolve the University shall give a notice to that

effect in the prescribed manner to the State Government. The State Government, after

due consideration, may dissolve the University in the manner as may be prescribed;

Provided that the dissolution of the University shall have effect only after the

last batches of students of the regular courses have completed their courses and they

have been awarded degrees, diplomas or, as the case may be, awards.

(2)

On the dissolution of the University all the assets and liabilities of the University shall

vest in the Sponsoring Body in the manner as may be prescribed.

(3)

Where the State Government decides under sub-section (1) to dissolve the University, it

may vest the powers of the Governing Body in the prescribed manner to other societies

having similar objects till the dissolution of the University takes effect under the

proviso to sub-section (1).

43.

Special powers of State Government under certain circumstances.

(1)

Where the State Government is of the opinion that the University has contravened any

of the provisions of this Act, the Rules, the Statutes or the Ordinances made thereunder

or has violated any of the direction issued by it under this Act or a situation of financial

mismanagement or mal-administration has arisen in the University, it shall issue the

notice requiring the University to show cause within forty-five days as to why an

administrator be not appointed.

(2)

On receipt of reply of the University on the notice issued under sub section (1), if the

State Government is satisfied that there is a prima facie case of contravention of any of

the provision of this Act, the Rules, the Statutes or the Ordinances made thereunder or

violation of directions issued by it under this Act or there is financial mismanagement

or maladministration, it shall make an order of such inquiry as it may consider

necessary.

(3)

The State Government shall, for the purposes of any such inquiry under sub-section (2),

appoint an inquiry officer or officers to inquire into any of the allegations and to make

report thereon.

(4)

The inquiry officer or officers appointed under sub-section (3) shall have the same

powers as are vested in a Civil Court under the Code of Civil Procedure, 1908 while

trying a suit in respect of the following matters, namely :-

(a)

Summoning and enforcing the attendance of any person and examining him on oath;

(b)

Requiring the discovery and production of any such document or any other

material as may be predicable in evidence;

(c)

Requisitioning any public record from any court or office.

(5)

On receipt of the inquiry report from the officer or officers appointed under sub-

section(3), if the State Government is satisfied that the University has contravened all or

any of the provisions of this Act, the Rules, the Statutes or the Ordinances made there

under or has violated any of the directions issued by it under this Act or a situation of

financial mismanagement and maladministration has arisen in the University which

threatens the academic standard of the University, it may appoint an administrator.

The administrator appointed under sub-section (5) shall exercise all the powers and

perform all the duties of the Governing Body and the Board of Management under this

Act and shall administer the affairs of the University until the last batch of the students

of the regular courses have completed their courses and they have been awarded with

degrees, diplomas or, as the case may be, awards.

(7)

After having been awarded the degrees, diplomas or, as the case may be, to the last

batches of the students of the regular courses, the administrator shall make a report to

that effect to the State Government.

(8)

On receipt of the report under sub-section (7), the State Government shall dissolve the

University and on dissolution of the University, all the assets and liabilities of the

University shall vest in the sponsoring body.

MISCELLANEOUS

44.

Power of the State Government to make Rules.

(1)

The State Government may, by notification in the Official Gazette, make rules for

carrying out the purposes of this Act.

(2)

All rules made under this section shall be laid for not less than thirty days before the

State Legislature as soon as may be after they are made and shall be subject to

rescission by the State Legislature or to such modification as the State Legislature or to

such modification as the State Legislature may make during the session in which they

are so laid or the Session immediately following.

45.

Completion of courses of students.

Not with standing anything contained in this Act or the Regulations, any student of the

constituent colleges or institutions of the University specified in the Schedule and affiliated to

any University who immediately before the commencement of this Act was studying or was

eligible for any examination of that University shall be permitted to complete his course in

preparation therefore, and the University shall provide for the instruction, teaching, training

and examination of such students, in accordance with the courses of studies of the respective

University in such manner and for such period as may be prescribed.

46.

Power to remove difficulties.

(1)

If any difficulty arises in giving effect to the provisions of this Act, the State

Government may, by order published in the Official Gazette, take steps not inconsistent

with the provisions of this Act, as appear to it to be necessary or expedient for removing

the difficulty.

Provided that no notification order under sub section (1) shall be made after the

expiration of a period of three years from the commencement of this Act.

(2)

Every order made under this section shall, as soon as may be after it is made, be laid

before the State Legislature.

SCHEDULE A

(1)

Acquire not less than 10 acres of land for its main Campus, if single-domain, and 25 acres of

land, if multi-domain within two years after starting the functioning of the university. An

integrated campus may have certain facilities in common such as auditorium, cafeteria, hostels,

etc. and hence the land requirement may vary accordingly.

(2)

Construct Administrative Building of at least 1000 sq. mtrs., academic building including

library, lecture theatres, laboratories of at least 10000 sq. mtrs., adequate residential

accommodations for teachers, guest houses, hostels which shall gradually be increased to

accommodate at least 25% of the total student strength in each course within 3 years of its

coming into existence. In case the University is conducting professional programmes of study,

prevailing norms and standards of respective statutory body shall be applicable. Existing

institutes must undertake expansion/renovation/restructuring to meet the prescribed norms of

the State Government.
