जाना और DरकाडE करना ऐसी रG2त से Aकया जाए जैसा Aक 2नधाEDरत Aकया जाए और ऐसे 2नवाEचन
IेJ या 2नवाEचन IेJB मK अपनाया जाए जैसा Aक भारत 2नवाEचन आयोग वारा 9येक मामले क<
पDरिOथ2तयB को Qयान मK रखते हुए Rव2न+दESट करे; और

यतः, 2नवाEचनB का संचालन 2नयम, 1961 के 2नयम 49क के परUतुक के अनुसार, ऐसे Vडजाइन
वाले Xाप बॉZस स+हत एक Rंटर, जैसा Aक भारत 2नवाEचन आयोग वारा अनुमो+दत Aकया जाए, ऐसे
2नवाEचन IेJ या 2नवाEचन IेJB या उसके भागB मK जैसा Aक भारत 2नवाEचन आयोग वारा, 2नदेश
+दया जाए, मतB के पेपर [ेल के मु\ण के लए मतदान मशीन के साथ जोड़ा जाए; और

यत: आयोग ने गुजरात मK 72-जसदण +वधान सभा नवा चन -े एवं झारख1 ड म2 71-
कोले4बरा (अ०ज०जा०) िजनमK वतEमान मK उप-2नवाEचन चल रहे ह_, क< पDरिOथ2तयB पर Rवचार Aकया
है, और वह संतुS ट है Aक उपयुEZ त Rवधान सभा 2नवाEचन IेJ मK मतदान के लए पयाE` त सं$ या मK
इलेZ [ॉ2नक वो+टंग मशीनK तथा पेपर [ेल के लए Rंटर उपलa ध ह_, तथा मतदान कमEचारG

इलेZ [ॉ2नक वो+टंग मशीनB तथा पेपर [ेल के लए Rंटर को दIतापूणE संचालन करने के लए
शcIत ह_ तथा 2नवाEचक भी इलेZ [ॉ2नक वो+टंग मशीनB तथा उZ त RंटरB क< कायEणालG से
पूणEतया पDर8चत ह_।

अत:, अब भारत 2नवाEचन आयोग लोक 2त2न8ध9 व अ8ध2नयम, 1951 क< उZ त धारा 61क
तथा 2नवाEचनB का संचालन 2नयम, 1961 के 2नयम 49क के अंतगEत अपनी शिZतयB का योग करते
हुए एतeवारा गुजरात मK 72-जसदण +वधान सभा नवा चन -े एवं झारख1 ड म2 71-कोले4बरा
(अ०ज०जा०) +वधान सभा नवा चन -े , को ऐसे 2नवाEचन IेJ के fप मK Rव2न+दES ट करता है,
िजसमK 26 नव:बर, 2018 को उZ त Rवधान सभा 2नवाEचन-IेJB से अ8धसू8चत Aकए गए संबं8धत
गुजरात एवं झारख1 ड के चालू उप-2नवाEचन मK, 2नवाEचनB का संचालन 2नयम, 1961 के अधीन
2नधाEDरत रG2त से तथा जैसा Aक इस Rवषय पर आयोग वारा समय-समय पर अनुपूरक अनुदेश जारG
Aकए गए है, इलेZ टॉ2नक मतदान मशीनB तथा पेपर [ेल के लए Rंटर के माQ यम से मत डाले और
DरकॉडE Aकए जाएंगK।

आयोग एतदवारा भारत इलेZ[ॉ2नZस लमटेड, बंगलौर तथा इलेZ [ॉ2नZ स कापiरेशन आफ
इिडया लमटेड, हैदराबाद वारा यथा-Rवकसत इलेZ [ॉ2नक वो+टंग मशीन और Xॉप बॉZस स+हत
Rंटर, िजसे उZ त वो+टंग मशीनB के साथ संलk न Aकया जाएगा, के Vडजाइन को भी अनुमो+दत करता
है िजनका उपयुEZत Rवधान सभा 2नवाEचन IेJB मK मतB को डालने और DरकाडE करने के लए उपयोग
Aकया जाएगा।

No.576/3/EVM/ECI/LET/FUNC/JUD/SDR/Vol.I/2018:- Whereas, Section 61A of the
Representation of the People Act, 1951, provides that the giving and recording of votes by Voting
Machines in such manner as may be prescribed, may be adopted in such constituency or
constituencies as the Election Commission of India may, having regard to the circumstances of each
case, specify; and
2.
Whereas, as per the proviso to rule 49A of the Conduct of Elections Rules, 1961, a Printer with
a drop box of such design, as may be approved by the Election Commission of India, may also be
attached to voting machine for printing a paper trail of the vote, in such constituency or constituencies
or parts thereof as the Election Commission of India may direct; and

Whereas, the Commission has considered the circumstances in 72-Jasdan Assembly
Constituency in Gujarat and 71-Kolebira(ST) Assembly Constituency in Jharkhand, in which
bye-election are currently in progress, and is satisfied that sufficient number of Electronic Voting
Machines and Printers for Paper Trail are available for taking the poll in the abovementioned
Assembly Constituencies, the polling personnel are well trained in efficient handling of the Electronic
Voting Machines and Printer for Paper Trail and the electors are also fully conversant with the
operation of the Electronic Voting Machines and the said Printers;

Now, therefore, the Election Commission of India, in exercise of its powers under the said
Section 61A of the Representation of the People Act, 1951, and rule 49A of the Conduct of Elections
Rules, 1961, hereby specifies 72-Jasdan Assembly Constituency in Gujarat and 71-Kolebira(ST)
Assembly Constituency in Jharkhand, as the constituencies in which the votes at the current bye-
elections to the State Legislative Assemblies of Gujarat and Jharkhand, from the said
constituencies, notified on 26.11.2018, shall be given and recorded by means of Electronic Voting
Machines and Printers for Paper Trail in the manner prescribed, under the Conduct of Elections Rules,
1961, and the supplementary instructions issued by the Commission from time to time on the subject.

The Commission also hereby approves the design of the Electronic Voting Machine and the
Printer with the drop box (VVPAT) as developed by the Bharat Electronics Ltd., Bangalore and
Electronics Corporation of India Ltd., Hyderabad, which shall be attached to the said voting machines,
to be used for the giving and recording of votes in the above said Parliamentary and Assembly
Constituencies.
