Notification No. 1/2019 – State Tax

S.O. No. 21 Dated.- 8^th February, 2019-- In exercise of the powers conferred

by section 147 of the Jharkhand Goods and Services Tax Act, 2017 (12 of 2017), the

Government of Jharkhand, on the recommendations of the Council, hereby makes the

following amendment in the Notification No. -48/2017- State Tax of the Commercial

Taxes Department, Government of Jharkhand published vide S.O. No. 113 dated the

24^th October, 2017 in the Jharkhand Gazette, Extraordinary, namely:–

In the said notification,

(i)

In the Table, the column number (2) against S. No.1, after the entry, the

following proviso shall be inserted, namely: -

“Provided that goods so supplied, when exports have already been made after

availing input tax credit on inputs used in manufacture of such exports, shall be used

in manufacture and supply of taxable goods (other than nil rated or fully exempted

goods) and a certificate to this effect from a chartered accountant is submitted to the

jurisdictional commissioner of GST or any other officer authorized by him within 6

months of such supply,;

Provided further that no such certificate shall be required if input tax credit has

not been availed on inputs used in manufacture of export goods.”;

(ii)

In the Explanation against serial number 1 the words “on pre-import basis”

shall be omitted.

This notification shall be deemed to be effective from 15^th January, 2019.

का0शत, म? नDन0ल2खत संशोधन करती है, अथाHत् :-

उ&त अधसूचना म?,

सारणी के Mतंभ (2) म? Nम सं. 1 के सामने 5विOट के पQचात् नDन0ल2खत परंतुक

अंतःMथा5पत Sकया जाएगा, अथाHत् :-

“परंतु इस कार पूतH Sकए गए माल का उपयोग, जब नयाHत, ऐसे नयाHत'

के 5वनमाHण म? यु&त इनपुट' पर इनपुट कर "यय का उपभोग करने के पQचात्

पहले हB कर Wदया गया हो, कराधेय माल (शूXय दर या पूणHतः छूट ाZत माल से

0भXन) के 5वनमाHण और पूतH म? Sकया जाएगा और चाटHडH अकाउंट?ट से इस भाव

का माणप>, केX[Bय माल और सेवा कर के अधका.रता वाले आयु&त या उसके

वारा ाधकृत Sकसी अXय अधकारB को, ऐसी पूतH के छह मास के भीतर Mतुत

कर Wदया गया हो, ;

परंतु यह और Sक यWद नयाHत माल के 5वनमाHण म? यु&त इनपुट' पर

इनपुट कर "यय का उपभोग नहBं Sकया गया है तो ऐसा माणप> अपे_`त नहBं

होगा । ” ;

(ii) MपOटBकरण म? Nम संcया 1 के सामने “पूवH आयात आधार पर” शdद' का

लोप Sकया जाएगा ।
