Order No. 03/2018-State Tax

S.O. No. 22 Dated.- 8^th February, 2019-- WHEREAS, sub-section (1) of

section 44 of the Jharkhand Goods and Services Tax Act, 2017 (12 of 2017)

(hereafter in this Order referred to as the said Act) provides that every registered

person, other than an Input Service Distributor, a person paying tax under section 51

or section 52, a casual taxable person and a non-resident taxable person, shall furnish

an annual return for every financial year electronically in such form and manner as

may be prescribed on or before the thirty-first day of December following the end of

such financial year;

AND WHEREAS, for the purpose of furnishing of the annual return

electronically for every financial year as referred to in sub-section (1) of section 44 of

the said Act, through the electronic system to be developed is at the advanced stage, it

may likely to take some more time for being made operational as a result whereof, the

said annual return for the period from the 1^st July, 2017 to the 31^st March, 2018 could

not be furnished by the registered persons, as referred to in the said sub-section (1)

and because of that, certain difficulties have arisen in giving effect to the provisions

of the said section.

NOW, THEREFORE, in exercise of the powers conferred by section 172 of the

Jharkhand Goods and Services Tax Act, 2017, the State Government, on

recommendations of the Council, hereby makes the following Order, to remove the

difficulties, namely:––

1. Short title.––This Order may be called the Jharkhand Goods and Services

Tax (Third Removal of Difficulties) Order, 2018.

2. In section 44 of the Jharkhand Goods and Services Tax Act, 2017, in the

Explanation, for the figures, letters and word “31^st March, 2019”, the figures, letters

and word “30^th June, 2019” shall be substituted.

3. This order shall be deemed to be effective from 31^st December, 2018.

अधनयम, 2017 (2017 का 12) (िजसे इस आदेश म इसके पचात् उ#त अधनयम कहा गया है)

क' धारा 44 क' उपधारा (1) म यह उपबंधत है *क इनपुट सेवा -वतरक, धारा 51 या धारा 52 के अधीन

कर का संदाय करने वाले 0यि#त, नै1मि2तक कराधेय 0यि#त और अनवासी कराधेय 0यि#त से

1भ4न 52येक रिज678कृत 0यि#त 52येक -व2तीय वष; के 1लए इलै#7ानक =प से ऐसे 5=प और

र8त म, जो -व@हत क' जाए, ऐसे -व2तीय वष; के अंत के पचात् आने वाले इ#कतीस @दसंबरको या

उससे पूव; एक वा-ष;क -ववरणी 56तुत करेगा;

और उ#त अधनयम क' धारा 44 क' उपधारा (1) म यथा न@द;Eट 52येक -व2तीय वष; के 1लए

इलै#7ानक =प से वा-ष;क -ववरणी 56तुत करने के 5योजन के 1लए -वक1सत क' जाने वाल8

इलै#7ानक 5णाल8 अFसरण 5Gम पर है, इसे 5चा1लत करने म कुछ और समय लगने क' संभावना

है, िजसके पIरणाम6व=प उ#त उपधारा (1) म यथान@द;Eट रिज678कृत 0यि#तयJ Kवारा 1 जुलाई,

2017 से 31 माच;, 2018 तकक' कालावध के 1लए उ#त वा-ष;क -ववरणी 56तुत नह8ं क' जा सक'

है और िजसके कारण उ#त धारा के उपबंधJ को 5भावी करने म कतपय क@ठनाईयां उ2प4न हुई हS ।

अत:, अब, राUय सरकार, झारखड माल और सेवा कर अधनयम, 2017 क' धारा 172 Kवारा

5द2त शि#तयJ का 5योग करते हुए पIरषK क' 1सफाIरशJ पर, क@ठनाईयJ को दूर करने के 1लए

नWन1लXखत आदेश करती है, अथा;त् :--

1. सं"#$त नाम—इस आदेश का संYZ[त नाम झारखड माल और सेवा कर (तीसरा क@ठनाईयJ का

नवारण) आदेश, 2018 है ।

2. झारखड माल और सेवा कर अधनयम, 2017 क' धारा 44 के 6पEट8करण म, “31 माच;, 2019”

अंकJ और श_द के 6थान पर “30 जून, 2019” अंक और श_द रखे जाएंगे ।

3. यह अधसूचना 31 @दसWबर, 2018 से 5वृ2त मानी जाएगी।
