Order No. 02/2019-State Tax

S.O. No. 29 Dated- 6^th March, 2019- WHEREAS, sub-section (4) of

section 52 of the Jharkhand Goods and Services Tax Act, 2017 (12 of 2017)

(hereafter in this Order referred to as the said Act) provides that every operator who

collects the amount specified in sub-section (1) shall furnish a statement,

electronically, containing the details of outward supplies of goods or services or both

effected through it, including the supplies of goods or services or both returned

through it, and the amount collected under sub-section (1) during a month, in such

form and manner as may be prescribed, within ten days after the end of such month;

AND WHEREAS, certain operators, were unable to obtain registration because

of technical issues being faced by them on the common portal but they collected the

amount for the months of October, November and December 2018, as a result

whereof, the statement under subsection (4) of section 52 of the said Act could not be

furnished and because of that certain difficulties have arisen in giving effect to the

provisions of the said sub-section;

NOW, THEREFORE, in exercise of the powers conferred by section 172 of the

Jharkhand Goods and Services Tax Act, 2017, the State Government, on

recommendations of the Council, hereby makes the following Order, to remove the

difficulties, namely: ––

(i) Short title. ––This Order may be called the Jharkhand Goods and Services Tax (Second

Removal of Difficulties) Order, 2019.

(ii) In section 52 of the Jharkhand Goods and Services Tax Act, 2017, in sub-section (4), in the

Explanation, for the figures, letters and word “31^st January, 2019”, the figures, letters and

word “07^th February, 2019” shall be substituted.

2. This order shall be deemed to be effective from 1st February, 2019.

2017 (2017 का 12) (िजसे इस आदेश म# इसके प%चात् उ*त अधनयम कहा गया है) क.

धारा 52 क. उपधारा (4) म# यह उपबंधत है 3क 45येक 4चालक, जो उपधारा (1) म#

7वन8द9:ट रकम का सं<हण करता है, उसके >वारा क. जाने वाल? माल या सेवाओं या दोनA

क. जावक पूत9यA, िजसके अंतग9त उसके >वारा वापस क. गई माल या सेवाओं या दोनA क.

पूत9यां भी हF, के Gयौरे और मास के दौरान उपधारा (1) के अधीन संगृह?त रकम के GयौरA

को अंत7व9:ट करते हुए ऐसे 4Mप और ऐसी र?त म#, जो 7व8हत क. जाए, ऐसे मास के अंत

के प%चात् दस 8दन के भीतर इलै*Nानक Mप से एक 7ववरण 4Oतुत करेगा ;

और कतपय 4चालक, जो सामाQय पोट9ल पर उनके >वारा तकनीक. क8ठनाईयA का

सामना करने के कारण रिजON?करण अSभ4ाTत करने म# असमथ9 रहे थे 3कंतु उQहAने

अ*तूबर, नवंबरऔर 8दसंबर, 2018 मास के Sलए रकम का सं<हण 3कया था, िजसके

पWरणामOवMप उ*त अधनयम क. धारा 52 क. उपधारा (4) के अधीन वे 7ववरण 4Oतुत

नह?ं कर सके और िजसके कारण उ*त उपधारा के उपबंधA को 4भावी करने म# कतपय

क8ठनाईयां उXूत हुई हF;

अत:, अब, राZ य सरकार, झारखड माल और सेवा कर अधनयम, 2017 क. धारा

172 >वारा 4द5त शि*तयA का 4योग करते हुए, पWरष> क. SसफाWरशA पर क8ठनाईयA को

दूर करने के Sलए न]नSल^खत आदेश करती है, अथा9त् :--

(i) सं`aTत नाम—इस आदेश का सं`aTत नाम झारखड माल और सेवा कर (>7वतीय

क8ठनाईयA को दूर करना) आदेश, 2019 है ।

(ii) झारखड माल और सेवा कर अधनयम, 2017 क. धारा 52क. उप-धारा (4)के

Oप:ट?करण म#, “31 जनवर?, 2019”अंकA और शGदA के Oथान पर “07फरवर?,

2019”अंक और शGद रखे जाएंगे ।

2. यह आदेश 1 फरवर?, 2019 से 4वृ5त मानी जाएगी।
