Notification No. -16/2019 – State Tax(Rate)

S.O. No- 84 Dated- 1^st November, 2019-- In exercise of the powers conferred

by sub-section (1) of section 11 of the Jharkhand Goods and Services Tax Act, 2017 (12 of

2017), the Government of Jharkhand, on there commendations of the Council, hereby

makes the following amendments in the notification of the Government of Jharkhand, in the

Commercial Taxes Department, No.3/2017-State Tax (Rate), dated the 29^th June, 2017

published in the Gazette of Jharkhand, Extraordinary, vide S.O. No. 33, dated the 29^th June,

2017, namely:-

In the said notification,-

(i) in the TABLE, against S. No. 1, in column (3), after item (5), the following item shall be inserted, namely: -

“(6) Petroleum operations or coal bed methane operations undertaken under specified

contracts under the Hydrocarbon Exploration Licensing Policy (HELP) or Open Acreage

Licensing Policy (OALP)”;

(ii) in the ANNEXURE, against Condition No. 1, in clause (e), the following proviso shall

be inserted, namely: -

“Provided that where the said goods so supplied are sought to be disposed of in non-

serviceable form, after mutilation, the recipient of outward supply or the transferee, as the

case may be, may at his option, pay the tax at the rate of 9 per cent. on transaction value of

such goods subject to the condition that the recipient of outward supply or the transferee, as

the case may be, produces before the Deputy Commissioner of Central tax or the Assistant

Commissioner of Central tax or the Deputy Commissioner of State tax or the Assistant

Commissioner of State tax, as the case may be, having jurisdiction over the supplier of

goods, a certificate from a duly authorised officer of the Directorate General of Hydro

Carbons in the Ministry of Petroleum and Natural Gas, Government of India, to the effect

that the said goods are non-serviceable and have been mutilated before disposal.”.

This notification shall be deemed to be effective from 1^st day of October, 2019.

“परंतु जहां इस "कार पूतW Hकए गए माल का :वकृत के पQ चात अ"यो9 य aप मG नपटान Hकया जाना है,

वहां बाbय आपूतW का "ाX तकताW या अंत1रती, जैसी भी िOथत हो, अपने :वकc प पर ऐसे माल के

संe यवहार मूc य के 9 "तशत क दर से कर का भुगतान कर सकता है, बशतf Hक ऐसे नO तारण से पूवW

उ' त बाbय आपूतW का "ाX तकताW या अंत1रती, जैसी भी िOथत हो, उस उप आयु' त, के_ g0य कर या

सहायक आयु' त, के_ g0य कर या उप आयु' त, रा9 य कर या सहायक आयु' त, रा9 य कर, जैसी भी

िOथत हो, िजसके अधकार NेF मG उ' त माल का आपूतWकताW आता हो, को पे\ो3लयम एवं "ाकृतक गैस

मंFालय के हाइUोकाबWन महानदेशालय के Hकसी :वधवत अधकार0 से "ाX त इस आशय का "माण पF

"O तुत करे Hक उ' त माल अ"यो9 य हो गया है और यह नपटान से पहले :वकृत भी हो गया है”;

2. यह अधसूचना 1 अ'टूबर, 2019 से लागू मानी जाएगी।
