अ.ध5नयम, 2018 क7 धारा-(4) क7 उप-धारा-(1) म9 द;त शि1तय= का योग करते हुए, राBय सरकार, एत
वारा इस अ.धसूचना के काशन क7 5त.थ से झारखड अ.धव1ता ल2पक क4याण 5न.ध सम5त के गठन क7
घोषणा करती है ।
2.
सम5त एक 5नगमत 5नकाय होगी, िजसके पास शाJवत उ;तरा.धकार तथा सKप5त के अजLन, रखने एवं
5नपटन9 क7 शि1त के साथ एक सामाMय मुहर (सील) होगी और वह उ1त नाम से वाद चला सकती है या उस पर
वाद चलाया जा सकता है ।

सम5त म9 5नKनलPखत सदQय होग9 :-
(क)
2व.धS पTरष के अUयक्ष ;
(ख)
धान स.चव, 2व.ध 2वभाग ;
(ग)
धान स.चव, गृह 2वभाग ;

यथा2व]हत ा.धकार एवं र^5त से अ.धव1ता ल2पक= म9 से नाम 5नद_शत तीन सदQय, िजन म9
से एक को सम5त वारा 5न.ध का कोषाUय` मनोनीत aकया जाएगा, और
(छ)
स.चव क7 5नयुि1त अUय` वारा उस 2व5नयम के अनुसार क7 जाएगी, जो ऐसे स.चव क7
5नयुि1त एवं सेवा-शतd के संबंध म9 सम5त वारा बनाई जाय।
परंतु इस कार 5नयु1त स.चव के पास सम5त क7 बैठक म9 मत देने का अ.धकार नह^ं होगा ।

सरकार के धान स.चव, 2व.ध 2वभाग, धान स.चव, गृह 2वभाग, धान स.चव, 2वत 2वभाग एवं
झारखड उ\च Mयायालय, के महा5नबंधक सम5त के पदेन सदQय होग9।

सरकार के धान स.चव, 2व.ध 2वभाग, धान स.चव, गृह 2वभाग, धान स.चव, 2वत 2वभाग य]द
aकसी कारण से सम5त क7 बैठक म9 उपिQथत नह^ं हो सकते हf तो वे अपने 2वभाग से उप स.चव Qतर से
अMयून पंि1त के aकसी पदा.धकार^ को बैठक म9 शामल होने के लए 5त5नयु1त कर सकते हf।

झारखड उ\च Mयायालय के महा5नबंधक य]द aकसी कारण से सम5त क7 बैठक म9 उपिQथत नह^ं हो
सकते हf तो वे उप 5नबंधक Qतर से अMयून पंि1त के aकसी पदा.धकार^ को बैठक म9 शामल होने के लए
5त5नयु1त कर सकते हf।

उप-धारा (3) के खंड (च) के अधीन नाम 5नद_शत कोई सदQय अपने नाम 5नद_शत क7 5त.थ से तीन
वषd क7 अव.ध तक अथवा अ.धव1ता ल2पक संघ के सदQय रहने तक, जो भी पहले हो पद धारण
करेगा।
9.
स.चव को 5न.ध से यथा 2व]हत र^5त से पाTरhमक का भुगतान aकया जाएगा ।

Notification No.-07 D/Advocate clerk’s-17/2020 - 457 /J.--In exercise of the powers
conferred by sub-section (1) of section (4) of the Jharkhand Advocates' Clerks Welfare Fund
Act, 2018 the State Government, w.e.f. the date of this notification, do hereby establish
Jharkhand Advocates' Clerks Welfare Fund Committee.
2.
The Committee shall be a body corporate having perpectual succession and a
common seal with power to acquire, hold and dispose of property and shall, by the said
name, sue and be sued.
3.
The Committee shall consist of the following members, namely:-
(a)
The Chairman of the Bar Council;
(b)
The Principal Secretary to Government, Law Department;
(c)
The Principal Secretary to Government, Home Department;
(d)
The Principal Secretary to Government, Finance Department;
(e)
The Registrar General of Jharkhand, High Court;
(f)
Three members to be nominated from amongst the Advocates' Clerks by such
authority and in such manner as may be prescribed, of whom one shall be
nominated by the Committee as the treasurer of the Fund; and;
(g)
A Secretary to be appointed by the Chairman in accordance with such
regulation as may be made by the Committee in respect of the recruitment and
conditions of service of such secretary.
Provided that the secretary so appointed shall not have the right to vote
at the meetings of the committee.

The Chairman of the Bar Council shall be ex-officio Chairperson of the Committee.
5.
The Principal Secretary to Government, Law Department, the Principal Secretary to
Government, Home Department, the Principal Secretary to Government, Finance
Department and the Registrar General of Jharkhand High Court shall be ex-officio
members of the Committee.
6.
In case the Principal Secretary to Government, Law Department, the Principal
Secretary to Government, Home Department, the Principal Secretary to Government,
Finance Department, is unable to attend the meetings of the Committee for any
reason, he may depute any officer not below the rank of Deputy Secretary to
Government to attend the meetings.

In case the Registrar General of Jharkhand High Court is unable to attend the
meetings of the Committee for any reason, he may depute any officer of his
Department, not below the rank of Deputy Registrar to attend the meetings.
8.
A member nominated under clause (f) of sub-section (3) shall held office for a term of
three years from the date of such nomination or until he cease to be a member of
Advocates' Clerks Association whichever is earlier.
9.
The Secretary shall be paid such remuneration out of the Fund, as may be prescribed.
