घोषणा कG थी, िजMहD 0दनांक 06.03.2020 कG अNधसूचना सं#या 318/रा.स.-म7ट8/2020 (1) के तहत अNधसूNचत
Pकया गया था। 0दनांक 18.03.2020 को नाम वाRपस लेने कG अं;तम तार8ख के उपरांत, संब Vरट;नWग
अNधकाVरय@ ने 10 रा?य@ कG 37 सीटD ;नRव<रोध भरे जाने कG घोषणा कG। इसके अ;तVरYत, संब Vरट;नWग
अNधकाVरय@ से ाZत हुई Vरपोट< के अनुसार, ये RववाRष<क ;नवा<चन आं[ देश, गुजरात, झारखंड, म\य देश,
म]णपुर, मेघालय और राजFथान रा?य@ से 18 सीट@ के लए 0दनांक 26.03.2020 (गु_वार) को आयोिजत Pकए
जाने थे और जैसा Pक आयोग वारा 0दनांक 06.03.2020 कG अNधसूचना के अनुसार पहले घोषणा कG गई थी,
िजस तार8ख से पहले ;नवा<चन संपMन करवाए जाने थे, वह तार8ख 30.03.2020 (सोमवार) थी; और
यत: लोक ;त;नNध`व अNध;नयम, 1951 कG धारा 153 मD यह Rव;न0द<ट है Pक ;नवा<चन आयोग PकMह8ं
भी कारण@, जो इसे उNचत लगD, से उYत अNध;नयम कG धारा 30 अथवा धारा 39 कG उप-धारा (1) के अंतग<त
आयोग वारा जार8 कG गई अNधसूचना मD आवaयक संशोधन करते हुए Pकसी भी ;नवा<चन को पूरा/संपMन Pकए
जाने के लए समय-सीमा मD RवFतार कर सकता है। तदनुसार, कोRवड-19 कG वजह से जन FवाFbय संबंधी

आपातकाल कG मौजूदा अ`याशत िFथ;त और देश मD जार8 संब 0हदायत@ (एडवाइजर8) को \यान मD रखते
हुए, ;नवा<चन आयोग ने 0दनांक 24.03.2020 के अपने आदेश के तहत मतदान आFथNगत कर 0दए थे और उYत
अNध;नयम कG धारा 153 के ावधान@ के अंतग<त उYत ;नवा<चन कG अवNध बढा द8 थी तथा यह ;नण<य लया
था Pक उYत RववाRष<क ;नवा<चन@ के लए मतदान तथा मतगणना कG नई तार8ख कG घोषणा, भारत ;नवा<चन
आयोग वारा Rवयमान िFथ;त कG समीeा करने के उपरांत कG जाएगी। इस आदेश मD यह भी Rव;न0द<ट था
Pक संब Vरट;नWग अNधकाVरय@ वारा उYत ;नवा<चन के लए ;नवा<चन लडने वाले अfयNथ<य@ कG पहले से ह8
काशत कG गई सूची, उन शेष सभी काय<कलाप@ के योजनाथ< वैध रहेगी जो उYत अNधसूचना (0दनांक
06.03.2020) के अंतग<त ;नधा<Vरत Pकए गए थे ; और
यत: जन FवाFbय संबंधी आपातकाल कG त`काल8न Rवयमान िFथ;तय@ कG समीeा करने के बाद
आयोग ने लोक ;त;नNध`व अNध;नयम, 1951 कG धारा 153 के साथ प0ठत भारत के संRवधान के अनुgछेद
324 के अधीन अपनी शिYतय@ का योग करते हुए अपने 0दनांक 03.04.2020 के आदेश के तहत ;नवा<चन कG
अवNध को उपयु<Yत सीट@ के Rव0हत काय<काल से आगे बढ़ा 0दया था और यह ;नण<य लया था Pक त`काल8न
Rवयमान पVरिFथ;तय@ कG समीeा करने के बाद उNचत समय पर मतदान और मतगणना कG नई तार8ख
सूNचत कर द8 जाएगी। यह भी Fपट Pकया गया था Pक संबंNधत Vरट;नWग अNधकाVरय@ वारा उYत ;नवा<चन@ के
लए ;नवा<चन लड़ने वाले अfयNथ<य@ कG पहले से काशत कG गई सूची, उन शेष काय<कलाप@ के योजनाथ< वैध
रहेगी, जो 0दनांक 06.03.2020 कG अNधसूचना के अंतग<त Rव0हत Pकए गए थे।
यत: आयोग ने इस मामले कG kयापक समीeा कG है। राl8य आपदा बंधन अNध;नयम, 2005 के
अधीन केMm8य गृह सNचव और राl8य काय<कार8 सम;त (एनईसी) के अ\यe वारा जार8 Pकए गए 0दनांक
30.05.2020 के 0दशा-;नदnश@ स0हत सभी कारक@ पर Rवचार करते हुए तथा रा?य@ के संबंNधत मु#य ;नवा<चन
अNधकाVरय@ से ाZत जानकार8 (इनपुट) को \यान मD रखते हुए, आयोग वारा ;नण<य लया गया है Pक आं[
देश (04 सीट), गुजरात (04 सीट), झारखंड (02 सीट), म\य देश (03 सीट), म]णपुर (01 सीट), मेघालय (01 सीट)
और राजFथान (03 सीट) रा?य@ से 18 सीट@ के लए RववाRष<क ;नवा<चन@ के संबंध मD मतदान और मतगणना

NOTIFICATION

No. 318/CS-Multi/2020(1): - WHEREAS, on 25.02.2020, Election Commission of India announced
elections to the Council of States to fill 55 seats of Members from 17 States, retiring in the month of
April,2020, which were notified vide Notification No. 318/CS-Multi/2020(1) dated 06.03.2020. After the last
date of withdrawal on 18.03.2020, respective Returning Officers declared 37 seats from 10 States filled in
uncontested. Further, as per the reports received from the concerned Returning Officers, the biennial
elections for 18 seats from the States of Andhra Pradesh, Gujarat, Jharkhand, Madhya Pradesh, Manipur,
Meghalaya and Rajasthan were to be conducted on 26.03.2020 (Thursday) and the date before which election
was to be completed as earlier announced by the Commission was 30.03.2020 (Monday) as per the
notification dated 06.03.2020; and
Whereas, Section 153 of the Representation of the People Act, 1951 specifies that the Election
Commission for reasons which it considers sufficient, may extend the time for the completion of any election
by making necessary amendments in the notification issued by it under section 30 or sub-section (1) of section
39 of the said Act. Accordingly, considering the prevailing unforeseen situation of public health emergency due
to COVID-19and related advisories in the country, the Election Commission, vide its Order, dated 24.03.2020,
deferred the poll and extended the period of said election under the provisions of section 153 of the said Act
and decided that the announcement of fresh date of poll and counting for the said biennial elections will be
made by the ECI after reviewing the prevailing situation. The Order also specified that the list of contesting
candidates, already published for the said election by the respective Returning Officers, is to remain valid for
the purpose of remaining activities as was prescribed under the said notification (dated 06.03.2020); and
Whereas, vide its Order dated 03.04.2020, after reviewing the then prevailing situation of Public
health emergency, the Commission further extended the period of election beyond the prescribed term(s) of
above-mentioned seats invoking its powers under Article 324 of the Constitution of India read with section 153
of the Representation of the People Act, 1951 and decided that the fresh date of poll date and counting shall
be intimated in due course after reviewing the then prevailing situation. It was further clarified that the list of
contesting candidates, already published for the said elections by the respective Returning Officer, shall
remain valid for the purpose of remaining activities, as prescribed under the notification dated 06.03.2020.
Whereas, the Commission has reviewed the matter in detail. Considering all factors, including the
guidelines dated 30.05.2020 issued by Union Home Secretary and Chairman, national Executive Committee
(NEC) under the National Disaster Management Act, 2005,and taking into account the inputs obtained from
the Chief Electoral Officers concerned, the Commission has decided that the date of poll and counting of votes
in respect of the biennial elections for 18 seats from the States of Andhra Pradesh (4 seats), Gujarat (4 seats),

Jharkhand (2 seats), Madhya Pradesh (3 seats), Manipur (1 seat), Meghalaya (1 seat) and Rajasthan (3
seats)shall be as per the following schedule:

Now, therefore, in view of the above and in exercise of the powers vested under article 324 of the

hereby makes further amendment in its notification No. 318/CS-MULTI/2020(1), dated 06th March, 2020 as
under:
sub-para (d) & (e) of para (A) of the said notification shall be substituted with
“(d) the 19th June, 2020 (Friday), as the date on which a poll shall, if necessary, be taken; and
(e) the 22nd June, 2020 (Monday), as the date before which the election shall be completed; and”.
