Notification No. 30/2020 – State Tax

S.O. No. 46, Dated- 25^th June, 2020 :- In exercise of the powers conferred by section 164 of

the Jharkhand Goods and Services Tax Act, 2017 (12 of 2017), the Government of Jharkhand, on the

recommendations of the Council, hereby makes the following rules further to amend the Jharkhand

Goods and Services Tax Rules, 2017, namely:-

1. (1) These rules may be called the Jharkhand Goods and Services Tax (Fourth Amendment) Rules,

2020.

(2) Save as otherwise provided, they shall be deemed to be effective from 3^rd April, 2020.

2. In the Jharkhand Goods and Services Tax Rules, 2017 (hereinafter referred to as the said rules), with

effect from the 31^st March, 2020, in sub-rule (3) of rule 3, the following proviso shall be inserted,

namely:-

“Provided that any registered person who opts to pay tax under section 10 for the financial year

2020-21 shall electronically file an intimation in FORM GST CMP-02, duly signed or verified

through electronic verification code, on the common portal, either directly or through a Facilitation

Centre notified by the Commissioner, on or before 30^th day of June, 2020 and shall furnish the

statement in FORM GST ITC-03 in accordance with the provisions of sub-rule (4) of rule 44 upto the

31^st day of July, 2020.”.

3. In the said rules, in sub-rule (4) of rule 36, the following proviso shall be inserted, namely:-

“Provided that the said condition shall apply cumulatively for the period February, March,

April, May, June, July and August, 2020 and the return in FORM GSTR-3B for the tax period

September, 2020 shall be furnished with the cumulative adjustment of input tax credit for the said

months in accordance with the condition above.”.

(2017 का 12) क धारा 164 वारा द"त शि&तय' का योग करते हुए, प.रष क 0सफा.रश' पर, झारखंड

माल और सेवा कर नयमावल2, 2017 का और संशोधन करने के 0लए न3न0ल4खत नयम बनाती है, अथा9त्

:-

1. (1) इन नयम' का सं=>?त नाम झारखंड माल और सेवा कर (चौथा संशोधन) नयमावल2, 2020 है ।

(2) इन नयम' मC अDयथा उपबंधत के 0सवाय, ये 3 अ ैल, 2020 से वृ"त मानी जाएगी।

झारखंड माल और सेवा कर नयमावल2, 2017 (िजसे इसमC इसके पIचात् उ&त नयम कहा गया है)

के नयम 3 के उपनयम (3)मC, 31 माच9, 2020 से, न3न0ल4खत Dतुक अंतःKथाLपत Mकया जाएगा, अथा9त् :-

“परंतु कोई पंजीकृत O यि& त, जो Lव" तीय वष9 2020-21के 0लए धारा 10 के अधीन कर संदाय करने का

LवकP प लेता है, " य> Qप से या आयु& त वारा अधसूचत सुLवधा कC T के माU यम से सामाD य पोट9ल पर

स3 यक् Qप से हK ता>.रत या इले& Wानक स" यापन कोड के माU यम से स" याLपत Qप जीएसट2 सीएमपी-02

मC सूचना को जून, 2020 के 30 वC Yदन या उससे पूव9 तक फाइल करेगा और नयम 44 के उपनयम (4) के

उपबंध' के अनुसार Qप जीएसट2 आईट2सी-3 मC Lववरण जुलाई, 2020 के 31वC Yदन तक Kतुत करेगा।”।

3. उ&त नयमावल2 के, नयम 36 के उप-नयम (4) मC, न3न0ल4खत Dतुक अंतःKथाLपत Mकया जाएगा,

अथा9त्: -

“परंतु Mक उ&त शत9 फरवर2, माच9, अ ैल, मई, जून, जुलाई और अगKत, 2020 के मह2न' के 0लए

संचयी Qप से लागू होगी और 0सतंबर, 2020 क कर अवध के 0लए Qप जीएसट2आर-3ख क Lववरणी, उ&त

मह2न' के इनपुट कर "यय का उपयु9&त शत[ के अनुसार संचयी Qप से समायोजन कर के Kतुत क

जाएगी।”।
