Notification No. 38/2020 – State Tax

S. O. No. 58, Dated- 04^th September, 2020- In exercise of the powers conferred by

section 164 of the Jharkhand Goods and Services Tax Act, 2017 (12 of 2017), the Government of

Jharkhand, on the recommendations of the Council, hereby makes the following rules further to

amend the Jharkhand Goods and Services Tax Rules, 2017, namely: -

1. (1) These rules may be called the Jharkhand Goods and Services Tax (Fifth Amendment) Rules,

2020.

(2) Save as otherwise provided in these rules shall be deemed to have come into force with effect

from the 5^th May, 2020.

In the Jharkhand Goods and Services Tax Rules, 2017 (hereinafter referred to as the said

rules), with effect from the 21^st April, 2020, in rule 26 in sub-rule (1), after the proviso, following

proviso shall be inserted, namely: -

“Provided further that a registered person registered under the provisions of the

Companies Act, 2013 (18 of 2013) shall, during the period from the 21^st day of April, 2020 to the

30^th day of June, 2020, also be allowed to furnish the return under section 39 in FORM GSTR-3B

verified through electronic verification code (EVC).”.

In the said rules, after rule 67, with effect from a date to be notified later, the following

rule shall be inserted, namely: -

“67A.Manner of furnishing of return by short messaging service facility.- Notwithstanding

anything contained in this Chapter, for a registered person who is required to furnish a Nil

return under section 39 in FORM GSTR-3B for a tax period, any reference to electronic

furnishing shall include furnishing of the said return through a short messaging service using the

registered mobile number and the said return shall be verified by a registered mobile number

based One Time Password facility.

Explanation. - For the purpose of this rule, a Nil return shall mean a return under section 39 for a

tax period that has nil or no entry in all the Tables in FORM GSTR-3B.”.

प6रषद क$ 8सफा6रश/ पर, झारखंड माल और सेवा कर नयमावल:, 2017 का और संशोधन करने के

8लए न; न8ल<खत नयम बनाती है, अथाAत् :--

1. (1) इन नयम/ का संFGHत नाम झारखंड माल और सेवा कर (पांचवां संशोधन) नयमावल:, 2020

है।

(2) इन नयम/ मJ अKयथा उपबंधत के 8सवाय, ये 5 मई, 2020 से (वृ*त मानी जाएगी।।

झारखंड माल और सेवा कर नयमावल:, 2017(िजसे इसके पQचात उ. त नयमावल: कहा गया

है) के नयम 26 के उपनयम (1) मJ, 21 अ(ैल 2020 से, परK तुक के पQ चात् न; न8ल<खत परK तुक

अंत:R थाSपत Tकया जाएगा, अथाAत् :--

“परंतु और Tक Tकसी भी रिजR W:कृत X यि. त को, जो Tक क; पनी अधनयम, 2013 (2013 का 18)

के उपबंध/ के अधीन रिजR W:कृत हो, को 21 अ(ैल 2020 से 30 जून 2020 तक क$ अवध के

दौरान, धारा 39 के तहत ([प जीएसट:आर-3ख मJ (Rतुत क$ जाने वाल: Sववरणी को इले. Wानक

स* यापन कोड (ईवीसी) के मा_ यम से स* याSपत करने क$ भी अनुमत है। ” ।

उ. त नयमावल: के नयम 67 के पQ चात, इसे बाद मJ अधसूचत Tकये जाने क$ तार:ख से,

न; न8ल<खत नयम अंत:R थाSपत Tकया जाएगा, अथाAत् :--

“67क. लघु संदेश सेवा सुSवधा के 'वारा Sववरणी (R तुत करने का (बंध - इस अ_ याय मJ Tकसी भी

बात के होते हुए भी, ऐसे रिजR W:कृत X यि. त के मामले मJ िजससे धारा 39 के अंतगAत ([प

जीएसट:आर-3ख मJ Tकसी कर अवध क$ ‘शूK य’ Sववरणी भरना अपेFGत हो, इले. Wानक तर:के से

भरे जाने के Tकसी भी संदभA मJ उ. त Sववरणी को रिजR W:कृत मोबाइल का (योग करके लघु संदेश

सेवा के मा_ यम से भरे जाने क$ बात भी शा8मल होगी और उ. त 6रटनA का स* यापन उसके

रिजR W:कृत मोबाइल नंबर आधा6रत ‘वन टाइम पासवडA’ क$ सुSवधा के आधार पर Tकया जाएगा।

प" ट$करण:- इस नयम के (योजन के 8लए, ‘शूK य’Sववरणी का मतलब धारा 39 के अधीन Tकसी

कर अवध से संबंधत कोई ऐसी Sववरणी है िजसमJ ([प जीएसट:आर-3ख क$ सभी सारणी मJ शूK य

दशाAया गया हो या उसमJ कोई (विe ट ना हो ।” ।
