Notification No. 72/2020 – State Tax

S.O. No. 03, Dated 11^th January, 2021 - In exercise of the powers conferred by section 164 of the

Jharkhand Goods and Services Tax Act, 2017 (12 of 2017), the Government of Jharkhand, on the

recommendations of the Council, hereby makes the following rules further to amend the Jharkhand Goods and

Services Tax Rules, 2017, namely:-

1. (1) These rules may be called the Jharkhand Goods and Services Tax (Eleventh Amendment) Rules,

2020.

(2) Save as otherwise provided in these rules, they shall be deemed to be effective from the 30^th September,

2020.

2. In the Jharkhand Goods and Services Tax Rules, 2017 (hereinafter referred to as the said rules), in rule 46,

after clause (q), the following clause shall be inserted, namely:-

“(r)

Quick Response code, having embedded Invoice Reference Number (IRN) in it, in case invoice has

been issued in the manner prescribed under sub-rule (4) of rule 48.”.

3. In the said rules, in rule 48, in sub-rule (4), the following proviso shall be inserted, namely:-

“Provided that the Commissioner may, on the recommendations of the Council, by notification, exempt a

person or a class of registered persons from issuance of invoice under this sub-rule for a specified period,

subject to such conditions and restrictions as may be specified in the said notification.”.

4. In the said rules, in rule 138A, for sub-rule (2), the following sub-rule shall be substituted, namely:-

“(2) In case, invoice is issued in the manner prescribed under sub-rule (4) of rule 48, the Quick Response (QR)

code having an embedded Invoice Reference Number (IRN) in it, may be produced electronically, for

verification by the proper officer in lieu of the physical copy of such tax invoice.”.

और सेवा कर नयमावल3, 2017 का और संशोधन करने के 1लए न5न1लखत नयम बनाती है, अथा:त् :--

1. (1) इन नयम) का सं=>?त नाम झारखड माल और सेवा कर (@यारहवां संशोधन) नयमावल3, 2020 है।

(2) अBय था उपबंधत के 1सवाय, ये नयमावल3 ता/रख 30 1सत5बर, 2020 से "वृ$त मानी जाऐगी।

2. झारखड माल और सेवा कर नयमावल3, 2017 (िजसे इसमG इसके पHचात् उ(त नयम कहा गया है) के नयम 46 मG,

खंड (थ) के पHचाि$न5न1लखत खंड अंतःKथापत Lकया जाएगा,अथा:त्:--

“(द) नयम 48 के उपनयम (4) के अधीन वMहत र3त मG बीजक जार3 Lकए जाने के मामले मG, इसमG बीजक सBदभ:

संNया (आई.आर. एन.) सिBनMहत करने वाला $व/रत "$यु$तर कोड।”

3. उ(त नयमावल3 के नयम 48 के खंड (4) मG न5न1लखत परBतुक अंतःKथापत Lकया जाएगा, अथा:त्:--

“परBतु आयु(त, प/रष! क 1सफा/रश) पर अधसूचना !वारा, ऐसी शतT और नबUधन) के अधीन रहते हुए जो उ(त

अधसूचना मG वनMद:Vट क गई हो, वनMद:Vट अवध के 1लए इस उपनयम के अधीन बीजक जार3 करने से Lकसी

रिजKX3कृत Yयि(तया Yयि(तय) के वग: को छूट दे सकेगा।”

4. उ(त नयम के नयम 138क मG, उपनयम (2) के Kथान पर न5न1लखत उपनयम रखा जाएगा, अथा:त्:--
