अ धसूचना सं-या - 1342 -- सू2म एवं लघु उयमय8 के :हत8 क< सुर=ा हेतु सू2म एवं लघु एवं म>यम

?वकास @नयमावल.-2006 के आलोक मC झारखड Procurement Policy-2014 के अDधसूDचत होने के उपरांत

सू2म एवं लघु =ेF क< इकाईय8 तथा औयोDगक संघ8 से यह माँग क< जाती रह. है Kक ?वभMन ?वभाग8/ @नगम/

नगर @नगम/ अDधसूDचत =ेF8 इNया:द के वारा जार. @न?वदा मC अनेक बा>यकार. शतQ के जुड़े रहने के फलSवTप

सू2म एवं लघु =ेF क< इकाईय8 को इसका लाभ नह.ं मल पाता है तथा @न?वदा K,या के थम चरण मC ह.

तकनीक< UिWटकोण से आयोXय करार कर :दये जाते हY। ऐसी िSथ@त मC झारखड Procurement Policy-2014 क<

मूल भावना Sथानीय सू2म एवं लघु इकाईय8 के :हत8 क< र=ा हेतु यह आव\यकता महसूस क< गई Kक झारखड

Procurement Policy-2014 मC ा]त सुझाव8 एवं भारत सरकार के @नदेश8 के आलोक मC छूट संबंधी अ@त_र`त

कंaडका का समावेश Kकया जाय।

:दनांक 09.02.2016 को अपर मु$य सDचव, उयोग, खान एवं भूतNव ?वभाग, झारखड, रांची क<

अ>य=ता मC आयोिजत Stakeholders बैठक मC झारखड Procurement Policy-2014 मC क@तपय संशोधन हेतु

सुझाव ा]त हुए थे। साथ ह. भारत सरकार के पFांक F.No.25(2)/2011-MA :दनांक 14.10.2011 एवं No.

22(1)/2003/EP&M :दनांक 29.07.2003 के वारा ावधान Kकया गया है Kक सामDcय8 के ,य करने संबंDध

झारखडगजट(असाधारण) शु,वार, 26 फरवर., 2021

@न?वदा मC सू2म, एवं लघु इकाईय8 (MSEs) के लए Mयूनतम टनd ओवर संबंधी बा>यकार. शतQ से मु`त रखा

जाय।

Procurement Policy-2014 क< कंaडका- 8.1 मC पूवd से ावधा@नत है Kक Annexure-I मC वfणdत

Exclusive Purchase List मC @नदेशक उयोग के वारा Nयेक वषd Revised एवं Notified Kकया जाएगा। उ`त के

आलोक मC :दनांक 12.04.2016 को ?वभMन िजल8 के महाबंधक, िजला उयोग केMh8 के साथ हुई बैठक मC ा]त

सुझाव8 एवं औयोDगक संघ8 क< मांग8 के आधार पर झारखड Procurement Policy-2014 के Annexure-I मC

वfणdत Items Under Exclusive List 35 अMय Items को जोड़नC का सुझाव :दया गया।

@न?वदा मC झारखड के manufacturing इकाई शामल हो इसके लए योजना-सह-?वNत ?वभाग का

मंतiय के आलोक मC झारखड ,य नी@त-2014 क< कंaडका-3 (vii) जो Applicability से संबंDधत है, मC संबंDधत

MSEs से वां@छत कागजात ा]त करने से संबंDधत ावधान को समावेश Kकया जाना है। इस संबंध मC वाfणjयकर

?वभाग से भी आव\यक परामशd ा]त Kकया गया है। साथ ह. योजना-सह-?वNत ?वभाग वारा जार. संकप पFांक

2504/?व0, :दनांक 24.07.2017 के आलोक मC झारखड Procurement Policy-2014 क< कंaडका-4 मC आव\यक

संशोधन करते हुए राjय सरकार के सभी ?वभाग8/ अधीनSथ कायाdलय8/ ?वNत दNत संSथान8 के लए Gem

Portal से वSतुओं के ,य करते समय JPP-2014 क< कंaडकाओं का अनुपालन सु@नि\चत करने से संबंDधत

अ@त_र`त कंaडकाओं का समावेश Kकये जाने क< आव\यकता महसूस क< गई है। :दनांक 01.04.2016 से झारखड

औयोDगक एवं ोNसाहन नी@त (JIIPP)-2016 तथा 01 जुलाई 2017 से Goods and Service Tax (GST) के लागू

होने से झारखड Procurement Policy-2014 क< कंaडका-3 (iv), 10.1 एवं 10.3 मC तनुTप प_रवतdन अप_रहायd

हो गई है। साथ ह. सू2म, लघु एवं म>यम उयम मंFालय, भारत सरकार वारा उयोग आधार Memorandum

जार. करने के फलSवTप कंaडका-3 (iii) मC आव\यक संशोधन क< आव\यकता महसूस क< गई।

उपरो`त वfणdत तkय8 के आलोक मC सlयक ?वचारोपरांत :दनांक 02.07.2019 को मंmFप_रषद क< बैठक

मC मद सं$या-11 के Tप मC लए गये @नणdय के अनुTप झारखड उपरो`त वfणdत तkय8 के आलोक मC सlयक

?वचारोपरांत :दनांक 02.07.2019 को मंmFप_रषद क< बैठक मC मद सं$या-11 के Tप मC लए गये @नणdय के अनुTप

झारखड ,य नी@त-2014 मC @नlन संशोधन/समावेश Kकया जाता हैः-

(i). कंaडका-3 (iii) को @नlनांKकत कार से @तSथा?पत Kकया जाता हैः-

“MSE is registered with the Directorate of Industries/District Industries Centre, Khadi and

Village Industries Board, Directorate of Handloom, Sericulture and Handicraft of Jharkhand

Govt, Industrial Area Development Authorities and National Small Industries Corporation Ltd

or any other body specified by Directorate of Industries, Jharkhand Govt from time to time and

other industrial units/enterprises which have submitted IEM and been issued. Date of

DIC/MD,

Industrial

Area

Development

Authorities/Director, Industries, GoJ or MSEs having Udyog Aadhar Number issued by

Ministry of Micro, Small and Medium Enterprises, GoI to be duly verified, whether unit is

existing/ functional and doing regular production at what capacity by GM, DIC/MD, Industrial

Area Development Authorities/Director, Industries, GoJ".

(ii). कंaडका-3 (iv) @नlन कार से @तSथा?पत Kकया जाता हैः-

"The MSEs /other Enterprises and units must be registered under Jharkhand Goods and

Services Tax (JGST) Act-2017 or The Central Goods & Services Tax (CGST) Act 2017".

(iii). कंaडका-3 (vii) को @नlनांKकत कार से @तSथा?पत Kकया जाता हैः-

"The MSE Unit availing preferential treatment will give an undertaking with respect to (i) to

(vi) above including a categorical statement that the product/services being supplied to Govt.

Deptt. or its agencies has been manufactured/created by the unit located in Jharkhand only,

giving details of batch no./date or any other identifiable tag (GSI etc) as per prevalent

established practice and will have to submit compulsorily duly signed copy of Form GSTR-9C

(For units having aggregate yearly turnover of more than 2 crores) as prescribed under JGST

Act-2017". However, in case of VAT products/services, Form JVAT-409 (For units having of

gross yearly turnover more than 60 lacs) issued by deptt. of Commercial taxes, Govt. of

Jharkhand.

Annexure-I मC वfणdत “Item under exclusive list reserved for purchase from State Micro and Small

Enterprises (MSEs) मC ?वSतार करते हुए Jharkhand Procurement Policy-2014 के Annexure-I मC

वfणdत 31 Items के अ@त_रक् त @नम् न 35 अ@त_रक् त Items को Annexure-I मC शामल Kकया जाता हैः-

कंaडका-4 मC अ@त_र`त कंaडका-(d) एवं (e) को @नlन कार से सिlमलत Kकया जाता हैः-

कंaडका- 4 (d) “It is mandatory for every department of the State Govt. or its agencies or aided

institutions to purchase from local MSEs supplier on GeM portal of the items

mentioned in exclusive list of Annexure-I and also ensure 20% procurement of the

concerned year from local MSEs supplier on Gem Portal as per provisions of JPP-

2014”.

कंaडका- 4 (e) “Department of Industries in coordination with department of IT and E-Governance

will encourage and facilitate MSEs of the State to register their products on GeM

Portal”.

कंaडका-10.1 मC JIP-2012 Para-18.1(i), [ii(a,b,c)] क< जगह JIIPP-2016 Para 4.1 को @तSथा?पत Kकया

जाता है।

कंaडका-10.3 को @नlन कार से @तSथा?पत Kकया जाता हैः-

"While preparing comparative price statement for evaluation of tender paper, the VAT/SGST

payable in Jharkhand state shall not be included in the quoted price or selling price. However, any

tax payable outside Jharkhand shall be added to the quoted price and selling price for such price

comparison".

कंaडका-11 (i) मC अ@त_र`त उप कंaडका-11(i) (e) को सिlमलत Kकया जाता हैः-

"No minimum Annual Turn Over and work experience related tender conditions for working

MSEs of Jharkhand State. (Without compromising on quality and specification of the

product/service and department has complete right to decide on the quality and specification)."
