सं०-09/&नजी सुर*ा(07)-39/2019- 4458-- /नजी सुर0ा अभकरण (2व/नयमन) अ3ध/नयम,

2005 (2005 का 29) क5 धारा 25 वारा द7त शि9तय: का योग करते हुए रोकड़ प@रवहन के लये

/नजी सुर0ा अभकरण: वारा सुर0ा उपलCध कराये जाने क5 रD/त का 2व/नयमन करने हेतु झारखड

सरकार ए7द वारा /नEनलFखत /नयमावलD बनाती है:-

सं2*3त नाम और ारंभ -

(1) यह /नयमावलD ’’ झारख:ड &नजी सुर*ा अ<भकरण (रोकड़ प@रवहन कायBकलापD के <लए

&नजी सुर*ा) &नयमावलF, 2020’’ कहD जा सकेगी।

(2) यह /नयमावलD राजपL मM उसके काशन क5 तारDख से भावी होगी।

प@रभाषाएँ - (1) इन &नयमावलF मJ, जब तक Kक संदभB से अLयथा अपे2*त न हो -

(क)

’’अ3ध/नयम" से /नजी सुर0ा अभकरण (2व/नयमन) अ3ध/नयम, 2005 (2005 का 29)

अभेत है;

(ख)

’’एटDएम" से Qवचालत गणक मशीन अभेत है जो रोकड़ का 2वतरण करती है या तब

बRककारD सेवाओं को करती है जब Tकसी बRक का कोई खाता धारक उसमM बRक काड-

डालता है;

NपOटFकरण - इस खंड के योजन: के लए ’’बRक काड-" मM VेWडट काड- या डेXबट काड- सिEमलत है;

(ग)

’’रोकड़ बंधन अभकरण", ‘‘रोकड़ पुनः पू/त- अभकरण" या ’’वहन मM रोकड़ अभकरण"

से कोई अभकरण या स7ता अभेत है, चाहे Tकसी भी नाम से \ात हो जो प@रवहन के

काय-कलाप: मM लगी हुई है;

(घ)

’’रोकड़ प@रवहन काय-कलाप:" से अभेत है, रोकड़ जैसे बRक नोट, स9के, VेWडट काड-,

डेXबट काड- या अ^य मूयवान मद: का एक Qथान से दूसरे Qथान को भौ/तक अंतरण,

िजसके अंतग-त Tकसी एटDएम मशीन मM रोकड़ डालना या उसके रोकड़ को /नकालना भी है;

(ङ)

’’/नजी सुर0ा" या ’’/नजी सुर0ा अभकरण" का वहD अथ- होगा जो उसका अ3ध/नयम क5

धारा-2 के खंड (च) या खंड (छ) मM उनके /त समनुदेशत Tकए गए है।

(च)

’’अनुसूची" से अभेत है, इन /नयम: से संलcन अनुसूची।

(2) /नयम: मM अप@रभा2षत शCद: एवं भाव का अथ- वहD होगा जो अ3ध/नयम के तहत है।

रोकड़ के प@रवहन के कायBकलापD, आद के <लए &नजी सुर*ा -

(1)

रोकड़ प@रवहन के काय-कलाप: के लए तब तक /नजी सुर0ा अभकरण वारा कोई

सुर0ा उपलCध नहDं कराई जाएगी जब तक Tक वह इस अ3ध/नयम के अधीन अनु\िeत

धारण न करता हो।

(2)

रोकड़ के प@रवहन के काय-कलाप: के लए /नजी सुर0ा उपलCध कराने के योजन: के

लए अ3ध/नयम के अधीन अनु\िeतधारD /नजी सुर0ा अभकरण और संबं3धत बRक के

बीच सं2वदा क5 जा सकेगी:

परंतु यgद रोकड़ बंधन अभकरण के पास अ3ध/नयम के उपबंध: के अधीन /नजी सुर0ा

अभकरण के hप मM अनु\िeत है तो ऐसा रोकड़ बंधन अभकरण Qवयं इन /नयमावलD

के उपबंध: के अनुसार रोकड़ प@रवहन काय-कलाप: के लए /नजी सुर0ा उपलCध करा

सकेगा।

(3) रोकड़ वैन क5 सुर0ा के लये तैनात सशQL /नजी सुर0ा गाड- को केवल सुर0ा उkेlय:

के लये /नयोिजत Tकया जाएगा एवं उ^हM कmतnय के दौरान रोकड़ बा9स ढोने मM

शामल नहDं Tकया जाएगा िजससे उनका सुर0ा से pयान हटे।

वशेष Rप से Sडजाईन कT गई और तैयार Kकए गए रोकड़ वैन का उपयोग -

(1)

कोई /नजी सुर0ा अभकरण Tकसी बRक को या रोकड़ बंधन अभकरण को रोकड़ के

प@रवहन के काय-कलाप: के लए तब तक /नजी सुर0ा या /नजी सुर0ा गाड- उपलCध नहDं कराएगा, जब

तक Tक ऐसे काय-कलाप सुरq0त रोकड़ वैन मM, जो पहलD अनुसूची मM 2व/नgद-rट Wडजाईन और

2वशिrटय: क5 शतs के अनुhप हो यथा िQथ/त, उसके या बRक के या रोकड़ बंधन अभकरण के

Qवाम7व मM हो, नहDं Tकए जाते है।

(2)

Tकसी /नजी सुर0ा अभकरण वारा रोकड़ के प@रवहन के लए Tकसी टै9सी या Tकराए

पर लए गए यान का उपयोग नहDं Tकया जाएगा।

परंतु कोई यान जो Tकसी /नजी सुर0ा अभकरण या बRक या रोकड़ बंधन अभकरण के पास

दDघ- अव3ध सं2वदा पर है और जो उप/नयम (1) के अधीन अभक3थत Wडजाईन और 2वशिrटय: क5

शतs का अनुपालन करता है का /नजी सुर0ा अभकरण वारा उपयोग Tकया जा सकेगा ;

परंतु यह और Tक Tकसी सुदूर अविQथ/त क5 दशा मM जहाँ /नजी सुर0ा अभकरण 2वयमान

नहDं है और Tकसी करMसी /तजोरD वारा जहाँ पर सेवाएँ नहDं दD जाती है, ऐसे Qथान पर Qथानीय पुलस

के कठोर सुर0ा /नयंLण और सहायता के अधीन एक अपवाद के hप मM Tकसी भी यान का उपयोग

Tकया जा सकेगा।

&त रोकड़ वैन के <लए अपे2*त <श2*त कमBचारFवृंद कT संWया -

(1)

/नजी सुर0ा अभकरण रोकड़ प@रवहन काय-कलाप: के लए, 7य0तः /नयु9त या

/नयोिजत अपेq0त सं$या मM उप/नयम (2) मM यथा 2व/नgद-rट शq0त कम-चारDवृंद को

/नजी सुर0ा के लए उपलCध कराएगा।

(2)

7येक रोकड़ वैन मM 7येक एकल रोकड़ प@रवहन काय-कलाप: के लए /नEनलFखत

^यूनतम कम-चारD वृंद हां◌ेगे िजनके पास अ3ध/नयम क5 धारा-10 के अधीन अ3धक3थत

अह-ताएँ और श0ण होगा, अथा-त्:-

(i)

चालक - एक,

(ii)

सशQL सुर0ा गाड- - दो; और

(iii)

एटDएम अ3धकारD या अभर0क - दो

(3)

रोकड़ वैन क5 हर समय कम से कम दो शq0त सशQL सुर0ा गाडy वारा अभर0ा

क5 जाएगी:

परंतु वहन क5 जा रहD रोकड़ क5 रकम पर /नभ-र करते हुए nयिrटक कंपनी के बीमा

माग-दश-क सzांत: या {ाहक सं2वदा या चालन Tकए जा रहे Qथान के अनुसार Tकसी

रोकड़ वैन मM दो से अ3धक सुर0ा गाडy को तैनात Tकया जा सकेगा।

(4)

यहाँ कोई रोकड़ वैन मpयम मोटरयान है, वहन के दौरान चालक के साथ आगे एक

सश}L गाड- बैठेगा और दूसरा वैन के 2पछले भाग मM बैठेगा, लादने या उतारने, शौच,

चायपान या भोजनावकाश के दौरान कम से कम एक सश}L सुर0ा गाड- सभी समय पर

रोकड़ वैन मM उपिQथत रहेगा।

इन /नयम: मM Tकसी अ^य उपबंध के होते हुए भी अ^यथा पाL भूतपूव- सै/नक को रोकड़

प@रवहन काय-कलाप: के लए सुर0ा उपलCध कराने के लए /नजी सुर0ा अभकरण

वारा /नयु9त करने या /नयोिजत करने मM ाथमकता दD जाएगी।

का<मBकD के पूवBवृत कT जांच -

(1) /नजी सुर0ा अभकरण रोकड़ प@रवहन TVया कलाप: के लए Tकसी काम-क को तब तक

/नयु9त नहDं करेगा या तब तक नहDं लगाएगा या तब तक त7समय वृ7त अ3ध/नयम

या Tकसी अ^य 2व3ध के उपबंध: के अनुसार अभकरण वारा उ^हM /नयु9त करने या

लगाने या अभ/नयोिजत करने से पूव- ऐसे काम-क: के पूव-वृ7त क5 पूण- जांच और उसका

उ3चत के॰वाई॰सी॰ स7यापन तथा पुलस स7यापन न कर लया जाए।

QपrटDकरण - इस उप/नयम के योजन: के लए ‘‘अपने {ाहक को जा/नए’’

(केवाईसी) के पद से अभकरण या कारबार से सहयोिजत या सहयोिजत Tकए जाने वाले

उसके {ाहक: या nयि9तय: क5 पहचान और स7यापन करने वाले अभकरण या कारबार

के ‘‘अपने {ाहक को जा/नए’’ TVया अभेत है।

(2)

7येक /नजी सुर0ा अभकरण रोकड़ प@रवहन TVयाकलाप मM भाग लेने वाले Tकसी

nयि9त को /नयु9त करने या लगाए जाने से पहले /नEनलFखत जांच: का अनुपालन

करने के लए उ7तरदायी होगा, अथा-त:-

(क)

पुलस अनापि7त माण पL - 7येक nयि9त /नयुि9त Tकए जाने या लगाने से

पहले◌े अपने 0ेLीय पुलस Qटेशन से पुलस अनापि7त माण पL ाeत करेगा।

(ख)

/नवास Qथान स7यापन - /नजी सुर0ा अभकरण 7येक nयि9त के /नवास

Qथान के पते का भौ/तक स7यापन िजसके अंतग-त आचरण क5 जांच भी शामल

है, अपने Qवयं संसाधन: का योग करते हुए करेगा और nयि9त रोकड़ प@रवहन

TVयाकलाप के लए /नयु9त होने या लगाए जाने से पहले कम से कम तीन वष-

के /नवास Qथान पते का माण सुर0ा अभकरण को देगा।

(ग)

पूव- /नयोजक क5 जांच - /नजी सुर0ा अभकरण nयि9त के पूव- /नयोजन क5

संदभ- सgहत जांच अपने Qवयं के संसाधन: का योग करते हुए करेगा।

(घ)

आधार का स7यापन - रोकड़ प@रवहन TVयाकलाप के लए /नयु9त या लगा हुआ

कोई nयि9त भारत के 2वशrट पहचान अ3धकरण से आधार नंबर के माpयम से

पूव- स7यापन कराएगा।

(ङ)

7यय इ/तहास क5 जांच - /नजी सुर0ा अभकरण 7येक /नयु9त या लगे हुए

nयि9त के 7यय इ/तहास क5 जांच, यह अभ/निlचत करने के लए Tक रोकड़

प@रवहन TVयाकलाप के लए /नयुि9त या लगे हुए nयि9त जानबूझकर 7यय

nय/तVम करने वाले नहDं है।

(च)

2वlवसनीयता बीमा - /नजी सुर0ा अभकरण रोकड़ प@रवहन TVयाकलाप: के

लए /नयु9त Tकए गए या लगाए गए 7येक काम-क: के संबंध मM 2वlवसनीयता

बीमा अभाeत करेगा।

का<मBकD का पयाB3त <श*ण और माणन - /नजी सुर0ा अभकरण यह सु/निlचत करेगा Tक

रोकड़ प@रवहन TVयाकलाप: के लए /नयुि9त या लगाए गए काम-क को -

(क)

दूसरD अनुसूची मM अ3धक3थत श0ण क5 अपे0ाओं के अनुसार ऐसे TVयाकलाप:

क5 सुर0ा और सुरq0त बंध के लए श0ण और माण पL gदया जाएगा और

(ख)

7येक दो वषs मM एक बार पुनlचया- श0ण gदया जाएगा।

चालनD के दौरान रोकड़ वैन कT सजीव जीपीएस खोज -

(1) 7येक रोकड़ प@रवहन TVयाकलाप ऐसी सुरq0त रोकड़ वैन: मM Tकए जाएंगे िजनमM

जीपीएस खोज युि9त लगी हो, तथा जहाँ तक संभव हो सके, एक समान समय तथा पथ

से परहेज Tकया जाएगा।

QपrटDकरण - इस उप /नयम के योजन: के लए जीपीएस पद से ऐसी वैिlवक िQथ/त

णालD अभेत है जो ऐसी अंत@र0 आधा@रत नेवीगेशन णालD है जो सभी मौसम क5

दशा मM अवQथा और समय क5 सूचना पृवी पर कहDं भी या उसके /नकट वहां उपलCध

करती है जहां चार या अ3धक जीपीएस उप{ह: क5 €िrट क5 अवz पंि9त ह:।

(2) /नजी सुर0ा अभकरण यह सु/निlचत करेगा Tक 7येक रोकड़ वैन हर समय प@रपूण-

संचार नवाचार के माpयम से रोकड़ प@रवहन TVयाकलाप के दौरान /नगरानी क5 जाएगी।

एकल रोकड़ वैन मJ अधकतम रोकड़ ले जाने के <लए मागBदशBन -

(1)

/नजी सुर0ा अभकरण यह सु/निlचत करेगा Tक रोकड़ प@रवहन TVयाकलाप मM शामल

कोई रोकड़ वैन /त दौरे पर पांच करोड़ पए से अ3धक नहDं ले जाएगी।

(2) /नजी सुर0ा अभकरण यह सु/निlचत करेगा Tक /त दौरे पर दस लाख पए से अ3धक

रोकड़ ले जाने के लए सुरq0त रोकड़ वैन अभ/नयोिजत क5 जाएगी।

बZक करJसी के रखे जाने तथा रात भर उसे अंतःक* मJ रखने के <लए योग Kकए गए &नजी

रोकड़ अंतःक* के <लए व&नद\श -

/नजी सुर0ा अभकरण यह सु/निlचत करेगा Tक सभी रोकड़ बंधन, िजसके अंतग-त गणना, छटाई

और बंडल बांधने संबंधी TVयाकलाप भी है, /नEनलFखत माग-दश‚ सzांत: के अनुसार सुरq0त प@रसर:

मM Tकया जाएगा, अथा-त्:-

(क)

/नजी रोकड़ अंतःक0 प@रसर: क5 अविQथ/त - रोकड़ बंधन TVयाकलाप: के संबंध मM

उपयोग Tकए गए प@रसर इस तरह से अविQथत ह: िजससे Tक TVयाकलाप:/संTVयाओं

क5 सुर0ा सु/निlचत हो सके, िजनके अंतग-त ऐसे 0ेL भी हR जो बRक के रोकड़ /नकासी

के^„ या पुलस Qटेशन के समीपतम है, और इनमM ऐसे एकांत 0ेL भी है िजनक5 अप

संयोजकता से बचा जा सके;

(ख)

प@रसर: का Wडजाइन -प@रसर: को इस तरह से Wडजाइन Tकया जाएगा Tक उनमM दो

भौ/तक प से QवतंL 0ेL ह:गे िजनमM से एक साधारण काया-लय योजन के लए और

दूसरा सुरq0त रोकड़ TVया एवं बंधन TVयाकलाप: को सिEमलत करने के लए होगा

और उसके अंदर सुरq0त रोकड़ वैन: पर रोकड़ जमा, सं{हण, छटाई, गणना और रोकड़

का प@रदान करने और ेषण के लए Qथान होगा;

(ग)

रोकड़ अंतःक0 -/नEनलFखत 2व/नद…श: के अनुसार रोकड़ अंतःक0: के संबंध मM भारतीय

@रजव- बRक क5 2व/नgद-rट अपे0ा को पूरा करने हेतु रोकड़ भंडारण के लए सुरq0त 0ेL

Wडजाइन Tकया जाएगा, अथा-त्:-

(i)

ऐसे छोटे शहर: मM, िजनक5 दस करोड़ पए से कम क5 सीमत रातभर अंतःक0

क5 आवlयकता है, उनमM र0क अलमारD वालD /तजोरD हो,

(ii)

ऐसे चालन के^„: पर िजनमM दस से एक सौ करोड़ पए तक क5 रातभर

अंतःक0 क5 आवlयकता है, उनमM ‘ग’†ेणी अंतःक0: के लए 2व/नgद-rट

भारतीय @रजव- बRक के सं/नयम: के अनुसार अंतःक0 सु2वधा हो,

(iii)

ऐसे बृहद चालन के^„: पर जहाँ एक सौ करोड़ पए से अ3धक रातभर अंतःक0

क5 आवlयकता है, उन पर संबं3धत बRक के परामश- से व3ध-त अंतःक0 सु2वधा

हो, और

(iv)

सभी रातभर अंतःक0 सु2वधाओं मM पृथक और अन^य पाL: मM बहु बRक: क5

करMसी को भंडा@रत करने क5 nयवQथा ह:,

(घ)

रोकड़ अंतःक0: क5 सुर0ा- /नजी सुर0ा अभकरण बRक क5 ओर से रोकड़ के सुरq0त

बंधन के लए योग Tकए गए उसके रोकड़ अंतःक0 मM /नEनलFखत सुर0ा पहलुओं

को सु/निlचत करेगा, अथा-त्:-

(i)

सशQL /नजी सुर0ा गाडs क5 पया-eत सं$या चैबीस घंटे तैनात हो,

(ii)

प@रसर 24ग7 इलै9‰ा/नक /नगरानी और मोनीटरD के अधीन हो,

(iii)

रोकड़ अंतःक0 मM कैमर: क5 पया-eत सं$या के साथ सीसीटDवी णालD लगी हुई

हो िजसमM कम से कम 90 gदन @रकाड- करने क5 सु2वधा हो, तथा @रका◌ॅWड‹ग

0मता कम से कम D1 @रजोयूशन मM 15 ेम /त सेकेड /त कैमरा हो।

णालD क5 मु$य Qटोरेज ईकाई एक संरq0त Qथान पर Qथा2पत हो एवं

सी0सी0टD0वी0 फुटेज का लाईव फ5ड बRक के कं‰ोल hम को उपलCध हो।

(iv)

रोकड़ अंतःक0 मM TVयाकलाप दोहरD अभर0ा आधार के अधीन हो,

(v)

मु$य रोकड़ अंतःक0 0ेL सभी सुर0ा सि^नयम: जैसे अिcन शमन णालD, धूŽ

खोज णालD, आपात लाईट, यान: के संचलान को /नगरानी करने के लए

/नयंLणक0, Qव-डायलकmता और चोरD सुर0ा णालD का अनुपालन करता हो,

(vi)

जी0एस0एम0 आधा@रत Qव-डायलकmता, अिcन और मैcनेgटक सMसर वाले सुर0ा

अलाम- संQथा2पत Tकए गए हो,

(vii)

रोकड़ क5 लदाई और उतराई 0ेL राXL €िrट सी॰सी॰टD॰वी॰ कैमर: वारा

आछाgदत हो,

(viii) रोकड़ अंतःक0 के भीतर इलैि9‰क 2वयुत दाय eलग इन और eलग आउट

सQटम के माpयम से लगाया गया हो,

(ix)

रोकड़ अंतःक0 के भीतर अनावृत लाईट ले जाना पूण-तया /त2षz हो और शुrक

बैटरD चालत टाच- या आपात लाईट /तजोरD के अंदर योग क5 जाती हो,

(x)

इ^वट-र क5 सहायता से आपात काशक सुर0ा कम-चारDवृंद: को सदैव उपलCध हो,

(xi)

रोकड़ संQकरण और अंतःक0 0ेL: क5 अ3धमानतः इंटरला◌ॅTकंग णालय: और

Tस्ंि◌कग के माpयम से /नबा-3धत और /नयंXLत पहुँच हो।

(xii)

रोकड़ बंधन एवं रोकड़ प@रवहन काय-कलाप: मM शामल /नजी सुर0ा एजMसी के

कम‚ बा◌ॅडी 2वयर कैमरे पहनMगे जो आ◌ॅWडयो और वीWडयो दोन: सु2वधाओं के

साथ कम से कम पं„ह gदन @रका◌ॅWड‹ग क5 सु2वधा वालD हो।

(xiii) /तजोरD मM या प@रवहन मM नकदD क5 सुर0ा के लए यgद कोई नई या बेहतर

तकनीक बाजार मM उपलCध हो या भ2वrय मM उपलCध होने वालD हो तो सुर0ा

एजMसी वारा सुर0ा और /नगरानी के उkेlय: के लए आसानी से अपनाई

जाएगी।

QपrटDकरण - इस /नयम के योजन: के लए ‘‘सीसीटDवी” पद से ऐसा बंद प@रपथ वाला

टेलD2वजन अभेत है जो भंडार या कंपनी मM TVयाकलाप: को /नगरानी करने के लए

कैमर: @रकाड-र: और WडQपले से मलकर बने Qवतः पूण- /नगरानी णालD है।

11.

जो]खम Lयूनीकरण के <लए उपाय -

(1) /नजी सुर0ा अभकरण यह सु/निlचत करेगा Tक उसक5 सुर0ा के अधीन एटDएम के

कम‚दल उठाई3गरD हा/न तथा एटDएम कपट क5 घटनाओं को कम करने के लए एक

बारगी इले9‰ा/नक संयोजन ताले लगे ह:गे ।

(2)

Tकसी एटDएम मशीन मM रोकड़ भरण के लए पूव- gदन या पूवा-हन् पर बRक से सं{हण

होगा ताTक उप/नयम 3 मM /नयत समय से पहले चालन समाeत हो सके।

(3)

एटDएम रोकड़ भरने या रोकड़ प@रवहन TVयाकलाप-

(क)

नगरDय 0ेL: मM 9 बजे अपराहन् के बाद,

(ख)

{ामीण 0ेL: मM 6 बजे अपराहन् के बाद,

(ग)

वामपंथी उ{वाद भा2वत 0ेL: के प मM के^„Dय सरकार वारा अ3धसू3चत 0ेL:

मM 9 बजे पूवा-हन् के पहले या 4 बजे अपराहन् के बाद नहDं Tकया जाएगा।

पहलF अनुसूची

िWनयम 4 (1) दे]खए,

सुर2*त रोकड़ वैन के <लए Sडजाइन और व<शOटता।

(क)

मेक - रोकड़ वैन -

(i)

कम से कम 2200 सीसी 0मता वाले इंजन के साथ, अ3धमानतः टबyचािज-त, हका वाFणि’यक

यान होगी,

(ii)

7 वष- से अ3धक पुरानी नहDं होगी,

(iii)

मM टयूबरgहत टायर लगे ह:गे,

(iv)

मM कम से कम 190 म॰मी॰ भू अंतःQथान होगा, और

(v)

मM ^यूनतम पांच याXLय: क5 जगह होगी,

(ख)

अ<भवLयास - रोकड़ वैन मM रोकड़ भंडारकरण के लए याLी कंपाट-मMट यू/नट से वQतुतः पृथकतः और

बंद कंपाट-मMट होगा,

(ग)

रोकड़ कंपाटBमJट सुर*ा - (i) रोकड़ कंपाट-मMट, वैन के बाहरD भाग से तब तक पहुंच से बाहर होना चाgहए,

जब तक आंत@रक प से हQतचालत या इले9‰ो/नक ताले के माpयम से चालत न Tकया जाए और

S.O-09/Private Security (07)-39/2019- 4458-- In exercise of the powers conferred by

section 25 of the Private Security Agencies (Regulation) Act, 2005 (29 of 2005, the Central

Government), the Government of Jharkhand hereby makes the following Rules:—

Short title and commencement.— (1) These rules may be called the “Private Security

Agencies (Private Security to Cash Transportation Activities) Rules, 2020"

(2)

These rules shall come into force on the date of its publication in the Official Gazette.

Definitions.— (1) In these rules, unless the context otherwise requires,—

(a)

“Act” means the Private Security Agencies (Regulation) Act, 2005 (29 of 2005);

(b)

“ATM” means the automatic teller machine that dispenses cash or performs other

banking services when an account holder of any bank inserts a Bank card therein;

Explanation – For the purposes of this clause, “Bank card” includes credit card or debit card;

(c)

“cash handling agency”, “cash replenishment agency” or “cash-in-transit agency”

means an agency or entity, by whatever name called, engaged in cash transportation

activities;

(d)

“cash transportation activities” means the physical transfer of cash, such as banknotes,

coins, credit card, debit card or other items of value from one location to another, and

includes loading cash in to, or unloading cash from, an ATM machine;

(e)

“private security” or “private security agency” shall have the same meaning as assigned

to it in clause (f) or clause (g) of section 2 of the Act;

(f)

“Schedule” means a Schedule appended to these rules.

(2)

Words and expressions not defined in the rules, shall have the same meaning as

assigned to it under the Act. "

Private Security for cash transportation activities, etc.- (1) No private security shall be

provided by the private security agency for cash transportation activities unless he holds a

license under the Act.

(2)

For the purpose of providing private security for cash transportation activities, a

contract may be entered into between a licensed private security agency under the Act

and the concerned bank:

Provided that in case the cash handling agency holds a license as a private security agency

under the provisions of the Act, such cash handling agency may itself provide the private security to

cash transportation activities in accordance with the provisions of these rules.

(3)

Private armed security guards deployed for security of the cash van shall be employed

for the security purposes only and they should not be involved in carrying cash boxes during the duty,

which may divert their security attention.

Use of specially designed and fabricated cash van.— (1) No private security agency shall

provide private security or private security guards to a Bank or a cash handling agency for

cash transportation activities, unless such activities are carried out in a secured cash van,

which complies with the conditions for design and specification specified in the First Schedule,

owned by it or owned by the Bank or the cash handling agency, as the case may be.

(2)

No taxi or hired vehicle shall be used for cash transportation activities by the private

security agency:

Provided that a vehicle which is on long term contract with the private security agency or

Bank or cash handling agency and the vehicle complies with the conditions for design and

specification laid down under sub-rule (1) may be used by the private security agency:

Provided further that in case of any remote location where private security agencies are not

present and not serviced by a currency chest, any vehicle at such location may be used as an

exception under the strict security control and support of the local police.

Requisite number of trained staff per cash van.— (1) The private security agency shall

provide the private security for the cash transportation activities with the requisite number of

trained staff, directly appointed or engaged by the private security agency, as specified in sub-

rule (2).

(2)

Every cash van shall have the following minimum staff, possessing the qualifications

and training laid down under section 10 of the Act, on board for every single cash

transportation activities, namely:—

(i)

Driver – one;

(ii)

Armed security guards – two; and

(iii)

ATM officer or custodian – two.

(3)

The cash van shall always be escorted by at least two trained armed security guards on

board:

Provided that more than two armed security guard may be deputed on a cash van

depending on the amount of cash carried and in accordance with the individual

company’s insurance guidelines or client contract or terrain of operation.

(4)

Where the cash van is a medium motor vehicle, one armed guard shall sit in the front

along with the driver and another in the rear portion of the van and while in transit,

loading or unloading, nature's call, tea or lunch break, at least one armed security

guard shall remain present with the cash van all the time.

(5)

Notwithstanding any other provision in these rules, the ex-serviceman, otherwise

eligible, may preferably be appointed or engaged by the private security agency for

providing security for cash transportation activities.

Antecedent check of personnel.— (1) No private security agency shall appoint or engage or

deploy any personnel for the cash transportation activities, unless such personnel has

undergone thorough antecedent check and his proper KYC verification and police verification

is done, before appointing or engaging or deploying them by the agency, in accordance with

the provisions of the Act or any other law for the time being in force.

Explanation.— For the purposes of this sub-rule, the expression “KYC” means the know your

customer process of an agency or business identifying and verifying the identity of its clients

or person associated or to be associated with the agency or business.

(2)

Every private security agency shall be responsible to comply with the following checks

before an individual is appointed or engaged to participate in cash transportation

activities, namely:—

(a)

police clearance certificate – every individual shall obtain the police clearance

certificate from his local police station before appointment or engagement;

(b)

residence verification – the private security agency shall use its own resources

to conduct a physical verification of the residential address of every individual,

including general conduct check and the individual shall furnish to the security

agency the proof of residential address of at least three years before

appointment or engagement for the cash transportation activities;

(c)

previous employer check – the private security agency shall use its own

resources to conduct reference check with previous employers of the

individual, if any;

(d)

Aadhaar verification – each individual appointed or engaged for the cash

transportation activities shall be antecedent verified through Aadhaar number

from the Unique Identification Authority of India;

(e)

credit history check – the private security agency shall conduct a credit history

check of every individual appointed or engaged to ensure that wilfull credit

defaulters are not appointed or engaged for the cash transportation activities;

(f)

fidelity insurance – the private security agency shall obtain a fidelity insurance

in respect of every personnel appointed or engaged for the cash transportation

activities.

Adequate training and certification of personnel.— The private security agency shall

ensure that every personnel appointed or engaged for cash transportation activities shall be

imparted,-

(a)

the training and certified for the security and safe handling of such activities as per the

requirements of training laid down in the Second Schedule;

(b)

the refresher training once in every two years.

Live GPS tracking of cash van during operations.— (1) Every cash transportation activities

shall be carried out only in secured cash vans fitted with GPS tracking device and as far as

possible, regular timings and routes should be avoided.

Explanation.— For the purposes of this sub-rule, the expression “GPS” means the global

positioning system which is a space-based navigation system that provides location and time

information in all weather conditions, anywhere on or near the Earth where there is an

unobstructed line of sight to four or more GPS satellites.

(2)

The private security agency shall ensure that each cash van shall be monitored at all

times during cash transportation activities through a redundant communications

protocol.

Guideline for maximum cash carrying limit in a single cash van.— (1) The private security

agency involved in cash transportation activities shall ensure that no cash van carries cash of

more than five crores rupees per trip.

(2)

The private security agency shall ensure that secured cash van shall be deployed for

carrying cash of more than ten lakh rupees per trip.

10.

Specification for private cash vaults used for holding and overnight vaulting of Bank

currency.— The private security agency shall ensure that all cash handling, including

counting, sorting, and bundling activities shall be carried out in secured premises in

accordance with the following guidelines, namely:—

(a)

Location of private cash vault premises – the premises used for cash handling activities

shall be located to ensure safety of activities/ operations, including areas closer to

bank’s cash withdrawal centre or police station and secluded areas with poor

connectivity be avoided;

(b)

Design of premises – the premises shall be designed to include two physically

independent areas, one for general office purpose and other for secured cash

processing and handling activities and it shall accommodate space for cash deposit,

collection, sorting, counting and delivery and dispatch of cash on secured cash vans;

(c)

Cash vault – a secured area shall be designed to store cash to meet with the

requirement of the Reserve Bank of India specified for cash vaults in accordance with

the following specifications, namely:—

(i)

in smaller cities with limited overnight vaulting requirements of less than ten

crore rupees, a strong room with defender safes;

(ii)

at operation centres with overnight vaulting requirements between ten to one

hundred crore rupees, vaulting facility as per the norms of the Reserve Bank of

India specified for C Class vaults;

(iii)

at large operation centres with overnight vaulting requirements of more than

one hundred crore rupees, increased vaulting facility in consultation with the

concerned Bank; and

(iv)

all overnight vaulting facilities shall have provision to store currency of

multiple Banks in separate and exclusive bins;

(d)

Security of cash vault – the private security agency shall ensure the following security

aspects at its cash vault used for secured handling of cash on behalf of the Bank,

namely:—

(i)

adequate number of armed private security guards are deputed round the

clock;

(ii)

premises is under 24x7 electronic surveillance and monitoring;

(iii)

cash vault is provided with CCTV system with adequate number of cameras

having at least ninety days recording facility with footage recorded at

minimum 15 frames per second per camera in at least D1 resolution. The main

storage unit of the system shall be placed in a secure location and live feed of

the CCTV footage be available to the control room of the bank.

(iv)

the activities at cash vault is undertaken under dual custody basis;

(v)

the main cash vault area complies with all safety norms, like firefighting

systems, smoke detection systems, emergency lighting, control room for

monitoring the movement of vehicles, auto-dialer and burglar security

systems;

(vi)

security alarm with GSM based auto dialer, fire and magnetic sensor are

installed;

(vii)

the loading and unloading area of cash is covered by night vision CCTV

cameras;

(viii) electric power supply inside the cash vault is provided through plug-in, plug-

out system;

(ix)

carrying of naked light inside the cash vault is strictly prohibited and dry

battery operated torches or emergency lights are used inside strong rooms;

(x)

emergency lighting with the help of inverter shall always be available to the

security staff; and

(xi)

cash processing and vault areas shall have restricted and controlled access,

preferably through interlocking systems and frisking.

(xii)

personnel of the private security agency involved in cash handling and cash

transportation activities will wear body worn cameras, with both audio and

video features, and having at least fifteen days recording facility.

(xiii)

For security of the cash in vault or in transporation if any new or superior

technology is available in the market or would be available in future be readily

adopted for the security and surveillance purposes by the security agency.

Explanation - For the purposes of this rule, the expression “CCTV” means the closed circuit

television which is a self-contained surveillance system comprising cameras, recorders and

displays for monitoring activities in a store or company.

11.

Measures for risk mitigation.— (1) The private security agency shall ensure that the ATM

under its security shall be fitted with one time electronic combination locks for reducing the

instances of crew pilferage losses and ATM frauds.

(2)

The cash for loading in to an ATM machine shall be collected from the Bank on

previous day or in the first half of the day so that operations can be concluded before

the time stipulated in sub-rule (3).

(3) No cash loading of the ATMs or cash transportation activities shall be done —

(a)

after 9 PM in urban areas;

(b)

after 6 PM in rural areas; and

(c)

before 9 AM or after 4 PM in the districts notified by the Central Government as

Left Wing Extremism (LWE) affected areas.

THE FIRST SCHEDULE

[See rule 4(1)]

DESIGN AND SPECIFICATION FOR SECURED CASH VANS

(a)

Make.— The cash van shall—

(i)

be a Light Commercial Vehicle, with an engine capacity of not less than 2200 CC,

preferably turbocharged;

(ii)

be not more than seven years old;

(iii)

have tubeless tyres;

(iv)

have a ground clearance of not less than 190 mm; and

(v)

accommodate minimum of five passengers.

(b)

Layout.— The cash van shall have the compartment for storing cash, physically separated and

locked from the passenger compartment unit;

(c)

Cash compartment security.— (i) The cash compartment should be inaccessible from outside

the van unless operated internally through manual or electronic lock and cash compartment is

specially reinforced with steel with only one door and grill gate;

(ii)

the entrance of the cash compartment shall be from the rear side to ensure proper

visibility, operational feasibility and CCTV surveillance;

(iii)

all windows and wind screen shall have wire mesh protection of not more than one

square inch and each window mesh shall have a circular port-hole of six inches

diameter for use of weapons;

(iv)

the panic switches for operating the hooter are available with the driver and other

occupants.

(d)

Cash box security.— Each of the cash boxes shall be secured to the floor with separate chains

and have locks that can be opened or locked only by using separate keys kept with different

custodians and cash for each bank shall be carried, preferably, in a separate box with the name

of the bank written on it.

(e)

Other security features.— (i) The cash van shall be provided with a small CCTV system with at

least five days recording facility and three cameras installed in front, rear and inside of the

cabin.

(ii)

A security alarm with GSM based auto-dialer shall be provided with a

motorised siren.

(iii)

The cash van shall be equipped with hooter, fire extinguishers and emergency

lights to ensure quick reaction in case of an attack.

(iv)

Emergency contact details shall be displayed in the driver's compartment as

well as cash compartment within the cash van.
