अधीन वाC तDवक *नवा.चक< का उनके मत देने के अ3धकार को और अ3धक भावी बनाया जा सके, मतदान के
समय *नवा.चक< क5 पहचान सु*निIचत करने के साधन के >प म6 *नवा.चक< के लए *नवा.चक फोटो पहचान प
के उपयोग हेतु *नयम< के वारा उपबंध ;कए जा सकते हL, तथा

यतः *नवा.चक< का रिजCOPकरण *नयम, 1960 का *नयम 28 *नवा.चन आयोग को, इस ?िAट से ;क
*नवा.चक< के *त>पण का *नवारण हो सके तथा मतदान के समय उनक5 पहचान को सरल बनाया जा सके,
*नवा.चक< को राTय क5 लागत पर फोटोयुBत *नवा.चक फोटो-पहचान प जारP करने के लए *नदेश देने क5
शिBत दान करता है; तथा

यत:, *नवा.चन< का संचालन *नयम, 1961 के *नयम 49 ज(3) और 49 ट(2) (ख) म6 यह उपबं3धत है
;क जहाँ ;कसी *नवा.चन Xे के *नवा.चक< को *नवा.चक रिजिCOकरण *नयम, 1960, के *नयम 28 के उB त
उपबंध< के अधीन *नवा.चक फोटो पहचान-प Yदए गए हL, वहां *नवा.चक< को मतदान केZ [ म6 अपना *नवा.चक
फोटो पहचान-प Yदखाना होगा तथा उनक5 ओर से उन *नवा.चक फोटो पहचान प< को न हPं Yदखाए जाने या
Yदखाने म6 असमथ. होने पर उZ ह6 मत डालने क5 अनुम*त देने से इZ कार ;कया जा सकता है; तथा

यतः, उBत अ3ध*नयम, और *नयम< के उपयु.Bत उपबंध< को मलाकर एवं सामंजCयपूण. ढंग से उनके
अ_ययन से यह C पA ट होता है ;क ययDप मत देने का अ3धकार *नवा.चक नामावलP म6 नाम के होने से हP होता
है, यह *नवा.चन आयोग वारा राTय क5 लागत पर, मतदान के समय उनक5 पहचान सु*निIचत करने के साधन
के >प म6 दान करवाए गए *नवा.चक फोटो पहचान प के योग पर भी *नभ.र करता है, तथा दोन< का एक
साथ योग करना होता है, तथा

यतः, *नवा.चन आयोग ने एक समयबa काय.bम के अनुसार सभी *नवा.चक< को *नवा.चक फोटो पहचान-
प ई०पी०आई०सी० जारP करने का *नदेश देते हुए 28 अगCत, 1993 को एक आदेश जारP ;कया है; तथा

यतः, केरल, तमलनाडू, आंcदेश, कना.टक, गुजरात, म_ य-देश, महाराA O, मजोरम, नागालLड, ओdडशा,
राजC थान, तेलगांना एवं उ4तराख ड म6 *नवा.चक< को 100% *नवा.चक फोटो पहचान प जारP ;कए जा चुके हL,
तथा

अत:, अब, सभी संबa कारक< तथा Dव3धक एवं तf या4 मक िCथ*तय< को _ यान म6 रखते हुए, *नवा.चन
आयोग, एतgवारा, यह *नदेश देता है ;क Yदनांक 12.03.2021 एवं 23.03.2021 को अ3धसू3चत चालू उप-
*नवा.चन< म6 केरल म6 6-मालापुरम् संसदPय *नवा.चन Xे, तमलनाडू म6 39-कZ याकुमारP संसदPय *नवा.चन Xे,

प C तुत नहPं कर पाते हL, उZ ह6 अपनी पहचान C थाDपत करने के लए *नp नलqखत वैकिiपक फोटो पहचान
दC तावेज< म6 से कोई एक C तुत करना होगा:-

एDपक के संबंध म6, लेखन अशुDa, वत.नी क5 अशुDa इ4याYद को नजरअंदाज कर देना चाYहए बशतz
*नवा.चक क5 पहचान ईपीआईसी से सु*निIचत क5 जा सके। यYद कोई *नवा.चक फोटो पहचान प दश.त करता
है, जो ;क ;कसी अZय सभा *नवा.चन-Xे के *नवा.चक रिजCOPकरण अ3धकारP वारा जारP ;कया गया है, ऐसे
एDपक भी पहचान CथाDपत करने हेतू Cवीकृत ;कए जाएंग6 बशत| उस *नवा.चक का नाम जहां वह मतदान करने
आया है उस मतदान क6 [ से संबं3धत *नवा.चक नामावलP म6 उपलwध हो। यYद फोटो}ाफ इ4याYद के बेमेल होने
के कारण *नवा.चक क5 पहचान सु*निIचत करना संभव न हो तब *नवा.चक को उपयु.B त पैरा 7 म6 वqण.त ;कसी
एक वैकिiपक फोटो दCतावेज को Cतुत करना होगा।

उBत पैरा 7 म6 ;कसी बात के होते हुए भी, वासी *नवा.चक< को जो अपने पासपोट. म6 Dववरण< के आधार
पर लोक *त*न3ध4व अ3ध*नयम, 1950 क5 धारा 20क के अधीन *नवा.चक नामावलय< म6 पंजीकृत हL, मतदान
केZ[ म6 केवल उनके मूल पासपोट. (तथा कोई अZय पहचान दCतावेज नहPं) के आधार पर हP पहचाना जाएगा ।

ORDER

No.3/4/ID/2021/SDR/VOLII--Whereas, Section 61 of the Representation of the People Act, 1951
provides that with a view to preventing impersonation of electors, so as to make the right of genuine
electors to vote under section 62 of that Act more effective, provisions may be made by rules under that
Act for use of Electors Photo Identity Card for electors as the means of establishing their identity at the
time of polling; and
2.
Whereas, Rule 28 of the Registration of Electors Rules, 1960, empowers the Election
Commission to direct, with a view to preventing impersonation of electors and facilitating their
identification at the time of poll, the issue of Electors Photo Identity Card to electors bearing their
photographs at State cost; and
3.
Whereas, Rules 49H (3) and 49K (2) (b) of the Conduct of Elections Rules, 1961, stipulate that
where the electors of a constituency have been supplied with Electors Photo Identity Card under the said
provisions of Rule 28 of the Registration of Electors Rules, 1960, the electors shall produce their
Electors Photo Identity Card at the polling station and failure or refusal on their part to produce those
Electors Photo Identity Card may result in the denial of permission to vote; and

Whereas, a combined and harmonious reading of the aforesaid provisions of the said Act and the
Rules, makes it clear that although the right to vote arises by the existence of the name in the electoral
roll, it is also dependent upon the use of the Electors Photo Identity Card, where provided by the
Election Commission at State cost, as the means of establishing their identity at the time of polling and
that both are to be used together; and
5.
Whereas, the Election Commission made an Order on the 28th August, 1993, directing the issue
of Electors Photo Identity Card (EPIC) to all electors, according to a time bound programme; and
6.
Whereas, Electors Photo Identity Card have been issued to approximate 100% electors in the
State of Kerala, Tamil Nadu, Andhra Pradesh, Karnataka, Gujarat, Jharkhand, Madhya Pradesh,
Maharashtra, Mizoram, Nagaland, Odisha, Rajasthan, Telangana & Uttarakhand and

Now, therefore, after taking into account all relevant factors and the legal and factual position,
the Election Commission hereby directs that for the current bye-elections from 6-Malappuram
Parliamentary Constituency of Kerala, 39-Kanniyakumari Parliamentary Constituency of Tamil
Nadu, 23-Tirupati(SC) Parliamentary Constituency of Andhra Pradesh & 2-Belgaum
Parliamentary Constituency of Karnataka, 125-Morva Hadaf(ST) Assembly Constituency of
Gujarat, 13-Madhupur Assembly Constituency of Jharkhand, 47-Basavakalyan & 59-Maski(ST)
Assembly Constituencies of Karnataka, 55-Damoh Assembly Constituency of Madhya Pradesh,
252-Pandharpur

Assembly Constituency of Odisha, 179-Sahara, 24-Sujangarh(SC) & 175-Rajsamand Assembly
Constituencies of Rajasthan, 87-Nagarjuna Sagar Assembly Constituency of Telangana and 49-
Salt Assembly Constituency of Uttarakhand notified on 12-03-2021 & 23-03-2021, all electors who
have been issued EPIC shall produce the EPIC for their identification at the polling station before
casting their votes. Those electors who are not able to produce the EPIC shall produce one of the
following alternative photo identity documents for establishing their identity:-
(i)
Aadhaar Card,
(ii)
MNREGA Job Card,
(iii)
Passbooks with photograph issued by Bank/Post Office,
(iv)
Health Insurance Smart Card issued under the scheme of Ministry of Labour,
(v)
Driving License,
(vi)
Pan Card,
(vii)
Smart Card issued by RGI under NPR,
(viii)
Indian Passport,
(ix)
Pension document with photograph,
(x)
Service Identity Cards with photograph issued to employees by Central/State
Govt./PSUs/Public Limited Companies, and
(xi)
Official identity cards issued to MPs/MLAs/MLCs.

In the case of EPIC, clerical errors, spelling mistakes, etc. should be ignored provided the
identity of the elector can be established by the EPIC. If an elector produces an EPIC which has been
issued by the Electoral Registration Officer of another Assembly Constituency, such EPIC shall also be
accepted for identification provided the name of that elector finds place in the electoral roll pertaining to
the polling station where the elector has turned up for voting. If it is not possible to establish the
identity of the elector on account of mismatch of photograph, etc. the elector shall have to produce one
of the alternative photo documents mentioned in Para 7 above.
9.
Notwithstanding anything in Para 7 above, overseas electors who are registered in the electoral
roll under Section 20A of the Representation of the People Act, 1950, based on the particulars in their
Indian Passport, shall be identified on the basis of their original passport only (and no other identity
document) in the polling station.
