Memo No. 08/Vivid (01)-13/2021- 1860, Dated 08.06.2021--

Whereas Borio (Zirwabari O.P.) P.S Case no. 127/2021 dated 9.5.2021

District Sahibganj, Jharkhand was instituted arising out of unnatural

death of Ms. Rupa Tirkey, Sub Inspector, Jharkhand Police.

Whereas the above incident has given rise to public order concerns,

allegations and counter allegations as well as claims regarding roles of

different persons/agencies.

Whereas the aforesaid claims and counter claims as well as allegations

and counter allegations are being raised with respect to the aforesaid

unnatural death which has become a matter of public importance.

AND,

Whereas the appropriate Government considers the issue to be of

public importance necessitating a thorough, independent and impartial

Inquiry. It therefore, deems it proper to exercise the powers vested in it

under Section 3 of the Commissions of Inquiry Act, 1952.

Now therefore, in exercise of the powers under Section 3 of the

Commissions of Inquiry Act, 1952, the Government of Jharkhand hereby

appoints Hon'ble Mr Justice Vinod Kumar Gupta (now retired), Former

Chief Justice of Jharkhand High Court and also former Chief Justice

of Himachal Pradesh and Uttrakhand High Court as a one member

"Commission of Inquiry" for the purpose of making an Inquiry

regarding all claims/counter claims/allegations/counter allegations and

or dispute and issues pertaining to this matter and all matters

incidental thereto.

The Inquiry shall be completed within six (6) months from the date of

issuance of this notification and Hon'ble Commission of Inquiry shall

submit a report containing, interalia its conclusions, findings and

recommendations to the Government.

This Inquiry shall be independent of the investigation in Borio (Zirwabari

O.P.) P.S. Case No. 127/2021, District Sahibganj, Jharkhand.

This issues with the approval of the competent authority
