झारख ड पंचायत राज अध(नयम, 2001 (झारख ड अध(नयम- 06, 2001) का संशोधन करने के +लए अ&यादेश

,-तावना

चूंFक झारखड रा;य Hवधान मंडल सI मJ नहK है, और, झारखड रा;यपाल का समाधान हो गया है Fक ऐसी

पNरिOथ1तयाँ Hवयमान हQ िजनके कारण झारखड पंचायत राज अRध1नयम, 2001 का, इसमJ आगे व4णCत रK1त से,

संशोधन करने हेतु उनके लए तुंरत कारCवाई करना आवTयक हो गया है,

इसलए, अब, ‘भारत का संHवधान’ के अनुछेद 213 के खंड- (1) वारा दXत शिYतयZ का योग करते हुए

झारखड के रा;यपाल 1न3नल4खत अ5यादेश $याHपत करते हQ –

सं[\]त नाम, HवOतार और ारंभ -

(1)

यह अ5यादेश झारखड पंचायत राज (संशोधन) अ5यादेश, 2021 कहा जायेगा ।

(2)

इसका HवOतार स3पूणC झारखड रा;य मJ होगा सवाय उन \ेIZ के जहाँ झारखड नगरपालका

अRध1नयम, 2011 (झारखड अRध1नयम 7, 2012) या के^टोनमJट अRध1नयम, 1924 (अRध1नयम

ii,1924) के उपबंध लागू हQ ।

यह राजपI मJ काशन क? 1तRथ से वृXत होगा ।

झारखड पंचायत राज अRध1नयम- 2001 (अRध1नयम, 06, 2001) क? धारा 24 का संशोधन । - उYत

अRध1नयम क? धारा 24 क? उप धारा (4) 1न3नवत 1तOथाHपत क? जाएगी:-

‘‘(4)

य<द उपधारा (3) मJ व4णCत अवRध क? समाि]त के पूवC, aाम पंचायत पुनगC<ठत नहKं क? जाती है

तो वह अवRध क? समाि]त पर Hवघ<टत हो जाएगी और धारा (107) के उपबंध उस पंचायत के

संबंध मJ, छः मास से अनाRधक अवRध के लए, िजस अवRध के भीतर aाम पंचायत इस

अRध1नयम के उपबंधZ के अनुसार पुनगC<ठत क? जाएगी, लागू हZगे ।

अRध1नयम क? धारा 24 क? उप धारा (4) के बाद 1न3न नई उपधारा (5) जोड़ी जायेगी:-

‘‘(5)

महामारK िजसमJ aाम पंचायत या aाम पंचायतZ के पुनगCठन के लए 1नवाCचन या उप 1नवाCचन

स3प^न कराना संभव न हो, तो उRचत कारणZ का उfलेख करते हुए रा;य सरकार, धारा (107) के

उपबंध उस aाम पंचायत या उन aाम पंचायतZ के संबंध मJ, छः मास से अRधक अवRध अथवा

आगामी 1नवाCचन पूणC होने तक क? अवRध के लए लागू करने पर 1नणCय ले सकेगी।

अRध1नयम क? धारा 42 क? उप धारा (4) 1न3नवत् 1तOथाHपत क? जाएगी:

‘‘(4)

उपधारा (3) मJ Hव<हत अवRध क? समाि]त के पूवC पंचायत सम1त पुनगC<ठत नहKं क? जाती है तो

वह उYत अवRध के समाि]त पर Hवघ<टत हो जाएगी और धारा (107) के उपबंध उसके संबंध मJ

छः मास से अनRधक अवRध के लए, िजस अवRध के भीतर पंचायत सम1त इस अRध1नयम के

उपबंधZ के अनुसार पुनगC<ठत क? जाएगी, लागू हZगे ।

1नवाCचन स3प^न कराना संभव न हो, तो उRचत कारणZ का उfलेख करते हुए रा;य सरकार, धारा

(107) के उपबंध उस पंचायत सम1त या उन पंचायत सम1तयZ के संबंध मJ, छः मास से अRधक

अवRध अथवा आगामी 1नवाCचन पूणC होने तक क? अवRध के लए लागू करने पर 1नणCय ले

सकेगी।

छः माह से अनाRधक अवRध के लए, िजस अवRध के भीतर िजला पNरष इस अRध1नयम के

उपब^धZ के अनुसार पुनगC<ठत क? जाएगी, लागू हZगे ।

उपबंध उस िजला पNरषद या उन िजला पNरषदZ के संबंध मJ, छः मास से अRधक अवRध अथवा

1नवाCचन या उप 1नवाCचन स3प^न कराना संभव न हो, तो उRचत कारणZ का उfलेख करते हुए

रा;य सरकार, धारा (107) क? उपधारा (3) (ख) (ग) एवं उपधारा (4) के उपबंध उस aाम पंचायत

या पंचायत सम1त या िजला पNरष के संबंध मJ, छः मास से अRधक अवRध अथवा आगामी

1नवाCचन पूणC होने तक क? अवRध के लए लागू करने पर 1नणCय ले सकेगी ।

रा;यपाल के ाRधकार से इसके वारा काशत Fकया जाता है, िजसे भारतीय संHवधान के अनुiछेद

348 के खंड (3) के अधीन उYत अ5यादेश का अंaेजी भाषा मJ ाRधकृत पाठ समझा जाएगा ।

The Jharkhand Panchayat Raj (Amendment) Ordinance, 2021

(Jharkhand Ordinance No. 01, 2021)

An Ordinance to amend the Jharkhand Panchayat Raj Act, 2001 (Jharkhand Act 06, 2001)

Preamble

WHEREAS, the legislature of the State of Jharkhand is not in session; AND, WHEREAS, The

Governor of Jharkhand is satisfied that the circumstances exist which render it necessary for him to

take immediate action to amend the JHARKHAND PANCHAYAT RAJ ACT, 2001 (ACT 06, 2001), in

the manner herein after appearing; NOW THEREFORE, in exercise of the powers conferred by Clause

(1) of Article 213 of Constitution of India, the Governor of Jharkhand is pleased to promulgate the

following Ordinance;-

Short title, extent and commencement-

(1) This Ordinance may be called the Jharkhand Panchayat Raj (Amendment) Ordinance, 2021

(2) It shall extend to whole of the State of Jharkhand excepting the areas to which the

provisions of the Jharkhand Municipal Act, 2011 (Jharkhand Act No. 7 of 2012) or

Cantonment Act, 1924, (Act II of 1924) apply.

(3) It shall come into force from date of publication in Official Gazette.

Amendment of Section 24 of the Jharkhand Panchayat Raj Act, 2001 (Act 06 of 2001).-

sub-section (4) shall be substituted of Section 24 of the said Act as Following :-

“(4) If the Gram Panchayat is not reconstituted before the expiry of the term mentioned in

sub-section (3), it shall stand dissolved on the expiry of the term, and the provisions of

section (107) shall apply to the said Panchayat for a term not exceeding six months within

which the Gram Panchayat shall be reconstituted according to the provisions of this Act.”

Amendment of Section 24 of the Jharkhand Panchayat Raj Act, 2001 (Act 06 of 2001).- A new

sub-section (5) shall be added after sub-section (4) of Section 24 of the said Act as Following :-

“(5) If due to pandemic it is not possible to hold the General Election or bye Election for

reconstitution of Gram Panchayat or Gram Panchayats, citing proper causes State

Government may take decision to enact provisions of section (107) for that Gram Panchayat

or those Gram Panchyats for a period exceeding six months OR up to completion of next

election or bye election”

Amendment of Section 42 of the Jharkhand Panchayat Raj Act, 2001 (Act 06 of 2001).-

sub-section (4) shall be substituted of Section 42 of the said Act as Following :-

“(4) If the Panchayat Samiti is not reconstituted before the expiry of the term mentioned in

sub-section (3), it shall stand dissolved on the expiry of the term, and the provisions of

section (107) shall apply to the said Panchayat Samiti for a term not exceeding six months

within which the Panchayat Samiti shall be reconstituted according to the provisions of this

Act.”

Amendment of Section 42 of the Jharkhand Panchayat Raj Act, 2001 (Act 06 of 2001).- A new

sub-section (5) shall be added after sub-section (4) of Section 42 of the said Act as Following :-

“(5) If due to pandemic it is not possible to hold the General Election or bye Election for

reconstitution of Panchayat Samiti or Panchayat Samities, citing proper causes State

Government may take decision to enact provisions of section (107) for that Panchayat

Samiti or those Panchayat Samities for a period exceeding six months or up to completion

of next election or bye election”

Amendment of Section 57 of the Jharkhand Panchayat Raj Act, 2001 (Act 06 of 2001).-

sub-section (4) shall be substituted of Section 57 of the said Act as Following :-

“(4) If the Zila Parishad is not reconstituted before the expiry of the term mentioned in

sub-section (3), it shall stand dissolved on the expiry of the term, and the provisions of

section (107) shall apply to the said Zila Parishad for a term not exceeding six months

within which the Zila Parishad shall be reconstituted according to the provisions of this

Act.”

Amendment of Section 57 of the Jharkhand Panchayat Raj Act, 2001 (Act 06 of 2001).- A new

sub-section (5) shall be added after sub-section (4) of Section 57 of the said Act as Following :-

“(5) If due to pandemic it is not possible to hold the General Election or bye Election for

reconstitution of Zila Parishad or Zila Parishads, citing proper causes State Government

may take decision to enact provisions of section (107) for that Zila Parishad or those Zila

Parishads for a period exceeding six months OR up to completion of next election or bye

election”

Amendment of Section 107 of the Jharkhand Panchayat Raj Act, 2001 (Act 06 of 2001).- A new

sub-section (6) shall be added after sub-section (5) of Section 107 of the said Act as

Following :-

“(6) If due to pandemic, it is not possible to hold the General Election or bye Election for

reconstitution of Gram Panchayat or Panchayat Samiti or Zila Parishad, citing proper

causes State Government may take decision to enact provisions of sub section (3) (b) (c)

and sub section (4) of section (107) for that Gram Panchayat or Panchayat Samiti or Zila

Parishad for a period exceeding six months or up to completion of next election or bye

election ”
