जCरए क= गई थी। काय8(म के अनुसार, मतगणना क= तारHख 23 @दसA बर, 2019 थी।
और यत:, लोक 6त6नIधJ व अIध6नयम, 1951 क= धारा 78 के अनुसार, 6नवा8चन लड़ने वाले J येक
अN यथO को, 6नवा8Iचत अN यथO के 6नवा8चन क= तारHख से 30 @दनP के भीतर 6नवा8चन Q यय के अपने लेखे क=
सहH 6त िजला 6नवा8चन अIधकारH को दाUखल करनी होती है;
और यत:, 20-बड़काठा वधान सभा 6नवा8चन XेY स@हत संबंIधत Cरट6नZग अIधकारH वारा उ\ त
6नवा8चन के पCरणाम 23 @दसA बर, 2019 को घो;षत ]कए गए थे। इस कार, 6नवा8चन Q यय के लेखे दाUखल
करने क= अंि_तम तारHख 22 जनवरH, 2019 थी;
और यत:, िजला 6नवा8चन अIधकारH, हजार*बाग, झारख ड वारा @दनांक 25 जनवर*, 2020 के पY सं
42/6नवा8० वारा ` तुत और मु य 6नवा8चन अIधकारH, झारख ड वारा अपने @दनांक 3 फरवर*, 2020 के पY

सं० 01/नवा -ई.ई.एम-को.-42/2019/201, के जCरए अbे;षत Cरपोट8 के अनुसार 2ी अ4मत कुमार यादव जो
झारख ड के 20-बड़काठा ;वधान सभा 6नवा8चन XेY से 6नवा8चन लड़ने वाले नद ल*य अN यथO हc, ;वIध वारा
आपेdXत रH6त से अपने 6नवा8चन Q यय का कोई भी लेखा दाUखल करने मe ;वफल रहे हc।
और यत:, िजला 6नवा8चन अIधकारH, हजार*बाग, झारख ड और मु य 6नवा8चन अIधकारH, झारख ड क=
Cरपोट8 के आधार पर 6नवा8चन आयोग वारा 6नवा8चनP का संचालन 6नयम 1961 के 6नयम 89 के उप 6नयम
(5) के अंतग8त 6नवा8चन Q यय ` तुत नहHं करने के लए 2ी अ4मत कुमार यादव को कारण बताओ नो@टस
@दनांक 3 माच , 2021 को जारH ]कया गया था;
और यत:, 6नवा8चनP का संचालन 6नयम 1961 के 6नयम 89 के उप-6नयम (6) के अनुसार, @दनांक 3
माच , 2021 के उपयु\ त कारण बताओ नो@टस के जCरए 2ी अ4मत कुमार यादव को 6नदेश @दया गया था ]क वे
इस नो@टस के ाh त होने के 20 @दनP के अंदर लेखे न ` तुत कर पाने के कारणP को ` पi ट करते हुए लUखत
jप मe अपना अN यावेदन ` तुत करe और साथ हH, 6नवा8चन Q यय का अपना लेखा दाUखल करe;
और यत:, उ\ त नो@टस 2ी अ4मत कुमार यादव के पY वारा @दनांक 20 माच , 2021 को ाh त ]कया
था। अN यथO से ाh त पावती रसीद िजला 6नवा8चन अIधकारH, हजार*बाग वारा अपने @दनांक 22 माच , 2021 मे
पY सं० 166/नवा ० के जCरए आयोग को ` तुत कर दH गई है;
और यत:, िजला 6नवा8चन अIधकारH, हजार*बाग वारा अपने @दनांक 14 जून, 2021 के पY सं०
01/न०(व.स.)-16-03/2020/1520 के जCरए ` तुत क= गई अनुपूरक Cरपोट8 मe यह बताया गया है ]क 2ी
अ4मत कुमार यादव ने आज क= तारHख तक न तो कोई भी अN यावेदन और न हH अपने 6नवा8चन Q यय का लेखा
दाUखल ]कया है। इसके अ6तCर\ त उ_ हPने भारत 6नवा8चन आयोग का सA यक नो@टस मलने के उपरांत भी उ\ त
;वफलता के लए न तो कोई कारण बताया है और न हH कोई ` पi टHकरण @दया है;
और यत:, आयोग का यह समाधान हो गया है ]क 2ी अ4मत कुमार यादव 6नवा8चन Q यय का लेखा
दाUखल करने मe ;वफल रहे हc और उनके पास इस ;वफलता के लए कोई भी उIचत कारण अथवा औIचJ य नहHं
है,
और यत:, लोक 6त 6नIधJ व अIध6नयम, 1951 क= धारा 10क मe अनुबंIधत ]कया गया है ]क :-
''य@द 6नवा8चन आयोग का समाधान हो जाता है ]क कोई Q यि\त-

(i) 6नवा8चन Q ययP का लेखा उस समय के भीतर और उस रH6त मe जैसी इस अIध6नयम के वारा या अधीन
उपेdXत है, दाUखल करने मe असफल रहा है: तथा
(ii) उस असफलता के लए कोई अn छा कारण या _ यायोIचJ य नहHं रखता है,
''तो 6नवा8चन आयोग शासक=य राजपY मe काशत आदेश वारा उसको 6नर@ह8त घो;षत करेगा और ऐसा
Q यि\त उस आदेश क= तारHख से तीन वष8 क= कालावIध के लए 6नर@ह8त होगा''
अत:, अब लोक 6त6नIधJ व अIध6नयम, 1951 क= धारा 10क के अनुसरण मe भारत 6नवा8चन आयोग
एतदवारा घोषणा करता है ]क झारख ड रा: य के 20-बड़काठा ;वधान सभा 6नवा8चन XेY से ;वधान
सभा के साधारण 6नवा8चन, 2019 मe 6नवा8चन लड़ने वाले नद ल*य अN यथO 2ी अ4मत कुमार यादव,
:ाम-छुतहर* क<टया, पो०-बरकनगांगो, थाना-बरक?ा, िजला-हजार*बाग, झारखB ड को इस आदेश क=
तारHख से तीन वष8 क= अवIध के लए संसद के ]कसी भी सदन अथवा रा: य अथवा संघ रा: य-XेY क=
;वधान सभा अथवा ;वधान पCरषद का सद` य चुने जाने अथवा होने के लए 6नर@ह8त है।

ELECTION COMMISSION OF INDIA

ORDER
9 July, 2021 / 18 Ashadha, 1943 (Saka)
No. JKD-LA/ES-I/20/2019--WHEREAS, the General Election to Jharkhand Legislative
Assembly 2019 was announced by Election Commission vide Press Note No. ECI/PN/102/2019 dated
1st November, 2019. As per the schedule, the date of Counting was 23rd December, 2019.
AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every
contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the
District Election Officer, concerned from the date of election of returned candidate;
AND WHEREAS, the result of the said election was declared by the concerned Returning
Officer including 20-Barkatha Assembly Constituency in Jharkhand State on 23rd December, 2019.
As such the last date for lodging of account of election expenses was 22nd January, 2019.
AND WEHREAS, as per the report vide letter No. 42/6नवा8० dated 25th January, 2020 submitted
by the District Election Officer, Hazaribagh Jharkhand and forwarded by Chief Electoral Officer,
Jharkhand vide letter No. 01/6नवा8-ई.ई.एम-को.-42/2019/201, dated 3rd February, 2020, Sh. Amit Kumar
Yadav, an Independent contesting candidate from 20-Barkatha Assembly Constituency in Jharkhand
State, has failed to lodge any account of her election expenses as required by law.
AND WEHREAS, on the basis of the reports of the District Election Officer Hazaribagh,
Jharkhand and the Chief Electoral Officer, Jharkhand a Show Cause Notice, dated 3rd March, 2021 was
issued by Election Commission under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to
, Sh. Amit Kumar Yadav, for non-submission of Election expenses;
AND WEHREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961,
through the above said Show Cause Notice, dated 3rd March, 2021, Sh. Amit Kumar Yadav, was
directed to submit her representation in writing to the Commission explaining the reason for non-
submission of accounts and also to lodge her accounts of election expenses/rectify the defects in her
accounts and submit the same to the District Election Officer concerned within 20 days from the date of
receipt of the notice;
AND WEHREAS, the said notice was received by Sh. Amit Kumar Yadav, on 20th March,
2021. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by
District Election Officer, Hazaribagh vide his letter 166/6नवा8० dated 22nd March, 2021.
AND WEHREAS, in the supplementary report submitted by District Election Officer,
Hazaribagh vide his letter 01/6न०(;व.स.)-16-03/2020/1520 dated 14th June, 2021 it has been stated that

Sh. Amit Kumar Yadav, has not submitted any representation or her account of election expenses,
duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor
explanation for the said failure even after receipt of the due notice to the Election Commission of India
as well;
AND WEHREAS, the Commission is satisfied that Sh. Amit Kumar Yadav, has failed to lodge
an account of election expenses and has no good reason or justification for the failure;
AND WEHREAS, Section 10A of the Representation of the People Act, 1951 stipulates that:-
"If the Election Commission is satisfied that a person-
(a)
has failed to lodge an account of election expenses within the time and in the manner
required by law or under this Act, and
(b)
has no good reason or justification for the failure,
"the Election Commission shall, by order published in the Official Gazette, declare him
to be disqualified and any such person shall be disqualified for a period of three years from date of the
order."
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act,
1951, the Election Commission of India hereby declares Sh. Amit Kumar Yadav, resident of Village-
Chhutahari Katiya, PO-Barkangango, PS-Barkatha, Dist-Hazaribagh, Jharkhand and an
Independent contesting candidate for General Election to Legislative Assembly of Jharkhand, 2019
from 20-Barkatha Assembly Constituency of the State of Jharkhand to be disqualified for being chosen
as and for being a member of either House of Parliament or the Legislative Assembly or Legislative
Council of a State or Union Territory for a period of three years from the date of this order.
