2019 के जDरए क= गई थी। काय9)म के अनुसार, मतगणना क= तारIख 23 AदसB बर, 2019 थी ।
और यत:, लोक 7त7नJधK व अJध7नयम, 1951 क= धारा 78 के अनुसार, 7नवा9चन लड़ने वाले K येक
अN यथO को, 7नवा9Jचत अN यथO के 7नवा9चन क= तारIख से 30 AदनP के भीतर 7नवा9चन Q यय के अपने लेखे क=
सहI 7त िजला 7नवा9चन अJधकारI को दाUखल करनी होती है
और यत:, 24-मा$ डु वधान सभा 7नवा9चन WेX सAहत संबंJधत Dरट7नYग अJधकारI वारा उ[ त 7नवा9चन
के पDरणाम 23 AदसB बर, 2019 को घो<षत \कए गए थे। इस कार, 7नवा9चन Q यय के लेखे दाUखल करने क=
अंि^तम तारIख 22 जनवरI, 2020 थी;

के 24-मा$ डु <वधान सभा 7नवा9चन WेX से 7नवा9चन लड़ने वालI झारख$ ड मुि7त मोचा (उलगुलान) क= अN यथO
हb, <वJध वारा आपेcWत रI7त से अपने 7नवा9चन Q यय का कोई भी लेखा दाUखल करने मd <वफल रहI हb।
और यत:, िजला 7नवा9चन अJधकारI, हजार)बाग, झारख ड और मु! य 7नवा9चन अJधकारI, झारख ड क=
Dरपोटf के आधार पर भारत 7नवा9चन आयोग वारा 7नवा9चनP का संचालन 7नयम 1961 के 7नयम 89 के उप
7नयम (6) के अंतग9त 7नवा9चन Q यय + तुत नहIं करने के लए 1ीमती बबीता देवी को कारण बताओ नोAटस
Aदनांक 8 जुलाई, 2020 को जारI \कया गया था;
और यत:, 7नवा9चनP का संचालन 7नयम 1961 के 7नयम 89 के उप-7नयम (6) के अनुसार, Aदनांक 8
जुलाई, 2020 के उपयु[ त कारण बताओ नोAटस के जDरए 1ीमती बबीता देवी को 7नदेश Aदया गया था \क वे
इस नोAटस के ाh त होने के 20 AदनP के अंदर लेखे न + तुत कर पाने के कारणP को + पi ट करते हुए लUखत
jप मd अपना अN यावेदन + तुत करd और साथ हI, 7नवा9चन Q यय का अपना लेखा दाUखल करd;
और यत:, उ[ त नोAटस 1ीमती बबीता देवी वारा Aदनांक 27 अग> त, 2020 को ाh त \कया था।
अN यथO से ाh त पावती रसीद िजला 7नवा9चन अJधकारI, हजार)बाग वारा अपने Aदनांक 14 ?सत@ बर, 2020 के
पX सं० 329/नवा ० के जDरए आयोग को + तुत कर दI गई है;
और यत:, िजला 7नवा9चन अJधकारI, हजार)बाग वारा अपने Aदनांक 15 अ7 टूबर, 2020 के पX सं०
361/नवा ० के जDरए + तुत क= गई अनुपूरक Dरपोट9 मd यह बताया गया है \क 1ीमती बबीता देवी ने आज क=
तारIख तक न तो कोई भी अN यावेदन और न हI अपने 7नवा9चन Q यय का लेखा दाUखल \कया है । इसके
अ7तDर[ त उ^ हPने भारत 7नवा9चन आयोग का सB यक नोAटस मलने के उपरांत भी उ[ त <वफलता के लए न तो
कोई कारण बताया है और न हI कोई + पi टIकरण Aदया है;
और यत:, आयोग का यह समाधान हो गया है \क 1ीमती बबीता देवी 7नवा9चन खचf का लेखा दाUखल
करने मd <वफल रहI हb और उनके पास इस <वफलता के लए कोई भी उJचत कारण अथवा औJचK य नहIं है,
और यत:, लोक 7त 7नJधK व अJध7नयम, 1951 क= धारा 10क मd अनुबंJधत \कया गया है \क :-
''यAद 7नवा9चन आयोग का समाधान हो जाता है \क कोई Q यि[त-

(क) 7नवा9चन Q ययP का लेखा उस समय के भीतर और उस रI7त मd जैसी इस अJध7नयम के वारा या अधीन
उपेcWत है, दाUखल करने मd असफल रहा है: तथा
(ख) उस असफलता के लए कोई अm छा कारण या ^ यायोJचK य नहIं रखता है,
7नवा9चन आयोग शासक=य राजपX मd काशत आदेश वारा उसको 7नरAह9त घो<षत करेगा और ऐसा
Q यि[त उस आदेश क= तारIख से तीन वष9 क= कालावJध के लए 7नरAह9त होगा''
अत:, अब लोक 7त7नJधK व अJध7नयम, 1951 क= धारा 10क के अनुसरण मd भारत 7नवा9चन आयोग
एतदवारा घोषणा करता है \क झारख ड रा; य के 24-मा$ डु <वधान सभा 7नवा9चन WेX से <वधान सभा के
साधारण 7नवा9चन, 2019 मd 7नवा9चन लड़ने वालI झारख$ ड मुि7त मोचा (उलगुलान) क= अN यथO 1ीमती बबीता
देवी, Cाम-सी.सी.एल.सDदा, पो०-भुरकु$ डा बाजार, थाना-भुरकु$ डा, िजला-रामगढ़, झारख$ ड को इस आदेश क=
तारIख से तीन वष9 क= अवJध के लए संसद के \कसी भी सदन अथवा रा; य अथवा संघ रा; य-WेX क= <वधान
सभा अथवा <वधान पDरषद का सद+ य चुने जाने अथवा होने के लए 7नरAह9त है ।

ELECTION COMMISSION OF INDIA

ORDER
23 July, 2021 /01 Sravana, 1943 (Saka)
No. JKD-LA/ES-I/24/2019-- WHEREAS, the General Election to Jharkhand Legislative
Assembly 2019 was announced by Election Commission of India vide Press Note No.
ECI/PN/102/2019 dated 1st November, 2019. As per the schedule, the date of Counting was 23rd
December, 2019.
AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every
contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the
District Election Officer, concerned from the date of election of returned candidate;
AND WHEREAS, the result of the said election was declared by the concerned Returning
Officer including 24-Mandu Assembly Constituency on in the Jharkhand State 23rd December, 2019.
As such the last date for lodging of account of election expenses was 22nd January, 2020.
AND WEHREAS, as per the report vide letter No. 42/नवा dated 25th Jan, 2020 submitted by
the District Election Officer, Hazaribagh Jharkhand and forwarded by Chief Electoral Officer,
Jharkhand vide letter No. 01/नवा -ई.ई.एम-को.-42/2019/201, dated 3rd February, 2020 Smt. Babita Devi, a
contesting candidate of Jharkhand Mukti Morcha (Ulgulan) from 24-Mandu Assembly
Constituency of Jharkhand, has failed to lodge any account of her election expenses as required by law.
AND WEHREAS, on the basis of the reports of the District Election Officer Hazaribagh,
Jharkhand and the Chief Electoral Officer, Jharkhand a Show Cause Notice, dated 8th July, 2020 was
issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election
Rules, 1961 to Smt. Babita Devi for non-submission of Election expenses;
AND WEHREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961,
through the above said Show Cause Notice, dated 8th July, 2020, Smt. Babita Devi was directed to
submit her representation in writing in the Commission explaining the reason for non-submission of
accounts and also to lodge her accounts of election expenses/rectify the defects in her accounts and
submit the same to the District Election Officer concerned within 20 days from the date of receipt of the
notice;
AND WEHREAS, the said notice was received by Smt. Babita Devi on 27th August, 2020.
Acknowledgment receipt obtained from the candidate have been submitted to the Commission by
District Election Officer, Hazaribagh vide his letter 329/नवा . dated 14th September, 2020.

AND WEHREAS, in the supplementary report submitted by District Election Officer,
Hazaribagh vide his letter 361/नवा ० dated 15th October, 2020 it has been stated that Smt. Babita
Devi has not submitted any representation or her account of election expenses, duly signed along with
original vouchers etc. till date. Further, she has furnished neither any reason nor explanation for the said
failure even after receipt of the due notice to the Election Commission of India as well;
AND WEHREAS, the Commission is satisfied that Smt. Babita Devi has failed to lodge an
account of election expenses and has no good reason or justification for the failure;
AND WEHREAS, Section 10A of the Representation of the People Act, 1951 stipulates that:-
"If the Election Commission is satisfied that a person:
(a)
has failed to lodge an account of election expenses within the time and in the manner
required by law or under this Act, and
(b)
has no good reason or justification for the failure,
Election Commission shall, by order published in the Official Gazette, declare him to be
disqualified and any such person shall be disqualified for a period of three years from
date of the order."
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act,
1951, the Election Commission hereby declares Smt. Babita Devi resident of Village-C.C.L. Sonda,
Post-Bhurkunda Bazar, PS-Bhurkunda, Dist. Ramgarh, Jharkhand and a contesting candidate of
Jharkhand Mukti Morcha (Ulgulan) for General Election to Legislative Assembly of Jharkhand, 2019
from 24-Mandu Assembly Constituency in the State of Jharkhand, to be disqualified for being chosen
as and for being a member of either House of Parliament or the Legislative Assembly or Legislative
Council of a State or Union Territory for a period of three years from the date of this order.
