जCरए क< गई थी। काय7)म के अनुसार, मतगणना क< तारHख 23 @दसA बर, 2019 थी ।
और यत:, लोक 5त5नIधJ व अIध5नयम, 1951 क< धारा 78 के अनुसार, 5नवा7चन लड़ने वाले J येक
अN यथO को, 5नवा7Iचत अN यथO के 5नवा7चन क< तारHख से 30 @दनP के भीतर 5नवा7चन Q यय के अपने लेखे क<
सहH 5त िजला 5नवा7चन अIधकारH को दाUखल करनी होती है;
और यत:, 81-भवनाथपुर :वधान सभा 5नवा7चन XेY स@हत संबंIधत Cरट5नZग अIधकारH वारा उ\ त
5नवा7चन के पCरणाम 23 @दसA बर, 2019 को घो:षत ]कए गए थे। इस कार, 5नवा7चन Q यय के लेखे दाUखल
करने क< अंि_तम तारHख 22 जनवरH, 2020 थी;
और यत:, िजला 5नवा7चन अIधकारH, गढ़वा, झारख ड वारा @दनांक 28 जनवर&, 2020 के पY सं
368/आ०) य०ले०को० वारा + तुत और मु! य 5नवा7चन अIधकारH, झारख ड वारा अपने @दनांक 3 फरवर&,
2020 के पY स0 01/नवा -ई.ई.एम-को.-42/2019/201, के जCरए अaे:षत Cरपोट7 के अनुसार 2ी भानु राम, जो

आपेcXत रH5त से अपने 5नवा7चन Q यय का कोई भी लेखा दाUखल करने मd :वफल रहे हb।
और यत:, िजला 5नवा7चन अIधकारH, गढ़वा झारख ड और मु! य 5नवा7चन अIधकारH, झारख ड क< Cरपोट7
के आधार पर 5नवा7चन आयोग वारा 5नवा7चनP का संचालन 5नयम 1961 के 5नयम 89 के उप 5नयम (5) के
अंतग7त 5नवा7चन Q यय + तुत नहHं करने के लए 2ी भानु राम को कारण बताओ नो@टस @दनांक 04 माच ,
2021 को जारH ]कया गया था;
और यत:, 5नवा7चनP का संचालन 5नयम 1961 के 5नयम 89 के उप-5नयम (6) के अनुसार, @दनांक 04
माच , 2021 के उपयु\ त कारण बताओ नो@टस के जCरए 2ी भानु राम को 5नदेश @दया गया था ]क वे इस
नो@टस के ाg त होने के 20 @दनP के अंदर लेखे न + तुत कर पाने के कारणP को + पh ट करते हुए लUखत iप
मd अपना अN यावेदन + तुत करd और साथ हH, 5नवा7चन Q यय का अपना लेखा दाUखल करd;
और यत:, उ\ त नो@टस 2ी भानु राम 5क नतनी वारा @दनांक 18 माच , 2021 को ाg त ]कया था।
अN यथO से ाg त पावती रसीद िजला 5नवा7चन अIधकारH, गढ़वा वारा अपने @दनांक 26 माच , 2021 के पY सं०
168/नवा ० के जCरए आयोग को + तुत कर दH गई है;
और यत:, िजला 5नवा7चन अIधकारH, गढ़वा वारा अपने @दनांक 01 जून, 2021 के पY सं०
238/िज०नवा ० के जCरए + तुत क< गई अनुपूरक Cरपोट7 मd यह बताया गया है ]क 2ी भानु राम ने आज क<
तारHख तक न तो कोई भी अN यावेदन और न हH अपने 5नवा7चन Q यय का लेखा दाUखल ]कया है। इसके
अ5तCर\ त उ_ हPने भारत 5नवा7चन आयोग का सA यक नो@टस मलने के उपरांत भी उ\ त :वफलता के लए न तो
कोई कारण बताया है और न हH कोई + पh टHकरण @दया है;
और यत:, आयोग का यह समाधान हो गया है ]क 2ी भानु राम 5नवा7चन Q यय का लेखा दाUखल करने
मd :वफल रहे हb और उनके पास इस :वफलता के लए कोई भी उIचत कारण अथवा औIचJ य नहHं है,
और यत:, लोक 5त 5नIधJ व अIध5नयम, 1951 क< धारा 10क मd अनुबंIधत ]कया गया है ]क :-
''य@द 5नवा7चन आयोग का समाधान हो जाता है ]क कोई Q यि\त-
(क) 5नवा7चन Q ययP का लेखा उस समय के भीतर और उस रH5त मd जैसी इस अIध5नयम के वारा या अधीन
उपेcXत है, दाUखल करने मd असफल रहा है: तथा
(ख) उस असफलता के लए कोई अl छा कारण या _ यायोIचJ य नहHं रखता है,
5नवा7चन आयोग शासक<य राजपY मd काशत आदेश वारा उसको 5नर@ह7त घो:षत करेगा और ऐसा
Q यि\त उस आदेश क< तारHख से तीन वष7 क< कालावIध के लए 5नर@ह7त होगा''
अत:, अब लोक 5त5नIधJ व अIध5नयम, 1951 क< धारा 10क के अनुसरण मd भारत 5नवा7चन आयोग
एतदवारा घोषणा करता है ]क झारख ड रा9 य के 81-भवनाथपुर :वधान सभा 5नवा7चन XेY से :वधान सभा के
साधारण 5नवा7चन, 2019 मd 5नवा7चन लड़ने वाले नद ल&य अN यथO 2ी भानु राम, सा०-पुरैनी, पो०-नगर उंटार&,
थाना-नगर उंटार&, िजला-गढ़वा, झारख; ड को इस आदेश क< तारHख से तीन वष7 क< अवIध के लए संसद के
झारखडगजट(असाधारण) शु)वार, 6 अग+त, 2021

]कसी भी सदन अथवा रा9 य अथवा संघ रा9 य-XेY क< :वधान सभा अथवा :वधान पCरषद का सद+ य चुने जाने
अथवा होने के लए 5नर@ह7त है ।

ORDER
23 July, 2021 / 01 Sravana, 1943 (Saka)
No. JKD-LA/ES-I/81/2019-- WHEREAS, the General Election to Jharkhand Legislative
Assembly 2019 was announced by Election Commission vide Press Note No. ECI/PN/102/2019 dated
1st November, 2019. As per the schedule, the date of Counting was 23rd December, 2019.
AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every
contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the
District Election Officer, concerned from the date of election of returned candidate;
AND WHEREAS, the result of the said election was declared by the concerned Returning
Officer including 81-Bhawanathpur Assembly Constituency in Jharkhand State on 23rd December,
2019. As such the last date for lodging of account of election expenses was 22nd January, 2020.

AND WEHREAS, as per the report vide letter No. 368/आ०) य०ले०को० dated 28th January, 2020
submitted by the District Election Officer, Garhwa Jharkhand and forwarded by Chief Electoral
Officer, Jharkhand vide letter No. 01/5नवा7-ई.ई.एम-को.-42/2019/201, dated 3rd February, 2020, Sh. Bhanu
Ram, an Independent contesting candidate from 81-Bhawanathpur Assembly Constituency in
Jharkhand State, has failed to lodge any account of his election expenses as required by law.
AND WEHREAS, on the basis of the reports of the District Election Officer Garhwa,
Jharkhand and the Chief Electoral Officer, Jharkhand a Show Cause Notice, dated 4th March, 2021 was
issued by Election Commission under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to
Sh. Bhanu Ram for non-submission of Election expenses;
AND WEHREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961,
through the above said Show Cause Notice, dated 4th March, 2021, Sh. Bhanu Ram, was directed to
submit his representation in writing to the Commission explaining the reason for non-submission of
accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and
submit the same to the District Election Officer concerned within 20 days from the date of receipt of the
notice;
AND WEHREAS, the said notice was received by Grand Daughter of Sh. Bhanu Ram on 18th
March, 2021. Acknowledgment receipt obtained from the candidate have been submitted to the
Commission by District Election Officer, Garhwa vide his letter No. 168/नवा ० dated 26th March,
2021.
AND WEHREAS, in the supplementary report submitted by District Election Officer, Garhwa
vide his letter 238/िज०नवा ० dated 1st June, 2021 it has been stated that Sh. Bhanu Ram has not
submitted any representation or his account of election expenses, duly signed along with original
vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure
even after receipt of the due notice to the Election Commission of India as well;
AND WEHREAS, the Commission is satisfied that Sh. Bhanu Ram, has failed to lodge an
account of election expenses and has no good reason or justification for the failure;

AND WEHREAS, Section 10A of the Representation of the People Act, 1951 stipulates that:-
"If the Election Commission is satisfied that a person:
(a)
has failed to lodge an account of election expenses within the time and in the manner
required by law or under this Act, and
(b)
has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to
be disqualified and any such person shall be disqualified for a period of three years from
date of the order."
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act,
1951, the Election Commission of India hereby declares Sh. Bhanu Ram resident of Village-At.
Puraini, Post-Nagar Untari, Dist-Garhwa, Jharkhand and an Independent contesting candidate for
General Election to Legislative Assembly of Jharkhand, 2019 from 81-Bhawanathpur Assembly
Constituency of the State of Jharkhand, to be disqualified for being chosen as and for being a member of
either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union
Territory for a period of three years from the date of this order.
