Eरपोट6 के आधार पर भारत :नवा6चन आयोग वारा :नवा6चनR का संचालन :नयम 1961 के :नयम 89 के उप
:नयम (6) के अंतग6त :नवा6चन S यय + तुत नहJं करने के लए .ी सु0 दर लाल मरा डी को कारण बताओ
नोBटस Bदनांक 8 जुलाई, 2020 को जारJ ]कया गया था;
और यत:, :नवा6चनR का संचालन :नयम 1961 के :नयम 89 के उप-:नयम (6) के अनुसार, Bदनांक 8
जुलाई, 2020 के उपयु\ त कारण बताओ नोBटस के जEरए .ी सु0 दर लाल मरा डी को :नदेश Bदया गया था ]क
वे इस नोBटस के ाh त होने के 20 BदनR के अंदर लेखे न + तुत कर पाने के कारणR को + पi ट करते हुए
लVखत jप मe अपना अP यावेदन + तुत करe और साथ हJ, :नवा6चन S यय का अपना लेखा दाVखल करe;
और यत:, उ\ त नोBटस .ी सु0 दर लाल मरा डी वारा Bदनांक 02 4सत5 बर, 2020 को ाh त ]कया था।
अP यथQ से ाh त पावती रसीद िजला :नवा6चन अKधकारJ, हजार!बाग वारा अपने Bदनांक 14 4सत5 बर, 2020 के
पY सं० 329/नवा . के जEरए आयोग को + तुत कर दJ गई है;
और यत:, िजला :नवा6चन अKधकारJ, हजार!बाग वारा अपने Bदनांक 15 अ7 टूबर, 2020 के पY सं०
361/नवा ० के जEरए + तुत क> गई अनुपूरक Eरपोट6 मe यह बताया गया है ]क .ी सु0 दर लाल मरा डी ने आज
क> तारJख तक न तो कोई भी अP यावेदन और न हJ अपने :नवा6चन S यय का लेखा दाVखल ]कया है। इसके
अ:तEर\ त उ_ हRने भारत :नवा6चन आयोग का सC यक नोBटस मलने के उपरांत भी उ\ त =वफलता के लए न तो
कोई कारण बताया है और न हJ कोई + पi टJकरण Bदया है;
और यत:, आयोग का यह समाधान हो गया है ]क .ी सु0 दर लाल मरा डी :नवा6चन खचk का लेखा
दाVखल करने मe =वफल रहे हc और उनके पास इस =वफलता के लए कोई भी उKचत कारण अथवा औKचL य नहJं
है,
और यत:, लोक :त :नKधL व अKध:नयम, 1951 क> धारा 10क मe अनुबंKधत ]कया गया है ]क :-
''यBद :नवा6चन आयोग का समाधान हो जाता है ]क कोई S यि\त-

(क) :नवा6चन S ययR का लेखा उस समय के भीतर और उस रJ:त मe जैसी इस अKध:नयम के वारा या अधीन
उपेdXत है, दाVखल करने मe असफल रहा है: तथा
(ख) उस असफलता के लए कोई अm छा कारण या _ यायोKचL य नहJं रखता है,
:नवा6चन आयोग शासक>य राजपY मe काशत आदेश वारा उसको :नरBह6त घो=षत करेगा और ऐसा
S यि\त उस आदेश क> तारJख से तीन वष6 क> कालावKध के लए :नरBह6त होगा''
अत:, अब लोक :त:नKधL व अKध:नयम, 1951 क> धारा 10क के अनुसरण मe :नवा6चन आयोग
एतदवारा घोषणा करता है ]क झारख ड रा< य के 24-मा डु =वधान सभा :नवा6चन XेY से झारख ड रा< य के
=वधान सभा के साधारण :नवा6चन, 2019 मe :नवा6चन लड़ने वाले नद ल!य के अP यथQ .ी सु0 दर लाल मरा डी,
म०स०-54, ;ाम+पो->दगवार, थाना-चुरचू, िजला-हजार!बाग, झारख ड को इस आदेश क> तारJख से तीन वष6 क>
अवKध के लए संसद के ]कसी भी सदन अथवा रा< य अथवा संघ रा< य-XेY क> =वधान सभा अथवा =वधान
पEरषद का सद+ य चुने जाने अथवा होने के लए :नरBह6त है।

ELECTION COMMISSION OF INDIA

ORDER
23 July, 2021 / 01 Sravana, 1943 (Saka)
No. JKD-LA/ES-I/24/2019--WHEREAS, the General Election to Jharkhand Legislative
Assembly 2019 was announced by Election Commission of India vide Press Note No.
ECI/PN/102/2019 dated 1st November, 2019. As per the schedule, the date of Counting was
23rd December, 2019.
AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every
contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the
District Election Officer, concerned from the date of election of returned candidate;
AND WHEREAS, the result of the said election was declared by the concerned Returning
Officer including 24-Mandu Assembly Constituency in Jharkhand State on 23rd December, 2019. As
such the last date for lodging of account of election expenses was 22nd January, 2020.
AND WEHREAS, as per the report vide letter No. 42/:नवा6 dated 25th Jan, 2020 submitted by
the District Election Officer, Hazaribagh Jharkhand and forwarded by Chief Electoral Officer,
Jharkhand vide letter No. 01/:नवा6-ई.ई.एम-को.-42/2019/201, dated 3rd February, 2020, Sh. Sundar Lal
Marandi, an Independent contesting candidate from 24-Mandu Assembly Constituency in Jharkhand,
has failed to lodge any account of his election expenses as required by law.
AND WEHREAS, on the basis of the reports of the District Election Officer Hazaribagh,
Jharkhand and the Chief Electoral Officer, Jharkhand a Show Cause Notice, dated 8th July, 2020 was
issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election
Rules, 1961 to Sh. Sundar Lal Marandi for non-submission of Election expenses;
AND WEHREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961,
through the above said Show Cause Notice, dated 8th July, 2020, Sh. Sundar Lal Marandi was
directed to submit his representation in writing to the Commission explaining the reason for non-

submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his
accounts and submit the same to the District Election Officer concerned within 20 days from the date of
receipt of the notice;
AND WEHREAS, the said notice was received by Sh. Sundar Lal Marandi on 02nd
September, 2020. Acknowledgment receipt obtained from the candidate have been submitted to the
Commission by District Election Officer, Hazaribagh vide his letter 329/नवा . dated 14th September,
2020.
AND WEHREAS, in the supplementary report submitted by District Election Officer,
Hazaribagh vide his letter 361/नवा . dated 15th October, 2020 it has been stated that Sh. Sundar Lal
Marandi has not submitted any representation or his account of election expenses, duly signed along
with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the
said failure even after receipt of the due notice to the Election Commission of India as well;
AND WEHREAS, the Commission is satisfied that Sh. Sundar Lal Marandi has failed to lodge
an account of election expenses and has no good reason or justification for the failure;
AND WEHREAS, Section 10A of the Representation of the People Act, 1951 stipulates that:-
"If the Election Commission is satisfied that a person:
(a)
has failed to lodge an account of election expenses within the time and in the manner
required by law or under this Act, and
(b)
has no good reason or justification for the failure,
Election Commission shall, by order published in the Official Gazette, declare him to be
disqualified and any such person shall be disqualified for a period of three years from
date of the order."
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act,
1951, the Election Commission hereby declares Sh. Sundar Lal Marandi resident of H.No-54,
Village+Post-Digwar, P.S-Churchu, Dist. Hazaribag, Jharkhand and an Independent contesting
candidate for General Election to Legislative Assembly of Jharkhand, 2019 from 24-Mandu Assembly
Constituency in the State of Jharkhand to be disqualified for being chosen as and for being a member of
either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union
Territory for a period of three years from the date of this order.
