और यत:, लोक 4त4नIधJ व अIध4नयम, 1951 क; धारा 78 के अनुसार, 4नवा6चन लड़ने वाले J येक
अO यथP को, 4नवा6Iचत अO यथP के 4नवा6चन क; तारHख से 30 ?दनQ के भीतर 4नवा6चन R यय के अपने लेखे क;
सहH 4त िजला 4नवा6चन अIधकारH को दाVखल करनी होती है;
और यत:, 76-डालटेनगंज 9वधान सभा 4नवा6चन YेZ स?हत संबंIधत Bरट4न[ग अIधकारH वारा उ] त
4नवा6चन के पBरणाम 23 *दस, बर, 2019 को घो9षत ^कए गए थे। इस कार, 4नवा6चन R यय के लेखे दाVखल
करने क; अं4तम तारHख 22 जनवरH, 2020 थी;
और यत:, िजला 4नवा6चन अIधकारH, पलामू, झारख ड वारा ?दनांक 29 जनवर/, 2020 के पZ सं

स० 01/नवा -ई.ई.एम-को.-42/2019/201, के जBरए अaे9षत Bरपोट6 के अनुसार 5ी 7जेश कुमार जो झारख ड के
76-डालटेनगंज 9वधान सभा 4नवा6चन YेZ से 4नवा6चन लड़ने वाले नद ल/य अO यथP हb, 9वIध वारा आपेcYत
रH4त से अपने 4नवा6चन R यय का कोई भी लेखा दाVखल करने मd 9वफल रहे हb ।
और यत:, िजला 4नवा6चन अIधकारH, पलामू झारख ड और मु! य 4नवा6चन अIधकारH, झारख ड क; Bरपोट6
के आधार पर 4नवा6चन आयोग वारा 4नवा6चनQ का संचालन 4नयम 1961 के 4नयम 89 के उप 4नयम (5) के
अंतग6त 4नवा6चन R यय ) तुत नहHं करने के लए 5ी 7जेश कुमार को कारण बताओ नो?टस ?दनांक 03 माच ,
2021 को जारH ^कया गया था;
और यत:, 4नवा6चनQ का संचालन 4नयम 1961 के 4नयम 89 के उप-4नयम (6) के अनुसार, ?दनांक 3
माच , 2021 के उपयु] त कारण बताओ नो?टस के जBरए 5ी 7जेश कुमार को 4नदेश ?दया गया था ^क वे इस
नो?टस के ाg त होने के 20 ?दनQ के अंदर लेखे न ) तुत कर पाने के कारणQ को ) पh ट करते हुए लVखत (प
मd अपना अO यावेदन ) तुत करd और साथ हH, 4नवा6चन R यय का अपना लेखा दाVखल करd;
और यत:, उ] त नो?टस पZ 5ी 7जेश कुमार वारा ?दनांक 04 जून, 2021 को ाg त ^कया था। अO यथP
से ाg त पावती रसीद िजला 4नवा6चन अIधकारH, पलामू वारा अपने ?दनांक 14 जून, 2021 के पZ सं०
402/नवा ० के जBरए आयोग को ) तुत कर दH गई है;
और यत:, िजला 4नवा6चन अIधकारH, पलामू वारा अपने ?दनांक 28 जून, 2021 के पZ सं० 470/नवा ०
के जBरए ) तुत क; गई अनुपूरक Bरपोट6 मd यह बताया गया है ^क 5ी 7जेश कुमार ने आज क; तारHख तक न
तो कोई भी अO यावेदन और न हH अपने 4नवा6चन R यय का लेखा दाVखल ^कया है। इसके अ4तBर] त उj हQने
4नवा6चन आयोग का स@ यक नो?टस मलने के उपरांत भी उ] त 9वफलता के लए न तो कोई कारण बताया है
और न हH कोई ) पh टHकरण ?दया है;
और यत:, आयोग का यह समाधान हो गया है ^क 5ी 7जेश कुमार 4नवा6चन R यय का लेखा दाVखल
करने मd 9वफल रहे हb और उनके पास इस 9वफलता के लए कोई भी उIचत कारण अथवा औIचJ य नहHं है,
और यत:, लोक 4त 4नIधJ व अIध4नयम, 1951 क; धारा 10क मd अनुबंIधत ^कया गया है ^क :-
''य?द 4नवा6चन आयोग का समाधान हो जाता है ^क कोई R यि]त-
(क) 4नवा6चन R ययQ का लेखा उस समय के भीतर और उस रH4त मd जैसी इस अIध4नयम के वारा या अधीन
उपेcYत है, दाVखल करने मd असफल रहा है: तथा

(ख) उस असफलता के लए कोई अl छा कारण या j यायोIचत् य नहHं रखता है,
4नवा6चन आयोग शासक;य राजपZ मd काशत आदेश वारा उसको 4नर?ह6त घो9षत करेगा और ऐसा
R यि]त उस आदेश क; तारHख से तीन वष6 क; कालावIध के लए 4नर?ह6त होगा''
अत:, अब लोक 4त4नIधJ व अIध4नयम, 1951 क; धारा 10क के अनुसरण मd भारत 4नवा6चन आयोग
एतदवारा घोषणा करता है ^क झारख ड रा8 य के 76-डालटेनगंज 9वधान सभा 4नवा6चन YेZ से 9वधान सभा के
साधारण 4नवा6चन, 2019 मd 4नवा6चन लड़ने वाले नद ल/य अO य र्थी 5ी 7जेश कुमार, :ाम-म;झगांवा, पो-
नर<संहपुर पथरा, थाना-चैनपुर, िजला-पलामू, पन-822110, झारखB ड को इस आदेश क; तारHख से तीन वष6 क;
अवIध के लए संसद के ^कसी भी सदन अथवा रा8 य अथवा संघ रा8 य-YेZ क; 9वधान सभा अथवा 9वधान
पBरषद का सद) य चुने जाने अथवा होने के लए 4नर?ह6त है ।

ELECTION COMMISSION OF INDIA

ORDER
26 July, 2021 / 04 Sravana, 1943 (Saka)
No. JKD-LA/ES-I/76/2019-- WHEREAS, the General Election to Jharkhand Legislative
Assembly 2019 was announced by Election Commission vide Press Note No. ECI/PN/102/2019 dated
1st November, 2019. As per the schedule, the date of Counting was 23rd December, 2019.
AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every
contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the
District Election Officer, concerned from the date of election of returned candidate;
AND WHEREAS, the result of the said election was declared by the concerned Returning
Officer including 76-Daltonganj Assembly Constituency in Jharkhand State on 23rd December, 2019.
As such the last date for lodging of account of election expenses was 22nd January, 2020.
AND WEHREAS, as per the report vide letter No. 61/नवा ० dated 29th January, 2020 submitted
by the District Election Officer, Palamu Jharkhand and forwarded by Chief Electoral Officer,
Jharkhand vide letter No. 01/नवा -ई.ई.एम-को.-42/2019/201, dated 3rd February, 2020, Sh. Brajesh
Kumar, an Independent contesting candidate from 76-Daltonganj Assembly Constituency in
Jharkhand State, has failed to lodge any account of his election expenses as required by law.
AND WEHREAS, on the basis of the reports of the District Election Officer Palamu, Jharkhand
and the Chief Electoral Officer, Jharkhand a Show Cause Notice, dated 3rd March, 2021 was issued by
Election Commission under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Sh.
Brajesh Kumar for non-submission of Election expenses;
AND WEHREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961,
through the above said Show Cause Notice, dated 3rd March, 2021, Sh. Brajesh Kumar, was directed
to submit his representation in writing to the Commission explaining the reason for non-submission of
accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and
submit the same to the District Election Officer concerned within 20 days from the date of receipt of the
notice;
AND WEHREAS, the said notice was received by Sh. Brajesh Kumar on 04th June, 2021.
Acknowledgment receipt obtained from the candidate have been submitted to the Commission by
District Election Officer, Palamu vide his letter 402/नवा ० dated 14th June, 2021.

AND WEHREAS, in the supplementary report submitted by District Election Officer, Palamu
vide his letter 470/नवा ० dated 28th June, 2021 it has been stated that Sh. Brajesh Kumar, has not
submitted any representation or his account of election expenses, duly signed along with original
vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure
even after receipt of the due notice to the Election Commission of India as well;
AND WEHREAS, the Commission is satisfied that Sh. Brajesh Kumar, has failed to lodge an
account of election expenses and has no good reason or justification for the failure;
AND WEHREAS, Section 10A of the Representation of the People Act, 1951 stipulates that:-
"If the Election Commission is satisfied that a person:
(a)
has failed to lodge an account of election expenses within the time and in the manner
required by law or under this Act, and
(b)
has no good reason or justification for the failure,
Election Commission shall, by order published in the Official Gazette, declare him to be
disqualified and any such person shall be disqualified for a period of three years from
date of the order."
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act,
1951, the Election Commission of India hereby declares Sh. Brajesh Kumar, Village-Majhigawan,
Po-Narsinhpur
Pathra,
Ps-Chainpur,
District-Palamu,
Pin-822110,
Jharkhand
and
an
Independent contesting candidate for General Election to Legislative Assembly of Jharkhand, 2019
from 76-Daltonganj Assembly Constituency of the State of Jharkhand, to be disqualified for being
chosen as and for being a member of either House of Parliament or the Legislative Assembly or
Legislative Council of a State or Union Territory for a period of three years from the date of this order.
