के आधार पर 8नवा:चन आयोग वारा 8नवा:चनR का संचालन 8नयम 1961 के 8नयम 89 के उप 8नयम (6) के
अंतग:त 8नवा:चन S यय 3 तुत नहIं करने के लए 6ी बीरे9 : कुमार को कारण बताओ नोBटस Bदनांक
03 माच , 2021 को जारI ^कया गया था;
और यत:, 8नवा:चनR का संचालन 8नयम 1961 के 8नयम 89 के उप-8नयम (6) के अनुसार, Bदनांक
03 माच , 2021 के उपयु] त कारण बताओ नोBटस के जCरए 6ी बीरे9 : कुमार को 8नदेश Bदया गया था ^क वे
इस नोBटस के ाi त होने के 20 BदनR के अंदर लेखे न 3 तुत कर पाने के कारणR को 3 पj ट करते हुए लWखत
(प मf अपना अP यावेदन 3 तुत करf और साथ हI, 8नवा:चन S यय का अपना लेखा दाWखल करf;
और यत:, उ] त नोBटस 6ी बीरे9 : कुमार के पता न9 द कुमार ?साद वारा Bदनांक 25 मई, 2021 को
ाi त ^कया था। अP यथQ से ाi त पावती रसीद िजला 8नवा:चन अKधकारI, पलामू वारा अपने Bदनांक
28 जून, 2021 के प[ सं० 470/नवा ० के जCरए आयोग को 3 तुत कर दI गई है;
और यत:, िजला 8नवा:चन अKधकारI, पलामू वारा अपने Bदनांक 28 जून, 2021 के प[ सं० 470/नवा ०
के जCरए 3 तुत क> गई अनुपूरक Cरपोट: मf यह बताया गया है ^क 6ी बीरे9 : कुमार ने आज क> तारIख तक न
तो कोई भी अP यावेदन और न हI अपने 8नवा:चन S यय का लेखा दाWखल ^कया है। इसके अ8तCर] त उ` हRने
8नवा:चन आयोग का स* यक नोBटस मलने के उपरांत भी उ] त =वफलता के लए न तो कोई कारण बताया है
और न हI कोई 3 पj टIकरण Bदया है;
और यत:, आयोग का यह समाधान हो गया है ^क 6ी बीरे9 : कुमार 8नवा:चन S यय का लेखा दाWखल
करने मf =वफल रहे हd और उनके पास इस =वफलता के लए कोई भी उKचत कारण अथवा औKचL य नहIं है,
और यत:, लोक 8त 8नKधL व अKध8नयम, 1951 क> धारा 10क मf अनुबंKधत ^कया गया है ^क :-
''यBद 8नवा:चन आयोग का समाधान हो जाता है ^क कोई S यि]त-

(क) 8नवा:चन S ययR का लेखा उस समय के भीतर और उस रI8त मf जैसी इस अKध8नयम के वारा या अधीन
उपेeZत है, दाWखल करने मf असफल रहा है: तथा
(ख) उस असफलता के लए कोई अm छा कारण या ` यायोKचL य नहIं रखता है,
8नवा:चन आयोग शासक>य राजप[ मf काशत आदेश वारा उसको 8नरBह:त घो=षत करेगा और ऐसा
S यि]त उस आदेश क> तारIख से तीन वष: क> कालावKध के लए 8नरBह:त होगा''
अत:, अब लोक 8त8नKधL व अKध8नयम, 1951 क> धारा 10क के अनुसरण मf 8नवा:चन आयोग
एतदवारा घोषणा करता है ^क झारख ड रा< य के 79-हुसैनाबाद वधान सभा 8नवा:चन Zे[ से =वधान सभा के
साधारण 8नवा:चन, 2019 मf 8नवा:चन लड़ने वाले झारख< ड वकास मोचा (?जातां@Aक) के अP य र्थी
6ी बीरे9 : कुमार, Eाम-वीर धवर, पो-मोह+ मदगंज, थाना-मोह+ मदगंज, िजला-पलामू, झारख< ड को इस आदेश
क> तारIख से तीन वष: क> अवKध के लए संसद के ^कसी भी सदन अथवा रा< य अथवा संघ रा< य-Zे[ क>
=वधान सभा अथवा =वधान पCरषद का सद3 य चुने जाने अथवा होने के लए 8नरBह:त है ।

ELECTION COMMISSION OF INDIA

ORDER
06 August, 2021 / 15 Sravana, 1943 (Saka)
No. JKD-LA/ES-I/79/2019--WHEREAS, the General Election to Jharkhand Legislative
Assembly 2019 was announced by Election Commission vide Press Note No. ECI/PN/102/2019 dated
1st November, 2019. As per the schedule, the date of Counting was 23rd December, 2019.
AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every
contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the
District Election Officer, concerned from the date of election of returned candidate;
AND WHEREAS, the result of the said election was declared by the concerned Returning
Officer including 79-Hussainabad Assembly Constituency in Jharkhand State on 23rd December,
2019. As such the last date for lodging of account of election expenses was 22nd January, 2020.
AND WEHREAS, as per the report vide letter No. 61/नवा ० dated 29th January, 2020
submitted by the District Election Officer, Palamu Jharkhand and forwarded by Chief Electoral Officer,
Jharkhand vide letter No. 01/नवा -ई.ई.एम-को.-42/2019/201, dated 03rd February, 2020,
Sh. Birendra Kumar, a contesting candidate of Jharkhand Vikas Morcha (Prajatantrik) from
79-Hussainabad Assembly Constituency in Jharkhand State, has failed to lodge any account of his
election expenses as required by law.
AND WEHREAS, on the basis of the reports of the District Election Officer Palamu, Jharkhand
and the Chief Electoral Officer, Jharkhand a Show Cause Notice, dated 3rd March, 2021 was issued by
Election Commission under Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961 to
Sh. Birendra Kumar for non-submission of Election expenses;
AND WEHREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961,
through the above said Show Cause Notice, dated 3rd March 2021, Sh. Birendra Kumar was directed
to submit his representation in writing to the Commission explaining the reason for non-submission of
accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and
submit the same to the District Election Officer concerned within 20 days from the date of receipt of the
notice;
AND WEHREAS, the said notice was received by Sh. Nand Kumar Prasad father of
Sh. Birendra Kumar, on 25th May, 2021. Acknowledgment receipt obtained from the candidate have
been submitted to the Commission by District Election Officer, Palamu vide his letter No. 470/नवा ०
dated 28th June, 2021.
AND WEHREAS, in the supplementary report submitted by District Election Officer, Palamu
vide his letter No. 470/नवा ० dated 28th June, 2021 it has been stated that Sh. Birendra Kumar has
not submitted any representation or his account of election expenses, duly signed along with original
vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure
even after receipt of the due notice to the Election Commission as well;
AND WEHREAS, the Commission is satisfied that Sh. Birendra Kumar has failed to lodge an
account of election expenses and has no good reason or justification for the failure;

AND WEHREAS, Section 10A of the Representation of the People Act, 1951 stipulates that:-
"If the Election Commission is satisfied that a person:
(a)
has failed to lodge an account of election expenses within the time and in the manner
required by law or under this Act, and
(b)
has no good reason or justification for the failure,
Election Commission shall, by order published in the Official Gazette, declare him to be
disqualified and any such person shall be disqualified for a period of three years from
date of the order."
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act,
1951, the Election Commission hereby declares Sh. Birendra Kumar, resident of Vill-Bir Dhawar,
P.O-Mohammadganj, Thana-Mohammadganj, Dist-Palamu, Jharkhand and a contesting candidate
of Jharkhand Vikas Morcha (Prajatantrik) for General Election to Legislative Assembly of
Jharkhand, 2019 from 79-Hussainabad Assembly Constituency of the State of Jharkhand, to be
disqualified for being chosen as and for being a member of either House of Parliament or the Legislative
Assembly or Legislative Council of a State or Union Territory for a period of three years from the date
of this order.
