=वKध वारा यथापेeYत रI8त से अपने 8नवा:चन S यय का कोई भी लेखा दाWखल करने मf =वफल रहे हd ।
और यत:, िजला 8नवा:चन अKधकारI, गुमला झारख ड और मुख् य 8नवा:चन अKधकारI, झारख ड क>
Cरपोट: के आधार पर 8नवा:चन आयोग वारा 8नवा:चनR का संचालन 8नयम 1961 के 8नयम 89 के उप 8नयम
(6) के अंतग:त 8नवा:चन S यय 3 तुत नहIं करने के लए 3ी संतोष महल. को कारण बताओ नोBटस Bदनांक
10 जुलाई, 2020 को जारI ^कया गया था;
और यत:, 8नवा:चनR का संचालन 8नयम 1961 के 8नयम 89 के उप-8नयम (6) के अनुसार, Bदनांक
10 जुलाई, 2020 के उपयु] त कारण बताओ नोBटस के जCरए 3ी संतोष महल. को 8नदेश Bदया गया था ^क वे
इस नोBटस के ाj त होने के 20 BदनR के अंदर लेखे न 3 तुत कर पाने के कारणR को 3 पk ट करते हुए लWखत
)प मf अपना अP यावेदन 3 तुत करf और साथ हI, 8नवा:चन S यय का अपना लेखा दाWखल करf;
और यत:, उ] त नोBटस 3ी संतोष महल. क: प; नी वारा Bदनांक 21 जुलाई, 2020 को ाj त ^कया था।
अP यथQ से ाj त पावती रसीद िजला 8नवा:चन अKधकारI, गुमला वारा अपने Bदनांक 31 जुलाई, 2020 के पZ
सं० 194/नवा . के जCरए आयोग को 3 तुत कर दI गई है;
और यत:, िजला 8नवा:चन अKधकारI, गुमला वारा अपने Bदनांक 28 जनवर., 2021 के पZ सं०
68(ii)/नवा ० के जCरए 3 तुत क> गई अनुपूरक Cरपोट: मf यह बताया गया है ^क 3ी संतोष महल. ने आज क>
तारIख तक न तो कोई भी अP यावेदन और न हI अपने 8नवा:चन S यय का लेखा दाWखल ^कया है। इसके
अ8तCर] त उ` हRने भारत 8नवा:चन आयोग का स+ यक नोBटस मलने के उपरांत भी उ] त =वफलता के लए न तो
कोई कारण बताया है और न हI कोई 3 पk टIकरण Bदया है;
और यत:, आयोग का यह समाधान हो गया है ^क 3ी संतोष महल. 8नवा:चन खचm का लेखा दाWखल
करने मf =वफल रहे हd और उनके पास इस =वफलता के लए कोई भी उKचत कारण अथवा औKचL य नहIं है,
और यत:, लोक 8त 8नKधL व अKध8नयम, 1951 क> धारा 10क मf अनुबंKधत ^कया गया है ^क :-
''यBद 8नवा:चन आयोग का समाधान हो जाता है ^क कोई S यि]त-

(क) 8नवा:चन S ययR का लेखा उस समय के भीतर और उस रI8त मf जैसी इस अKध8नयम के वारा या अधीन
उपेeYत है, दाWखल करने मf असफल रहा है: तथा
(ख) उस असफलता के लए कोई अo छा कारण या ` यायोKचL य नहIं रखता है,
8नवा:चन आयोग शासक>य राजपZ मf काशत आदेश वारा उसको 8नरBह:त घो=षत करेगा और ऐसा
S यि]त उस आदेश क> तारIख से तीन वष: क> कालावKध के लए 8नरBह:त होगा''
अत:, अब लोक 8त8नKधL व अKध8नयम, 1951 क> धारा 10क के अनुसरण मf 8नवा:चन आयोग
एतदवारा घोषणा करता है ^क झारख ड रा< य के 67-%ससई (अ०ज०जा०) =वधान सभा 8नवा:चन YेZ से
झारख ड रा< य के =वधान सभा के साधारण 8नवा:चन, 2019 मf 8नवा:चन लड़ने वाले बहुजन समाज पाट9 के
अP य र्थी 3ी संतोष महल., >ाम+पो-बरगांव, थाना-%ससई, िजला-गुमला, झारखC ड को इस आदेश क> तारIख से
तीन वष: क> अवKध के लए संसद के ^कसी भी सदन अथवा रा< य अथवा संघ रा< य-YेZ क> =वधान सभा अथवा
=वधान पCरषद का सद3 य चुने जाने अथवा होने के लए 8नरBह:त है ।

ELECTION COMMISSION OF INDIA

ORDER
16 August, 2021 / 25 Sravana, 1943 (Saka)
No. JKD-LA/ES-I/67/2019-- WHEREAS, the General Election to Jharkhand Legislative
Assembly 2019 was announced by Election Commission of India vide Press Note No.
ECI/PN/102/2019 dated 1st November, 2019. As per the schedule, the date of Counting was 23rd
December, 2019.
AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every
contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the
District Election Officer, concerned from the date of election of returned candidate;
AND WHEREAS, the result of the said election was declared by the concerned Returning
Officer including 67-Sisai (ST) Assembly Constituency in Jharkhand State on 23rd December, 2019.
As such the last date for lodging of account of election expenses was 22nd January, 2020.
AND WEHREAS, as per the report vide letter dated 24th January, 2020 submitted by the
District Election Officer, Gumla Jharkhand and forwarded by Chief Electoral Officer, Jharkhand vide
letter No. 01/नवा -ई.ई.एम-को.-42/2019/201, dated 3rd February, 2020, Sh. Santosh Mahli, a contesting
candidate of Bahujan Samaj Party from 67-Sisai (ST) Assembly Constituency in Jharkhand, has
failed to lodge any account of his election expenses as required by law.
AND WEHREAS, on the basis of the reports of the District Election Officer Gumla, Jharkhand
and the Chief Electoral Officer, Jharkhand a Show Cause Notice, dated 10th July, 2020 was issued by
Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to
Sh. Santosh Mahli for non-submission of Election expenses;
AND WEHREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961,
through the above said Show Cause Notice, dated 10th July 2020, Sh. Santosh Mahli was directed to
submit his representation in writing to the Commission explaining the reason for non-submission of
accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and
submit the same to the District Election Officer concerned within 20 days from the date of receipt of the
notice;
AND WEHREAS, the said notice was received by Wife of Sh. Santosh Mahli on
21st July, 2020. Acknowledgment receipt obtained from the candidate have been submitted to the
Commission by District Election Officer, Gumla vide his letter 194/नवा ० dated 31st July, 2020.
AND WEHREAS, in the supplementary report submitted by District Election Officer, Gumla
vide his letter 68(ii)/नवा ० dated 28th January, 2021 it has been stated that Sh. Santosh Mahli has not
submitted any representation or his account of election expenses, duly signed along with original
vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure
even after receipt of the due notice to the Election Commission of India as well;

AND WEHREAS, the Commission is satisfied that Sh. Santosh Mahli has failed to lodge an
account of election expenses and has no good reason or justification for the failure;
AND WEHREAS, Section 10A of the Representation of the People Act, 1951 stipulates that:-
"If the Election Commission is satisfied that a person:
(a)
has failed to lodge an account of election expenses within the time and in the manner
required by law or under this Act, and
(b)
has no good reason or justification for the failure,
Election Commission shall, by order published in the Official Gazette, declare him to be
disqualified and any such person shall be disqualified for a period of three years from
date of the order."
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act,
1951, the Election Commission hereby declares Sh. Santosh Mahli, resident of Village+Post-Bargaon,
P.S-Sisai, Dist.-Gumla, Jharkhand and a contesting candidate of Bahujan Samaj Party for General
Election to Legislative Assembly of Jharkhand, 2019 from 67-Sisai (ST) Assembly Constituency in the
State of Jharkhand to be disqualified for being chosen as and for being a member of either House of
Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period
of three years from the date of this order.
