के पDरणाम 23 Cदस+ बर, 2019 को घो>षत ^कए गए थे। इस कार, 9नवा;चन S यय के लेखे दाWखल करने क?

के 41-झ$रया >वधान सभा 9नवा;चन YेZ से 9नवा;चन लड़ने वाले नद ल*य अP यथQ हd, >वLध वारा आपेeYत रJ9त
से अपने 9नवा;चन S यय का कोई भी लेखा दाWखल करने मf >वफल रहे हd।
और यत:, िजला 9नवा;चन अLधकारJ, धनबाद झारख ड और मु! य 9नवा;चन अLधकारJ, झारख ड क?
Dरपोट; के आधार पर 9नवा;चन आयोग वारा 9नवा;चनR का संचालन 9नयम 1961 के 9नयम 89 के उप 9नयम
(5) के अंतग;त 9नवा;चन S यय 4 तुत नहJं करने के लए मो० आलम अंसार* को कारण बताओ नोCटस Cदनांक
02 माच , 2020 को जारJ ^कया गया था;
और यत:, 9नवा;चनR का संचालन 9नयम 1961 के 9नयम 89 के उप-9नयम (6) के अनुसार, Cदनांक
02 माच , 2020 के उपयु] त कारण बताओ नोCटस के जDरए मो० आलम अंसार* को 9नदेश Cदया गया था ^क वे
इस नोCटस के ाi त होने के 20 CदनR के अंदर लेखे न 4 तुत कर पाने के कारणR को 4 पj ट करते हुए लWखत
)प मf अपना अP यावेदन 4 तुत करf और साथ हJ, 9नवा;चन S यय का अपना लेखा दाWखल करf;
और यत:, उ] त नोCटस मो० आलम अंसार* वारा Cदनांक 18 माच , 2021 को ाi त ^कया था। अP यथQ
से ाi त पावती रसीद िजला 9नवा;चन अLधकारJ, धनबाद वारा अपने Cदनांक 12 अ3ैल, 2021 के पZ सं०
170/नवा ० के जDरए आयोग को 4 तुत कर दJ गई है;
और यत:, िजला 9नवा;चन अLधकारJ, धनबाद वारा अपने Cदनांक 12 अ3ैल, 2021 के पZ सं०
170/नवा ० के जDरए 4 तुत क? गई अनुपूरक Dरपोट; मf यह बताया गया है ^क मो० आलम अंसार* ने आज क?
तारJख तक न तो कोई भी अP यावेदन और न हJ अपने 9नवा;चन S यय का लेखा दाWखल ^कया है। इसके
अ9तDर] त उ` हRने भारत 9नवा;चन आयोग का स+ यक नोCटस मलने के उपरांत भी उ] त >वफलता के लए न तो
कोई कारण बताया है और न हJ कोई 4 पj टJकरण Cदया है;
और यत:, आयोग का यह समाधान हो गया है ^क मो० आलम अंसार* 9नवा;चन S यय का लेखा दाWखल
करने मf >वफल रहे हd और उनके पास इस >वफलता के लए कोई भी उLचत कारण अथवा औLचM य नहJं है,
और यत:, लोक 9त 9नLधM व अLध9नयम, 1951 क? धारा 10क मf अनुबंLधत ^कया गया है ^क :-
''यCद 9नवा;चन आयोग का समाधान हो जाता है ^क कोई S यि]त-

(क) 9नवा;चन S ययR का लेखा उस समय के भीतर और उस रJ9त मf जैसी इस अLध9नयम के वारा या अधीन
उपेeYत है, दाWखल करने मf असफल रहा है: तथा
(ख) उस असफलता के लए कोई अm छा कारण या ` यायोLचM य नहJं रखता है,
9नवा;चन आयोग शासक?य राजपZ मf काशत आदेश वारा उसको 9नरCह;त घो>षत करेगा और ऐसा
S यि]त उस आदेश क? तारJख से तीन वष; क? कालावLध के लए 9नरCह;त होगा''
अत:, अब लोक 9त9नLधM व अLध9नयम, 1951 क? धारा 10क के अनुसरण मf भारत 9नवा;चन आयोग
एतदवारा घोषणा करता है ^क झारख ड रा= य के 41-झ$रया >वधान सभा 9नवा;चन YेZ से >वधान सभा के
साधारण 9नवा;चन, 2019 मf 9नवा;चन लड़ने वाले नद ल*य अP य र्थी मो० आलम अंसार*, मो०-भूलन बरार*, डा०-
भूलन बरार*, िजला-धनबाद, पन-828133, झारख9 ड को इस आदेश क? तारJख से तीन वष; क? अवLध के लए
संसद के ^कसी भी सदन अथवा रा= य अथवा संघ रा= य-YेZ क? >वधान सभा अथवा >वधान पDरषद का सद4 य
चुने जाने अथवा होने के लए 9नरCह;त है ।

ाLधकृत पाठ समझा जायगा ।

ELECTION COMMISSION OF INDIA

ORDER
16 August, 2021 / 25 Sravana, 1943 (Saka)
No. JKD-LA/ES-I/41/2019-- WHEREAS, the General Election to Jharkhand Legislative
Assembly 2019 was announced by Election Commission vide Press Note No. ECI/PN/102/2019 dated
1st November, 2019. As per the schedule, the date of Counting was 23rd December, 2019.
AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every
contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the
District Election Officer, concerned from the date of election of returned candidate;
AND WHEREAS, the result of the said election was declared by the concerned Returning
Officer including 41-Jharia Assembly Constituency in Jharkhand State on 23rd December, 2019. As
such the last date for lodging of account of election expenses was 22nd January, 2020.
AND WEHREAS, as per the report vide letter No. 60/नवा dated 28th January, 2020 submitted
by the District Election Officer, Dhanbad Jharkhand and forwarded by Chief Electoral Officer,
Jharkhand vide letter No. 01/नवा -ई.ई.एम-को.-42/2019/201, dated 3rd February, 2020,
Md. Alam Ansari, an Independent contesting candidate from 41-Jharia Assembly Constituency in
Jharkhand State, has failed to lodge any account of his election expenses as required by law.
AND WEHREAS, on the basis of the reports of the District Election Officer Dhanbad,
Jharkhand and the Chief Electoral Officer, Jharkhand a Show Cause Notice, dated 2nd March, 2020 was
issued by Election Commission under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to
Md. Alam Ansari for non-submission of Election expenses;
AND WEHREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961,
through the above said Show Cause Notice, dated 2nd March 2020, Md. Alam Ansari, was directed to
submit his representation in writing to the Commission explaining the reason for non-submission of
accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and
submit the same to the District Election Officer concerned within 20 days from the date of receipt of the
notice;
AND WEHREAS, the said notice was received by Md. Alam Ansari, on 18th March, 2021.
Acknowledgment receipt obtained from the candidate have been submitted to the Commission by
District Election Officer, Dhanbad vide his letter No. 170/नवा ० dated 12th April, 2021.
AND WEHREAS, in the supplementary report submitted by District Election Officer, Dhanbad
vide his letter No. 170/नवा ० dated 12th April, 2021 it has been stated that Md. Alam Ansari has not
submitted any representation or his account of election expenses, duly signed along with original
vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure
even after receipt of the due notice to the Election Commission of India as well;

AND WEHREAS, the Commission is satisfied that Md. Alam Ansari, has failed to lodge an
account of election expenses and has no good reason or justification for the failure;
AND WEHREAS, Section 10A of the Representation of the People Act, 1951 stipulates that:-
"If the Election Commission is satisfied that a person:
(a)
has failed to lodge an account of election expenses within the time and in the manner
required by law or under this Act, and
(b)
has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to
be disqualified and any such person shall be disqualified for a period of three years from
date of the order."
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act,
1951, the Election Commission of India hereby declares Md. Alam Ansari, resident of Mo-Bhulan
Barari, Post-Bhulan Barari, Dist-Dhanbad, Jharkhand, Pin-828133 and an Independent contesting
candidate for General Election to Legislative Assembly of Jharkhand, 2019 from 41-Jharia Assembly
Constituency of the State of Jharkhand, to be disqualified for being chosen as and for being a member of
either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union
Territory for a period of three years from the date of this order.
